Looks like those of us convicted of a push 20 years ago will all be free and cleared with the new gun bill provided we havent been convicted of a similar misdemeanor within 5 years! I literally pushed past my ex wife 20 years ago who told police that I never hit or hurt her but because I was honest and said that I DID push her they had to take me downtown. I was convicted of a misdemeanor battery (the push) under the Lautenberg Ammendment. Am I wrong in thinking that the new safer communities act will provide a pathway for us who have never been convicted of another offense in over 10 years to restore our rights?

That’s what I’m hoping for when I speak to my attorney It was 15 years ago. I cheated and she was scratching me and I pushed her off of me and neighbors called cops. I got adjudication withheld but still lost my rights. I haven’t been charged at all or convicted with any crimes simce past 15 years

My goodness, that makes no sense. What is the purpose of sealing it if it is still accessible? I had a case which was adjudicated into a dismissal and I believe it's now come back to haunt me. You know, there are women who falsely accuse men of domestics and men have no choice but to take these plea deals which help them avoid jail time for crimes they never committed. So I have the ability to carry, but not to purchase! I am absolutely beside myself.

@@RumbleFish69 I'm going through the same thing even though my charge from 10yrs ago was vacated I was denied being able to purchase a firearm! It's ironic because I have a carry permit and my line of work I'm required to open carry a firearm! SMH!

Edwin Torres First, I am sorry to hear of your troubles. I would like to ask if you're sure that was charge was vacated? By definition, and as far as I know, a vacated charge just goes away as if it never happened. I also have a vacated charge that was not an issue at all with my background check. Also, do you have proof that this charge was in fact vacated? You might need to do what I did because it sounds like there is something the that is not going away. What I did, for the issue that was not going away, I filed an application for a pardon in the state where I had my issue. My application, after nearly a year, is finally on the governor's desk awaiting a decision. I have received 4 letters so far updating me of every step and it's now on the governor's desk which is a good sign. There are several options which I will not detail completely, but if your application is strong, after all the reviews, it goes to the governor, as mine has, along with a recommendation. If they initially have an issue with it, they have a hearing to determine where the application should go next or if it should be rejected before even going to the governor. I recommend that you investigate where your concern really is to see if you need to file for a pardon or clemency, which is similar, but slightly different. It sounds to me as if you might not have all the details. I hope this helps.

Wow thank you for your input, there's so much I don't know but I will look into it deeper and probably have to consult an attorney because of my limited knowledge of the laws and procedures.

Edwin Torres You're welcome, however, before you spend money on an attorney, you should do the research and file yourself. I thought about getting an attorney at first but I ended up doing everything myself. If you haven't already, begin by filing a NICS appeal with the FBI. You'll need your "NTN" number which is the number generated from the attempted purchase of the firearm. You can get that from the dealer where you tried to buy your gun. In several weeks, the FBI will send you back your violation in print. If you have all that already, then just go to your state's government website and search for the clemency or pardon application process. It should give you a printable application. Now, the applications usually have about six lines for you explain why you should get a pardon, but in that section, I wrote see attached document because six lines was not enough for me to explain my situation; I recommend you do the same. I wrote in nearly two pages what happened on the day in question and where and how the injustice occurred. I also sent them my work history, credit report, mortgage pay statements, bank statements and model citizen work commendations, which was my work with law enforcement - plus notes of my clean record for over 30-years since the incident! I basically sent anything I thought would be helpful. It seemed to work because it bypassed all three possible hearings and went directly to the governor. Now, I might get denied, but it's looking good so far. This is pretty much what a lawyer would do anyway. I would say, save the money because no lawyer knows you better than you do. By the time I was done, I sent them a folder that was about an inch thick full of personal and relevant information. I made copies of all of it and sent it off. It took nearly a year, about 8-months, but I'm now on deck to finding out where I stand! Anyway, good luck and if you have any other questions, feel free to ask. Maybe I circle back and let you know how it turns out when I find out. Oh, and another thing, the FBI has been really helpful through this entire process. Once you get your report back, they're available by email or phone to discuss options and what happens. They know I'm waiting for this pardon and said they would work with me to clear it, if it comes back as a pardon. So, keep that in mind too. Good luck!
