@@ekie7473 If it were classical, I would agree but the chess in chess boxing isn't classical. These days, Hikaru and Magnus are close to an even match in any form of "speed chess", as seen by the speed chess championship. Not sure about the boxing part though.

Han's response strongly suggests that he is full of crap. People respond like this either when the proof is absolutely clear or when they have no explanation. And, since it's not clear, Hans apparently does not have a good explanation. He responded the same way when initially asked about the cheating scandal. He said, "His chess speaks for itself." It didn't.

He already threw HIkaru under the bus after learning about the suit by saying HIkaru has tried to get players banned from tournaments in the past so he was not surprised by his actions....LMAO. Wouldn't be surprised if he is called to testify for the plaintiffs. I could also see HIkaru end up testifying against Magnus. hahah It will be a wild circus if it goes to court. Personally I don't give a crap about cheesy com, hikaru or magnus so I welcome the entertainment and dirty laundry it will bring out.

@@ulisesmora1282 What are you both on? I have watched almost all the hikaru videos on the topic. Hikaru has nowhere accused Hans of deliberate cheating. His videos only ever contained wishy washy phrases like "could be/may be/suspicious" etc. No jury in their right mind will convict him.

100% a SLAPP Lawsuit by Niemann. Even with elementary level knowledge of law, you would know none of these charges are going to amount to anything. Even if any of the accused said that Hans Niemann did for sure cheat without proof, there still needs to be proof that they said this KNOWING it to be false. So not only do they have to outright say he cheated as fact, Hans team would also need to prove that the accused KNEW he wasn’t actually a cheater. Considering there is no currently known meaningful relationship with Hans and the accused to suspect malicious intent and the fact Hans has already admitted to cheating before, there would be no reason a judge would find any of them guilty for defamation.

I think we need to start punishing the lawyers of the SLAPP cases to prevent such frivolous cases from happening. I am pretty sure now that Neiman's lawyers are just milking him dry on a useless case. Anyone with half a brain can see how stupid this lawsuit is even if Hans' grievances are legitimate

The lawsuit is more about Niemann's futures earnings being damaged by actions and speech of Carlsen and Nakamura. It's not so much about whether Niemann actually cheated or not. If the lawsuit goes to trial (which it probably won't), the focus will NOT be on proving whether Niemann cheated or not over-the-board (as opposed to online, which he did, by his own admission). It will be about proving whether Niemann's career was damaged by their actions.

@@potzysk2 Yes, OP already mentioned Hans admitted to cheating. This is why he is saying the lawsuit will have no merit because he is a proven cheater(among other things). Someone can’t be held liable for monetary damages when you actually did those things. Simply bringing up potentially harmful (but true) things about someone to the public’s attention is not defamation at all. This is a complete joke of a case.

Thanks for the update Epic. I'm pretty sure the Court will dismiss the action against Hikaru, and probably Rensch/Chesscom. Magnus is the only one in jeopardy, and even that's a bit of a stretch. Everyone's hoping Hans plays Magnus and/or Hikaru next week; if so, they could be the most watched matches in chess history.

Some Lawyers like Pasha Law PC on youtube says Hikaru has the most to fear. Noone knows what a judge will do, And Case Precedent in Missouri, Legal Vignettes on youtube said they have cited California pecendents, meaning if it was on the internet HIkaru doesn't have to be in the state as long as Hans was and as long as they consider it defamation. I have a feeling these guys are all gonna scramble to settle out of court. Hans doesn't even have to pay his lawyers...

From what I understand though is that Chesscom make a point of never settling, and after reading Hikaru's and Carlsen's defences they seem determined to not settle either. Time will tell, I guess.

The truth is an unbreakable defence for defamation and Hans has repeatedly admitted to cheating in the past - that makes any claim that he is a cheater provably true. I don't want to see this get settled because I think it is a blatant cashgrab by Hans and I want to see it backfire massively.

I gotta disagree, I think Hikaru has a lot more to worry about. Magnus kept his mouth shut pretty much the whole time, while it was Hikaru who kept talking about it on stream. There’s almost nothing Magnus could’ve said that was defamatory because he didn’t say anything, while it’s entirely possible that Hikaru may have crossed that line a couple times during various live streams.

Consequence of the lawsuit. His lawyers would (very strongly) advise him to participate until the legal dispute is resolved. Edit: Also, he literally can't comment on it for the same reason. That's why it's potentially a SLAPP.

