Judge Mary Marlowe Sommer dismissed the involuntary manslaughter charge against actor Alec Baldwin in the 2021 death of cinematographer Halyna Hutchins on the set of the Western film “Rust.”
Baldwin’s attorney had filed a motion to dismiss the case, arguing misconduct by state investigators in not properly disclosing evidence in the case.
The judge agreed the state improperly disclosed evidence to the defense and dismissed the case with prejudice, meaning it cannot be brought again.

@@saratullas5509 i agree. A man doesn’t check the ammo in his fully functional weapon and shoots a woman DEAD, leaving two children without a mom. Then he makes the RIDICULOUS argument that “I didn’t pull the trigger.” Sure he should walk free because he is a hateful leftist. That IS your argument, or did I misunderstand your statement. Those little kids don’t have a mom to see them grow up, but, he still shouldn’t have been held accountable since he WAS the one who did not check the firearm and shot her dead. Is that your argument?

Because the first rule of firearm safety is simple; Treat every firearm as if it is loaded, until YOU determine it's condition. The condition of being loaded, or unloaded. If you picked up a gun, and someone told you it wasn't loaded, then you negligently discharged the weapon resulting in injury, you'd be charged with multiple counts and convicted. It's YOUR responsibility to determine a weapon's condition.

@valspals9188 You are right that the first rule of firearm safety is treat every gun as if it's loaded, but that's not a law. That's a best practice to remain safe in normal every day life. This is a unique situation though. When you are acting, you are pretending that you are using the gun. That is directly contradictory to firearm safety. You can't hold that rule to this situation. We realize that acting is simulating life, and acting like your in a gun fight means that you are going to be simulating firing the gun. Which is why the industry has experts who can safely engage in cinematic production and rarely does anyone get hurt. When you hand the gun to an actor who will be using it to rehearse firing the gun, it's not negligent of the actor to pull the trigger or point the gun at the camera. He is relying on the experts to ensure the gun is safe to point and pull the trigger. A movie set isn't your home. The rules are different for a movie set.

They charged him because when you are in possession of a firearm and a round leaves the barrel, you are legally repsonsible for that round until it stops. Welcome to America 2024: Hardly a day goes by where I'm not reminded that we have two systems of justice in this country: One fo the beautiful people and one for the rest of us. This is a trial that should not have happened in the first place. When an actor is rehearsing or performing a scene, they are in the hands of other professionals that are charged to perform certain duties. As an actor you place your trust in them to make sure that everything is done correctly. So when you are handed a prop, you should have every expectation that it is safe. When the director gives you a directive to rehearse or perform in a certain way, likewise you comply. Mr. Baldwin could very well could have injured himself as well. It was a tragic accident, but Mr. Baldwin was never the guilty party in this incident. This was a case that never should have been tried.

Prop is just short for the word property, is doesn't mean fake. The firearm safety rules are universal. Doesn't matter if it's a movie set, or real life. Baldwin ignored the first rule, then broke two more. You MUST break multiple firearm safety rules to result in injury. The first rule; Treat every firearm as if it is loaded, until YOU determine it's condition. It was Baldwin's responsibility to determine the weapon's condition and it was his duty to handle it safely until he made that determination. He was negligent, and it resulted in the loss of life.

It was not at all the same circumstances that was a gun that was properly not cleaned, and there was material left in the barrel, which then ejected into Brandon Lee. He was directed (by the director) to aim at the camera.. they needed point of view footage from the standpoint of the actor who would be playing the 'bad guy' character who would be shot in the movie. He didn't want to hurt anyone. Baldwin wanted the movie to be made and seen. Now that won't happen, and tragically the woman died. Big difference. Republicans don't like him for making fun of Trump on SNL.

Whenever prosecutors pull stunts like that it usually means that they never had a good case to begin with. It was the same thing with the Rittenhouse trial. The prosecutor was constantly admonished by the judge for trying to talk about things that he shouldn't have. Things that are not allowed.

Should be going forward anytime a firearm is on set the actor must be taught how to load/unload the firearm, know the 4 firearm safety rules, and be able to know the difference between live ammunition and blanks.

