Continuing Disability Reviews: a Threat to Your SSDI Benefits?

Social Security conducts "continuing disability reviews" (called CDRs) of approved disability claimants and is increasingly using this process to cut off benefits.
Most favorable decisions contain a paragraph where the judge classifies an approved claim as one that should be reviewed in three, five or seven years. Generally, five and seven year review cases are ones where the judge feels that medical improvement is not likely. Three year reviews (or even one year reviews) are cases where the judge believes that with medical care (arising from Medicare or Medicaid) you are likely to improve and regain the capacity to work.
Whatever the type of review noted in your decision you should prepare for a possible CDR down the road. I advise my clients to:
- continue treating with their physicians
- keep their own medical record files
- identify individuals who might be able to testify on their behalf in a CDR hearing
Because there are no past due benefits in a continuing review case, you will not be able to retain a lawyer to represent you in a CDR hearing under a "no fee unless you win" contingency fee contract. Most disability claimants will not have the funds to hire a lawyer to appear with them at hearings. Social Security knows this means that claimants appearing in a CDR hearing are likely to be unrepresented and thus less likely to win CDR hearings.
Success at a CDR hearing will go to the organized and the prepared. Do not become complacent and assume that your benefits will necessarily continue for the rest of your life.

Depends on how much people have if someone has worked and made good money for years and/or they have other sources of income such as a landlord investments or something like that. It still is not easy but such people will likely have an easier time because they will have more money each month. Now SSI is different. There are so many offsets and such a low max benefit.

I have always seen them as a threat. They are always looking for some loophole to stop people's benefits. The worst thing they send you to a doctor who is not being paid enough and just wants to get you out as quick as possible to see the next patient. The result is you have doctors contracting with the SSA who don't care and will say that every one is not disabled.

They pay the state Dr.'s to do an examine for review's. Supposedly mental review examine within 30 mins. That these Dr.'s are paid to deny people as competent just cause they look it. And because they ask you a few questions that you answer within the 30 mins. and they turn around and tell Social Security Disability you are able to work full-time job unskilled labor. And Social Security takes this over your professional Dr. you have been seeing for years. Who is specialized in this area of practice. Over there paid crooked Dr.'s to deny receiving more disability benefits.

I have been on SSI since March 2011. I had first applied for disability in 2007 and they lost the first application and I had to start all over. Started over in 2010. Had a hearing during appeals in January 2011. The judge wrote down some accommodations that would have to be made in order for me to hold down a job and asked this expert they had there if those would be reasonable to an employer. The expert said no for each one saying that no employer would find that reasonable. They started a review on me in October 2016. I got notice on the 2nd that they were cutting me off. They admitted I still had problems but said I could adapt to another line of work. It makes no sense since the expert went through and eliminated all lines of work during that appeals hearing. None of my illnesses are curable. I was unable to renew my lease and will be permanently homeless next week. I won't even be able to have electricity to run my breathing machine I was put on. I appealed their decision, but I haven't been able to find anyone to help me with all of this. They won't even return my phone calls. I'm on about two thousand dollars in medications each month. They are going to take away the Medicaid if the appeals fail and I won't be able to even get my medication. I'll run out of money to put gas in my truck and will end up losing the truck too. Where will I live without the truck? I'm so scared.

I just got the huge dreaded CDR form that asks all kinds of questions today and filled everything out today. I am going to have a counselor/professional I know look everything over to make sure I did everything correctly in forms before sending forms out. I get SSDI for Autism and LD. If it gets decided that I should get cut off of SSDI, I will get plenty of legal help and help from professionals I know and family members to help get the SSDI back. If this fails and or they change policy in Washington making it impossible for I and many others to get back on SSDI, I will then flee the USA going to UK, Europe, Australia, etc where all they take much better care of their citizens regardless of whether or not my passport is renewed at that time if that time comes. If I am going to lose SSDI and cannot get it back exhausting all legal avenues, then I am through with being a US citizen in this SHIT HOLE of a country! The CDRs I feel goes back to the ideology in this country that if you get any kind of government help in this country, you are a burden on the taxpayer while some of taxpayers in USA scream communism and socialism. Ashamed to be born and raised in a country that could careless about its citizens putting profits over people not providing universal singlepayer healthcare and providing only flimsy social safety nets that do not do much.