Cheating is much harder in blitz. If you see some of the banter blitz clips online where the player the GM is facing is obviously using stockfish you'll see them slow down when a human wouldn't and they end up losing on time.

Indeed, and it should be no surprise that Hikaru’s defense put lack of personal jurisdiction in the motion to dismiss, because it’s a no-brainer from a legal standpoint. The lawsuit was insanely flimsy in the first place, ESPECIALLY for trying to bring in Hikaru as a defendant in a Missouri case 😅

That anti slapp counter suit was a good move. If the courts support Hans in this then it forces him to push through with his suit and prove he’s serious and not just leveraging the threat of court to silence opponents.

Not really. Hans has already admitted he has cheated, therefore could be called a cheater. I have no doubt he has cheated in live tournaments. There is strong evidence he cheated in at least 100 online matches. He has nowhere near the gifts Magnus has.

Your "strong evidence" is also nothing but statistical probability, which has yet to be seen how much said evidence is weighted in a court of law, not to mention, it holds no baring on the actual articles of the present suit. Finally, not having the gifts of Magnus... bro, for one, no one does, so it seems a pretty empty statement, and for two, the amount Hans has accomplished in such little time clearly demonstrates an immense talent. Did I say he didn't cheat? No. Does the question of whether or not he cheated change in any way the fact that he is consistently beating some of the best players in the world now and very obviously a beast a chess - not in the slightest.

@@anthonyrun He admitted to cheating already so yes he can be called a cheater. His coach admitted to cheating in chess for money using one of his students and a chess software (look it up). A basic understanding of statistics shows it not humanly possible at this time. The probability is akin to being struck by lightning twice. It can be said beyond a reasonable doubt he cheated in at least 100 games online during the last 3 years.

Chess is very prestigious and if you want to cheat and defraud people, don't expect anyone to ever believe you. Humans have the ability to cheat undetected in live chess, that is fact. Maybe make them play inside a Farraday cage? So signals could not get in or out. Referees and a video camera with them in the cage. No internet or other connection to the outside. Post the video online after each game. 😊

When did he cheat? Years ago a few games? Also doesn’t using an engine is something half the population has done at least once including professional players and due to the scandal a lot of gms were found to have cheated some games in the past as well

@@tengu8560 imagine this, you're in a high dollar fps tournament. Your opponent is doing decently okay with some kill here and there. The next day comes and all of a sudden it's prefire headshots kills only. After that game of prefire headshots, the interviewer ask "so how did you know to prefire him on this corner on round 1 when he made no audible noise? Then, how did you know he wasn't at that same corner but prefire under the car in the next round? He got there before you enter the sound proximity." "The game speaks for itself." My point is, he couldn't explain any moves he did, which I find hard to believe that he can't remember any moves right after playing the game. I play hour long session CSGO and can remember why I did what I did after the game. I even go back to watch my games to see if I can improve.

@@magicmilkshake8901 He never admitted to cheating in those games. He can deny it all. Thats why cheesycom chose to slander delugy by releasing his emails instead, because they had none on Hans. Ken Regan himself said the claims of those 100 games is outlandish and I'm sure the guy is ready to testify in court for the plaintiffs. It will be a juicy trial and the defendants would be foolish not to settle and choose to air all their dirty laundries out in court if it goes that far. The arrogance on all 3 parties is historic.

Carnage in the context of a chess tournament sounds over the top, but knowing the details, it's over the top...I don't have a stake in the game, but Newman's case brought me back to playing chess. Cheating allegations didn't make any sense to me initially without someone being caught with a device, especially over the board. I didn't know who these people are, nor understood the rankings, and thought of Magnus as spoiled by successes. After playing for free months, understanding the power of engines, and how easy it is to create a simple device, how every player has a range of abilities, and styles I can see the point. Fascinating though how in the world, this puzzle can be solved without catching someone cheating. What is interesting is these chess players with high IQs and 5 competitive moving competitions from the game board to life.

