Felony Charges Announced For 2 Hialeah Officers Arrested For Allegedly Beating A Homeless Man

Three people, including two Hialeah Police Department officers, are facing criminal charges in connection with an alleged beating of a homeless man last month, authorities said Thursday.
Police Chief George Fuente and State Attorney Katherine Fernandez Rundle announced the charges against the three suspects during a news conference at police headquarters.
This was a "serious criminal acts and that is why they are being charged today.

@@kewlztertc5386 First of all they are not going to go to jail for life, they will do a few years at most or less. Second, when you're allowed to sue them directly, you can hurt them much longer than few years or few months in jail. When they have to pay back to their victims thousands If not hundreds of thousands of dollars. That will mean greater burden that is much more to bear than few years in jail. And that will create the deterrence to do better.

@@yusuf6778 no, unless they drop the kidnap charge, they're going to jail for a very long time (life). They'd get less time for murder, because there's mandatory life for armed kidnapping. The judge nor the jury has any discretion in that sentence. I don't see how that charge can be lowered or dropped when it's the foundation of their actions. Suing the cops might hurt them longer, but the victim in this case wouldn't benefit from it. After attorney fees, the small amount of money he can squeeze out of the officers will leave him in debt.

Ah yeah the homeless. An officer could make a 30 year career out them without even breaking a sweat. The fruit of their labor is just laying there waiting to be picked up. Besides the homeless are nobody, won't be missed and nobody cares, or so they thought.

IA was never intended to discipline an officer. By design, it protects the officer and the department. If you FOIA them and research, you'll see a basic template they follow. 1. Describe the complaint as per the complainants statement. 2. Dilute or dispel the complaint with the target's explanation, statement or rebuttal. 3. Elevate the target's image by manufacturing positive or saintly qualities exhibited or possessed. 4. Draw a favorable nexus between the complainant and target, as if an alliance existed or was being pursued. 5. Last but not least; find or contrive blame, and tilt the preponderance of any ill will or culpability toward the complainant. If even so very slightly, the IA conclusion will either plainly state clearly, or subtly infer, that the complainant was the real problem. Not exactly,..but kinda like that. By design.

@William Robinson AND, if the aforementioned template does not satisfy the intended outcome, leadership should hold a press conference with at least one black officer in a supporting role (the stand behind) who's sole duty is the lead in the reciting of the pledge of allegiance, before the conference begins (nothing more). The public should then be told what they saw wasn't what they saw and offensive strategy should be deployed if confronted with a narrative supporting the perp. As well, thoroughness and quality should be emphasized where investigative timeliness is in question as well as importance of supporting the rights of ALL citizens. (Geesh. I mean Rome wasn't built in a day.) PS Where minority officers are the implied wrongdoers, apologize and move toward closure. We don't need the media's anthropological recapture of the events or "THE DEPARTMENT" to be implicated in any failures it may assign and as always, the courts time should not be wasted.

I hate the preamble to stating cops have been caught by camera / or tracking their cars. Not about trying to dissuade people from seeing bad cops, hatefilled, brutal and murderous cops getting caught. Stop trying to use a vile situation into a PR drive. @@Beaheadoeverybody I understand the purpose behind immunity but we have to be realistic about how this lead to a total lack of accountability. When police investigate themselves? They find themselves not guilty. This oversight team in Florida hopefully will be followed nationally. We need law enforcement reform. It's gotten so bad that the good cops are demoralized by the bad cops. The rotten apple behaviors are affecting all one way or another.

It's going to steps to get there but we won't make it unless citizens make the demands, vote the change, and hold elected and appointed accountable. These mayors and sheriffs are elected and have much to say about what goes on during their watch. DAs depending on your area are either elected or appointed and they decide what cases move forward. LEO cannot be trusted to self regulated so we have to put teams like this one in place because internal affairs as a department has dropped the ball across the national. LEO for black and brown communities and poor white have become modern day lynch men. LEO act like the occupying forces against the enemy of we citizens. We must have accountability and qualified immunity does not work. As for unions? Do they need them? Most of the time a bad just transfers with recommendation from his superiors. No problem. They just shuffle them. Especially true for cops that use the badge to sexual assault.

My thoughts exactly, as well. The culture in that police department made these criminal cops feel confident enough to commit such an egregious assault on that man. Then, to blatantly attempt to buy that man's silence, knowing he was already in a desperate situation? Yeah, there's a reason they think they're invincible. In a well run police department, cops would actually fear the consequences of their actions. Unfortunately, there aren't too many well run departments across this country. And with so many more cameras around to catch the many crimes & constitutional violations committed by cops these days, it shows. It'll take forever, but I do hope eventually we'll see qualified immunity abolished in the future. That's our only real hope that this nonsense will ever end.

I have multiple sclerosis in the same thing happened to me in Cutler ridge. Butch tribal show me be abused in front of the police station. One Sergeant stop the outcome. I saw the bus driver later she told me that she had to keep her mouth shut or else you would lose her employment.

I am white American & back in the 60s, I had an aunt dating a Hialeah police officer named Al Smith & his parents had a barber shop on E 4th Ave & E 9th Street. One night my aunt & this cop were arguing in her car & she side swapped some cars parked on Hialeah Drive. This cop did something to cover it up &my aunt got away Scott free!!

It should not be allowed for officers to manipulate body worn cameras ever! If the camera or Mike are ever covered or any attempt to manually manipulate the units, they should be arrested and fired immediately! Qualified immunity needs to go! They doesn’t want to change their ways and the abuse of power and out of control because their are no afraid to a consequence because they are to out of reality and think they are untouchable we need more and severe punishment to any officers who are out of control or think he is untouchable or above the laws ..

I live in near Hialeah & in early 2022, I entered an intersection with the traffic light being yellow.Halfway through the intersection the light turns red, but one does not try to stop but you just go through. I get pulled over & the Hialeah cop said I literally ran a red light before I entered the intersection. I had a ticket clinic handle my ticket & I won!!

Consider this, the day before these two crooked, abusive cops got caught abusing this man...THEY would have been among those "excellent officers...BLAH, BLAH, BLAH...too.
