I think her drunken, incoherent ranting was the most accurate description of what actually happened. It wasn’t murder, it wasn’t suicide. It was two very drunk people fighting over a loaded gun and she MAY HAVE pulled the trigger - but it is VERY likely that his hand was over hers basically saying I DARE YOU! HERE - let me help you! Neither had intentions of shooting. This is the NUMBER ONE reason not to have a loaded gun ANYWHERE near you!!

I've had to tell people before that if they showed up to my house unannounced before that we had loaded weapons, and they politely backed off. It's a way of saying "I am able to protect myself from intruders, especially when I don't know who is on the house."

Having dated someone similar to the way he was described with the other encounter with the ex, I believe her. I’ve had to wrestle my ex with a knife as he threatened to hurt himself after I had picked up my phone to call someone to pick me up to get away from him. Worst part was a neighbor called the cops, and the cops saw a scratch on his arm that I had did when I disarmed him and automatically painted him as the victim. I eventually escaped the abusive relationship, but I learned to never rely on the cops because all it takes is one charismatic guy to discredit your trauma.

Om my gosh something incredibly similar happened to me with my ex but he was holding a box cutter to his throat and I was trying to take it away from him and it cut my hand this was in the middle of the street in broad daylight he also poured lemonade on me and the neighbors saw and called the cops I didn’t even realize my hand had been cut till I started walking back to my house which was about 10 minutes away so I completely understand being in a struggle and not really sure of who did what that was when I was maybe 16-17 and im almost 27 now and I still don’t know if he had meant to do it or if I did it to myself in the motion of trying to take the box cutter away from him. He did some other really crazy shit like pushing me out of a car and trying to run me over and stalking me after the break up so it’s safe to assume he probably did do it on purpose but I really don’t know.

His alcohol level was pretty high, so I would assume hers would be much higher too if they drank the same or similar amounts. A sad situation all around, but definitely not enough evidence to convict her.

honestly, if you’re drunk and fighting over a gun, both grabbing at it, i’m sure it’s possible to not know which person pulled the trigger and how exactly it happened also i think the disney world comment was her in a very emotional state after that, getting questioned and bombarded by the media, and she meant it as like she’s glad it’s over and she has freedom

@@sheriwl right ??? this is the only thing that made me feel a little weird. i feel like she shouldn't be put in prison for life or anything because they were both drunk and it was an accident, but doesn't even involuntary manslaughter get some kind of charge ? if someone hits someone drunk in a car they would still go to jail if they died, no ? so why does she get off with no punishment for killing him on accident ? in my opinion you just shouldn't be fucking around with a gun when you're drunk. i don't know if i personally think she deserves jail time. but i think she was lucky to not have any and i would be very angry if this happened to someone in my family and the person got off with no punishment. it was reckless for them to be fucking around with a gun while drunk

Threatening suicide is not only a trait of someone who is depressed, it is also a common abuse tactic. He sounds toxic and abusive using “I’ll kill myself if you don’t do what I want”. He did it before to his ex wife, he was likely doing it to her too. It’s a common manipulation tactic done by abusive partners.

They were both crazy alcoholics and I'm not surprised only one made it out alive. She should've put the gun down when she realized he was not a strange intruder, and he should've taken her deadly threat seriously and gotten the heck outa there instead of taunting her. No tears shed over this case, the world is a better place with one less abusive alcoholic in it.

Yesyesyes I’m so glad someone said this. I’ve been in a similar situation with my ex-abuser before where he would threaten suicide if I didn’t comply, or if I tried to defend myself. I could totally see her trying to defend herself and him saying “oh you want to hurt me? Here let me do it for you.” I strongly feel she had a gun because she was afraid of him and he took it away and pretended to use it on himself to make her feel guilty for defending herself, but then in a struggle it went off accidentally. I don’t believe she is at fault.

After struggling with alcohol for a while and being in a toxic relationship during that time, this story really makes me realize how quickly something like this can happen. I remember being confused during a lot of our arguments while drunk or waking up the next day not remembering anything. I feel bad for both of them.