I'm 57 and was awarded disability 15 years ago.I've been going through a bullish CDR for 7 months.From being sent two long forms initially with an 30 days to being followed. Since being awarded disability I've had two other chronic health issues. I lost my voice and need boric injections into my larynx every three months(sparring dysphonia) in order to be able to talk. The other is I have chronic back pain.I had back surgery in 2005 and 2015 and my recent MRI looks so terrible my neurologist said that's nothing he can do except another back surgery.I had a CE by their doctor who agreed I was disabled.They then sent me for a mental examine which went well I guess,since I don't have any issues except depression.Today they sent a letter asking about work I did as a skilled pipefitter 15 years ago but can't physically do today.I'm scared as he'll! I been on disability for 21 years and I still get reviewed every 3 years. Which I feel is stupid and a waste of money in my case as it's been obvious from the start I can not get better. Simply because the reason I was finally approved disabled is because of my back injuries I am unemployable. I am a liability to any employer due to my extensive back surgeries and implanted hardware in my spine. Being able to work or not doesn't matter in my particular case. Although now that I am almost 62 my condition due to age has deteriorated considerably and now I truly am not able to work. But just last year I had to fill out yet another review of my case even though I am nearing retirement age and have been on disability over 20 years what on earth could improve after all that time and 20 years older? Come on SSA good grief guess they plan to continue reviews after I pass retirement.

I know you recorded this awhile ago. I was dx with MS in 2003 and started receiving SSDI in 2004. I had a review in 2013 and they stopped my benefits for one month. I was up for another review this last summer and I had forgotten about it. They started getting aggressive at the end of 2017 and ended my benefits again. They keep trying to say that my nine month work trial period was way back in 2005. When I went on SSDI, I was an insurance agent and got to keep 50% of my residual income. I’ve been receiving that since January of 2004 when I left the company up to today’s date. However, the only months they’re fixated on were those in 05. I had worked some in 2012, 2016, and a cpl months in 2017. Currently I have $0 in my accounts and all my bills are past due. I thought the trial work period had to be nine months within a five year period, not 17 years.

Thank you for sharing this information. It is very useful to anyone who may be in need of disability benefits. Fortunately I had the foresight to buy additional disability coverage while employed. This turned out to be the best decision I've ever made. My mother and sister have scoliosis and my older brothers all have a history of back problems (DDD). Given my genetics I thought it a good decision. Five years later I was involved in a car accident and a few months after that I fell down a flight of stairs. I could no longer walk. I filed for LTD through my employer. When the time came for extended benefits my disability insurance carrier provided an attorney to assist and represent me when filing for Medicare and Social Security Disability. The insurance company paid for my attorney. I was very lucky to have an employer that provided access to such good coverage as many do not.

Social Security Disability videos Well kinda... I was denied twice, followed by car, video taped and even had investigators follow me on foot while taking care of personal business and seeing doctors. I was unaware of all of it until my court hearing. After the hearing (which I won) the surveillance continued with unmarked cars and local police often slowly driving by my residence. Frankly I was shocked at the effort and amount of tax dollars that must have been spent to attempt to disprove my disabilities. I hold an advanced degree, put myself through school and was on a tack to become Vice President of Finance before my injury and illness. My attorney told me privately that the Claims Manager that worked my case had a reputation for being vindictive. The irony of the situation was that my private disability coverage would cover me if I won or lost the Social Security case. However I was contractually bound to cooperate with my disability carrier in their attempt to recover benefits from Social Security, as those benefits offset the private disability carriers benefit. Further, one of the reasons cited in the need for a hearing was that, "I had retained an attorney" and therefore was considered "suspicious". Given the complexity and level of impunity exhibited by the claims investigators, I can't imagine anyone being successful without an attorney.

Hey please answer this I applied in March of 2019 for disability in ga where I was living then moved to South Carolina and they sent here so I had to reapply for medicade here I did that in May so I found out they don't make a decision until disability makes one got denied then I did the reconsideration and nov.5 found out I got approved for medicade so I thought I won my claim but a lady from medicade said I lost but got approved for medicade but it's only going to last til the end of this month not understanding none of this mess at all cause I have no change in income or anything and haven't received any letter yet for my disability why did this happen this away what can I do.

