the fact that a stoner can’t buy a gun (if they’ve been caught) but an drunk can is irrefutable proof that background checks are about your obedience not your safety. drunks are a lot more likely to get violent than stoners (theres a reason that alcohol is sometimes called “liquid courage”)

The 2a, regarding "civilian" rights to bear and carry arms that "SHALL NOT BE INFRINGED" has been infringed to the point, where even those protecting their homes, families, self, and others, plus those simply legally allowed to carry, are FALSELY ARRESTED... and/or oftentimes SUED by their assailants. VAWA has been #weaponized by women to destroy even the best of men. PLEASE NOTE: I am a woman stating this. Gun laws change arbitrarily, in order to increase revenue, and to intimidate good people, for, let's face it, criminals don't care about "The law." We love I'm dangerous times. The enemies of "The United States Government" are NEVER from abroad (foreign). The enemies thereof are right here, sitting on seats of authority; in government. I do not make these statements lightly. I see the exponential growth of authoritarian abuses of power every single day.

It's our 2nd Admendmint right. Any government officials deprive you of s constution right can be charged with U.S. code 18 title 242 also 241 and US code 44 title 1983 anybody took oath office can be held accountable for there actions . Folks best education is study your state constution and the United States constution and understand your rights and some simple US codes

I am not sure if that is legally or philosophically correct. Rights of all kinds, contractual, societal, inherent and others are frequently taken away. The right to possess a firearm, like many rights, are guaranteed in the Constitution, however, they can be limited or entirely taken away.

The constitution does not give you rights.it guarantees you God given rights.everyone has the right to be able to protect themselves. The government is trying to limit people.from what I see they need limiting.the dumb asses

You know it's it's messed when people falsely press charges on you and now you're screwed if you want to have basic rights the Injustice hurts.. domestic cases sucks more because you're partner could lie out of spite which mine did press charges on me for assualt now I'm waiting to prove good moral character because he lied

I have a question back in 1994 I was charged with simple possession of cocaine (false charge) and it was small as match head so in 2015 the court expunged it via prop 47 which she said would restore my gun rights she was wrong and the did the expungement wring so I went to court a week ago and petition for a 17(b) which gives me my rights back so please give me advice on what to do in court so the judge grants the 17(b). And if he doesn't I was told I couldappeal

Did you say a denial is purged after a short time? I was denied in 2015 because the FBI had not updated their records yet after I had a expungement in indiana. Could I go try to buy on again without a appeal?

If a person in the state of Missouri is presented woth an ex parte, filed by an ex girlfriend to prevent supposed harrassment, and that person goes to court and accepts a "no contest" 1 year temporary protection order, will his right be automatically restored after that order has passed?

I have lived in California all my life ,dang 60 years now. in 2001 (16 years) I was convicted of 2 felonies sales of a controlled sub. and possession of a dangerous weapon (a antique cane sword) I did 1 year on work furlow with a ankle moniter , testing 2 times a week which probably saved my life. What is my best options ? please.if any

Wayne Co. Mich. felony CCW in 1992 .. placed on HYTA , and completed probation , but still DENIED 25yrs later .. felony still shows up on every traffic stop .. that is SUPPOSED to be OFF MY RECORD isnt it ?

I live in PA, got a felony when I was 18 (non-violent) I'm now 32. I've also had a bunch of misdemeanors. But it's been like 10-12 years since I've been convicted of anything at all. I grew up. I've never had a violent charge at all. How do I get my rights back? I can vote. Why can't I own tool to protect myself and my home?

hmmm ok let me ask this if i was to have a felony based nearly 10 years ago thats a NON VIOLENT charge can you still buy a gun ( i am in Tennessee ) will there be a ban or hold up on a purchase on say a rifle or any other weapon? ( i have read all laws regarding this in TN but am having trouble understanding the yes and no's on the topic at hand )

check Tennesse law, but I'm guessing you can own muzzle loading rifles and shotguns and black powder handguns. Go to cabelas and see if they ship to your state. no ffl needed.

