Go shopping for a used car these days and one of the first things a salesperson will show you is the Carfax.
It's supposed to be a helpful, comprehensive report on the vehicle's history, accidents and all.
Arthur Watley told the Georgia Consumer Protection office he was shown a Carfax with "fraudulent information" from Used Imports Auto in Roswell. He bought a 2008 BMW 535I there, the eighth BMW he's ever owned.
It's the only one he truly hates.
"I said, well, let me see the Carfax," Watley remembered. "They brought the Carfax out. My wife and I looked at it. It said one owner."
But we got the Carfax for that BMW straight from the Carfax website. It showed Watley is actually the fifth owner not the second. And guess what it says at the top of the page?
Watley bought a used BMW listed as a Lemon.
"If I'd seen that I'd already known I had a bad car," he complained. "There's no way I would have driven off the car lot."
In his complaint, Watley accused Used Imports Auto of selling him a car based on "fraudulent information," saying "there was no bad information on the carfax they showed my wife and I."
With the Lemon warning on the Carfax report, Watley says when he tried to sell it he could get only $4000. He paid $16,000.
"I don't know how they done it, but with technology today, if you can make money certainly you can make a new Carfax," Watley pointed out.
Can a Carfax really become a Carfake? We emailed Used Imports Auto as just another customer, asking about a 2014 Nissan Pathfinder advertised on their website. We already got the Carfax on our own. It showed the Pathfinder suffered "severe damage" from an accident in Alabama last year.
But we received a different Carfax emailed to us by someone named Shairz of the "Used Imports Auto sales team." One of the pages had information cut off at the bottom.
And instead of "Severe Damage," the Carfax the dealership sent us said only "accident reported."
Instead of "Major damage" reported to right front, right rear, and right side, the Used Imports Auto Carfax said it was just minor damage... and only to the right front.
On sale for 17 grand.
So we checked out that 2014 Nissan Pathfinder in person, one of our producers asking about that supposed minor accident on the Carfax they emailed us.
Producer: "So this comes straight from Carfax? Official?"
Used Imports Auto Salesman: "Yeah. We don't. I mean, I don't think that we have the way to move them around so obviously yes, it comes from the Carfax."
We took our evidence of two different Carfaxes to Used Imports Auto floor manager Sonny Khattak. He said he felt bad about what we found.
"I actually feel really bad."
He was disturbed, too.
"I mean, if that's the truth, that is disturbing."
"Is it possible someone in your company is faking these Carfaxes, taking out damaging information?" I asked.
"I'm a computer illiterate," he answered. "What I do is what I see right here and that's what I go with."
He pointed out that the Used Imports Auto website lets customers click on the Carfax themselves, the link going straight to the Carfax website.
But of the 98 cars on the website, we found 19 that did not have that free Carfax feature. For those cars, you had to ask the dealer to email you a free copy. All but one of those 19 cars had been in accidents, including the Pathfinder we picked out. Two of them had structural damage.
"If that information has somehow been purposely removed, we don't condone any tactic used to mislead consumers," warned Chris Basso, a spokesman for Carfax.
The owner of Used Imports Auto is Jonaid Malik. Years ago he also owned a company called Alpha Cars on the same lot. In 2012, the state of Georgia reached an agreement with Malik after Alpha Cars customers complained they had bought cars with undisclosed accidents.
Without admitting wrongdoing, Malik agreed to pay a $25,000 fine and "cease advertising that motor vehicles they offer for sale have no known accident history when the advertised motor vehicles have a known accident history."
Malik's attorney said the dealership "has not and does not modify Carfax reports and does not encourage employees or anyone else to do so." He could not explain how we wound up with one, or why Arthur Watley says he was shown bad information, too.
Meanwhile, Watley says he can't sell his Lemon BMW... or enjoy it either.
"No, I'm scared to death to take it past 100 miles," he sighed. "Because I don't want to get it stuck out there and I can't get it back. People work too hard for their money. It's too hard for people to come by for people to just rip you off with no remorse."

This happened to me also b/c i didn't watch them print it out...when I did months later, I saw the accident listed! $25k fine isn't enough...20 cars w/accidents unreported is fraud, simple as that!

The dealership or owner has already been fined before, so he just changed the name of the old business on the same lot, probably had a ‘closing sale’ then re-opened under ‘New owner/Grand opening’ with a new name and it’s business as usual. If they fine him, he will ‘open’ a third dealership on the same lot. Unless the city of Roswell takes away his dealership license. Or state of Georgia bans him from doing such a business scamming people.

Yes carfax can be faked. If you know how HTTP and easier with chrome inspector. The dealer knew and modified it. The fix is pay for your own carfax.

We found out a car we bought had been damaged in hurricane Katrina, yet was advertised as having two previous owners and never involved in an accident, and in good condition. And they had hid the damage EXTREMELY well to the point that even a professional had missed the flood water damage at first. After finding the flood damage they tracked the car back to being involved in hurricane Katrina. How do you sell someone something like that and sleep well at night?