Hikaru not having "knowledge" is BS lol. They are chess professionals, they know very well how cheating accusations affect someone's business dealings. Thats like an actor slandering another actor, which may cause them to lose future roles, and then being like "Hey i dont have any knowledge of their current business dealings! I cant be held liable!" As a professional in the industry you know very well how certain things may affect the business dealings of another professional in the industry. If Hikaru was some random chess fan, or someone outside the industry then that would make sense. But for someone like Hikaru, its BS

Not necessarily I think. He didn't destroy his career by admitting to having cheated, that would have helped him if anything, IF he did it properly. But he sticked to version where he cheated only twice or whatever. And then he got all but proved to lying. THAT is what I believe will contribute to his career going to shit. And also by being an overall douchebag. He tried hard to be a chess world "bad boy", well it's now going to bite him back in the ass. The reason why noone cares about online is because it is a website that lets its streamers cheat for living. A website that has let 1000s of titled players who cheated play in money events. Online gaming itself has never been respected by general society because of all the anonymity and sandbagging. Its already considered a cesspool and the perception is everyone cheats. Its simply not treated with the same respect as real life chess and Hans argued he has much more respect for OTB chess. The fact the website coudln't even prove he has cheated since he was last caught and promised not to doesn't look good on them for banning him cause Magnus was upset he lost a game. Also doesn't look good that not expert in the world woudl claim he cheated in the sinquefield cup or any otb game.

Thank you. I must read the filing before i say much more but from this video it seems you are getting the hang of such cases already. Im not sure the contractual piece will work. You could be on the way to sign a multimillion dollar deal and get involved in a car crash. Because you didnt show up the deal may be cancelled. The other driver would have no idea about the deal. This is not a forseable consequence of the crash but im sure there is a ruling somewhere covering it. On jurisdiction. Thats tricky. Federal law is supposed to be the same throughout the US. In practice it differs. There are for example four different tests for copyright. The Supreme Court has declined so far to sort this one out. Neiman is based in one state. Nakamura in another. As a general rule the court will favour the weaker party as it is required to do so. I dont see Nakamura being the weaker party so the suit will stay where it is most likely. Regardless there is nothing other than money stopping Hans refiling it in another state so that is unlikely to be the end of it. The other defenses are more technical and i will have to bone up on them before saying anything more. Nakamuras lawyers like the others certainly seem to be competent judging from this filing alone. This case if it progresses from here looks very interesting. The next step in the process is Hans filing a motion rebutting these defenses. If he fails to rebute these the case will be dismissed. The filing is not the end of the matter as both sides get to argue thier case in front of the judge. And any other bystander who wanders in. The judge hears the oral arguments and then issues a ruling. Here the only matter to be decided is if Hans claims can survive dismissal. Nothing else will be decided normally at this point. If the case survives this motion to dismiss then we may get to hear evidence on which the claims are made. Which imho will be the most interesting part of this matter. Of course it may not come to that. If the case survives the motion to dismiss a settlement may be agreed without admission of liability. This might be a lot cheaper for all concerned. But it would be a pity for the rest of us.

If they are conspiring to defame and block Hans from competing, they can be found liable in a civil court. There were multiple counts in the suit, and Hikaru had danced about the idea of Hans as a cheater for months before he was slapped with a lawsuit. His defense claim #1 is a technicality on jurisdiction, and the court can effectively rule "if not here, where?"

I doubt this will move beyond preliminary evaluation and even if it does, it won't be anything more than a frivolous lawsuit. Imo, hans will be lucky to escape without getting slapped with frivolous lawsuit charges if it goes for trial.

Also, Neither magnus nor hikaru ever accused neimann of cheating. They only claimed that 1. Hans is a known cheater(which hans himself admitted), 2. Cheating is a serious problem in chess, 3. Cheating could be possible despite precautions. Magnus went above that and said he won't play against such guys. First three points are not enough outside of a Kangaroo court of public opinion to get a conviction of defamation. Magnus saying he won't play with past cheaters is his damn right. I don't understand how he can be prosecuted for that. This is why i find it crazy that so many guys support Hans neimann lawsuit. Seriously, Hans has no case even if his grievances are legitimate. It's one thing to be right but entirely different thing to prove you are right.

I expected this. I don't think all the allegations will be dismissed against Magnus, there are allegations there that, if proved, would make a good case. Those facts are unlikely to be proved in court and I expect Magnus to win. But not to get it dismissed. The allegations against Hikaru are different. There really is no case against him on the facts even as Hans claims them to be.

That's not likely, but he gets to seek discovery to find evidence of it. By the time Hikaru said anything, Magnus had already turned it into a big news story and Hikaru was just commenting on it. The standards are different, as was what he said. He was opining on whether or not he agreed with Magnus, not making his own accusations.

