I broke this Council's unpublished SECRET RULES 

Bruce, I know that I speak for 99.999% of the model flight community when I say "Thank you for doing what you do and keep on doing it."

I would be simply ignoring the council's BS and contine to fly under the published rules. I would also be daring them to take me to court over non-existant rules.

That is at this point called harassment Bruce ....I'd get a lawyer and sue the pants off the counsel.....Clearly they are merely trying to get at you....Outstanding job on your part and doing your due diligence... Now go ahead and take a crack at them now

Keep up the good fight Bruce. My Dad fought the South Wairarapa council from the 1970's - 1990's and won every time they went to court. In the end the troublemakers departed or died.

I had my own fight with Australian Border Force back in 2021. They back down once you start issuing Freedom of Information Requests and calling Members of Parliament. Never let them off the hook mate!

I have zero knowledge of the legal system, but isn’t that letter from the council… fraud, discrimination, or abuse of authority, and at the same time, a signed confession of the crime?

I assume that you don’t HAVE to fly every flight you request, so maybe print out a request for a 1 minute flight for the entire day. Then for 2 min flights. Then for 3 min, and shuffle the requests. Submit them all, every day. Should be easy to automate your part and be a major pain on their side. Assuming they must reply to every request.

Sadly in New Zealand politicians of all shapes and sizes have given up on democracy in favour of Authoritarianism.....If I was you...I'd be giving that letter along with this video to a lawyer....

Imagine threatening someone for breaking rules that haven't even been written yet, if this is tolerated it means that these people are allowed to punish whoever they want for whatever they want RETROACTIVELY, giving them effectively unlimited power, sith-style

If the CAA is anything like the FAA in the USA, only the FAA can govern the airspace. Local governments can govern where you can take off and land, but the FAA rules all of the airspace, period. That ensures uniformity of the laws nationwide. It also prevents rogue councils from creating confusion. I suspect the CAA is similar.

The same rule that took away the Iconic Tower. Keep flying until we see the video when they waste the police resources and put the egg on the council's face. Then the video when they put up an exact replica of the Tower.

Your situation reminds me of the scene in "The Hitch-Hiker's Guide To The Galaxy", by Douglas Adams in where the published notification of the demolition of Earth was filed in a drawer in a dark basement, in an office, on another planet which humans can't even travel to! When I first read those books, I thought it was about space-travel, however I soon realised these books are a satire or the ridiculousness of bureaucracy.

Our law or rule makers forget why they have been placed into office. Power corrupts, absolute power corrupts absolutely!

The council has enough spare time to review and approve or deny every single flight of every single RC pilot and every single RC plane in thier county ? Who gave them the authority to require this and what makes them uniquely qualified to determine weather a particular model is safe or pilot is qualified to fly that model of aircraft. Absolutely redicoulous. Here's the thing folks, There's no power in saying yes only in saying no do petty tyrants feel powerful and important.

Keep the correspondence, file it way , dont set up any courts to sue them, your playing into there money trap, fly n see what happens have legal representation on a card ready, do it on there dollar after getting a charge number. "Wich probably never happen". Take a deep breath relax and enjoy life, your fighting an invisible pen, make it expose it self first.

The rules have to apply to everyone Bruce, so you need get an enforcement action going so you can demonstrate to a magistrate / crown court etc that it is vindictive enforcement.

When I asked the other day if the council had clipped your wings I was completely unaware that NZ knowledge certificate is referred to as "Wings".

I admire your dedication to the hobby and your perseverance.

Surely the wings certification is issued by a private organisation and has no legal standing. Isn't it something akin to a racing "licence" for motorsport? Don't see how any authority can require private certification to engage in recreational activity at a public location. Does someone need to join a football club to kick a ball around at the local park? Ignore their letters, carry on flying and if they think you've broken the law as opposed to their rules let them prosecute you.

The council claimed that they were acting under the instructions of CAA. Those instructions must have been in writing, so ask the council to produce the relevant documents. If they refuse, ask them to swear an affidavit that they exist and what they say. Remind them that if they provide an affidavit and it can be shown that the documents did not exist or did not state what they claimed, then they may be liable for a charge of perjury or false utterances.

Hi Bruce. I checked on the website, and you're right, the current rules are no longer linked there (they used to be, which is strange). That said, you were a recipient of an email on the 12th of February 2019 with the new rules attached when they came into effect (as was I, we were both CC'd along with other airfield users). Hope this helps.

It's the same as most licenses. I am a safe legal driver till the day after my drivers license expires, suddenly I'm breaking the law and dangerous to the community. Even though nothing has changed at all with my driving. It's all about money and power just like everything else. The biggest problem I see is people don't think or question anything the majority of people just accept it and obey.

Bruce, you should be on the council. Lean into it. Replace one of them. In America, we have something called certified mail. This is more serious and produces a legal record that can be used in proceedings. Sending emails is not an indication of as serious a litigation risk. Send the letters in duplicate to their barrister as well. Litigation can be expensive for them. Attorneys charge fees to deal with these issues and the counsel has every right to be informed of potentially pending litigation. Demand specifically for the date the new rules were voted on, when the public was notified and the minutes from the any meeting in which it was discussed. These little Napolean's do not respond to reason, only risk of shame. Framing is important. Thay have restrained access to public services based solely on your disgruntlement or political perspective. Additionally, grave concerns of equal access for people with disabilities or partial disabilities. This is the correct framing that produces the greatest shame the public can understand. I’d love to know the legality of forcing you to be a member of a specific club in order to fly. Unfortunately the local body politicians are copying the authoritarian example of NZs central govt.

The Council building looks like it was built with unlimited funds and where did all this incredibly expensive luxury building come from? Who paid for it? It stinks.

Are their demands lawfully enforceable? It would seem not, so you could ignore them and go do whatever you like. Political positions (with very rare exceptions), and even many unelected government jobs worldwide have degraded into individual licenses to further ones interests and they collectively will do anything to protect that license. This has been slowly happening in the US since our forefathers wrote our constitution. It took 200+ years, but slowly less than honorable people have bent the rules and altered the system to bend to their will. The good news is that people seem to be slowly realizing that this has occurred and are starting to hold people in power accountable. You are one of those people and are fighting your personal fight, but also are making more people aware of our situation by doing it publicly. Thank you for that. Hang in there!

That council needs a round of applause. They've done such a good job that all they have left to worry about is an old man flying models at an airfield with his friends. I'm frankly surprised they don't run the whole country, or the world by now.

This is why i fly slope and dynamic soaring now. Im probly still required to have something no doubt ?

There is a group of people here in Switzerland, a local RC club, they also have an ADSB alarm on hand. Don't know since when or how long, I've been there only once, am not a member there.

Dear bruce. I am about your age, a very keen model flyer and love your videos. Firstly you are 100 percent right and your adveseries in the councli are 100 percent wrong. I do however feel compelled to give you warning. About 20 years ago i found myself in a situation while working as a prison officer where i discovered the most appaling power abuse and corruption by senior management. I did not whisle blow, but simply made an internal comment. This resulted in a magagment backlash so exteme that i eventally went to my MP. I stayed in post working, but a war then took place berween myself and the managment resulting in an enquiry. The end result was the reallocation of the senior management to other prisons in order to break up their power base, and an apology issued to myself by the minister of state for the prison service. 15 years ago i left the job to work in the private sector. Now to my point. All of the managment team who were critised in that enquiry have now got senior roles in the prison service. Corrupt power structures always protect their own in the long run. Best of luck, but don't forget the way the world works, and don't make yourself ill trying to change sociapathic behaviour. You never will. All my best wishes. Andy in uk.
