Conveniently, let the illegal detainment go unacknowledged there didn't you? Rodriguez v US: extending a traffic stop. Just asking him to step out of the car without Reasonable Suspicion of a crime is a 4th A violation and could make any further investigation "Fruit of the Poisonous Tree" OF COURSE Fraudit the Audit would overlook that part. Under recent case law, even a 90sec detainment to ask if they could search was considered a 4th A violation. It is well established that a routine traffic stop is not to be used as a pretext to any other investigation and doing so is a Civil Rights violation is every case. You cannot cease someone's movement in the hopes of finding them committing a crime.

Unfortunately, there are several cases of this. It’s ridiculous that they almost always have to pay for a lawyer just to get their money back too. But of course, they can sue the dept in return. As they should. Maybe eventually, they will catch the hint that not everyone that carries large amounts of cash around are drug dealers.

They are even doing it to armored trucks in California. The armored vehicle in question was owned by a company that hauled currency for legally licensed marijuana retailers. The amounts seized now exceed a million dollars.

*SOMETHING* is fishy. Why did he get pulled over in two different states for the exact same, supposed charge of following too closely, and then have his vehicle searched to boot? Did the first cop suspect him of being a drug courier and tip off the other cops?

True but they if want to search they will say they will bring the K-9s who will find a false positive and conduct a search anyhow. The real lesson is do not travel with large sums of cash until civil forfeiture laws are changed.

It should be like this. “Can I search your car or vehicle?” That question alone SHOULD suggest a cop is NOT there to make sure you have no dust bunnies in your vehicle. He/she is not there to clean it. Common sense.

I'll give a C: While AtA is correct that the officers never exceeded their rights, and I think there is Some merit to asset forfeiture, that is, as a result of a criminal conviction, or pending trial (with funds held in escrow pending results), it is woefully abused, an in a case where the officers literally say "I don't think the guy did anything wrong" this should be treated as needless and severe escalation, resulting in a C- or lower- just barely scraping a pass on technicalities, but should be scrutinized for their action.

After cases are over, lawyers have to work with the same cops, judges, and prosecutors that they just embarrassed. I've been involved in a seizure of funds. The cops took exactly 123k out of my home because they thought it was drug money. Cost me almost 20k in lawyers and to this day I still haven't gotten that money back. This was in 2014. This was my life savings that I literally kept in my closet. The forfeiture all stemmed from false allegations that I was cleared of. The money was deemed to be mine by law but all I got back was the money to cover my lawyers fees. This is a way that the government steals from its citizens and is just wrong. The crazy part about all of this is that it was the postal police who did the seizure and raided my home with out a warrant. They said they had probable cause. Such bs.

Well, while you are correct, the cops would have searched anyway. The dog 'alerted' on the passenger fender, which would have given the cop permission to search anyway. This dude was stuck between a rock and a hard place.

When i was a teen. I must had gave about 8 consent to search my car. I didn't have anything to hide and i felt intimidated. I also once was told to remove my shirt to see if i had any tattoos. An officer stepped in and said to me "you don't have to do that" But the other officer replied "ok he'll just spend the night in jail" I had nothing to hide and i removed my shirt. Now with dashcams and cell phone recorder i feel more safe standing up for my rights.

None of that officer's questions had anything to do with a simple traffic stop of "following too closely". What a absolutely disgusting miscarriage of justice. Someone tipped that officer off to keep an eye out for this man in this car. There is no other reason that this stop should have happened in the way that it did or for this officer to ask to search the vehicle. This was premeditated and that officer knew that cash was there.

I don’t know why this video says that the man should have “always refused” the search. I mean I think we should always be able to refuse the search too. HOWEVER, it literally will not matter one bit. All they will do then is run their dog around it, say their dog alerted, and search it anyways. So the narrator in this video saying “he should have refused the search in the first place, and you should ALWAYS do the same’” as if it would have made a difference in the outcome!! They would have still searched it anyways, citing that their dog “alerted” as their justification and stolen his bread anyways. So… why does it matter?

It's basically no different from Canada's freezing of bank accounts of protesters who haven't even been accused of breaking any laws. The only difference is that this is probably less widespread and not motivated by hatred of political enemies but rather just disdain for the populace as a whole. It's insane that we continue to allow governments to just steal like this.

