Good day po atty. Napaka Ganda po ng programs ninyo marami po akong natututunan tungkol po sa papeles ng lupa. Pansamantala nais ko po itanong ung amendment to RA 9176 kc mayron po akong inuukupang lupa na ayon po sa aking pagkkaalam ay wala pang issued title at ang sukat po ay mga 10 hectars at hindi ko pa na applyan ng free patent. Ano po kaya ang dapat kung gawin sinimulan ko itong pusisyunan 1992 at malalaki na mga tanim ko. Salamat po and God bless

Thank you for your question. I will definitely make a video on how to cancel problematic annotations and is there a need to have it cancelled (on some annotations). To answer one, if the loan has already paid and the mortgage has already been cancelled, you must annotate the release and cancellation of mortgage to make it a clean title again.

My situation is that, gusto ko sana na magtayo ng Studio sa 100 sqm na naka register sa pinsan ko, para matirahan sa 92-year old ko na Father, upang next door lang siya sa kapatid ko. Hello po Atty. ano po ang mangyayari if there are claimants of a certain parcel of land (like Phase 2 only) inside a subdivision? Mapapaalis po ba ang home owners (whose title are already under their name) if the developer losses the case? And possible po ba na some lot portions are clean title and the adjacent one is not? Sample po, Blk 1 is clean title (title is already transfered to the buyer) then Blk 2 (title is still with the developer and has a pending case from another claimant which is not a client of the developer) is not which are of the same phase.

Jeme, i finally saw your attachment on your email. And yes, I am right all along that it was a long time ago that Milling Contract :-) , and maybe it was a sugar plantation before. If you want to have that removed, you must file a petition in court to cancel that entry and prove that the use of the land is NO longer for that purpose. (here you have to hire a lawyer to help you). On the canal right of way entry - that is an easement which you cannot remove. it is a burden on the property for the benefit of all (that is - not to disrupt the flow of water in the canal). If you will purchase the property or even a portion of it, the annotation will be carried over to the derivative title (your title). This is also true if you will not file a petition in court to remove the annotation of milling contract. I hope I am of help to you on this very interesting matter.

Okay lang yan si balikatan, but know that there will be 2 tax consequence and transfer registration that will happen. Balikatan to seller and seller to you. In this case, you must have an idea magkano cost nung balikatan to seller becoz that is his obligation to pay (if the sale has been made years ago, the tax penalties may be high for him already) also, you must check who is in possession of the property. Is it the seller or other people. Remember that balikatan gets the property from foreclosure sales
If i dont let the buyer borrow my orig title the buyer should doubt thats its fake, in the 1st place why will i give the orig title to the buyer na hindi pa naman bayad ung property ko eh kung mawala niya ung title paano na me??? 2nd for verification @ROD, u only need the details of the title then ROD upon payment can give u already the e-copy of the title where u can check if there are encumbrances. No need to bring the original title coz if its really an orig or fake just providing the details to the ROD they will tell u already if it exists or not.😀

Please be informed that awarded lands covered by Emancipation Patents (EPs), undoubtedly, can be the subject of a contract of sale. As elucidated by the Supreme Court in the Case of Engracia Vinzons-Magana vs. Hon. Conrado Estrella, et al., 201 SCRA 536, the issuance of Emancipation Patent confers on the farmer-grantee a vested right of absolute ownership in the landholding - a right which has become fixed and established and is no longer open to doubt and controversy. Thus, Emancipation Patent is a proof of ownership which can be the subject of a contract of sale in the exercise of one's right of ownership without violating the prohibitions embodied in Section 27 of R.A. No. 6657 (Comprehensive Agrarian Reform Law) relative to sale or disposition of awarded lands for a period of ten (10) years from their award because said provision of law solely applies to awarded lands under R.A. No. 6657 covered by Certificates of Land Ownership Award (CLOAs) and not to PD 27 lands covered by EPs. [dsr opinion]
How is an agricultural free patent different from a Certificate of Land Ownership Award (CLOA)? An agricultural free patent comes from public lands while a CLOA comes from private lands distributed by the Government under the agrarian reform program.

Hello hazlyn, first hindi nia mabenta ang lupa dahil kailangan nia ang marital consent mo. gaya ng sabi mo, andun pangalan mo sa title. Ang problema lang kapag i forge ang signature mo or kaya gagawa ng spa na kunyari eh, may pahintulot ka - pero yan ay assumption lang or haka haka na maari mangyari or hindi magyari. So the best way is to file a case in court. para mabilis, legal separation with separation of properties and then pag na i file na, pa annotate na may pending case (lis pendens). Kaya lang dapat ka umuwi para asikasuhin ang pag file sa korte

@@RC-hj2cf ah okay, yes pede na photocopy. If you are not the owner of the property, the registry of deeds will ask from you an authorization letter to secure a certified true copy for verification. Licensed real estate service practitioners and lawyers are exempted on this
@@attybatu Thanks atty. Im a licensed R.E. Broker, meaning no need na po ng authorization letter and ID ng seller to verify the Title? I only have to present my licensed? Nangaling po ako sa LRA, only title lang pala ang ma issue nila no encumbrances copy sa RD lang daw po. Thanks atty.
@@RC-hj2cf hello bro, what we do here in davao city is we write a formal letter asking for a certified true copy from ROD attaching a scanned copy of our reb license. We state that we are licensed practitioner by the prc and we need thr document for due diligence. We are given naman 😀

I'd like to consult with you re a property which has apparently been foreclosed but the creditor has not been able to transfer the title under their name or any other name/party for more than 30 years. The creditor also has not paid the real estate taxes so much so that one of the properties has already been taken by the local government for auction. Meanwhile, the borrower has updated the r/e taxes and continues to pay the taxes on the remaining mortgaged lots. Can the borrower apply for a lifting of that restriction/annotation on his 2 lots or does he have any other option?