Mr. Ginsberg...how does age factor into these reviews? If a person is over 50, and they get a 5 or 7 year review, they will be pushing 60 by the time that their review is due. Their working days are almost over, so what would be the point of "revoking" their SSDI? That seems beyond cruel and unusual. Where does the court stand on these situations?
@ssdattorney

Mr. Ginsberg, thanks for the feedback (and the research). There may not be any precedent for it, but it seems like this is one of those "common sense things". If cases are supposed to be reviewed by the SSA (and I am sure that there are people over 50 that have their cases reviewed) every 3, 5 or 7 years, then it seems strange that there are NO instances where someone's claim has not been reversed or denied...or does the SSA just "turn a blind eye" and let these people "ride out their time" until they qualify for "regular" soc. security at 62 (or whenever they qualify for retirement benefits)? I hope that this makes sense...

Mr.Ginsberg I have a question about my SSDI. I have been on it since 2004. I had a review about 2014. Now I am going through another. I was originally on SSDI in 2004 for ankle surgeries I was going through. I had a total of 12 to 2010. When I had my leg amputated below the knee. I had a Brain surgery during this time in 2009. After which my mental condition made me unemployable according to VA medical examiner. I have been through 4 psychiatrists in several sociologists to try to help me with my mental state of mind. My question is is Social Security only using my surgeries or will they also look at my mental condition when reviewing my SSDI case?

If I am over 55, and was originally approved one year ago for SSDI with Osteo-Arthritis in my knees, how likely would they be to pull my benefits on a continuing review? I received a large form today to fill out to determine if I am still disabled. If anything, in the past 6-8 months, I am worse. Do they see arthritis as a condition that would improve with age? Arthritis is only treatable by knee replacement which they only approve past 60 years of age.

have been on disability for 7 years for bipolar. I received an SSA-454-BK They want the past 12 months of medical history The problem is a little over a year ago My 12th counselor had quit her job (as so did the other 10) which made me stop going because i felt i was not getting anywhere with the treatment due to having the need to explain my whole emotional beginning, and building trust in someone again. After had losing friends and family due to this hideous disorder, It's weighed very hard and actually made me not trust anybody so i just stopped going to doctors and joined a bipolar support group which made me feel a little more confident surrounded by people like me who really understood. Did i just lose my Benefits for doing so? Are they just gonna cut me off and throw me back into the workforce after not having a history for almost 10 years? Or will they send me to a dr first. My condition has been declining as to where i decided to go back and try the counseling and med management again, and have a future appointment but is it too late?

Q14: What changes did we make to our rules about how we consider decisions from other governmental agencies and nongovernmental entities? A14: For claims filed on or after March 27, 2017, we will not provide any written analysis in our determinations and decisions about how we consider decisions made by other governmental agencies or nongovernmental entities that an individual is disabled, blind, or unemployable in any claim for disability or blindness under titles II and XVI of the Act because those decisions are inherently neither valuable nor persuasive to us. However, we will continue to consider relevant medical and other evidence that supports or underlies other governmental agencies' or nongovernmental entities' decisions that we receive based on the applicable evidence categories discussed above.

from my experience, with CDR reviews, social security disability doesn't care about medical information up until a year before you get your CDR. I've gotten 2 CDR forums and each time they ask me the places and doctors I have seen in the last 12 months prior to when they sent out the review. So keep that in mind, which is why if you are on a 3 years review or 5 year or even 7 year review, that the only medical information that matters to social security disability is the last 12 months prior to when you got your CDR forum.

Why if their just going to cancel it make me drive knowing how I am and why would they think the head doctors that gave me pills for stuff I don't have would work. Hi, can you shed some light on someone that was approved for ssdi due to injuries sustained in a car accident. Some required surgeries, therapy. After a couple of years, there are still a host of residual permanent medical issues but none by themselves that would necessarily result in continued benefits. Does SSA look at a multitude of health issues when considering to continue benefits. balance issues, chronic pain, behavioral, headaches etc...

The problem I suspect is that SSA makes it very difficult for attorneys to get paid for handling a termination case. If you choose to have benefits continue while you appeal the termination, there will be no past due benefits so there is not way for a lawyer to take a termination case using a contingency fee contract. If you do not elect to have benefits continue you will have no money coming in for the next 2 years.

Will I be notified if my case is due to be reviewed after approval..? Love your channel several year sub

It is my understanding that SSA's computer system flags cases for review based on a non-public algorithm. The algorithm may be triggered by your age, your underlying medical problem, earnings being reported, a recommendation by the judge recommending review or any number of other factors. It is possible that a human looks at the flagged claims and makes a decision whether to proceed. Thereafter they will send you either a "short form" (SSA-455-OCR-SM) or a "long form" (SSA-455-OCR-SM). At that point an SSA employee will make the decision to pursue termination or not. You can appeal a notice of termination, which is like the reconsideration stage of a new claim.

