Basically their attempt to remove themselves from this lawsuit has now made them seem like they’re MORE implicit than they actually are in the case. Way to go Disney lawyers, great job
There's so much misinformation surrounding this case. 1) The restaurant is not owned by Disney, Disney is their landlord. The restaurant is privately run. 2) The restaurant is located at "The Landing" is Disney Springs, which you don't even need a ticket to Disney land to access. It's publicly accessible. 3) The only real way Disney might be potentially be liable here at all is because you can make reservations at the restaurant + view the menu through Disney's website. Now, it's up to the privately run restaurant to maintain its menu, food safety practices, and accurate allergen information. They failed in this and someone sadly died. But should DISNEY be liable for that? Sure you can book a reservation and view the menu through their site, but the menu would just be given to them by the restaurant after all. Is it Disney's responsibility to oversee the menu of a privately run restaurant in their building, to whom they're just renting space? I don't know the legal answer, but the case itself is not as cut and dried as people think. Disney's reaction/defense to it is **insane** though, but I don't necessarily think they should be liable. **EDIT:** I should've waited to finish the video to type this all out. they have to be at least partially responsible. they endorse them through their website, and advertised the the restaurant was allergen free. if they want to be detached from them, they shouldn't cooperate in this fashion
Yeah it’s good to know the details but everyone’s outrage is still justified towards Disney. I mean, they literally went after a family whose child had died because they made the headstone have something from the movie Cars on it since it was his favorite movie.
It’s hard to imagine that Disney has absolutely zero involvement with an establishment on their property. Downtown Disney/Disney Springs may be publicly accessible, but it’s still Disney’s property. Aside from mandatory state inspections, Disney likely has their own standards imposed on the restaurants to ensure something like this or inherently uncompliant/illegal isn’t happening. And if that’s the case, which a trial would discover, then they would absolutely be liable for a dish marketed as allergen free in fact having allergens.
