I love watching videos on how this works. You broke it down very well. I would add that you can pay the distributions by check to yourself or through account deposit. I think that’s what most people wonder when they first look up how to pay yourself

@@TobyMathis HELP! I don’t want my personal income to increase due to my side job consulting. I have a sole ownership LLC (business consulting) but I don't take a salary nor do I want the LLC's income to count as my own income. I have taken a reimbursement for traveling expenses. That said, when it comes to tax filing can I separate the LLC income as a separate filing entity? (The income of the LLC is going right into savings with NO compensation to the single owner AND no salaries to be paid.)

So an LLC as an S corp would not need to sign up for a payroll service given that we choose to take a one time annual salary (equal to at least 1/3 of total revenue generated)? I guess my question is, can i choose the frequency at which i take my salary from my LLC (i.e. quarterly, annualy... and would that affect my need for a payroll service) thank you

Great video. I have watched it 10 times! Can we get more detailed videos on Partnerships? I have an investor who would like to do some real estate investing with me so seeing details on how we would pay ourselves, pay taxes etc. would be really helpful. The plan is to form a partnership LLC and that LLC owns other single-member LLCs that hold property.

Great video Toby, I have a question: I have the business with tax deed and suppose in 2022 I make the 100k profits and if I choose to be taxed to the LLC in New Mexico with the C-Corp I know that I do not pay tax in New Mexico but the tax to IRS is 21% linear only if I withdraw the money to my personal account then I will be taxed for the amount withdrawn what is in the LLC remains exempt, okay? For example, if I withdraw 40K to my personal account, I will be taxed at 21% on that 40k ( Total Taxes: 8.4k ) and the remaining 60K would not be taxed, is that correct? 😎

Future Show idea: Best strategies for paying the least in taxes if someone is a pensioner and collecting social security. Maybe a more broad question; what is the best way of accumulating wealth for someone for a retiree earning a pension and social security? Because investments vary so much, this may be difficult to answer so maybe you could discuss advantages of flipping homes, investing in rentals, starting some kind of online business, or investing in stocks/options, day trading, etc. I know that's a lot to throw at you but maybe there are perspectives on each of these that we haven't considered that would help those of us in this position.

Wow! I've been hunting for this information for weeks now. Thank you so much for your amazing videos. I am considering setting up an LLC taxes as an S Corp that holds long term publicly traded securities (stocks, bonds, REIT's, etc.) positions for income and capital gains objectives. You mentioned the 401k implications. I assume that that employee income I receive also counts as earned income that qualify my for annual trad/roth IRA contributions. I am vey curious about other expenses that I could deduct from the structure such as employee benefits like health insurance, optical insurance, dental insurance, company provided car, deferred comp plans or any other qualified tax deductible expenses that this structure could allow. I am considering this as a sole owner/operator scenario. Thank you again for your awesome channel. Any response is welcomed and appreciated!!!

example: 70 years old, sell all stocks in your Roth brokerage account. Fund a brokerage account you set up in an llc so that future earnings from that account can be distributed to you as long as you lilve and heirs after that. any problems with this?

I've been an employee for many years. Would it make sense to LLC myself, as Sub S, and get my employer to hire my company (me)? If so, would the IRS frown upon, the LLC paying my phone bill, gas, insurances, or even leasing my own car to the LLC? Seems like I'd have to prove I'm using my car for other than just driving to the office every day. Also, my W2 income will drop A LOT. Seems like red flags everywhere. Probably not a good idea, correct?

Can you briefly explain how payroll taxes play into this? Say in the S-corp scenario, I take the reasonable salary of 33k, does the company have payroll taxes now? Would it be better to 1099 myself for services totaling 33k?