Hi ,do the grid rules still come into play during a continuing disability review?

Answer: Yes; and this can be used in your favor-especially if you need to appeal your case-in a CDR!

Mr. Ginsberg, can you tell me when a 7 years cdr would be secheduled. Would it be 7 years from approval date or 7 years from onset date. Thank you
@ssdattorney

I believe it is from the approval date but that is a very good question. I'll see if I can confirm that for you.

This was very helpful, thank you. I do have a question.My first DCR is set for 7/2017. My health has improved since my case was approved but new issues have come up. For example I have a new diagnosis of fibromyalgia. I tried working in retail but just can't handle it. Despite all my hard work working with a local agency after activating my TTW I'm finding no one will hire me because I stutter. Of course HR reps will deny that. Its also a case of they said/I said. I already contacted my local human rights department and they say I don't have a case. If the judge at my DCR finds I'm no longer disabled based on the previous decision but I am due to new issues what happens then?
@ssdattorney
@ssdattorney 9 лет назад
+Tracy Sault - first, if you have a documented stutter, that may very well eliminate jobs that require regular verbal contact with the public and/or coworkers and supervisors. So I would argue that a stutter can be a vocational issue. It will not disable you from all jobs but it can reduce several categories of jobs. Fibro is a tough sell to SSA currently. This is probably a case where it would be worthwhile talking to a lawyer in your area to develop theory of disability for your changed situation.

Is it wise to try to work before a persons first 3 year continuing diabilities review
@Kingbasspickleball1

mine says one year review , my condition could get better with proper medical treatment.... I have two completely reconstructed knees and degenerative spine and severe brain injury due to multiple concussions....not sure how I could get better at 50..its a downhill spiral from here on

Part of why I'm on disability is because of PTSD. In this state there aren't really any regular therapists that take medicaid. They have comp care for the poor and the therapists are social workers. I tried going to them and they quit seeing me. It's like they don't understand how PTSD is or something and they act like if you just have this positive attitude that you won't have triggers and anxiety attacks anymore. I'm undergoing CDR now and haven't been to therapy because no one else will see me with the medicaid and I don't have the money to pay a therapist out of pocket. SSI here only pays $733/month. It doesn't go far. I'm scared it will be held against me. I keep trying to tell them that I try to go to therapists. I have off and on since I was a child and he started attacking me. I never felt like any of them listened to me and some of them even told me I needed to learn to get over it. I even have trouble sleeping at night because of all the nightmares. I haven't had a good night's sleep in a long time. I can't even remember when. It's like people who have good insurance just don't know what it's like to be so limited as to whom you can go see for therapy. The last therapist I went to refused to see me anymore last year because I wasn't showing improvement on these charts where you circle numbers indicating how you feel about things. I was just being honest.

I'm over 60 never been reviewed but recently trying to find part time work local employment office they try setting me up. Think they're gonna try an take.Two brain surgeries an any over exertion caused a rebleed. Can't find any info on any over 60 on disability. And as a decorated old vet thought they would try an help! Live on less than 15K a year and have to buy my glasses dental etc let alone prices now it's be nice not to live on soup for a week each month. What the hell id wrong with our country.Worked since I was 14 would give my right arm to be well and work full time. Try sitting at home for two weeks with nothing to do. It sucks.But aren't they giving social security to Ukrainian refugees who never paid into it?

Bart you have to be very careful when trying to work. The Trial Work Period program is so difficult to navigate it could easily put you in overpay status - ssdanswers.com/working-after-disability-approval/

I received an update form that says second request, but I am certain that I didn't get a first request. Should I call the service line on the request form and discuss it with them? Or should I just fill out the second request and mail it?

Thank you for your videos. I was awarded disability in 2011. I am now under a medical CDR review. I have seen my doctor every few months since that time. Does Soc. Sec. have to follow 2011 guidelines (by the way, I have not improved) for my CDR or will they use the new cut throat rules of 2019? Thank you, Sir.

In my case, it is very traumatic, I am sure you as well--the review can take up to 6 months. I am on month 3. I see my doctors all the time--that is important. But my stress is over the roof, and I am even worse...Blessings.