I do too! So many people make so many assumptions that are incredibly unrealistic. Thing is, if you don’t go through a situation yourself, you can’t possibly understand it. I also think it was pretty dirty how the cops were going to speak to her when she was very intoxicated. The make officer was trying to coax her into speaking without an attorney. Typical!! Just crazy reading the comments and all the ignorance. I was so glad to see your comment. I believe the jury got it right. I've been in a relationship with an alcoholic. I've wrestled over weapons before. The suicide thing is also something abusive people like to use to scare others into doing things they want, which has also happened to me. In this case I believe her. I think it was an accident. She had the gun for a reason even after knowing it was him. Everyone describes my ex as an amazing guy who's not aggressive. Behind closed doors he's abused 3 women and has charges against him from two of us. Some may disagree, but no one knows you like your significant other. That's when the true evil comes out. Not guilty.

Most trauma victims don't have the best recollection of what has happened in that moment, so her story being inconsistent in the beginning isn't that strange to me. I witnessed my ex being shot (not by me) and I could hardly tell the officers what happened when they interviewed me 20-30 minutes later because you have so much adrenaline and shock running through you and your brain wants to block that horrific memory out. It took me about 2 weeks to get the storyline straight of what actually happened that night and trying to remember what the suspect looked like. But on top of it she was extremely intoxicated, which just makes it even harder to remember you can hear how intoxicated she is in the body cam footage. I genuinely believe this was a horrible drunk accident on both parts, it's truly a sad case.

It is insane that someone in that line of work that a drunk, in distress woman, not being able to keep to one story and changes, means she is guilty. Both distress, and alcohol, significantly impacts memory. I would be MORE surprised and think she was more guilty of making things up if she had provided one solid story in that situation.

“[Go] to Disney world” is a quote from a sports game where a reporter asked one of the winning players what he was going to do next and he said “I’m going to Disneyworld”. It was a quote everyone said for a while. Completely sarcastic but also relevant to the time period.

I don’t like the fact the cops were listening to her and openly stating that she was already working on her defence. The police need to learn to put aside their own bias when speaking with people who have just witnessed or committed a crime or incident. I mean, look at what happened with Gabby Petito when the officer couldn’t set aside his own bias when talking to her.

I think it’s so weird when people judge 911 calls. My husband passed out once. He hit his face on the floor. Blood was everywhere. He stopped breathing and then had a seizure. I called 911. I was screaming. I have no idea what I even said. I was just screaming to get the paramedics there. I remember she asked what happened and I literally just rambled. I don’t even know what was said specifically. I was just screaming for them to get there and screaming at him to please wake up. Like everyone is upset when people are calm and collected on the 911 recordings. But they’re also upset if they’re frantic. This 911 call is exactly what I would expect from someone that was shook at what had just happened. But it’s not accurate to decide if someone is guilty or not. And I am not defending her. I’m just saying 911 calls are too chaotic to be able to judge.

I completely agree. I work in the medical field, visiting people at their homes. I’ve had to call 911 many times before. Sometimes when I watch these videos I wonder if I ever had to be in that situation, would I be calm like I usually am or would I be hysterical? And if I weren’t hysterical would I be criticized for that? Ultimately I don’t really think you can judge someone on how they’re acting on a 911 call all the time.

I used to work 999calls (British 911) and honestly people can range from sounding abnormally cold to extremely hysterical. There are red flags in listening to these calls but lack or extreme emotion can just be how people handle emotional distress

I completely agree with you. I had to call the ambulance for my daughter when she was 3 months old because she couldn't breathe. I was hysterical. I was screaming, crying. The only thing I know for certain was that I kept screaming, "My baby can't breathe, my baby can't breathe, my baby can't breathe!"

I was friends with an old Brooklyn detective, who told me that a lot of fatal shootings. follow someone saying “What are you going to do.. shoot me?” Because apparently, your unconscious hears “shoot me”, and, well.. does. I hope she gets sober. For the sake of everyone around her.

