Yeah if you own a home or business, you pay taxes on the lowest amount possible. Turbo tax literally helps you do that. The lenders got paid in full (and they were 17:57 supposed to verify that the security for the loan is adequate) Property owners usually hire consultants to argue valuation before the taxing authority in order to lower the taxes based on many variables such as depreciation, comparable property transactions, etc. So it’s possible differences in valuations in his valuations and the taxing authorities valuations
@@helenhalford7927 It's indefensible to present disparate financials to different parties, which are many orders of magnitude apart, *for the exact same properties.* It doesn't matter if you return the money from a bank robbery. Further, it's fraud because it's unjust enrichment. When you over-inflate values, you end up with a sweetheart deal on interest, when you would have otherwise paid through the nose using the _real_ numbers. You also get a much larger loan than you qualify for, far more than your fair share, siphoning away allocated lending funds from other members of the financial institution.

He's kind of trapped as having to be there this week as his attendance at this trial was used to avoid being deposed in another case. He's still going to be deposed on Saturday but he has gotten a few days relief by claiming he can't be deposed as he would be in a trial.

If you deposit $200k into a bank tomorrow, and try to withdraw it on Monday it will be impossible. Banks use to be required to have a certain % of deposits always available. Now that’s been removed, so I don’t feel nothing for banks. Both democrats and Republicans always agree to bail out banks, but leave regular American taxpayers to bail them out

Bruce, love your podcasts. One issue I have with the banks excepting an over evaluation is that why didn’t they perform their due diligence? Every time I used properly for loan collateral, the bank required an appraisal from their chosen appraiser. Why would a bank blindly accept at $1.5B value on Mar Lago?
Because as long as he successfully grifts *the next bank* to pay off this bank (with interest), the current bank makes a profit. They have a strong financial incentive to believe the claimed values, protect him, and vouch for him to the next sucker in line. You or I as general members of the public without complicated asserts like various amounts of ownership through various businesses that lose and generate income can't pull this scheme. Without all those layers indirection we can't give the bank a made-up number, AND CRUCIALLY, a plausible sounding explanation that the bank can accept to legally cover it's self.
@@pedro33226 Since the whole scheme has pretty much fallen apart I imagine that any banks with loans out to Trump will be complaining and attempting to demand repayment. That is helped because they can use this trial and it's findings as evidence that he lied to obtain favorable terms. The problem is that there many not be much left to collect. It might be less costly (not just in terms of money) to cut their losses. Maybe the loan manager only gets a 100,000$ bonus this year instead of the scheduled 150,000$ one. I doubt any bank is actually going to fail because they lost money on a loan to Trump. The loses will just be passed on to the customers, as is tradition. I don't know the full history of the case, but it might have been initiated or at least supported by complaints/evidence from those banks that are looking to separate themselves from Trump. The New York AG isn't prosecuting on behalf of the bank, however they certainly could have brought their allegations to the AG's attention. Any ''alternative valuations' (lying on financial disclosures) that would violate the civil contracts with the banks could also violate criminal law as well.

I don’t think he fully appreciates the extent of his liability. He’s still spewing about the summary judgement while at trial for damages. Keeps saying ‘caveat emptor’ as if it’s possible to waive standards of good faith in insurance/credit/RE contracts despite like 200 years of precedent. Here's the thing is you never handed them a official statement of your valuation of your property with bogus numbers on it, that is the fraud! You cannot make false statements on any official documents they are to be sworn to truth of the matter that are true and factual. He misrepresented the valuations of his properties many many times he essentially has 3 sets of books for his companies, ones with false increased valuations, ones with lowered valuations, one with the actual valuations. He chose which set to use depending on the situation. He used the higher book valuations for the bank the lowered ones for tax purposes and the actual ones were not something he shared with anyone. His main argument is that his disclaimer clause that said you cannot believe anything on his documents, this is misuse and abuse of that clause because you cannot give false valuations to begin with and then claim do not believe them. It's supposed to be based on fact not falsehoods.

