Can My Citizenship Be Revoked?
CURRENT REGULATIONS REGARDING
THE REVOCATION OF CANADIAN
CITIZENSHIP
As of 2018, there is still only one way a Canadian citizen can lose their citizenship without
voluntarily renouncing it and this only applies to naturalized citizens. If you were born in Canada
since February 15, 1977 you cannot lose your citizenship, you can only renounce it
If you were naturalized as a Canadian citizen, the only way your citizenship can be revoked is if you
are convicted in court of fraud, and this fraud must have been committed either as part of
your application for permanent residence or your application for Canadian
citizenship. To learn more about reasons why a Canadian citizen or permanent resident could be
investigated for fraud relating to permanent residence or citizenship, read our articles on the
residence questionnaires. If the government is able to prove in court that you committed fraud on
your permanent residence or citizenship application, then your citizenship may be revoked.
This increased enforcement was introduced in the Protecting Canada's Immigration System Act,
which was passed on June 28, 2012. This act amended the Immigration and Refugee Protection Act
(IRPA). Prior to this amendment, it was a lot harder to get your citizenship revoked: only 60
Canadians total had their citizenship revoked between 1976 and 2011 under special provisions in the
IRPA. With the new amendment, it is much easier for the government to meet the burden of proof
required to get a conviction for immigration fraud. In 2017, further changes were made and, as of
2018, the citizenship revocation process will be handle by courts, instead of IRCC.
HOW MANY PEOPLE HAVE LOST THEIR
CITIZENSHIP UNDER THE CURRENT LAW?
Though the Government of Canada was actively investigating over 3,000 Canadian citizens for
immigration fraud in 2012-2013, to date about 300 people have lost their citizenship. Somewhat
surprisingly, the number increased drastically after the Liberals won the 2015 election, despite
tabling a bill to change the law. (This bill passed in 2017.) Fewer than 70 people lost their citizenship
through this new law between 2011 and 2014, but hundreds have lost it since the Liberals came to
power. However, the courts have struck down over 300 of those revocations due to various problems
with the procedures.

Only in these cases: 1. if you tamper with your social insurance or birth certificate (example laminating it illegally), and Government of Canada finds out, they will void it and not issue you a new copy. 2. If you were originally a immigrant from a different country and obtained citizenship in Canada legally, but then convicted of several serious crimes. 3. if you are in the Canadian Armed Forces and you become a Deserter or commit an act of Treason.

How about Bill C-24 they're saying this in one of the article I read, " For all naturalized citizens, a federal government official can revoke your citizenship if he believes you never intended to live in Canada. This could happen if you decide to study in, accept a job in, or reside in another country. In contrast, Canadian citizens born in Canada cannot lose their citizenship by living outside of Canada".

@@immigroup What are the chances of this becoming law? I personally think it is silly to revoke a naturalised citizen's citizenship just because they want to move and live somewhere else. It essentially creates second class citizens. It's just moving elsewhere, not committing treason for goodness sake. What happened to the law being the same for every Canadian no matter where they are born? One of the rights of a citizen is the freedom to enter and leave the country whenever they want.

If I was born in another country and I have naturalized Canadian citizenship, can I lose my Canadian citizenship by being in the country I was born in for years at a time?

The short answer is no. The long answer is, if you are old enough, you might have trouble proving your citizenship satisfactorily. Were you born before 1977?

Use to be based on crime and it was a better system then. Also citizenship used to be based on people actually being useful to the country and not being supported by the system. In terms now newcomers only just live on the system and it's effected born citizens and every citizen as a whole now. In terms revoking citizenship would be a positive to correct things as well as returning refugees back to their countries after war has passed and things have improved in their previous nations regardless how people feel. It use to be very strict for becoming a citizen like requiring to be in the field of say a doctor or working under the oil riggs. In terms those supported the country much better then what has happened. On the contrary children born in Canada were deemed Canadian and it wasn't revoked. This also made sense. Modern citizenship doesn't make sense and it doesn't support the nation at all but puts it back into poverty.

Robin Thicke the American singer, couldn’t pass his Canadian citizenship to his kids. His dad Alan Thicke, a Canadian, didn’t pass it to him. In other words if your child is born outside of Canada you have to apply it for them.
@immigroup
@immigroup 4 года назад
So Alan Thicke did indeed pass his citizenship to Robin, that's why Robin is a dual citizen. What you got right is that Robin cannot past his citizenship to his children (provided they were born after 2008). In early 2009 the law changed so that children born abroad to Canadians who themselves had been born abroad cannot pass on their citizenship to their children who are born abroad. So Robin is Canadian because Alan was born in Canada. But Robin's children are not Canadian because Robin was not born in Canada. Make sense?

Can I volontarily lose my canadian citizenship and still be a canadian permanant resident if I am born in canada?
@immigroup
@immigroup 4 года назад
You cannot lose your Canadian citizenship if you were born in Canada. You can voluntarily renounce your Canadian citizenship if you are a citizen of another country as well. When you renounce your citizenship you will NOT become a permanent resident of Canada. You will no longer have status in Canada.

When an Indian citizen acquire Canadian citizenship, he automatically lose his Indian, he has no right to claim as Indian, and use Indian passport even if it is valid. I think this is Indian law and India still not allow dual nationality. Now if Canada renounce his Canadian citizenship, it does not mean that he is again become Indian, AND a country can not make a citizen stateless. Your comment?
@immigroup
@immigroup 5 лет назад
Yes, in most cases, India does not allow dual citizenship: en.wikipedia.org/wiki/Indian_nationality_law#Dual_Citizenship If you are a Canadian citizen and your Indian citizenship has been revoked, you cannot renounce your Canadian citizenship unless you have an additional citizenship.

@immigroup Interesting. What if Canada tries to revoke citizenship based on misrepresentation and a person has already surrendered Indian citizenship. Will he become stateless??