Caryn literally said he didn’t mean to shoot himself, and neither did she. I believe her. The lady doing the autopsy and everything she was trying to prove was based on him trying to shoot himself, which Caryn never said it was intentional. It was an incredibly stupid and avoidable accident, not murder. A sad tragedy really.

agreed. i really think it was a fucked up, confusing accident. sometimes people downplay how much being very drunk affects what a person does, how they react to things, etc. she was not lucid, it isn't an excuse but it is an explanation. imagine being completely loaded and ending up in a situation anywhere near that. having been pretty damn drunk several times in my life, not only is it hard to remember shit, it's hard to think straight or do anything really. i invite those who think she was calculated and decisive to get wasted and put themselves in a high stress situation. to me that sounds like a literal nightmare.

The phrase about “going to Disney world” was said in sarcasm I believe bc it used to be a commercial in the 80s, and something about the super bowl.. it was probably bc the way the reporter asked it was very similar to the commercial. I don’t think they had enough evidence to convict her, and I actually do think it wasn’t intentional. I think they were both wasted, and a horrible accident!

I think cases like this where drugs, alcohol, toxic relationships, and seeming mental instabilities are existing all together… are just tough. The story could be so much more complicated than we can imagine. As someone who has struggled with addiction, mental illness and toxic relationships Im so thankful that I never accidentally hurt someone or I was never hurt by someone. Im glad to be living a better life. So yeah… I don’t think we’ll ever know for sure with this one.

the way this case was handled in such a black and white way is honestly infuriating to listen to. it being disproven that it was an intentional suicide doesn't suddenly prove that it was an intentional homicide. personally all the evidence sounds to me like it was a genuine accident - and sadly it isn't surprising that two very drunk people handling a gun ended this way.

The fact that they chose to interrogate an obviously incredibly drunk woman in her nightgown was the nail in the coffin for me. Then having the balls to say “her story was inconsistent” as proof of her guilt, as if her being drunk was not an explanation for that. Imagine a lawyer trying to use witness testimony from someone who was intoxicated. It’s be thrown out!

💯 idk who held the gun but it is without a doubt an accident not premeditated murder. The motives she mentioned are not motives to kill Maybe more in line with her killing his wife Sandra than him. Still clearly two drunk people in the heat of an argument trying to have a power play with a loaded gun.

This seems like a complete freak accident. I don't think she shot him and I don't think he committed suicide, it looks like a drunken accident brought on by the passion of the argument. The gun went off in the struggle, and here we are. I feel genuinely bad for her... she realized the consequences of getting that gun out as soon as the shot fired.

As a domestic violence survivor I could see all the red flags in Philip. If I hadn’t gotten out of it as soon as I did I probably could had snapped. I was suffering extremely mentally and even had violent thoughts about my abuser. My psychologist it’s completely normal and it’s called reactive abuse

I thought the same. Yes, there was circumstancial evidence that she may have had a motive to kill him (purposefully) but the evidence of the situation itself was not consistent with that being the case. I actually had to look up Florida law for manslaughter and manslaughter defences because I felt slightly conflicted as to if I thought there was enough to say that she was legally responsible and concluded that at least under Florida law she truly couldn't have been found legally responsible for manslaughter with the evidence being what it was.

Doesn’t seem like she meant to do it & seems like she doesn’t want to say he shot himself because of that. It honestly seems it was accidental.

I think the same. Even if she shot him in anger, she was absolutely drunk and so was he. People make split second decisions when they’re completely drunk and terrible things can happen. Her 911 call is shock to me. She’s not in her right mind and she’s dissociating from what she did. It’s really common when something traumatic happens to dissociate and subconsciously deny what happened 😔 Your brain unconsciously creates an alternative sequence of events to protect itself. She clearly immediately regretted what happened. This is what happens when there is a lethal combination of: loaded guns are in peoples’ houses, people who get angry drunk and they make split second decisions 😔

I'm at a loss as to why her blood alcohol wasn't taken at the time.I think it could have shed a lot of light on the entirety of the situation. She's clearly inebriated on the 9-1-1 call and so she comes off questionably. He was also very drunk so he may also have been acting erratically. I don't think she could have had intent being as drunk as she was at the time, and I think her changing story is more likely due to being drunk than trying to change a narrative to fit emerging evidence.

