In a civil case, the judge uses their discretion to determine facts. In a criminal case, the judge is a basically making sure the prosecution and defense use legal documents/media to show to a jury. The evidence the woman had, wouldn't have even made it in front of a criminal judge, it wouldn't be allowed. It doesn't matter if she got the paperwork illegally unless the defendant takes her to court (criminal) and he has this video as proof. Before anyone tells me I don't know what I'm talking about, I work for defense attorneys and spend 5 days a week in front of judges.

My ex wife left all her clothes behind when she moved out. I bugged her for close to 6 months to come and get it. I finally boxed everything up and stored it in the basement. I even went the extra distance of putting mothballs in the box's and raising them up off the floor. Must have been 15 box's of clothes. Took 3 years to settle the divorce, I gave her 30 days to come get her stuff. She got the stuff and told me later she had to throw it all away because she could not get the smell of moth balls and basement musk out of them. If he had decided to sue her for those crimes she admitted to, then she could have done something. On top of that this is a claims court, not a criminal court so those issues are out of this Judge's hands. Now he could take her to court for intruding on his privacy, which would have to be in criminal court not a claims court.

It does sort of have a point... the house was his property... and she didn't remove her property from his house... and possession is 9/10 of the law... she didn't come to claim her property, and left it on his property... However by that logic... he *_is_* responsible for fees she incurred due to him dumping "his" (formerly her) property. He is incorrect...if he assumed the mortgage, that does not necessarily mean the house is his. She would also need to sign a quitclaim deed I would think. The mortgage is entirely separate from the deed.
Incorrect, Lance. The mortgage is a legal document securing the loan with the lender. The deed is the ownership paper to the property. I used to work for Wells Fargo Home Mortgage, and I wish I could count the number of people I spoke to whose attorney gave them bad advice and told them to sign a quitclaim deed and they would be absolved of financial responsibility for the mortgage...that is simply incorrect. You sign a loan document, you are on the hook until that loan is refinanced in only one person's name. Likewise, if you assume a mortgage, but you still have someone's name on the legal deed, that person still has a legal right to the property. I would have to hear differently from an attorney before I changed my forecast. Relinquishing your right to a property does not mean you do not still owe for it; and, taking financial responsibility does not necessarily make it legally yours.
