Exactly! The visa always has an initial validity of one year renewable annually for at least two years. The actual legislation in no way limits how many times you can renew this visa.

Thanks for making this video. So what you are saying is for the citizenship it will be 4 years of temporary plus 4 years of permanent residency that would make it 8 years in total right? From what other channels have been advertising it's 4 years of residence and then one can apply for citizenship

Thank you for watching us. A more narrow and conservative interpretation of the legal requirements is 8 years: 4 years of temporary residency plus 4 years of permanent residency if you are applying - for instance - through the real estate investment visa (aka Golden Visa). However, we are aware about the ongoing interpretation that you just need to have a "permanent residency" and "have lived in Brazil" for 4 years. This would be an available and correct route for those who marry a Brazilian since they usually start immediately with the permament residency instead of a temporary one. We recommend our own clients to consider the 8 years as the correct interpretation (again, for real estate investment visa aka Golden Visa) while taking a shot immediately after securing 4 years of residency along with the permanent resident status. Thanks for the great content. Does Itacare town 200km south of Salvador Bahia qualify as Urban? and does it qualify for 700K BRL?

Bahia is in the Northeast so, today, it would require an investment of just R$700.000. Distance from Salvador does not have any effect on a property in Itacare being urban or rural. The main factor determining whether a property is urban or not is the type of tax expected to be paid for this property. This could be assessed by a careful review of the title (via certidão de ônus or inteiro teor).

700,000 reals for real estate in the north east. If my apartment that i am buying is 650,000, would the fees for the sales tax, real estate agent, escritoria publica be added to that 650. Also if i put improvements into the apartment would that count towards the 700,000?

Thanks for watching us.The real estate investment amount is specifically addressing how much you pay to the seller of the property. Nothing else should be considered. Construction and improvements are also not considered. The golden visa does not require you to stay in Brazil during the application. You could apply from either Brazil or abroad as long as you have a qualified law firm like ours applying on your behalf. The main factor establishing if a property is urban or rural will be the deed. Properties in the North and Northeast of the country must cost at least R$700.000 while in other areas (such as Parana / Curitiba) will require R$1.000.000 as of today. You didn't provide an information how foreigners can bring in large amounts like 700000 in Brazil Brazil cannot bring more than 3000 dollars in cash.

We do not recommend for anyone to handle such remittances or any aspect of the Brazil Golden Visa application by themselves. Minor issues could preclude the applicant from securing this important immigration benefit.

I am buying a appartment in raddision hotel in north east brazil, which is owned by a indivisual peron (with deed)and it is in urban area city area. Question: 1)does this property eligible for golden visa program. 2) after buying property can i put it on rent and go back to my country? And just come to complete 14days in 2days

This would allow us to review the property paperwork during the call over screensharing and have more information to tell you if this property qualifies or not. After buying a qualifying property, applicants of the Brazil Golden Visa can rent their properties while making sure they stay physically in Brazil (it does not need to be at the purchased property) for at least 14 days every two years.

Minimum documents for a review will usually be the "Registro Geral do Imóvel" as well as a purchase agreement if available. Other documents will usually be provided by the realtor and can help us understand the proposed transaction.

I understand that you don't have to send the funds directly to the seller, you can setup a non resident bank account in your own name and send it there first, which is safer anyway. Why is it you are saying it has to be to the seller?

See article II, (b) of the Regulation no 36 of the CNIG: " b) A statement of a financial institution registered in the Country or authorized by the Central Bank of Brazil to operate in the national territory, confirming the international capital transfer destined to the acquisition of real estate or its payment..." . If you send money to your local account in Brazil, the money being used to pay the property does not narrowly meet the requirement of the visa. The visa requires the money to come from abroad for the purchase. If your money is already sitting in your Brazilian account, then it is not coming from abroad. Another distinction is that when you send money to your local Brazilian bank account, the money will be tagged by the recipient bank with the Brazil central bank as "availability" instead of "money to purchase real estate". These are legal nuances not immediately recognized by foreign citizens, but they are enough to risk triggering a denial of your application. On the other hand, we do agree that sending the money from abroad directly to the Brazilian seller without being able to time the release is very risky. In our practice, we work with partner currency exchange banks that allow us to schedule the release for the exact same day of the closing. Finally, while we have already approved applicants who first sent money to their own bank accounts in Brazil (maybe by luck or maybe because the analyst wanted to avoid denying an application coming from a law firm), we always advise against sending the funds to a local Brazil bank account first since, in our understanding, it could justifiably trigger a denial by the Brazilian immigration.

@@oliveiralawyers I looked that up in Portuguese and you are right a registered bank in Brazil must make a declaration that the funds are for the purchase of a property in order to get the golden visa. However no where is it specified it must go to the seller. Is there another law or regulation, guideline or explanatory note saying that?

banks have to code the currency exchange for incoming money as required by the Brazilian Central Bank. If you are sending the money from your account abroad to your account in Brazil, banks have no way to tell this money is for the purchase of real estate. Most probably they will code it as "availability", which is not what an immigration analyst would be looking for when reviewing the currency exchange paperwork@@mcdanielap

Two questions: I plan to buy 2 apartments in Rio De Janeiro (1 for $53K & 2 for $61K) and 1 apartment in Sao Paulo ($98K) over the next two years. Question #1: Will I qualify for the investment visa? Question #2: Can I qualify for the student visa in Brasil if I enroll in Spanish classes?

If it was today, you probably would not qualify as these amounts should result in less than a million reais as per the current exchange rates. Additionally, properties may be bought over time, but the current administration will probably increase the required amount in the near future. Unfortunately, we do not handle student visas at the firm. You can, however, consider the digital nomad visa which could allow you to stay in Brazil for as much as two years (renewal included).
