Ashley Moody, the Attorney General in Florida, is considering backing up Florida State University in their fight with the ACC over the Grant of Rights. The specific issue that has caused Moody to act is “sovereign immunity” and whether FSU, as a state institution, can be sued. The ACC argues that FSU waived their sovereign immunity when they joined the ACC and Judge Bledsoe in North Carolina agreed. Moody has petitioned the AG’s in the other states where ACC Universities are located in order to back her up. Where will this take us?

She is a Gator, a UF Alumni: The Florida Attorney General is an elected Cabinet Level position. AG Ashley Moody comes from a prestigious family, a Law Firm in Tallahassee. She should not be taken her lightly; because, she will eat the ACC for lunch. Soon to follow is the State of Florida Chief Financial Officer Jimmy Patronis: Again, the CFO is an Elected Cabinet Level position, who will examine every stupid & self serving decision done by the ACC leadership that cost Florida State University & Miami $$ money. He will be looking at more than public schools, but also the University of Miami that is a private institution located in Florida. The ACC has lined their pockets with ill gotten funds. The U & NC State have landing spots, I am disappointed at the sheer mismanagement of the ACC.

FSU doesn’t dispute that they signed document. They are alleging that the ACC committed fraud by not disclosing or misrepresenting facts on which the contract depends. That would invalidate the contract. They are also disputing the ACC’s interpretation of the text of the contract.

All those that say, "it's a bad deal that FSU signed," forget to ask the question, "can a contract holder charge ANY amount of money if the other party wants out"? and..also, were they lied to?

I think Kenton misses the point. The Florida AG’s actions are not about whether FSU should be held to signing a bad deal. It is whether a bad deal signed by public institutions should be available for scrutiny. EVERY ACC school should support having these documents open for investigation. First it holds ESPN accountable. Second, if ESPN did do something unfair it makes possible a remedy for every ACC school. Defending having a crap sandwich in order to argue you have a sandwich ignores the sandwich isn’t edible.

Her letter was sent to the AGs of the “Magnificent 7” (public schools affected by the NC judge - sovereign immunity ruling) that if the upheld would affect FSU’s and Clemson’s departure from the ACC. Unless Kenton feels that when UNC (SEC/ BIG10) or NC State (BIG12) should pay over $500 mil to leave the ACC, and support the ACC over the state of NC, it’s a no brainer. The FL judge stated in his motion to stay ruling, waiver of the sovereign immunity cannot be implied.

Why did the ACC request the contract approval from the FSU Board of Trustees for the initial contract signing (1991) and then try to go around them for the extension approval? The BOT is only group authorized to waive the sovereign immunity.

It would make more sense if the remaining ACC & Big 12 teams sue ESPN for unfair business practices, or collusion with SEC. When the SEC & B10 brag about how they are the only ones investing big money, it sounds like the rich kid who’s daddy bought him a Ferrari when he got his permit mocking the kids who are only able to drive their Mom’s 15 year old cast off (if they’re lucky). Of COURSE these teams are spending big money! That’s easy to do when you’re given more money to spend! If the SEC, B10 & ESPN were serious about a universally competitive game, then be more fair with the investments doled out. If you don’t want to share, then at LEAST stop mocking those of us left cutting coupons to make ends meet. My team’s spending money on many facility upgrades, and FINALLY making coaching and roster changes. But will it even matter? Breaks my heart. 💔

Mailbag question: Some people say that college football should have exempt from anti-trust. The 2026 college expansion is why I disagree. When you have 14 teams but its: 4 teams (Big 10)l 4 teams (SEC); 2 teams (ACC); 2 teams (Big 12)l 1 team (Notre Dame) and 1 team (Group of 5) then you see why that 1890 Sherman Act (antitrust) must apply towards college football. Equity is 3 teams per each Power 4 conference plus Notre Dame and Group of Five. That's 14 teams too.

I am in the Big 10 (Ohio State). That is not going to happen. The 1890 Sherman Act needs to stay in place to stop the inequity in pay, TV and resources. That very same Sherman Act bust up billionaire trusts gviing us a lot consumer and work protection laws that we have today.

The best thing Phillips could do to save his legacy would be to quickly march to the settlement table with FSU and Clemson. Resolve the rift in the ACC. Let FSU and Clemson move on and return to the member institutions with some money that can be used to move on to what comes next. Be the changes you want to see in football/sports. Convince your member institutions to actually care about football and invest in football instead of complaining that you are underpaid or mooching off the teams that do invest in football. Then you can be viewed as a Yormark and not a Kliavkoff sitting tight in a burning building

IF you were an AG, would you rather be held responsible for? (1) Foresight that saves the tax payers from having to carry the financial burden and is a huge feather in the cap for future elections. (2) Hindsight which clearly puts the burden on your tax payers that are supporting these state funded universities.

FSU has no choice but to get out of the ACC, and the sooner the better. If they stay in the ACC until 2036, they could be as irrelevant then in football as the University of Chicago (original B1G founding member, Natties 1905, 1913) is today

The ACC will only get one guaranteed conference championship team in the playoffs, while the SEC and Big Ten will each get three teams in the playoffs. The ACC GUARANTEED they would look out for the best interest of all the teams in the ACC as part of their contract agreement. Clearly they have failed to uphold their end of the contract. The ACC and ESPN’s contract expires in 2027. ESPN WILL NOT resign with the ACC, until FSU and Clemson leave the conference. The Big Two Conferences will pick who they want from the ACC. The rest of those teams will stay in the ACC or go to the Big 12. CASE CLOSED!!

FSU is not denying signing the document. The question is what rights were granted. FSU has a strong case on that when you read the GOR but without the ESPN agreement you can't make a definite interpretation

They do have a strong case. The NC judge doesn’t have jurisdiction on waiving Florida sovereign immunity based on an implied waiver of rights. That’s why it’s under appeal. The adults are handling it now.

@@toast803 to clarify, the sentiment is that USF would not cooperate with any measures against the ACC. If they hope to join as a replacement in the ACC. UCONN has been placed on the back burner for years because the participated in litigation.

Florida's AG is grandstanding, pure and simple. Not only that, but she advocates a principle that is antithetical to the principles of the Declaration of Independence. The Declaration of Independence says that our rights come from our Creator. "Sovereign immunity" says that all rights come from the King. Her theory is that Florida State University is the King, who can do no wrong, and everyone else is a slave or serf, if you want to be polite, who has ZERO rights other than what Florida State University gives him. So, you may think that you own a house. Nope Florida State University may take that house and the courts which are owned lock, stock, and barrel, by Florida State University won't let you in the door. If Florida State University is immune then it can take your life and it is immune from prosecution. "Sovereign immunity" is an archaic remnant of the law prior to the Magna Carta in 1205. It is manifestly unjust and no right thinking person defends it. I will write my AG and ask him to give her letter all the consideration it deserves as he throws it into the garbage.

All FSU and Clemson need to do is exit, and host no home games for two years. Watch the ACC come begging to negotiate. The media deal is the real dispute, who owns the Rights to home games until 2036. I don't think either judge will allow the ACC to retain those after a member leaves, after paying an exit penalty. Though, which member institution would stick around after ESPN fails to extend after 2025? I bet the league would be dissolved.

The ACC has no real win, all they can hope for is to scare others into sticking around. Though the ACC will have to get that contract option picked up, or they are toast.