@@cooloutac Maliciousness is part of the calculation, especially for Hikaru. For Magnus, it is a little more nuanced because they have to analyze whether or not Hans was a "public figure" at the time Magnus withdrew from competition in a manner that sent a clear message he thought Hans was cheating (I had certainly never heard of him). Then there is some real question about the way he made his point clear, if it was clearly an opinion or if he would reasonably have been interpreted to be stating a fact he knows. All of that makes the case against Magnus MUCH stronger than the one against Hikaru which is why I think Hikaru's motion to dismiss will be successful, but not Magnus'. I think they get to seek evidence on Magnus.

Upon learning of the lawsuit for example Eric Hansen said he is not surprised because hikaru does not like Hans and has been known in the past to try and get players banned from tournaments. The whole thing will be better than Johnny Depp versus Amber Heard if it goes to trial. And regarding Magnus the guy literally came out with the public statement exposing himself as a sore loser to the whole world, quite a historic event. And the website themselves we all know their actions were purely vindictive and malicious. Even their own streamers said it didn't look good they released their hit piece on the day of the US championship o0ening ceremony. and they basically admitted to Banning the guy because of what he said in his interview. They already all lost in the court of public opinion for most of General Society even if the courts do not agree. And I'm sure at least Magnus and Erik from the website regret their actions. AFAIK a case cannot be dismissed with an argument of "I'm innocent" or "the prosecution is wrong", or even "the prosecution is lying". Those are things that have to be argued in court, in other words, the trial, with evidence presented and the prosecution allowed to cross-examine. An appeal for dismissal cannot be the trial itself. A plea to dismiss the case can be granted only when the lawsuit is completely invalid (for example the lawsuit is based on an alleged law that doesn't actually exist), or in situations where even if the defendant were found guilty there would be no sentence (for example if the crime is too old and has expired, and thus cannot be prosecuted anymore). In other words, the case is dismissed if it can be shown that the actual trial could not lead to any kind of sentence regardless of anything because it's just an invalid, frivolous or non-punishable accusation, even if the defendant were "guilty" of what he's being accused of. But I suppose lawyers make dismissal pleas anyway, regardless of anything. And, for some reason, sometimes judges will actually sentence the accused to be innocent and dismiss the case (even though according to legal procedure they shouldn't do that. They cannot declare the accused to be innocent without an actual proper trial.) I suppose in some cases jurisdiction questions might be grounds for dismissal (as it would be a case where the lawsuit trial simply cannot proceed and cannot be held.)

LOL!!!! 9LX removes openings, so Magnus should be STRONGER not LESS STRONG. Yet in 2019 Magnus lost 13.5-2.5 to Wesley and didn't get a single win. Why?!?!?!!!! And look now in 2022 Magnus lost 3-1 to Nepo despite beating Nepo 4-0 in the 2021 WCC (where Magnus cheated against Nepo). And of course consequently Magnus indirectly lost 3-1 to Hikaru. Also Magnus should be better in rapid than classical re Sergey 2016 and Fabi 2018. Yet 2nd 2019 and 3rd 2022. LOL. Part4. Magnus is a coward re the 2022 WC because: 4.1 - The 2022 WC doesn't have a candidates the same way the last 4 WCCs do. Magnus had the privilege to defend against ONLY 1 OPPONENT each of the last 4 times. (And Vishy from 2008-2013.) Here, there isn't like a tournament / a series of tournaments and then the unique winner will face Wesley. 4.2 - FIDE lowered the time controls by 25%!!!!! Magnus obviously has a higher advantage in rapid since Magnus was rapid WCC and reached 2900 in rapid. Magnus even beat Sergey and Fabi only because of rapid tiebreaks. Magnus couldn't beat Fabi in a classical WCC game!!! But anyway, Sergey and Fabi I guess 'deserved' to have lower time controls because they only drew against Magnus in original time controls. But Wesley didnt lose a single a game to Magnus in 2019 and even beat Magnus 4x !!! Why did Wesley deserve lower time controls?!?!! Bobby was on top for only a short period of time because FIDE and Anatoly (no offense Sergey Karjakin!) were cowards who ran away from Bobby. (Wait Sergey ok I can compromise that FIDE were cowards but not necessarily Anatoly.) See? It happened again. FIDE and Magnus were being cowards running away from Wesley. But it backfired on them because they didn't expect Nepo, and apparently Hikaru too, is more talented than Magnus. But I already knew it: Nepo lost only 3x to Wesley in 2019 FIDE and drew with Wesley in 2022 St Louis while Magnus lost 4x to Wesley in 2019 FIDE and FURTHERMORE lost to Wesley in 2020 St Louis.
