This reminds me of a few years ago when I was studying ISIS. When new people would go join them, like from Europe, the ISIS leaders would _immediately_ have that person execute a prisoner. Often in the most brutal manner. It was done to make them psychologically unable to leave and go back home. They felt they couldn't "go back." Once a person does that, they are much less likely to be able to leave. These young Russian soldiers are being psychologically manipulated in the same way. They will continue doing it. Note: Being forced or ordered, as Lt. Gen. Hertling says, doesn't give them an excuse. I can just see that the Russian commanders may not only be just desperate to gain control, they are also psychologically torturing their own people to get them to do what is wanted and to control them.

Because there's been many psychological experiments that have shown that the vast majority of people defer to authority when put in that position. After WWII, nobody understood how so many average German citizens could support or condone Nazism, now we know that it could happen anywhere. This isn't new however. Western, more specifically the US military utilizes a decentralized command structure which gives field-level command elements the ability to make decisions, whereas Russia (and old Soviets) use a more centralized command structure. This is evident in how this war has gone for them. They're very slow to adapt to what's happening on the battlefield and keep running into the same ambushes and getting air assets shot down in their same areas of operation.

Hitler actually had some good points. His generals wanted to focus on conquering Moscow and Hitler was focused on Russian oil fields. If Germany reached those oil fields the war might of lasted a lot longer

I recall hearing some oligarchs (I think 4 at this point) have "suicided" since the start of the year. Putin is going to have to clamp down on a populace feeling affects of sanctions. It's a downward spiral between public discontent and maintaining control by increasing force as the discontent grows. It could get real ugly in Russia at the end of the start of the new year. At first I agreed with the soldier and only following commands, then I remembered a lesson from my time in the military. To the question of "what do we do if a superior orders us to do something illegal?" Response from the staff sergeant was to not do it and ask repeated confirmation, stalling basically. Not sure how well that works under pressure, as the general here pointed out.
In germany this is different. If a german soldier disobeys an lawful order, he can get in jail for three years. He can get impunity if the order goes against human dignity or has nothing to do with military service. Also § 11 Abs. 2 Soldatengesetz ("soldier law") states: "An order must not be followed, if it would require commiting a crime" (ger: "Ein Befehl darf nicht befolgt werden, wenn dadurch eine Straftat begangen würde.")
Yep, you're supposed to refuse to carry out the unlawful order and report it up your chain of command, bypassing the person who gave the order if he is in your immediate chain of command.

There are many reports of russian commanders killing conscripts who don't follow orders. It's not just a possibility that he might get punished, it's very likely that he gets killed by his own men if he doesn't obey. Of course, that should not be an excuse for his deeds, but saying he could freely choose is just not true.

The world cannot let Russia get away with its war crimes. Justice must be done for the people of Ukraine. As long as Russia retains their illegal occupation of Ukraine territories the sanctions should get higher and higher until Russia is bankrupt. Russia has to leave all of Ukraine including crimea, as they violated international laws and with their criminal government raped, killed and stole from the Ukrainian people.

Can American taxpayers sue somebody for 'conning' us into unnecessary military expenditures? Can defense contractors be charged for intentional cost overruns on military contracts? And what about all those elected officials who 'pushed' for unnecessary defense spending? Who will be America's next enemy?
Young soldiers that have committed these crimes are emotionally destroyed for life. While that in no way exonerates them for the choices they have made, it illustrates that Putin has no regard for humanity, even of his own people. This is a tragedy on so many levels.
This is very important what the general said. The boy may be looking humble and expressing remorse in the court , but the fact is they" killed, raped and looted". This trial is just a drop in the ocean. There are hundreds of atrocious murders where people who did this must be taken to responsibility. What about Bucha, Borodianka ? Will they say that they were ordered to tight their hands and murder the civilians ? All of a sudden it is the generals who ordered are responsible, not the people who actually murdered them. In our military by contrast, our members are trained to be thinkers as well as fighters. What Russian generals are tasked with; the US military gives those tasks to more junior officers. But what the Russians really lack is a dedicated Corps of NCOs, the institutional glue of any military. If Officers were the brains, and the Enlistees the muscles, the NCOs are the vital organs.

He is so young. I looked like that when I became a SGT in the Army. So difficult to imagine myself in his predicament. I had been taught the concept of illegal orderrs but a young soldier can so easily be shamed or bullied into committing war crimes as I saw during Vietnam. The Mei Lai massacre is a very good example. Young inexperienced Officer pushing very angry and pumped up bunch of guys wiyh the average age of around und 20 yrs old. I am not excusing his actions but there were cases of squadmates pushing and ordering the newbies to participate in crimes of war, I was considered very mature at 21. I was a good soldier and made rank fast and was given my strpes very quickly but I remember so well that soldiers even 4 or 5 years older and especially those who had been to the Nam seemed and looked older and so "aged" that given order to do wrong in the heat of battle would be soul and gut wrencking moment..

Something to consider is that while in the US military, a disobeyed order might land you in jail or at least getting yelled at and ridiculed, in the Russian military would likely get you killed. Can one really demand some 18 year old kid to do such a sacrifice, to rather be killed than to kill another? I feel that many people who comment on stories like this fail to realise that Putin's Russia isn't like the US or Sweden where I come from. You can't just refuse or say that it's illegal. The whole political system setup by Putin is illegal and corrupt. If he followed laws, he shouldn't rig elections, assassinate journalists and dissidents, invade countries, bomb civilians, censor media. When the whole operation in Ukraine is one big illegal mess, can we really blame a young conscript for doing the thing he did?

Just wanted to chime in and say thank you for your service in the US armed forces and in Vietnam. I know many Vietnamese families who's older people were saved by US troops service and action in Vietnam and then their children are doing great things in our nation.
This needed to be said. I was a Marine at the age of 18. I can see myself just looking at him. I have to trust in Ukraine to do a better service to him, than his own country ever would.
It's not just shaming or bullying. Russian officers were killing young soldiers who didn't follow orders to kill civilians and prisoners. In one case with a grenade. That doesn't change the guilt for killing a civilian but it should be considered when sentencing him.
I have NOT heard a word spoken about the folks who were called separatist. Did they join the Russian's? Killed for their efforts? Given a medal? Are their homes spared? What?
