She continued to accept rent from the in October and November after the date she told them to be out. can’t have it both ways. Accept rent and call them squatters. Law - A holdover tenant is a renter who remains in a property after the expiration of the lease. If the landlord continues to accept rent payments, the holdover tenant can continue to legally occupy the property, and state laws and court rulings determine the length of the holdover tenant's new rental term.

Squatters' rights is an oxymoron.

Squatters rights is actually commonly misunderstood. It only applies to an unoccupied and otherwise neglected property. You have to live there for a fairly lengthy amount of time without anyone coming to evict you, ask for rent, claim the property etc. Basically at some point the state considers the property abandoned and let's you have it with some arrangements. It does not apply to "I just stopped paying rent and refused to move out" and indeed if at any time before that golden length of time someone comes to kick you out or claim the property, squatters rights are gone and you will not have claim to the property

Take a scenario like this for example: You live in the South where it gets well over 100 degrees in the summers. Your housing's AC stops working, and on the lease it says that the landlord is responsible for the upkeep and maintenance of appliances and home amenities, like the AC/Heat units. You call your landlord about the broken equipment, but you never get any kind of follow-up from the property maintenance or any HVAC technician to fix the problem, so you're stuck in 95 degree housing the entire time. You cannot just break the lease, without substantial fines and your credit getting shafted. Squatter's Rights allows the tenant to effectively stay there and refuse to pay the rent until the landlord fulfills their end of the contract. Because failing to pay rent makes you by law a "squatter". Is it really fair at that point for the landlord to neglect their duties, force you into uncomfortable housing arrangements that they were required by law to fulfill (by the terms of their lease contract), then kick you out and sue you for the missed payment(s), breaking your contract, and their legal fees? Squatter's Rights aren't giving bums free reign, meaning it doesn't apply to the defendants here, it helps people to dispute landlord negligence and dispute unfair treatment. You may sit down.

You can't put those 2 words in the same category. Squatter's are more disgusting than trespassers.