I have a question: don't banks do their own valuation before offering the loan? When I get a loan from a bank for my home, whether to purchase or refinance, the bank sends an appraiser before determining the loan amount. How did Trump get to set his own valuation?
On the property map you showed, aren’t those $25mill non-beachfront properties a tiny fraction of the size of his huge dual beach access one? If it’s 20x the size and has features that they don’t, wouldn’t it easily be a $700-800mill property? Speaking as a Canadian who wouldn’t vote for either of these parties, btw.
It could very well be worth 700-800 Million. The issue is that Trump is trying to say worth twice that at 1.5 Billion. The bigger issue is that he's a criminal that steals from his charities and supporters to fund his failing businesses.

@@pilomatrixoma You're just asking for trouble with that last point. It's so hard to know what a property is actually worth because they have three or four different values. Insurance will say one value, taxes say their own, but then the government has their own, and then there's what someone is willing to pay for it. It's all a racket and purposefully confusing. Based on Trump's reputation, I would wager that it will never go for what it's actually valued at (700-800 Mil was a good guess IMO). That property is stained with his shit and will be for a LONG time.
It's not zoned for residential though. You can't sell it as a house and you can't subdivide it. You can only use it for a club, Trump has about 100 million in deposits from members that would have to be paid back if he sold it. If he got 100 million for it he would end up with nothing.

This doesn’t make any sense. 1. I have a house in the same county as Trump. My house is not taxed based on what I say it worth. It’s taxed based on what the assessed value is by the county. 2. If I were to take a loan out on the equity of my property. I don’t decide what the property is worth/the equity I have in that property. The bank determines that. The $18 million valuation was provided by the trump organization. Which, and this is how numbers work, was lower than other valuations that they also provided. They claim its worth x to pay lower taxes, then claim its worth y to get a better loan agreement. At best one of those has to be wrong. Most likely, both values are wrong. The 18mil certainly is, but trump argued that valuation when the county TRIM'd it at 24 mil. That discrepancy is what the case pertains to. Believe it or not, a NY judge didnt go down to Palm Beach County in 2020 regarding a case he would oversee on 2023. The passage of time also doesn't work like that.

Despite claiming to be a self-made billionaire, he's uses campaign funds to cover his legal costs and criminal defense lawyers. The fundraising opportunities, media exposure, and a valid justification to delay trial dates, may be the reason he's candidate for for the GOP nomination; he's said that even if he is sentenced to prison, he doesn't plan on dropping out of the race. I can only imagine how long it takes for the attorneys to fully brief Trump on the criminal trials, civil litigation, and the numerous countersuits and frivolous tort actions for damages that he has a history of filing as retaliation against his "enemies."

Taxpayers are certainly victims. Those of every municipality in which he does business, the state of each business or real estate holding, and those of us paying federal taxes. Why aren't the banks being charged with anything? Don't they have due diligence to grant a loan? There should be more than just him involved here if they loaned the money and didn't confirm the values of the properties first. He didn't just say, trust me, it's worth miiiiiiolllliiioons and they took his word for it... there's no bank indictments?.. were they secretly settled? That's what i don't get.
Part of it is when your dealing with somebody who claims to effectively have billions spread across the world, you deal with their public filings and accounting statements. These are effectively statements by the company, under penalty of law, to be accurate and honest statements of your worth. That includes actual assets, income streams, costs...ect. A bank may not have to do too much due diligence, because only somebody crazy for falsify records on this scale. It is one thing to overstate some property or asset, but he had a complex web of hiding debts, overstating values that lasted for decades. Not only that, but auditors like Mazars probably could have done due diligence better, since that is what the banks rely on.

1. IRS doesn't tax property value because the feds don't have a property tax. 2. Assessment of a property's value for property tax purposes is done by the county assessor. The numbers on the balance sheet are completely irrelevant. 3. Even if we lived in a world where the balance sheet was used to determine property value, he is accused of inflating the balance sheet, which only would've increased the tax paid in such a scenario. It isn't illegal to overpay taxes.

@rigel2112 The statement 'He doesn't care', doesn't mean he doesn't care about the trial, instead it means he is not buying into all the actual 'flim flam' of it all, or the hype. He is willing to stare it all in the face and do his job. It is a great attitude to have.

It's quite apparent that Trump is guilty. Overvalue for loans, undervalue for taxes. My property got reassessed and in my county they do it at about maybe 90% of the market value. Even if Trump is saying that it was assessed to low because of how the town/county, whatever does assess, that is insane if they would only do not even 10% of the real market value. That smells fishy in and of itself, and maybe Florida should investigate that.