You can't observe those rules when you're using a gun as a prop. If anything, this is an argument that real guns shouldn't be used as props. He was being instructed to point the gun in the general direction of the crew to establish the shot. You can't do that if you're assuming the gun is loaded. If actors were suddenly liable for accidents like this, you'd never see an actor touch a prop gun again. That's why they have armorers.

@@WaxPaper I understand during the scene the firearm rules wouldn't apply and I don't want the actor to be held liable. What my goal is for the actor to have a fundamental understanding of basic firearm safety and operating it. If Baldwin was handed the weapon and immediately checks for it to be clear. Then handed the ammunition and inspected it. He would have loaded the weapon. Upon finishing the scene he unloads the weapon and returns it back to the armorer. This would be an additional layer of safety and if it was done on the movie set then lives would have been saved. Instead we had an incompetent armor and a culture were everyone assumed all rounds on set were blanks so everyone just blindly went along not knowing the danger they were in.

Anyone who handles firearms KNOWS you don’t point a weapon at anything you do not intend to destroy if it is a fully functional weapon. So he SHOULD have checked the weapon because HE was responsible. But he is anti-gun so he didn’t follow the rules, and he killed that lady. So he shouldn’t be held accountable, right?

The Armorer was at fault for sure, but to say that then Bloatwin had a responsibility too not just as the one with the weapon and DID NOT follow basic gun safety but, also as a producer. Plus he had everyone rushing about at his beg and call.

If that wasn't the case, you'd never see a real gun used in movie again, because actors wouldn't wanna accept that liability. If you wanna argue "no more real guns used as props," that's a valid argument. But blaming the actor for someone else putting a loaded gun in their hands isn't.

I’m thrilled for Alec Baldwin.😢 However, in Newsweek it says that Hannah Gutierrez-Reed texted and asked the Rust prop supplier named Seth Kenney if she could shoot live ammo out of a prop gun!!! Seth Kenney said that he told her it was a bad idea and doing so "always ends in tears,” as quoted in Newsweek. Did Hannah Gutierrez-Reed put live ammo in the gun that killed and wounded two people on the set of Rust? If she did, her 18 month sentence doesn’t match.

Doesn't matter. Baldwin was negligent and it resulted in death. It was his responsibility to determine the weapon's condition and it was his duty to handle it safely until he made that determination. The firearm safety rules are universal. It doesn't matter if it's a movie or real life. The first rule of firearm safety; Treat every firearm as if it is loaded, until YOU determine it's condition. Why are you against safety? That's why she's dead.

Glad he wasn't shooting a m134 minigun. Baldwin would have to check all 3000 rounds before they called action. It's the Armeror's duty and responsibility, that's why they are there.

If you picked up a gun and thought it wasn't loaded, negligently discharged the weapon resulting in injury or death, you'd be charged with multiple counts. You'd also be convicted, without question.

I'll give you one better. She tried to charge him with Involuntary Manslaughter with a firearm, max sentence 5 years. The incident happened before that statute passed raising the maximum from 18 months to 5 years. Did she think that no one was going to notice?

i disagree. it wasn't thrown out because he was proven not guilty. it was thrown out because the prosecutors screwed up. This is the same process that allows pedos and other murderers to go free. Its about the right to a fair trial and the loophole that sets ppl free when they do not get one. that doesnt mean they are not guilty, just that the system screwed up . alec will always carry the stigma of this because of the lack of the not guilty verdict. its the luckiest thing that could have happened in his position because the trail wasn't looking good for him up to that point. continuing hatred is a personal opinion but the flaws in our justice system do need to be addressed. a prosecutor who cant do their job correctly affects all of us, not just alec baldwin.

I’m not understanding, how did live rounds end up in the guns chamber? Now if I were a conspiracy theorist, I’d say someone planted the bullets in the gun or switched out the prop gun for a real gun but it wouldn’t have hurt to check the gun before using it. It makes no sense to me.

Alec’s didn’t deserve any of this. It was others that are 100% responsible by failing Alec’s first and foremost, as well as others in this project. Any other thoughts otherwise are simply based on biased, shallow and a lack of any poignancy feelings of disregard for this man. The girl on the staff was the armorer whose job it was to make sure the gun had no live bullets. She’s also the one who brought live bullets to the set! Should never have been any live bullets there but for her actions.