There have been major additions to the list of offenses that can be expunged in Tennessee, and the process has been simplified and made more affordable as well. It's very likely that all you need to do is file your paperwork and make an appearance in the court in which you recieved sentencing, largely a formality if you you qualify. Any local attorney should be able to handle this for you if you're uncomfortable with the process, it can be daunting for the uninitiated. (Just keep in mind its just a big show for all intents and purposes, everybody in and around it puts on thier pants just like you do, its a long way from St. Peter and the pearly gates)

1st in '94 i was charged with 4th degree theft, received 18 to 36 months sentence. yes i was guilty of that.. 2nd. i plead guilty to domestic assault in 2000 it sounds more horrible then what really happened when i explain it to people, they always say you fool why did you plea guilty, well at the time i just wanted to get out of jail and did not have an attorney, received 9 months probation.. would explain that assault now but would take to long, but good news here is on 12-19-2011 i received a FULL pardon which i done on my own in nebraska. now the last and 3rd thing 3rd degree burglary in 1990 this is in iowa even after all these years. i applied with the gov of iowa and was denied even after i got the full pardon from neb. iowa is a state that don't believe in giving out second chances. this is why i need help now from more experienced pro's. and by the way i know it don't matter but this also was bogus deal. i know many don't believe me but it is the truth for it does not matter now anyway it is over but still. if i only had a real lawyer during these times. thank you all for reading.

I'm in Philadelphia, Pennsylvania (PA.) I have recently, legally purchased a pistol. I am ready to get my Concealed Carry Permit in Philadelphia County which also means Philadelphia 1st class city (different from all other PA Counties!) My question concerns the face to face interview. This is a REQUIREMENT in the CCP process in Philadelphia. When interviewed by the police and asked, "why do you need to carry a gun".? Is the response, "for all and any legal purposes only" considered the LEGAL and ONLY answer necessary?

Jordan Hess! Second degree burglary. It was a wobbler. So I was eligible for a felony reduction to a misdemeanor, under penal code 17b which Higbee and Associates told me I can restore my gun rights.

Are you allowed to own a firearm after a non criminal protective order expires (virginia). It was a non criminal case in which my ex spouse filed a fraudulent protective order . I was not subject to any criminal charges, and the judge basically just extended the order . Then it expired

I want my gun rights back. When is it that Congress doesn't want to give felons their rights back? You know, because the government and politicians don't wish to give felons justice, I'm not sure that I'd be willing to help them if they are faced with violence.

Thank you for commenting Cliff. I think you are asking why Congress does not want to allow felons to restore their firearm rights. It is a good question, especially because many felony offenses are non-violent or are much less predictive of whether a person will misuse a firearm than many misdemeanor offenses or other information available about people. The ban on gun ownership should be narrowed and it should allow a means for people to have them restored.

I was convicted of a misdemeanor domestic violence back in 1996. In california and tried to purchase a gun permit and got convicted for perjury and got 1 year probation...i thought it would have been ok. After many years...

Yes, we have helped many people get their gun rights restored after being convicted of what a state calls domestic violence. We have never attempted it in Virginia. The key things to look for is (1) if the elements of the offense for which you were convicted meet all of the elements of the federal definition of domestic violence, if not, the federal ban should not apply to you and (2) does the state that convicted you (a) take away your rights for your conviction and (b) provide a way for you to have those rights restored, if so, there is a way for you to restore your rights.

RecordGone.com so after their rights were restored were they able to purchase a firearm without going through a bunch of trouble with the federal government that's the question? I personally use your guyses Law Firm got a restoration order from Pierce County Superior Court but now I'm afraid when they run a background check they're going to see the conviction and deny me to purchase. And then ultimately I could be charged with an additional crime. Well that's at least how I understand it.