It really should, it is a violation of due process and another example of the loss of civil liberties due to the war on drugs just like no knock warrants. They should all go away along with the rest of the war on drugs laws like cash reporting requirements and structuring (using just less than the reporting requirements to avoid reporting).

@@quiksix25, every other Court Case in America, you walk into Court with a presumption of innocence, it's up to the Prosecution to build a case to prove that you are guilty! Civil Asset Forfeiture, you walk into Court with a Presumption of Guilt, the Government has seized your property and it's up to you to prove your innocence to get your property returned from the Government! And you haven't been charged with any criminal offence! It's totally against the 4th Ammendment especially as it is usually large sums of money and most bills in the USA have trace amounts of illegal drugs on them! But the Government use this as proof of illegal activities! Wrong, just plain Wrong!

The state(s) such as Arkansas are breaking their own laws, and working with the Federal civil asset forfeiture laws to steal a civilians cash, the state if they keep the cash, get to keep 80% of cash, the Feds keep 20%. Shame, it's corruption, and it's out of control.

unfortunately if a police officer has a reason for any they have legal power to search your car even if you declare no permission without an warrant. Now this is a double edge sword for them if you gave no permission while he did his search based on reasonable suspicion you can sue for monetary compensation for braking your rights if they do not find anything that is of criminal nature. I feel this guy could sue them for only finding money but no substance in question this is clear brake in rights and highway robbery, remember guys dash cams are a great investment get them they could mean the difference in losing your money or your car.

My biggest issue besides the grade was the fact the 2 troopers MADE their own scenario up to make what they were doing valid even there was no probable cause (outside of the money he had from transporting cars) that would suggest it was "weed money" as they suggested.

Stories like this boil my blood. The guy was investigated the day before, he could prove he was conducting *legitimate* business. The cops didn't care, and took the money anyway. That wouldn't be too big of a problem if they at least gave the money back after conducting a more thorough investigation. The thing that really gets me is that the government completely *lied* about a drug dog detecting drugs in order to straight up *steal* the money. The company that lost that money probably will be able to recover from the loss, but if I had $100,000 stolen from me, it would be financially devastating. That's what really pisses me off about this: the government would be content to completely lie and make things up so they can steal the money regardless of the devastating impact those lies have on the person. Disgusting. Just disgusting.

This is so frustrating to watch. I feel so sorry for that guy. Roughly 90% of US bills have traces of drugs on them so to use that as an excuse to seize somebody’s money without charging them with a crime is flawed and unacceptable. The trooper said I don’t believe he’s doing anything wrong yet seized his money anyway. This was a legal robbery. I would’ve given him an F.

That, and make sure you put that money in some sort of case not a backpack with a ziplock bags LOL If it's money from the legal marijuana industry for instance, what you want to do is hire an armored truck, or at least buy a car like a panel van brand new, dedicated for all cash transactions, and then weld a safe that is 5% of the value of cash that is planning to be moved each trip to the frame of the van, and make sure that there's enough room to fit the cash that you want to fit into this safe. Get two keys, one at the destination, and one at the origin point that can open the safe, and make sure that the driver does not have a key at all.

I agree with you, but you have to put yourself in his shoes though. I don't understand AtA's grading system sometimes, either, but I think he's just grading solely on conduct while trying to appease the public too, or the people that watch his videos. If he just outright kept on giving police officers "F's" for "illegal activity" then it would imply more so as hateful bias rather than an informative / justice RU-vid channel that tries to promote an unbiased review of the conduct between the public and law enforcement. He probably feels like his videos wouldn't make a difference if he didn't grade on anything other than conduct. I think he tries his best and does obviously consider illegal activity, but I think his true aim is to make a difference. He's going about it the right way I think, sometimes you just have to do things in a certain respectful manner in order to make a difference or gain the people's trust. I get it, and it sucks, I'm sure there are a lot of times he wants to just lay into how pathetic all of this organized crime really is as well as call them out on their bullshit. Unfortunately that would blow his cover, and make his channel's aim unsuccessful/unproductive.

