The Clemson Tigers took a hard shot at the ACC in their amended complaint. Clemson is suing the conference and is now seeking unspecified damages, accusing the conference of hurting Clmeson’s ability to seek a new conference with their “erroneous assertions” in regards to the Grant of Rights agreement. Does Clemson offer a valid claim, here? Meanwhile, Florida State and the ACC were ordered into mediation by a Florida judge, but are unable to agree on a mediator so far. They’ve asked for a 60 day extension. Can the ACC find a way to settle with FSU and Clemson without creating a mass exodus?

Kenton the money is not just about facilities. With that much gap in money vs the P2, those schools will use the ACC and B12 as feeder programs for coaches, assistants and players even more than now. Anyone they want from the ACC programs they can take. They’d have the money for it. You can rejoice all you want if FSU and Clemson loses but under the circumstances of the new contracts, the ACC is done regardless. It’s only a matter of time. And what I find disingenuous, is that if NC State had a solid landing spot I bet you’d be singing a different tune.

Going to cost tens of millions more PER YEAR to start the revenue sharing which the House settlement proposes Also completely discredits the effects of P2 having a half BILLION more conference revenue than acc schools thru 2036, or that the p2 is inching closer to a breakaway and/ or p2-only football and basketball postseason (or, at the very least, grabbing more power, access, and money from each)

Alex, in the same Leon County hearing you referenced, the ACC attorney lied and said the ACC held the grant of rights even if ESPN didn’t extend their media rights. The GOR specifically states the GOR is linked directly to the ESPN contract, not the ACC.

And when they were completely okay with being paid about half of what the 2 big conferences get from the new playoff format that demonstrated this point alll too well

1. These two sound like fans of teams that dont have a a place to go if ACC teams are allowed to leave. The bias is strong. 2. FSU already has a PE firm lined up for facilities and the exit fee(if need be). These guys are either uniformed or being disingenuous. 3. If more money isnt needed, then why are you pressing FSU and Clemson on the exit fee and GOR? "What more do you want?". Right? The ACC is full of small minded programs. Quit with the crab mentality and get out of the way of programs trying to compete on a national level now and into the future.

Kenton thinking the delay in mediation is nearly time to put on his acc victory dancing shoes is done of the dumbest 💩 ever The court case will continue while mediation goes on in the background, regardless of any delays in mediation or not. And it's not like mediating right now would even be beneficial. Neither case is even arguing the merits yet. It will likely be at least a few months before mediation could actually result in a settlement

don't need discovery, The contract is between the ACC and the media company is based on the independent GOR which fully empowered the ACC to take the actions they did. So the contract needs to be shelved until the GOR is fully challenged in court and either stands up or it doesn't. And for the ones desperately wanting the ACC to die, The snippets of the contract say that if a team leaves then ESPN is under no obligation to the ACC to collect those GOR fees.

Face the whole thing, FSU is worth more than they get from the ACC contract. But that does not mean they get to walk away from a a legitimate GOR with on reason. And no matter the FSU "value" they are bound by the GOR unless some court says they are not.

As I listened to Donno's description of Clemson's amended complaint, I thought, "That's absurd!", and then I asked myself what would I say in an amended complaint if I were representing Clemson, and I thought, "I might make the very same arguments, because that would be my job." My conclusion is that the ACC has a very, very strong case, but I never wager on the outcome of a lawsuit. Oh, and I totally agree with you Kenton, that this is all about what the contract says. The stuff about "sovereign immunity" is absolute garbage, but again, it is "garbage" that I would regurgitate if I were representing Clemson.

It's not absurd. The gor literally says it's only for the "rights necessary to perform the contractual obligations of the espn agreement" And the acc attorney - in court - stated: "Espn doesnt have the right to broadcast anything once FSU leaves the conference. The conference holds those rights," and "Espn's got no right whatsoever to broadcast those games once FSU leaves. The conference still holds the rights" So the acc literally agrees with FSU and Clemson that espn only has rights to conference institutions, which no longer applies once a school withdraws. And the gor literally says the acc is only granted the rights necessary for the espn agreement, which the acc agrees no longer applies once a school leaves It's genuinely just two poorly worded contracts. Espn signed one. The acc signed both. And now schools likely have a legal and penalty free exit from the gor

Before you say it Alex, Cam Ward is not going to win the Heisman. The guy is on his 3rd team, has won 12 total D1 games., and turned the ball over 19 times in 1 season. And before that lame OL talking point has lost shelf life. Shadeur Sanders threw 2 fewer passes than Cam and turned the ball over 3 times behind a worse OL.

Ward had a four fumble game against Colorado State and a three fumble game against Cal. In his college career, Ward has fumbled it 46 times, according to PFF. Maybe. Still FSU has aired enough malfeasance of the ACC and ACC attorneys have lied so frequently in court that no one will believe the ACC in the future. Yes, schools signed the initial GOR and an amendment but not the most recent amendment that revised the GOR. Sounds like only the ACC commissioner signed the latest revised agreement.