If you are referring to changing the method of taxation of your LLC, yes, you can change the way your LLC is taxed. The IRS does not allow you to do it regularly and you would also want to be aware of any potential tax implications by changing your election, but you can do it.

if you get a $50,00 loan from a bank and put into the LLC would you have to pay on that $50,000 after you pull it back out or would you only have to pay taxes on the excess income past the $50,000 mark

Hi. I have two questions. First, can you change the way your LLC is taxed in the middle or end of the tax year or at any time? Second. If you're just forming your business, how do you determine the best way to tax your company? So for example- say I'm opening a pressure wash co, I file as an LLC taxed as an Scorp.I'm hoping to make at least 60k in my first year, but if I don't or If I take a loss will that cost me more in the end ? On your first question, yes you can change the classification (away from its original classification) anytime, but then you are barred from changing it again for 60 months

Either a disregarded LLC or an LLC taxed as an S-corp - depending on whether you want to make contribution to a 401k. There are nuances, so it is always best to speak to someone regarding everything you are doing.

thank you for this. It was very helpful. quick question. My Tax Deed Real Estate business has been open since 2018. I have an LLC with an S-corp. Since it is still in its infancy, I have been funding the business with my 9-5 job. According to my taxes, I have a total of $150K that I have put towards my business. I feel very optimistic this 2022 and I believe it will be profitable. Does this mean that when I file my 2022 tax returns, I can get back 150K without getting taxed? (let's say its profitable)

You can always receive back your investment without tax consequences. The issue is whether there are taxes on the profit which will depend on your individual facts. If you have been receiving loss passthrough, there may be tax consequences.

If I have an LLC used for stock trading with, say, a 5% C corp partnership, taxed as a partnership, and I use my C -Corp accountable plan to make reimbursements to me for business expenses, using profits (short term or long term) from my LLC stock trading, how are the amounts used to reimburse business expenses taxed to the LLC, the C-Corp and me personally? Since they are expenses, are they just deducted from the LLC and C-Corp profits, and then paid to me tax-free?

Yes. You nailed it. So long as there is an accountable plan in corp, the monies received are deductible to the corporation and not includable in income by you. see 26 CFR § 1.62-2

Toby, (can you clarify?) I recently became disabled BUT I have an LLC since 2014. The max I'm allowed over my benefits is $1400 per month. BUT, some of my contracts r MORE than that, can I leave the additional earnings in the LLC acct and just pay myself a set salary of $1,400 without impacting my SSI? (Some mos. I may have a good contract...other times less than $1,400)...which of course isn't considered SGA. Suggestions?

You can elect for the LLC to be taxed as a corporation, where it will be taxed as a corporation with a regular tax rate of 21%. President Biden hopes to raise that rate. As a corporation, the LLC would file Form 1120. If the single owner ever makes use of corporate funds, the owner may be taxed on dividends received.

It depends on the work being done. Ultimately a reasonable salary is what a 3rd party would pay, but the rule of thumb is to pay 1/3 of net profit.

It really depends on how much you are making, but the general rule would be to be an LLC taxed as a sole proprietor for businesses with net income below $30,000 and and LLC taxed as an S-corp of making more.

How would I pay myself in a structure with a single-member holding LLC (S-Corp) that owns my operating LLC, of which I’m the only owner and employee? How can this be done without piercing the corporate veil and losing asset protection, while still seeing the tax benefits of an S-Corp? Which LLC would handle payroll and how would dividends be distributed? Thanks!

If I start my SS early retirement and earn more than $21240 in 2023 I will be penalized. Can I set up a LLC or S Corp to pay myself up to that amount? I will be publishing some of my creative work and the income will be based on royalties.

Generally, yes, you'll need to report the withholding on any wages paid using Form 941 and any unemployment withholder on Form 940.

This is the second video I am watching from this channel. I find these videos very frustrating. If a person is setting up an LLC for their full time business as a trader, why do you always assume that the person has another job or business? In this case, a pizza shop. Make a video where the person's ONLY source of income is from stock trading. Isn't this what this is supposed to be about?

If you make your living from actively trading, you might be okay being a trader and bypassing the structure. If you do not want to deal with the IRS and their facts and circumstances tests for traders, use the structure I set out. I does not matter whether it is your primary source of income or not.