The “going to Disney world”thing was bc back in the late 80’s and 90’s super bowl winners used to say, when asked by reporters what are they doing next the response was “I’m going to Disney world!” It then become pretty much a meme before there were memes. It was used in commercials and in tv shows as punch lines. Was it tone deaf? Yes. But it wasn’t all that strange considering her age it would’ve been something she heard hundreds of times as a response to that question and it was just the first thing that popped into her mind and as her brain is probably going a mile a minute with relief and nerves and she didn’t think much before she spoke. I think it was incredibly insensitive but not intended to be.

Disney is considered "one of the happiest places on earth". It's an expression to tell someone how happy you are. That's why football players continued the saying after winning the super bowl. They are extremely excited/happy and what better place to continue that euphoric happiness than going to the "happiest place on Earth". She was happy and relieved. I would've been too if I had gotten off.

This woman was my landlord when this happened. I can honestly say she was a real character. She was out of contact when my lease ended and we moved out without ever hearing from her. It was months and months later that I found out about this case.

I'm amazed at the number of comments in defense of this woman. She is a grown woman, sounding like a child even in her police interrogation. During the 911 call, she may have been rambling but she remembered everything she said when she talked about it later. She said she didn't know what to do to help him, as in CPR, and asked the 911 dispatcher "what do I do?" I know well how a person can naturally react to a stressful, shocking situation. Every part of her behavior shows she was trying to sound flustered and incoherent. It sounds like she got away with murder.

I’ve watched too many innocence project docs/read articles to ever be willing to speak without counsel. I don’t think it’s an admission of guilt at all.

Even as I was watching this, I commented to a friend that I'd get an attorney, guilty or not. I hear so many tactics used about interrogation to get a false confession and tricking people into saying stuff either in a way they can twist, or making them believe themselves they're guiltier than they are (ex: a detective *could* talk with Caryn and put the idea in her head that she shot him in the heat of the moment due to anger, even if that's not the case. And with the stress and exhaustion, her brain could take that and run with it.)

This whole case was super sloppy, from not testing her alcohol level to trying to find motive and reasoning.

Great show. Thank you for bringing this case to our attention. You know, without having been a juror and having the opportunity to hear ALL testimony, it just is fruitless to say whether justice was served. A man is dead! I do believe that the system worked. The prosecution clearly failed to PROVE their accusations/charges. That lands solely on them. Regardless, if I was in her position, on the night of the Phillip's death, I would have immediately asked for an attorney before answering any questions whether I was guilty or not. In my firearms training, during and immediately after a person is involved in a shooting, they are not truly able to recall details for a period of time and in the want to please the authority's a person MAY say something that proves later to be untrue/inaccurate. Not because they are being deceptive but due to the fight/flight response to trauma. I really "enjoy" going through these cases and drawing my own opinions on things. This channel brings attention and value to people who have lost loved ones and just want justice. Thank you Kendall!

I've heard of these kind of cases before and it's always said that guns cannot accidentally go off, because it takes some pressure to pull the trigger. Is this not always true of certain guns.? I can't imagine that someone "drunk" could keep the pressure on the trigger, especially if they were "fighting". I think she had found out he was going to finish with her (probably still in love and possibly seeing his ex) and wanted to hurt him, but probably didn't intend to kill him.

Guns actually don’t need that much pressure, all you need to do is squeeze the trigger once (not keeping pressure on it) and it will fire, the problem they had was being drunk and fighting for control of the gun, impossible to know who pulled the trigger but with the awkward angle of the shot itself and the fact that they were both just grappling for any purchase they could find on the gun it makes total sense to me that it went off without either of them intending for it to.