This channel chooses to focus on what is currently legal and within courtroom precedent. It doesn't advocate for what is morally right or what should be the next statuary change (even if that is obvious from the presentation of the story). In fact, the call at the end to contact your representative and share your opinion on civil forfeiture is one of the clearest statements I've heard here. The very fact that the trooper acted within his authority and can technically earn a B is what should embarrass and shame himself and the entire system that incentivizes and allows this kind of thing. The fact that the channel does deep research and exposes the loopholes within what is even technically legal is a very important service. Anyone can point out the ignorant and illegal acts happening within modern policing. I find the morally evil acts which are technically legal far more concerning and often difficult to expose.

@@ohnoitsthatguy09 While it's true that the officer _could_ have left the driver alone, he was not _obligated_ to do so. You mention officer discretion, but that is a flimsy hope in this day and age. It's better to have a legal system of laws, courts, and departmental policies in place that make officers morally accountable and obligated to do the right thing in these circumstances. Instead we have explicit financial incentives to do just the opposite. While the officer deserves an F in the moral arena, he earns a B in a technical sense. This translates to an F for the entire system that encourages and perpetuates this thievery.

I go 15 grand western union to me from my mom for a car and the feds stopped the transfer for a week, the feds made the car dealership fax all the info and my mother literally paid over 700 bucks to western union for me to get my money that day in minutes. But they held it for 7 days and made us jump through hundreds of hoops for a mother sending her son money for a car. BS SMH. But I did learn never to carry or send anything over 9,999 dollars cause once it's over the 10k mark the feds automatically get involved. I feel so sorry for this dude losing 100 grand. Government biggest scumbags alive.

There’s 0 reason to force someone out of their vehicle and force a search. You can deny the search, but they’ll just circumvent your rights by calling in a 30% success rate K-9 that will more than likely give a false positive. This whole process needs to be on a situational basis and not textbook aggressive policing.

Then some try to force their rights, only to be stuck outside in the cold while the police pretend they’re having trouble getting through to dispatch to run your ID. They got me like that, i was outside for 20 minutes in the cold while they said, hey if you just let us search the car we can let you go, dispatch is taking forever. I let them search my car and luckily they didn’t plant anything, they probably actually thought they would find something. I went home safely.

Let’s be honest about the consensual search. If he refused, a dog would’ve been called and then ‘hit’ giving the cops the means to search. Happens all the time. This is a robbery plain and simple. Cops see that amount of money and instantly think of the perks that could bring to the department. (Cars, gear, etc.). The whole ‘large amounts of cash’ is a joke in general. Because it’s in paper form it’s suspicious..? But that amount on let’s say, a debit card, or on your phone in the form of bitcoin, etc. is fine. I understand drugs and cash go hand in hand, but even that has changed in recent times. Many drug deals are being paid for via the internet means. The cop stating ‘I know it’s weed money’ is aggravating. Great assumption 🤦🏽‍♂️. This entire fraudulent system of police needs to be restructured and updated into modern times. Being held accountable and learning is an easy huge step to take.

If say it was for a simple broken tail light and the officer has no other reasonable suspicion, but gets a drug sniffer our anyways then the traffic stop becomes unlawful and can be taken to court.

It’s no coincidence that the first time he got pulled over for following too close and the second time he got pulled over for the same thing. These cops the next day were absolutely tipped off. “Yeah I pulled him for following too close and he had a ton of cash, didn’t take it though because he proved it was legit, maybe you guys can get it”. The cops entire demeanour as soon as he speaks to him and his tone of voice just speak to him knowing exactly why he pulled this dude over and he doesn’t even talk to him about following too close or anything like that. Just goes straight to asking him to get out of the car and asking to search it. Cop knew exactly what he was looking for.

Disagree. I can't believe that two separate agencies (not even in the same state) could pull off the coordination to find this guy a day later. Additionally, the Texas DPS did their due diligence and let him go. Do you really think that they would voluntarily offer up to Arkansas LE the fact that "we weren't good enough to get him" and then pass on the intell to get the guy that "got away"? I'm not opposed to conspiracy theories but this gives the police way too much credit for the ability and the energy to pull this off. While many are quick to believe that the bias of the police compromises their judgment, it appears that many commenters here suffer from the malady.

I gotta say, I disagree with you when you say it’s difficult to fault an officer for acting within their authority. Taking advantage of a broken system when it is clearly against the public interest, is a problem that lies with the frontline. At any point, an officer can decide a situation like this is reasonable and allow the citizen to be on their way. My personal score would be an F.

