Great video sir...but how to know that colour were registered or not in same industry..and were do I register colour if I want??? In pentone website???
Hi Veenod, you would register the colour with your countries trademark, or IP office. For example, in the United States of America, you would register with the www.uspto.gov, for mew in the UK, it would be trademarks.ipo.gov.uk/ipo-apply To search for registered trademark colours, you are best getting help from a trademark specialist.
@@kittenkagome1 I see what you are saying. I wouldn't worry too much about colour when it comes to using them in marketing materials. If however you are creating a logo for a business, then it is best to do some research to see if there are any registered colours in your clients sector.
Hey Srijita, I'm sorry but I don't know if they do. You'd have to do a trademark search to find out. They may have colours registered as part of a specific logo or design, but I don't know if they have trademarked specific colours in relation to their overall brand, the same way for example, that Coca Cola have done with their red colour.
If I am using my logo without having registered And someone copy my logo and get registered I am using that logo for 1 year Then what happens I have to remove that logo from my brand Or not?
I don't know the answer to that I'm afraid. I do know that if you have been using a logo and/or name for a long time then you probably stand a better chance in court defending against someone who has trademarked a similar design. As far as I am aware, every case is treated on its own merit and every country will probably have its own way of dealing with situations like that.