That totally hits hard, that fellow is stuck without a recourse. The closest thing to recourse would be to file against the dealership's bond. But that would likely cost more in attorney fees than he would get from the bond.

I doubt that he's without recourse. Have you seen the video about a guy who bought a flooded car from Mossy Toyota? It's on RU-vid. While it's not in the video, when it was all over ( and it did take years ) for Jon Perz to be awarded $335,115.45 on a $12,000 Ford Escort.

Spirit Auto in Harrodsburg, KY does the same thing! Went in there years ago, they showed me a car fax that was perfect! Engine light came on a week later. Bought car fax for 3 months, looked up the car I got, said it was TOTALLED from hitting a deer! No wonder the engine light came on after a week!

I checked their website. They have a Carfax logo, but it doesn't link to the Carfax website. I checked a few cars and didn't see any with a Carfax report or option. Instead they had Carstory, which is more about the make and model in general, not specific to that car's experience.

Rick Hendricks Mini in Buford Ga sold me a car that had the airbags deployed. The carfax they showed me said “no accidents” when i went about 6 months to a year later to possibly trade it because I decided I was not happy with the van Athens Ford pulled the carfax right in front of us and it showed the major accident with air bags deployed!!

some dealership tried lies to get me to buy one of the suvs. i checked online car fax and it had 2 accident they never disclosed to me. good thing I walked away and not into their trap... another dealership tried selling a suv with an undisclosed wreak. remember boys and girls. make sure the body panels line up correctly. if they dont it was probably wreaked.. another place tried selling one that had been in a flood. it was rusty inside always look under the footwell for rust or crossrion of the metals. this is normally the place they forget to touch up

The prior owners are in prison. I purchased a car from them and they lied about prior accidents on all their vehicles and falsified the carfax reports. I was hit just down the street by a drunk driver and my airbags never deployed.

They could be printing out a doctored copy in front of you, having previously saved it. Only rely on a CarFax report that you get yourself direct from the source.

What’s so bad about branded cars? I’ve bought some that have lasted me years with no problems. The independent dealer even gave a full one year warranty that would cover any problem without me having to pay a deductible.

Carfax scammed you? Carfax, like any other NMVTIS service, can only disclose accidents that have been reported, such as those in which there was a police report or an insurance payout. If I crash my car, and fix it up myself, out of my own pocket without notifying police, and then put it up for sale and offer you a Carfax, it will not be listed on the report because they were never told. That's why there are so many cars that have been flooded in recent hurricanes with "clean" Carfax reports. Many of those cars were not insured ( or if they were insured, the policy did not cover flood damage ). Some of those owners simply cleaned up the car and listed it on craigslist. I just bought a 2003 Cadillac CTS and the entire interior is covered in mold and the truck is full of water, but the Carfax is clean.

John Davis Omg do you live in NJ? The same thing happened to my sister with the exact same car. She started having problems with the car as soon as she bought it. She took it to the dealership and they kept giving it back to her saying they could find nothing wrong. She then took it to an independent car shop and they discovered that it was a salvaged flood car. The mechanic showed her where water was in the trunk, under the floors, rusted seat rails, a ton of dirt and debris under the hood in hoses and such, and mold behind the back seat among many other things. She went to the car dealership with the mechanics report of findings and threatened action against the dealership if they didn’t rectify the situation. They offered her a newer slightly more expensive Honda Civic at no extra cost. She decided to take the car as she really needed one at that moment. She got it seen by the same mechanic that discovered the flood damage of the other car and they gave her the all clear. It’s been about 5 years now and she hasn’t had a single issue.

Now it makes sense. I bought a 2012 535i and the carfax they had it was clean no accidents and all good. After I bought the car I did my Own research because I was having problems with t. And the car had been stolen in ny and recovered. I purchased it in nj. Also had a accident in the back. That was not disclosed whatsoever and also the car fax they had online said it was clean.

I've been ripped of by a dealer. Bought a low mileage accord coupe. 60,000 miles on an 05, this was last year. They showed the carfax which was clean. I went to do the oil change and noticed some things that were obvious somebody had done some work. I got the vin off of the tag on the back of the motor which didn't match the vin on the car. I pulled the carfax and found that the motor was replaced a week before I bought it. I did a search on the engines vin and found that it was a wrecked car with serious front end damage that was sold at auction to the dealer. Will never trust a preprinted carfax again.

Even if you absolutely know for sure that you have a legitimate report from carfax or one of their competitors offering the same service, you can only use that as a guideline. Not all negative information about a car is reported to carfax, likewise there is positive information not reported to carfax. Nothing replaces a physical inspection by a qualified person trained to do so.

I have the same issue with power Nissan in Salem,OR I just barely found out that the vehicle I financed has a SERIOUS recall and they neglected to tell me this, and on the carfax it only showed a minor damage report, and nothing about a recall for the side airbags. I need help I know I was screwed, plus they had called me about two weeks later stating that the bank will not pay for the warranty! So now if anything happens to this vehicle, mechanically, it would come out of pocket. I'm certain I'm a victim of a fraudulent dealership. Please if someone sees this post help me!