Why do police interview ppl who are wasted and then say “they’re obviously lying because their story changed/didn’t make sense.” Like yeah no shit, they were drunk smh. And even when she sobered up a bit, she only had a few hours of sleep at best, she probably didn’t even know wtf was going on. It sounds just like you first said, that she had the gun pointer at whomever came in, then held it up and he saw it and was sort of belligerent like “oh what, ur gunna shoot me?” And then messed around, struggled, and it went off. Hence the distance from his cheek, they were both pulling on it. Also sounds like he didn’t get divorced because he was still holding on to his marriage at least in his heart. Dating another girl for 4 years before this relationship shows that he wasnt in a hurry to change his marital status, but it didn’t hold him back from moving on either for some reason. Sad all the way around, they sound like they were terrible for each other and drinking way too much 😕 his poor kids man.

The inconsistencies in her story seem to stem from being drunk, emotional, and disoriented more than intentionally deceitful. Personally I'm not sure SHE even knows what happened. "We were drunk and there was an accident" seems true and is possibly the most details she can really accurately provide.

Possible she was not invited to the wedding was to prevent her finding out that he was still married. In court, before sending someone to jail you need to be 100% convinced that it was a crime. They both drank to much alcohol and it could have been an accident

"What are you gonna do now? Go to Disneyland" was a popular slogan, it really seems she was just being dismissive of reporters. I believe he was challenging/mocking her regarding the gun and so said "I'll do it myself!" And tried to gt th gun from her. It was in that moment of no one wanting anyone to get shot, the gun did fire and he did die. It seems incredibly logical the way she kept saying "he was shot" and not entirely committing to INTENTIONAL suicide. It was an accidental suicide or an accident, it doesn't seem that she even knows for sure how it went off, it just did.

You can’t question any inebriated person and expect a straightforward true consistent story. The gabble petito case is a perfect example of why I do not trust police to correctly identify a domestic violence situation. The fact that they brought her in drunk should be raising a million red flags. She is not in a frame of mind where she can even consent to questioning. The detectives need to be charged for doing that, that’s despicable. Not only all of that, which could easily explain her changing testimony and possibly make her not even remember clearly what happened, he has a history of threatening suicide to his significant other. And he kept secret the fact that he was married the whole time, but doesn’t that reflect poorly on HIM? It seems like that fact was only used against HER. I think the jury was right to vote not guilty. Even if you think she is guilty, the case was handled disastrously and maliciously and there isn’t compelling evidence of her guilt.

Gut feeling: her character - based on witnesses - tells me that it's entirely possible she had a "heat of the moment" type situation. As far as actually proving it...i think the jury ruled the correct way based on the charges karen had and the evidence they were presented with. Makes it tough to separate your gut feelings from the law, but it's necessary.

Two alcoholics in a toxic relationship fighting after a night of drinking, and high emotions. Honestly, she probably knew it was him, and wanted to act tough with the gun. He acted angry, and emotional, and wanted power over the situation, and grabbed the gun, and a drunken toxic fight ensued. At some point the gun was fired. I totally believe this was accidental for both of them. It's an unfortunate accident in a drunk and toxic relationship that probably had past fights of varying elevating levels. Not hard to believe honestly.

I took the, "go to Disney" comment as a sort of tired, sarcastic, "just stop talking to me" response. "What are you going to do next" is a rather stupid question to ask. How would she know for sure after everything that had happened. Honestly, if I'd lost the love of my life, been accused of being the killer, had the prosecution parade a bunch of people who disliked me to bad mouth me to the jury, had a doctor with a bias try to condemn me with invalid testimony, and then get asked THAT when it was finally over........I can't say how I'd react. Her demeanor more reminds me of how I am when it's all too much and I just shut down. Maybe I see that because I have depression myself, but that ordeal can emotionally exhaust anyone.

In the 90s/early 00s, it was a popular thing for sports reporters to ask winners of big games "what are you going to do next" and they'd always say "I'm going to disneyland!", it ended up in some disney commercials and promos, etc. When this case took place, if you asked almost anyone "what are you going to do next", they'd respond that way. I agree with you that she just said it because it was the first thing that came to her mind and an easy way to dismiss the dumb question.

The smirk when she was found not guilty was proof and then the flippant reply to what she is intending to do next 'going to Disney' just shows what a cold hearted killer she is. I woke up the next morning thinking I had dreamt it all until I saw a cigarette in the pot plant .