Grading officers following an unjust law is just comedy stuff, bordering on obscene. "Just following orders" or "Just following the law" when the order/ law becomes unjust is a recipe for disaster. Unfortunately, cops have never really had a burden of proof. That is for the courts, and cops damn well know it and take advantage of it. That's why they can lie their asses off, or use their comfy blanket of "officer safety concerns" to citizens in order to get their desired outcome, but if they catch you lying to them or trying to assert your rights for your own safety, you are screwed.

I doubt it. State troopers love to stop every out of state car they see, particularly in the southern states when your car has plates from somewhere other than the south. Firstly because they know out of state drivers are almost never going to travel back to the state for a court date over a traffic ticket, so they're just going to plead guilty and mail the form in along with their payment. And secondly because they view every out of state driver as a likely mule for drug dealers. So they're always looking to escalate every traffic stop with an out of state vehicle into a search.

The Law states that it may be seized, but only when it's among other/Additional suspicious circumstances? You gave this cop a B , horrible. At some point, this Police Department must have learned that this cash was not associated with a crime, so how in hell were they permitted to keep 60% of it? Civil Forfeiture has turned Law Enforcement into the mob and has legalized criminal theft. None of you understand law. I'm gonna try to keep this short. Just like the cops said, this almost guaranteed came from a "legal in California" weed operation. If he was dealing in cars, he could deposit the cash in any bank in California and have the money wired to the other bank. He isn't doing that because banks in these states where weed is legal on a state level have to abide by FEDERAL law because they are under federal jurisdiction. Weed is ILLEGAL by federal law. So it would be illegal for banks to accept it knowing where it came from and could be confiscated from the bank as well as criminal action brought against them potentially. That said, when money from a drug operation, even if it's legal on state level, crosses state lines, it's now subject to FEDERAL law, where once again, marijuana is ILLEGAL. He is transporting it across the country because they found probably some small bank, far from weed legal states, who either don't know better and being naive, or they are simply willing to take the risk and claim plausible deniability. Regardless, they have to hand deliver the cash in a attempt to not get the federal government's attention. Since the feds know what's going on and are not stupid, yeah they seize it because it is ILLEGAL to transport drug money across state lines. If they really wanted to, they could charge him with criminal charges, but let's be honest, they like the occasional easy asset forfeiture, and don't want them locked up where they can't make money and the feds seize it from time to time. They need to either keep the cash in the state where it was made, or they need to hire a armored transport company to move the cash, as it would not be unusual for armored transport to have a large sum of money.

That was good of you to give the officer a B for being "within his rights ",but I think this is LEGAL THEFT and Legal Bullying. Just something to consider, these guys are the ones who have to go to a person's home and break the news that a family member has been in a accident, and that the "courier " might be involved in illegal activities and was supposedly following to close...we don't get to know that, so maybe I shouldn't have been so quick to judge,..we can't pre judge them any better than they can pre judge us.

Most money especially $100 bills have traces of cocaine on them. There are statistics on this. To use that because “some of the money” had cocaine on it doesn’t mean shit. That’s crazy.

There is a recent Supreme Court case involving civil asset forfeiture stemming from Indiana. Look up Timbs v. Indiana. Dude got a life insurance payout from his dad and bought a Land Rover, and got it taken from officers because they believed it was bought with drug money.

This happens really often. I once got pulled over, my car smelled like weed (it literally always does because I smoke before I go to bed in my car, I had no marijuana or drug paraphernalia in my car. Even with no evidence, the police ended up taking my tips from work claiming that I was obviously a drug dealer.

I'm surprised they settled. How can they claim they found traces of cocaine when the dash cam footage doesn't even show him doing a test? That's some straight up bull shit right there. The whole "We know it's weed money" comment is sickening too. Cops don't have the "innocent until proven guilty" mentality, and that's the biggest problem.

@@kentlbrown5810 Not federally. Federally, weed is still considered a controlled substance, the same as meth/crack/cocaine. It's why you can't use a credit card at a weed shop, banks can't allow it. You basically have to launder the money, legally, for a bank to take it. Even though it's state legal, FBI/DEA still can raid and shutdown and charge weed shops. They generally don't, but they can if they wanted to.