Cc Bb If you have a conviction in Washington for a domestic-violence misdemeanor, you may be able to have a court restore your rights under Washington law to possess firearms. But federal authorities may not recognize the Washington court order, so you could be in a position where your possession of firearms does not violate Washington state law, but does violate federal law. Before giving up hope of ever owning a gun again, take a close look at whether your conviction truly fits the federal definition of “misdemeanor crime of domestic violence.” The federal definition is much narrower than the definition appearing in Washington law. To put things a little differently, an offense classified as a DV offense under Washington law may not be classified as a DV offense under federal law. In that situation, if your Washington gun rights are restored there is no prohibition on your right to possess firearms. For example, in order to qualify under federal law as a “misdemeanor crime of domestic violence,” an element of the crime must be the use of force or the threat to use force (such as an assault). Thus, if your conviction is for violating a protection order, it does not prohibit your possession of firearms under federal law, because one can commit the offense without using force (by telephoning the protected person, for example). The other critical difference between the Washington and federal laws on domestic violence is the nature of the relationship between the offender and the crime victim. Again, the federal definition is much narrower. Under federal law, an offense is categorized as a “misdemeanor crime of domestic violence” if the offender and victim are related as spouses, parent and child, guardian and ward, cohabitants, or people who have a child in common. Under Washington law, the category includes people in a “dating relationship,” siblings, roommates, and others. Thus, for example, a brother-against-brother assault is a DV offense under Washington law, but not under federal law. The person convicted of a brother-against-brother misdemeanor assault will lose his gun rights under Washington law. If obtains an order from a Washington court that restores his firearm rights, he will face no problem with federal authorities. Unfortunately there is no good solution right now for the most typical case: a misdemeanor assault committed by one spouse against another. In that case, a restoration of Washington rights will not be recognized by authorities as a restoration of federal rights. Curiously, federal authorities will almost always recognize a restoration of Washington rights which were lost due to a felony conviction. In this situation, a person convicted of a more serious offense has an advantage over someone convicted of a less serious offense. Go figure!

I have a non-violent 3rd degree felony (Grand Theft) from 1993, I was giving my civil rights back in 2004 but I still don't have my gun rights back. I sent all my paperwork to the State of Florida, for a Full Pardon, can I or should I request my Restoration of firearms instead, since Pardons are rarely giving, and if my Pardon is not giving will the state then restore my firearms right or will I need to start the process all over, thanks.

I know in indiana a pardon doesn't give you your gun rights back, but a expungement or firearm rights restoration will. Then again the FBI had said a while back, indianas expungement is not recognized as a true expungement since the courts and law enforcement can still see your record as of June 1 2015. I got mine done in September 2015, but they haven't said anything about me owning guns

I was arrested in California last year for domestic violence even tho my girlfriend said there was no violence and just wanted me to leave the police still arrested me and took me into the jailhouse to book me. the next day they tried to take me to prison but they let me go. with some paperwork. I don't know if it was a conviction or not. is it still considered a conviction if I didn't get charged with the crime?

Is there a way to get a 302 expunged from your recorded I was already a licensed CCW and Open but due to ptsd and unlawful due process in my case my firearms I had to sign over. My guns where never used to harm anyone any info would be appreciated

I live in the state of Rhode Island and have never been in a federal court and only have one felony against me from my home state but have a relief of disabilities signed by a judge from the state I now live in Rhode Island and had a muzzle loader that I had in my passion confiscated from me after I was living here for 4 years and was told that I was not allowed to have it because I uses a former of powder to propel a metallic projectile and that the relief of disabilities for was not valid in this state how can I get my rights back I am an avid outdoors man and am obeying the laws and want to continue to hunt it is a way of life for me I am on si and do not have a lot of money.

If its a felony, yep. However that offense should be one that qualifies to be expunged. Check findlaw.com for your states laws regarding that process..

im in louisiana and i had my non violent felon expunged but what concerns me i was put in two hospitals back in day when on all the strong pain meds....they claim you can get your firearm rights back in ten years, i just want to hunt and not have to worry about going to jail for something from 2004....i want to be able to buy and hunt bc it was a non violent actions....