It wasn't sold they hauled it to the auction and handed it off to the next lot rodents....fyi car fax works the other way as well. Eg my dad lives in the rust belt and bought a ford truck to my astonishment. I looked under it and noticed the exhaust pipe was rusty and a couple years later rust was falling from the rockers at everybump...the car fax stated the truck was bought in Florida and was only recently registered in NY apparently the truck was driven extensively from Florida to NY in the 50,000 miles on it when my dad purchased it.

When you buy a car or before you buy a car you should run your own car fax. Do net depend on the dealer car fax. And if you are buying from a private party dont just settle with their own car fax copy..run your own. The problem is that most people are too cheap to spend the $20 to run their own carfax. I always run my own carfax.

This is sad for this owner and other owners who've been scammed by this company and it's jacked up that companies will change a Carfax report however you know what will fix them having these problems? Stop being cheap and pay for their own carfax report. Also buy from reputable dealers.

@@brandielyn21, I disagree with your assessment of used car dealers producing falsified Carfax reports. In my opinion this is a rare case. I'm a licensed car dealer at a small lot ( when I say small, I mean tiny, but we're growing ), and one thing any dealers wants to stay away from are cases of fraud. These cases can strip a dealer from his/her license in a hurry. The criteria for proving fraud is relatively high. It may vary from state to state, but generally speaking, the dealer must intentionally make a false representation of the goods in question to his (the dealer) benefit at the detriment of the customer. In my opinion, the generalized summary fits the practices in this video. The customer was harmed in that he purchased a vehicle that he would not of otherwise purchased. The dealer made a false representation as to the condition of the vehicle, and the dealer did it with intent (the falsified Carfax reports). The fines/lawsuits against fraud can be quite high, and even if the dealer refuses to pay, most states (if not all states) require that the dealer be insured with a Surety Bond. The fine/lawsuit against the bond would render the bond invalid until the dealer repays it and has it reinstated. No bond = no dealer license = out of business sign in the window. No dealer in his right mind will want to risk selling a $20k car in a fraudulent matter that he knows that in the end it can easily cost him $125k or more. Court assessed damage limits vary from state to state, try looking up Unfair and Deceptive Trade Practices Act in your state for more information.

@@vivillager come on man give it a rest. Anybody who's dealt with a used car dealer know it's a risky proposition at best. A pig in a tuxedo is still a pig. Used car dealers get cars from auctions. These cars are mostly insurance jobs and Levin's that new car dealers do not want on their used car line.

hahahahhahaha! man I can't believe it. I have been to this place in Roswell and they were selling us a Toyota Sequoia that looked like it was rebuilt but the Carfax said it had only two owners and was never in an accident until my brother found blood stains on the 3rd row seats that they missed to clean. Then we started looking around and every single panel of that SUV looked freshly painted. Used Import Auto is a very shady business.

As a dealer, carfax is no help at all. Some vehicles aren't reported in the accidents to the insurance agency or the State. I've seen a car smashed like an accordion and brought back to life like new. Hire an expert to review the vehicles you buy.

Great plan, except buying from an individual means that you have to arrange your own financing if you can't pay for it in cash, and when you're done financing there's no guarantee that the car will even be there ( Depending on the bank, I've seen some banks take as long as 30 days before they decide to approve or deny a credit application. Smaller credit unions tend to be much quicker ). Dealers can finance on the spot. Also dealers are regulated by the state and consumers do have some recourse if they violate certain laws, with individuals, not so much. For example, under the UCC ( Uniform Commercial Code ) a merchant with respect to goods of that kind ( such as a used car dealer who sells used cars ) can be in violation of fraud or misrepresentation, depending on circumstances if he fails to disclose certain issues. But do these laws apply to some random guy who makes a living flipping burgers at McDonalds? As I said, these laws apply to merchants with respect to goods of that kind. Is a guy at McDonald a merchant - yes, he is. But he's in the business of selling Big Macs and fries, not cars. You could sue him for giving you a bad cheeseburger, but if he sold you a car that was fished out of the bottom of a lake, the engine was filled with gear lube to mask any knocking, the catalytic converters were chopped off and now it won't pass emissions, all of these would be situations in which a purchaser would have recourse against if purchased from a licensed dealer, but there is none if purchased from an individual.

its easy to modify itt. fake web page and editing the page then printing it. very easily faked. urls are easy to fake but the printer cutting it off can happen as it happened to me before

The CARFAX is our bulshit anyway a lot of repairs are done to cars that are never reported to Carfax

Carfax is Expensive. One report is $50. How many reports do I have to pay. They should lower it to $5 a report. I was shopping for a car I saw by a private owner. Just looking. Wasted $50 just to say no thanks, change my mind

Blame those buying deals where you can scan like 10 or more VINs for one low price (or heck even unlimited deals), and people just went on forums, fb groups, reddit, etc be all like: can one of yall do a carfax on this? Carfax eventually caught up and now we have this.

Too bad Carfax doesn't tell you if it's a manufactured piece of s*** . A good example is the Chrysler 200 . If the mileage is low and it has one owner CARFAX is going to tell you it's a good car . When the fact is , it's not .