You can’t always listen to what the family says. Sometimes the family doesn’t really know what’s going on when the relationship their family member’s in is toxic. They are only hearing one side of the story, so they think he was the victim in the relationship and that she was the evil one but I think it was both of them

I wanna know more about her habits and routine. Did she normally have the gun locked and loaded at her bedside? Why did she “warn” Phillip that if he came home unannounced she might shoot? Did he usually text or call when he came home late at night? Did she use their drunken night as an opportunity? When she recognized him did she question herself and that’s why she didn’t put it down? I believe she saw him, hesitated, seriously thought for a second about doing it, then they fought for it and he got shot. Then she freaked out and realized she never truly wanted him dead, she was just irritated as hell with him and boom. There you have it.

In this case, i feel like it genuinely was an accident… when a couple are both drunk and belligerent- it makes sense that she wouldn’t exactly be able to recall everything that happened in the moment, which obviously made her look bad cause she couldn’t keep her story straight. But I don’t think it was on purpose. She genuinely seemed distraught. This is simply what happens when you’re drunk, belligerent, and have a gun. Although, in the end- the only two people that will ever truly know the truth are her and him.

I agree with the jury's verdict. Her 911 call and actions afterward, including the odd behavior, sounds like she had snapped due to shock. When your brain experiences trauma, as others have mentioned, it does not always process in chronological order or in coherent detail. The Disney World comment, being that she is in Orlando, seemed like a snarky annoyed response to the constant questions. She probably hadn't had a chance to process her freedom completely and was hit with interview questions. In the 80's and 90's after the the super bowl the athletes were asked what they were going to next. They always responded, "I'm going to Disney World!" It became a tongue and cheek response to something good happening. Her tone of voice sounded tired and unattached as she responded. That wasn't a real response...just a sarcastic response to an annoying question. I actually believe this woman this time. 🤷🏻‍♀️

Yeah, the Disney World comment reminded me of the thing they always did after the Super Bowl/ football games when they’d ask the winners what they were gonna do now that they won and the winner would always say “I’m going to Disney world!”. I don’t know if that’s still a thing, but it was a trend back in the day. That’s how I took her saying it. Playing into a common saying during that time period.

Where a reporter would ask the captain of the winning team of the Super Bowl, “So what are you gonna do next?!” And the captain would reply “I’m going to Disneyland!”. It was some sort of advertisement for Disney ever Super Bowl. I think that’s why she said it. It was like, a common catch phrase in the late 80s/early 90s.

'Go to Disney Land' sounded so sarcastic to me. She sounded exasperated over the questions and just sprouted Disney Land as that kind of back handed way of saying 'what the f**k do you think I'm going to do?' A bit like when something bad happens to someone and you stupidly ask them - 'are you okay?' - most people would shake their head Sadley, others might sarcastically snap 'yeah i'm blo*dy lovely! Might throw party!' Whether she was exasperated because of the questions as a guilty person and more annoyed, or as a innocent who was just fed up ... who knows?

I don't know why people thought it was suicide when it just sounded like an accident. Like suicide to me seems like an intention to kill oneself not accidentally kill themselves. Saying it was suicide because of depression even makes less sense because he was literally drunk no one thinks straight when they are drunk. I also understand the not putting the gun away because she had it up in the air to not point it anywhere. She could have been going to put it back but they fought over it. The police were definitely bias which led to tunnel vision. You could see it in the whole "sHe'S mAkiNg HeR dEfEnSe RiGhT iN fRoNt Of Us" statement

On the "Disney World" comment, anytime someone asks me "What are you going to do now?" That is my exact immediate response, "Go to Disney World!" It's a really popular line from a Super Bowl Advert. and when I was in High School, everyone said. I even think it was in a few movies. --------------- Also, Officer Boop! Personally, I think the gun went off in the struggle. Both had their hands on it, emotions high and alcohol thrown into the mix. I think the jury made the right call, I don’t think it’s a case of beyond reasonable doubt.
