I had a misdemeanor that was expunged , for going to meet an underage girl, I told a marine recruiter and he said even tho it was expunged it still happened so I can’t join the marines

My experience joining as a felon I had to get a moral waiver it did take about 1.5yr total to join. I didn’t have to expunge it would’ve actually been pointless for me because I plan on staying 20+ and rather your record is expunge or not gov jobs will still see it. I joined as an 11B and yes I was able to get a secret clearance. I don’t know about a top secret as my mos doesn’t require I need one.

@@TEAMSWARTZ thank you for your support I’d be glad to share. 9/17/17 I was arrested on trafficking bud, unlawful possession of a firearm and fleeing eluding high speed, the first two charges were dropped and I was sentenced to 8 months in FL on 01/28/18 I was released 07/11/18. Fast forward to 2021 I spoke with a army recruiter SSG Reed she helped me out a tone as I was the most unfit candidate due to my charge and no education she got me set up with Sophia’s learning program I passed 8 classes for 36 college credits which was enough for the Army to recognize it as 1 semester of college. As far as my morale waiver it had to be sent up to higher ups that reviewed my packet the only things I had going for me was I stayed out of trouble for the 5yrs in between getting out and contacting a recruiter I also had over 60 references that wrote about the good I did MAJOR Erickson was the person that had final say so and she approved me after a phone interview her only request was that I help others do the same which I took to heart I’ve now helped over 8 people with felonies join the Army. All depends on what state you live, many states when a record is expunged it is GONE and will not show up on any background check. However, some states only offer record sealing or record restriction which often does not remove the criminal history from a person's rap sheet. Also, the FBI doesn't own the criminal record the issuing state does and therefore under the 1974 compact agreement with all fifty states must follow what laws are set by the state governing the criminal history. Remember one thing an expungement is a court order commanding that a person's criminal history be removed/ destroyed and that includes arrest records.

Records may be deleted but an arrest date still lives within the system. If the applicant doesn’t have a record and the state obviously doesn’t either after expungement, significantly decreases the chances for a favorable consideration for a moral waiver because we have to take the word of the applicant to what transpired with no documentation. Depending on the statement, doesn’t always workout for the applicant.

Hey brother I’m currently going through the process of joining the army and I have expunged charges. Nothing too serious and I got them expunged before turning 18, but I was wondering if this would possibly affect me from getting a packet for the green berets since you need a secret security clearance. I had an assault charge at 18 that was dropped by the prosecutor due to lack of evidence. Record was quickly expunged and hasn't ever popped. This took place 17 years ago. Should I be worried?

I had a misdemeanor arrest when I was 12 that I scratched a teacher. (I’m 29) I had the recorded sealed cause I was underage. I’ve had no other issues but one thing that happened that was dropped. Will that prevent me from getting a top secret and going to ranger school?

Being Sealed is being sealed to the general public. Like a civilian employer won’t see it unless you disclose it but the Government can see it. Divulge it to your Recruiter, obtain the necessary waiver and see if you’re otherwise eligible for those opportunities with your recruiter. I have 6 misdemeanor charges on my record from 1 case when I was 19. I am 23 now, Is there any branch of the military that will give me a waiver to enlist even if I were to get an expungement without getting any new arrest since??

Expunging it makes it more difficult to obtain a waiver. For a definitive determination… Obtain all dispositions and see your local recruiter to see what and if you have options for a moral waiver. Will I enlist properly if - Arrested with no court date PLUS documentation from the District Attorneys office stating (No files charged) and case is reviewed and rejected. FYI my statue of limitations for the case is clear.

What about a misdemeanor DUI? 4 years ago. I was on probation for 18 months. Didn’t have my license suspended or revoked. Would that stop me from enlisting?

I got my paperwork sent up for an informal review and was denied for a terroristic threat when I was 19, I was told to come back in October after I get better letters of recommendation and getting involved in my community. Prior to that I was arrested on suspicion of a dui when I was 17 and a couple pi’s shortly after that initial arrest. I’m 24 now about to finish college and have only gotten in trouble once for neglecting to pay vehicle registration tickets. Any hope ? You hear about guys getting more severe felonious charges when they were minors and managing to get approved.

It really depends on record and the unique details and what you’ve done since thy r violations… Volunteer a shit ton of time to volunteer work. You’ll need character reference letters from those organizations and employment and from school that you’re a stand up person, “trustworthy,” possibly an asset, etc… having earned your degree will def help. Earning certificates in anything will help as well. Get involved with church activities, etc… Good luck on your waiver and may the waiver gods forever be in your favor! You know anything about like dismissed and sealed charges? Or say you were arrested but charges were then never brought against you?

Dismissed with no prejudice, meaning can’t be reopened and your 100% in the clear. Should be good to go. Dismissed but paid a fine other than a court surcharge fee and/or had community service or a conditional release/probation and then dismissed. Will be treated as guilty then. My recruiter ran my fingerprints, and he said that it was clear. But I have a disorderly conduct conviction. Would meps see that my record is clear also. I did get it set aside (like expunged)

It’s very possible… if not at meps during your background investigation they could uncover that. Do a self admittal and disclose it. Go to the court and get the disposition. If no records are found do to the expungement, then self admittal is the process. That usually doesn’t require a waiver, just a suitability review. Don’t listen to your recruiter on keeping quiet and lie by omission. If find later, you’ll be discharged as a fraudulent enlistment. @@lockdown10 If all you have is a disorderly conduct, I don’t see why you would need a waiver altogether. Now, why I don’t like expunged records, is because the waiver authority has only your “word” to go by and they aren’t generally willing to take that risk. Hopefully your Guard Recruiter can see what your options are. Good luck!

Majority of those are denied. Even if dismissed. Ultimately need proof that you did in fact not commit the crime. Being dismissed because the other party failed to show up and dismissed isn’t a true indication you didn’t commit the crime or offense. @@nicholassolo7185 Depends on your unique circumstances. You’ll need the records… Unfortunately, there’s still a record of your arrest with no details. Without the actual records they aren’t going to accept your word on the details. You need proof you didn’t commit the offense. Regardless if dismissed. Most if not close to all dismissed DV’s are because the plaintiff fails to show up because they don’t Wang their significant other to be officially charged. That doesn’t prove you didn’t commit the crime. I say try any way if you can find a recruiter willing to try…

Hey I have a question I had a juvenile felony sealed completely I was 17 and was charged with attempt but I wasn’t the one who did it nor touched anyone I just happen to be with wrong people after I got arrested I was 17 went straight graduated and been doing good since am boutta be 20 now I wanna serve my country and be a better person than I already am please be honest do I have a chance I also have some army friends that can reference me

In the process of getting class h felony larceny expunged from 13 years ago. Its about the lowest level felony there is. Once its expunged, if i could get in the military, is there any chance i could become an army ranger? Im 32 by the way and in North Carolina
