The biggest issue with the parkland case, which was not put in the defense's motion, is that she asked repeatedly who the next witness was and which attorney was questioning them and no one said anything. She essentially had to force them to get to the point of saying they were resting. They weren't going to tell anyone. That's why she flipped out. It was pretty bad honestly.
@paulweston8184

She should have known who the next witness is. The judge is completely incompetant, biased, unprofessional, and unprepared. If this judge was overseeing the Depp trial and treated Depp's attorney this way, they'd have her head on a stake.

RE: Parkland Shooter Trial IMO, this judge was right to reprimand the defense. That defense attorney has behaved in a disrespectful manner on a number of occasions (based on various clips I have seen on RU-vid - Law and Crime, etc). What doesn’t come across in the documents is the WAY the defense went about resting it’s case. @freedomring757
@freedomring757 2 года назад
@@Diane_B_41 “Gullible” was the wrong word and unnecessarily insulting. I apologize. Let me put it this way. Look at the big picture. The defense attorney’s job is to save her client’s life. To do that, she needs to multi-task. She is preparing motions and outlines of questions, downloading exhibits, and printing same. She is making oral motions and arguing them. Momentarily, when arguing a motion, she looks at opposing counsel, not the judge. Judge instantly jumps down her throat. Judge also gets annoyed at all the activity that the attorney is engaged in as part of the attorney’s effort to save her client because the judge finds it noisy and distracting. But judge’s annoyance doesn’t automatically equate with disrespect by defense attorney. The one doesn’t = the other. Candidly, if the defense attorney’s choices are: 1) print out the exhibit to introduce into evidence as part of an effort to save her client’s life, at the risk of annoying the judge; and 2) don’t print the exhibit, this avoiding annoying the judge, but missing a chance to introduce important evidence to help her client - which should she do? Obviously, #2. I haven’t seen the defense attorney do a single disrespectful thing. I’ve seen the judge pick on her, looking for excuses to criticize her. That’s my perception.
@Diane_B_41
@Diane_B_41 2 года назад
@@freedomring757 Apology accepted. The time I'm referring to, when she was speaking to the state, it wasn't momentarily. It was like a full on conversation. The judge would respond to her points, then when defence made a follow up remark, she again looked to the state. This happened about 4 or 5 times before the judge asked who she was talking to. Regarding the printing, I'm sorry but any lawyer worth their salt should be making sure they have everything they need in advance. If something comes in unexpectedly, then she should inform the judge and request permission to print it off and submit. I absolutely agree her job is to save her clients life, but she also needs to show the court the respect that is expected in every trial. This also applies to the state when they are not showing the court the correct amount of respect.

She always had to pay for EVERYBODY'S lawyers during the conservatorship. She had one court-appointed lawyer she was paying for (but didn't get to choose), and I think her dad had three legal firms at one point? Then Jodi Montgomery, temporary conservator of the person had a lawyer, and Britney's court-appointed lawyer also had to hire more lawyers, because Daddy Spears had hired more lawyers and was filing so many motions that one court-appointed lawyer couldn't keep up. At some point, somebody must have decided that Britney had to pay for all the lawyers. I still find it odd that nobody did anything, even when it became clear that this had become an arms race of lawyers, with both sides just hiring more lawyers and paying all of them out of Britney's estate. It's not like Britney wasn't saying anything, either. That very memorable speech to the court in June 2021 - some of that was her recapping what she'd already said to the court two years before that, according to her. And THREE years before that speech she'd told somebody at the court that she was afraid of her father and was unhappy with him being in control. This was a lawyer fight, with Britney as both the chew toy in the middle of them, and the cash register.