No, any assault that meets the federal definition. You have to look at the relationship to the victim and the nature of the violence or threat.

I’ve been told that a 5150 in my record only prohibits me from owning a firearm for 5 years.(If the Hospital Admission was 72hours or less) Can anyone confirm this for me and others who might have this record? I’m trying to join a police academy; I even got all my clearances, papers, passed the Physical Assessment and the PelletB but because my 5150 from 4 years ago(mind you I was also a stupid teenager at the time), I cannot.

As I read the law; after 5 years have passed after a non violent level 3 drug crime that is actually 10 years old now; but 5 years since release of jurisdiction (probation) automatically reinstated that 2nd amendment right; but how is it still a risk of a felon with a firearm etc...?

If the elements of your offense met the federal definition of domestic violence, it is unlikely that you will ever get your rights back Federal law (18 U.S.C. § 921(a)(33)) defines domestic violence as: "has, as an element, the use or attempted use of physical force, or the threatened use of a deadly weapon, committed by a current or former spouse, parent, or guardian of the victim, by a person with whom the victim shares a child in common, by a person who is cohabiting with or has cohabited with the victim as a spouse, parent, or guardian, or by a person similarly situated to a spouse, parent, or guardian of the victim."

I went through the gun rights restoration through your website subsequently received a gun rights restoration order by the Pierce County Superior Court, but now I'm concerned that when I go to buy one I'll be breaking the law if I'm denied by the feds. If the state restores my rights to own and possess a firearm then why would the federal government deny? should I go down and try to obtain a concealed weapons permit?

Clif 4533 I hired recordgone and within a month to a month and a half it was completed. And this took place in Washington State. I have not tried to go purchase one though. rumor all over the internet has it that they will not recognize a Washington state court order. Unfortunately there is no good solution right now for the most typical case: a misdemeanor assault committed by one spouse against another. In that case, a restoration of Washington rights will not be recognized by authorities as a restoration of federal rights. Curiously, federal authorities will almost always recognize a restoration of Washington rights which were lost due to a felony conviction. In this situation, a person convicted of a more serious offense has an advantage over someone convicted of a less serious offense. Go figure!

I am not aware of any state's law giving preferential treatment to disable veterans when it comes to restoration of firearm rights. I know some states have special courts and remedies to handle sentencing and expungement related matters involving veterans.

Yes, we have offices in California (as well as 17 other states). California law has a 10 year prohibition for that offense. Assuming that the victim was not one that would make this offense meet the federal definition of domestic violence, you should get your gun rights back after 10 years.

If you renounce U.S citizenship Your rights are given back to you, being a Citizen you have PRIVILEGES not RIGHTS. Sovereignty has lawful rights by God and must obey his Commandments, Tho shall not kill, turn the other cheek but when someone comes in your home trying to hurt your family NO LAWS are being discussed. if u do a crime and claim Sovereignty and say it is not a crime under your rights as Sovereignty you will be right in jail with all the rest. as long as your in the usa you obey there rules no matter what you try to claim you will always be wrong. Sovereignty doesnt work in no court, ive seen it tried many times and failed each time. he only way for it to work is for you to buy land and claim it as its own nation with its own law. but then it only applies while you are on your land in your nation. when you leave your land you are under there rules till you go back to your land so cant win

Only a U.S. citisen on U.S. soil, may be entitled to the rights and responsibilities defined by the U.S. Constitution. MEANING if you renounce your citizenship, but remain on American soil, you have less rights, than a cockroach. I have tried the sovereign citizens thing, and it only works one way. You state that you're an American citisen, and a Constitutionally protected sovereign citisen of the United States of America. Sovereignty defined here as the empowered citisen, being armed with the knowledge contained within the United States Constitution. That's the only way it works. And you need to know 100%, how the Constitution works in your favor. Otherwise, this nation will only recognize you as, POW.
