AND IF SCOTUS said we did have to answer, it would be a direct violation of our 5th Amendment right, freedom and liberty; also a direct violation of the Miranda Rights afforded to all in the U.S. of A. There is no such thing as "consensual" conversation when accosted by an armed, uniformed bully who makes the interaction an interrogation, a Phishing expedition (Fishing season is over). There is also something called Federal Code 18, Chapters 241 and 242 (Deprivation of Rights Under Color of Law).
@d s YES, YES, YES. Curious, I saw a video a few years ago where the driver asked the checkpoint officer his reasonable articulable suspicion was that he (the driver) was not a citizen, and the patrol officer insisted; the supervisor was eventually called, the driver refused to go to the spot for further interrogation and said he'd like to exercise his right to travel within the USA unimpeded without answering questions or proving anything because he in innocent until proven guilty in a trial by his peers. The supervisor insisted; the driver invoked his 4th and 5th Amendment rights, he told the supervisor to check US Fed Law 18, Chapters 241 and 242 (Deprivation of Rights Under Color of Law). They copied his license plates and told him to leave.
@d s That sheriff told you wrong. You don't have to answer at all. You don't even have to listen to the question. You don't have to roll your window down. SCOTUS wrote Martinez-Fuerte that the principal protections for the people lie in the appropriate limitation on the scope of the stop. (428 US 567) Matinez-Fuerte makes it clear that a motorist must stop at an inspection station, and must move to the secondary inspection area if ordered to do so. That's all. What are the things a person doesn't have to do? SCOTUS makes it clear in Florida v Royer that a person approached by law enforcement need not answer question and may decline to listen to them (460 US 498)

That includes the right to establish immigration checkpoints to ask motorists about their citizenship.
My grandparents came to the United States in September 19th, 1945 from the defeated Nazi Germany, my grandfather (R.I.P.) told what it was like living in Germany during the Third Reich’s 12 years regime. The German people democratically elected a conman who promised to make Germany great again, but instead only brought war, destruction, hunger, death and shame to the German people. The Nazis systemically undo democracy in Germany with ridiculous laws and started deportations of Jews blaming them for Germany’s ills. It’s called fascism and that train is never late, it’s coming to America. People thought they could control the tyrant Hitler but they were wrong, they thought Germany could never go to another war and they were wrong again. The American people think fascism can’t never happen in the U.S, and it’s happening right now in front of our own eyes. Trump will won a third term as president, just like Roosevelt, he actually mentioned it, he thinks it’s a great idea and that he could change the laws. You watch, don’t believe now? Nobody Knows the burden of proof is not borne by the citizen, it is the states’. Bullies grow up to be cops and prison guards and they aren’t heroes. Sometimes they do their jobs and actually serve and protect, but this is bs.
Nobody Knows And how do you determine if someone is “illegal” without infringing on the rights of citizens. If I, as a Canadian, travel to America as a tourist and am driving down the highway, I’m not there “illegally”. Americans travel into Canada all the time and no one is randomly doing “papers checks” like was done to Jews in Nazi Germany. Stop for a minute to think about what you are proposing or endorsing. What kind of society do you want to live in? Yes, I think people need to honour the borders. Threatening detention of citizens or legal non-citizens isn’t how to do that. I have no problem with pulling someone over for a driving infraction and asking to see their license. Not American? Okay. Ensure they are legally allowed to be there. All fine. Randomly stopping people without cause for paper checks? Yeah. That’s fascism.
B dub Or were you not paying attention. SCOTUS has NOT determined that border patrol can stop people without cause at non-border locations to do papers checks and cannot detain without cause for extended periods of time. They can detain “briefly” although that was not defined and yes, a serious oversight of the Supreme Court.

@@ALuis-js3zs Benjamin Franklin did make that statement. However, people should read the statement in context. Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety. This was first used[1] by Franklin for the Pennsylvania Assembly in its "Reply to the Governor" (11 Nov. 1755) This quote was used as a motto on the title page of An Historical Review of the Constitution and Government of Pennsylvania (1759); the book was published by Franklin; its author was Richard Jackson, but Franklin did claim responsibility for some small excerpts that were used in it. In 1775 Franklin again used this phrase in his contribution to Massachusets Conference (Objections to Barclay’s Draft Articles of February 16.) - "They who can give up essential Liberty to obtain a little temporary Safety, deserve neither Liberty nor Safety." en.wikiquote.org/wiki/Benjamin_Franklin

@@davidjones-vx9ju The exact quotation, which is from a letter that Franklin is believed to have written on behalf of the Pennsylvania General Assembly, reads, those who would give up essential liberty to purchase a little temporary safety deserve neither liberty nor safety. He was writing about a tax dispute between the Pennsylvania General Assembly and the family of the Penns, the proprietary family of the Pennsylvania colony who ruled it from afar. And the legislature was trying to tax the Penn family lands to pay for frontier defense during the French and Indian War. And the Penn family kept instructing the governor to veto. Franklin felt that this was a great affront to the ability of the legislature to govern. And so he actually meant purchase a little temporary safety very literally. The Penn family was trying to give a lump sum of money in exchange for the General Assembly's acknowledging that it did not have the authority to tax it. Good enough for the P.C. police?