The Defense attorney spent 5 minutes ducking and diving the question about who the next witness was and when the Judge insisted she just answer the question, outsider, to me it looked like she threw a strop and just rested out of nowhere. I don't think she knew in advance at all. And if they were supposedly talking to the state about putting it on the record instead of calling witnesses, why were the state just as surprised? I haven't watched any of the videos of this trial so I can't speak to how the defense has behaved, but I believe a judge is supposed to present a good example to the jury no matter what is happening in her courtroom. I understand that she walked back her comments & took full responsibility, but that's basically closing the barn door after the horses have escaped. In other words, the seeds of blame were placed in the jury's minds already and given the horrific nature of the crime it is human nature to use anything negative to bolster an argument for capital punishment. I agree with the motion that those words could have been construed by the jury as not only the court blaming the defense for wasting their time, but also the court aligning itself to the prosecution (which is a big no no). In this case, I don't think the judge's intent matters. What matters is the impact of her words on the jury and that's a bell she can't un-ring, even by walking back the statements. No matter what atrocities Cruz committed, he is entitled to basic rights and however unintentional, the judge seemingly violated them in those statements to the jurors. Do I think the judge will recuse herself? Not a chance. Do I think the defense will use this argument to appeal the jury's sentence? In a heartbeat. This motion seems designed only for appeal and I don't know how likely it is to succeed upon appeal, but IMO it has some validity.

The way I think of the whole “everyone has a right to a fair trial, a competent defense attorney, etc” in the most atrocious cases like this one is no longer in the “they deserve it” kind of way, but rather in a “this is being done as a formality” kind of way. Idk if that gives anyone solace for these cases but here ya go

I'm team Defense on this one. I can understand the judge's frustration, but it's her duty to not let that infringe on the defendant's rights. It also seems like she played into her own frustrations. My question is, how much notice did the judge expect to get that the defense was going to rest? If they had let her know the day before, it seems like the prosecution still wouldn't have been ready to call witnesses. So the delay can't be blamed on the defense. At most, the defense team cost the jury one day.

I had to stop following because I felt like some of the stuff she did actually was maybe unprofessional, and kept wondering if she was leaving the door open for his lawyers to appeal. Thank you so much, Emily, for covering the NC trial fiasco. I was really hoping to her your view on the defense's moves here. I can't help but ask what exactly did the defense team expect for a reaction from the judge by resting their case and doing it in the worst manner possible? There was already a great deal of animosity brewing before this due to the D's shenanigans throughout the trial. They HAD to know they were going to push her straight over the edge, so no need for them to act surprised by her response. It feels like badly misguided & ill advised strategy to me. I agree with you that their job is to defend the client at all costs, but to try to force a do over is grossly unfair & hurtful to the families. And would a new judge really have such immense impact on a jury's decision anyway? If the jury makes a decision based on facts and evidence rather than their feelings about the judge, it shouldn't make a difference. Would any other judge allow the disrespectful behavior of the defense? If a mistrial is declared, and again, what an absolute nightmare for the victims & their families, I pray it's with a new defense team because this group created many of their own problems by persisting with unprofessional behavior and lack of courtroom decorum. Feels like they themselves are doing their own client a great disservice.

I’ve just gone back and checked the actual video of the Parkland trial - both of the defence resting and the judge calling out unprofessional behaviour. The defence completely misrepresents what happened in both. When the defence rested, the judge literally told the jury that they should blame her and NOT any of the lawyers. When she told the room to stop messing around, she looked and pointed across the room NOT exclusively at the defence. I’ve not watched the trial, but these misrepresentations alone show the defence is playing dirty tricks. Really hope the case doesn’t get thrown out because of this nonsense.

They waited until the judge said bring in the jury to say we rest after the judge had asked many times who was the next witness and who was asking questions. This was after some shenanigans trying to get stuff retracted from trial but wouldn't say what they wanted retracted because they didn't know. As to the phone call the lawyer rang another lawyer and he added a witness. And the witness admitted nothing wrong was said and the defence admitted that the state lawyer was allowed to talk to the witness.

I don't read what the judge said to be blaming the defense AT ALL! She's just explaining to the jury why they're being dismissed so early in the day and why they won't be back in for almost two weeks, because - that IS what happened: The defense team didn't give anyone a heads up, and that's the result. She kept it brief and concise, and was in my opinion respectful. She COULD have said "THE DEFENSE TEAM didn't tell us" blah blah blah, but instead she said "WE didn't anticipate" and "if I had known" - keeping the focus on the court and not the defense team. So if I had been one of the jurors, I would have just been grateful for the explanation. Otherwise I can imagine they'd have left feeling a bit confused.

From what I was and heard that morning, 9/14/22: 1) the judge rec’d No Notice from the Defense that it may rest it’s case that day; 2) the defense had almost 80-100 to go (tho someone from the State side, stated the Defense at one time, had up to near 1000 witnesses) then the defense said it had another updated witness list that it was going to submit on 9-14-22; 3) Nicholas Cruz himself, omitted several of his “not yet called” defense witnesses of the, yet again “revised” Defense Witnesses List. He always stated “I don’t recall/know that name/person”; as a Defense attorney named all the witnesses they had left to have on the stand and there were A LOT!! The defense has been going since beginning of August & they have been rather rude w/frequent movement along the defense table w/exchanges of documents or give ear comments, walking into court to have drop papers off to them, plus being on their cellphones; ALL while a witness is testifying, etc. The defense table appears 2 tables longer (3 total) than the prosecution’s 1 long table. A very giant L.😂😂 PS glad to hear the judge didn’t recuse herself.🎉😅 💜✌🏼🦋

I’ve watched quite a lot of this trial. It reminds me of school kids who do not respect their teacher and a teacher who has lost control and has to shout to get them to listen. I feel that the judge is too inexperienced for this case and seems to be a little bit out of control. There clearly is a clash of personalities and borderline inappropriateness between the defense lawyer and the judge. She tried to say she was too blame for the extended wait until the 27th after it was obvious she was blaming the defense. Anyways I agree that they had to try to remove her and now it’s on the record for the appeal. Maybe it will get the courtroom back in order to continue and stop the eye rolling!

Talking back and forth. She was correct to say what she did and pull them across hot coals. Its been a joke and she has actually let it go for too long. The defense needs to sit down and reconsider how they are running their show. Its been a joke so far to be honest. Hands up who thinks Cruz actually wrote all the objections about the judge being biased against the defense. No hands? Any hands? I don't think the court aligned itself with the State. It read & sounded more as an overall "we". Plus I did not hear nor read the statement of the judge talking about the time mix up as blaming the defense. Unless she said it rather dramatically, I just don't get from ...here's what happened, here's why...blaming Defense. Seemed more like that is what or how the Defense expected the Judge's intention rather than how she actually presented the intention.

I think the reason she got mad was they spent 20 mins refusing to answer questions about the plan for the day. They were purposefully trying to avoid saying they planned to rest I keep seeing so much hate for this judge over this. It makes no sense to me. If you've been watching this case for the last 4yrs and pretrial hearings leading up to this. You would know that this judge has dealt with this defense attorney being so rude and disrespectful throughout it all. She has treated this judge like a child the entire time. And all while she herself has behaved like one every time she didn't get her way. She has talked over her. She raised her voice to the judge. She cut her off. She talked back. She has purposefully tried to get removed from this case on more than one occasion. And has seemed to punish the judge because she wouldn't allow her to leave this case or delay any longer. I am not a huge fan of the judge half the time either. She has a demeanor that would be difficult to deal with for me. She's inexperienced for a case like this. And she has let the defense walk all over her multiple times. But her calling the defense disrespectful and unprofessional is nothing compared to what she actually should've said. The defense has been acting like children and throwing fits with motions to dismiss or for a mistrial every time they exhale. And again, that attorney has raised her voice. Slammed things around. Stomped. Rolled her eyes. They've out right insulted her every chance they got. McNeil has acted like a spoiled teenager whose parents took her iPhone away. She was being petulant again in the another motion with her demands that the judge limit the evidence the state can bring in on rebuttal or else she would file a motion for a mistrial. She even told the court in one of the hearings a few years ago, while talking over and cutting off the judge, that "Well I need to repeat myself(in a raised voice btw) so you can understand what I'm saying!" Any other judge would've have taken action against them by now. What judge do you know of that would allow an attorney to yell at them with over the top theatrics on a regular basis?! I have never seen anything like these attorneys. This trial has been a $hit show because of the unprofessionalism of it all!

I also have high school kids in the Broward County School System. I acknowledge we have the best legal system in the world, though not perfect. My idea of handling a case such as this is if the defendant on trial admits to his guilt and there is no question of responsibility etc, then instead of spending all this time and money and recounting this horrific act...put the parents of those murdered into the jury room and let them decide his fate. Although we in ways adopted these kids into our hearts as our own the defendants future should be decided by the parents of the victims. I think even the defendant (won't say his name) requested as much. Again, just my opinion.

The judge WAS very annoying... tossing her hair, rolling her eyes, sighing ( like Rottenborn ) and coming up just short of either whining or stamping her feet. But it was toward both sides.
