After spending the day in court, Larry is going to give you all the inside scoop on the jurors' reactions to today's opening statements and witness testimony.
A grand jury in New Mexico has charged Alec Baldwin with a fresh count of involuntary manslaughter over a fatal movie set shooting in October 2021. Alec will stand trial in this series as we cover the case live.
The Allegation: Alec Baldwin received the firearm from David Halls, a safety coordinator and assistant director (not the armorer), and was told it was safe (He shouted 'cold gun', meaning the gun was not live). Interestingly, Halls had witnessed two negligent discharges (ND) in the days before the accident and had failed to take any appropriate action.
Also, in his position of Safety coordinator, he should have checked the gun was indeed 'cold' before handing it over, in my opinion. While the buck might stop somewhere else, he is still in the chain of negligence [and pleaded 'no contest' to the charge of 'negligent use of a deadly weapon',] and was convicted of that last year.
Baldwin did not check the firearm, and seemingly the person who handed it to him did not check it either. The armorer was not on set. The armorer should always be on set when firearms are being used to ensure safety protocols are being followed. Usually an armorer should give an 'all clear' once firearms are secured. There is scant information on whether Baldwin had the required on-set safety training mandated. Even if he had been using guns on set for decades, it's still required to go over things with an actor before the scene.
As an actor he may be culpable for the incident if it can be shown that he acted negligently when in possession of the firearm. However, an actor is not supposed to be a firearms expert. That's the reason why productions are required to hire someone who is. However, he was also a producer on the production, so in his capacity as producer, he might have some level of culpability. Especially as the armorer, Hannah Gutierrez, said that the producers overruled her and therefore created unsafe work conditions.
However, Gutierrez was found guilty of the misdemeanor of negligent firearm use. It is further alleged that she spent most nights drinking heavily and smoking weed and was very likely hung over when she loaded the weapon.

With Baldwin, he looked very smug and gave many side eyes to morrisey. You could tell he was annoyed. Emily wondered if his lawyers told him to write to focus his energy so he wouldn’t have emotional outbursts or something. 🤷🏼

He looked like he was trying not to fall asleep at points and the constant lip curls of contempt while the lawyers and sometimes the witnesses were speaking and especially when the bodycam footage was shown was very angering for me to watch. It makes him feel like he has zero compassion for the victim.

For me the issue isn’t that Baldwin didn’t check the gun - when he was handed the gun, he mishandled it. I can buy that he was trained on multiple sets over the years that the experts check the gun and that the actor doesn’t because they may f it up (this is a grey area). What if he had checked the gun, thought it was all good, then pointed it at people and shot them? Would that make him not guilty? His guilt for me lies in the facts that he didn’t attend safety meetings, he pointed and fired the gun at people at close range, and it was not even a live scene but during blocking so he had no reason to use the gun, point it at anyone, or pull the trigger (setting aside his role as producer which may have contributed to the dysfunctional safety protocols). Whether he believed it was safer/best practice to check the gun or not after he was told it was a cold gun, it is basic gun safety knowledge to treat any gun as if it is loaded, therefore whoever is handling the gun is ultimately responsible for any outcome if they point it at a person and pull the trigger. Multiple people are at fault, including Baldwin.

I am not a gun person, I avoid them whenever I can, it's is just a personal thing for me. However two key tenets of gun safety have been drilled so deep into my head by friends that own guns and my own military grandfather that I won't even break them when using a Nerf gun. 1: Never point a gun at anything you are not willing to destroy and 2: Never ever put your finger on the trigger until you are 100% ready to fire the gun. All Baldwin had to do is follow those two very simple rules and this would not have happened.

13:52 interesting you mentioned 6 rounds in the Colt. As per Runkle, in the old west, these guns would only be loaded with 5 rounds at a time, leaving the last chamber empty for safety reasons. Just a fun fact for ya! 😃 Runkle of the Bailey has a Colt long barrel revolver and has done some videos showing how it works, what it can do and what it can’t do. Very interesting and useful information for this trial. Shout out to Ian Runkle! ❤

Guns are used all the time in movies and they are loaded with blanks. The trigger is pulled and the blank is fired. I don’t think most actors would know the difference between a blank and a live round. That is the purpose of hiring an armor. Very sad situation, but a professional was hired and I would not hold Baldwin accountable, even though I can’t stand the guy. Can’t imagine having to live with knowing you pulled the trigger of a gun who killed someone you knew.

​@@doreenhuston9623I'd agree if he was just an actor, but he's also the producer. He shouldn't just be aware a safety protocols but also ultimately in charge of ensuring a safe set. Him doing interviews on tv showing how he didn't and wouldn't pull the trigger won't help him. But I don't know.

Every gun training course always says many times over, Never point a gun at someone you don't want to kill. Always Check and Recheck the gun to make sure it's unloaded ALWAYS. Always treat the Gun as if it Loaded Always.

In movies they point the prop gun at other actors all the time. This isn’t the first death by gun fire on a movie set. Brandon Lee was killed by a gun loaded with blanks. The person responsible was not charged in that case.

Before I fire a gun for the first time in my life, I'd have imprinted in my brain to never aim at the person, (if I do not intent to shoot at that person) no matter what. Even if the magazine is out, even if I checked the gun ten times, this is the principal you follow ALWAYS. Even when I target shoot with bb gun, still the rule applies. It is like a second nature. Baldwin showed such a disrespect and ignorance for the seriousness of handling a fire weapon, he should be held responsible.

It’s obvious Hannah didn’t check what rounds she put in the gun, she didn’t double check the gun at the church, Dave didn’t check the gun at the church And Baldwin didn’t ask to be shown a check on set. That’s 4 missed checks between 3 people. 😳 It’s been a minute since HG trial, but who was determined to have handed the gun to Alec? Was it Hannah (who said she gave it to Dave and left) or was it Dave (who said Hannah did)? I forget.

If 100 people handled a pistol and they all said it was safe, then hand it to me, it is only my duty to be sure it is clear and safe along with handling it in a safe manor. Other wise actors can “accidentally” get a loaded gun and “accidentally” shoot someone..? How does sag rules, basically a work place policy give immunity to someone ?

SAG = industry custom. A prop. master checks. Then an AD rechecks. An actor is not expected to triple check. And he's not led to believe that live rounds would be anywhere near the gun to begin with.

@@dontmindme2844 I understand. But, if the both the prop master & AD had done their jobs, whatever AB did thereafter would've been harmless. He's def. civilly liable, since pointing a gun and firing is stupid. But, given that the gun was deemed cold, he wasn't criminally stupid. If he had fired without an "all clear," he would've been criminally culpable.

If you watch the Hannah Gutierrez trial, you will see it is most likely that Hannah got the bullets from her famous Armorer father Thell Reid and was very careless and inexperienced about performing her job. But, that doesn't relieve Baldwin of his culpability in mishandling the gun.

The details of bullets, blanks, armorers, movie set protocols or who loaded the gun are not relevant now. The armorer had her trial and is now being held to account. But this does not absolve Alec of his role and crimes. Now, the shooter who actually killed someone must be held to account. "I thought the gun was not loaded or lethal", is not an adequate legal defense against negligent homicide and manslaughter with a firearm according to the law. Alec took a gun he assumed was not lethal and he was the last person in its chain of custody, he pointed it at another person that was not even another actor, he cocked the hammer, he pulled the trigger and killed that person and wounded another. Guilty. Does not matter who loaded it prior to his firing the gun. The armorer's negligence and crimes do not absolve Alec of his negligence and crimes. The law makes no exceptions for movie sets, actors and hired armorers. Because a gun has the potential to be lethal, the last person in the chain of its custody has to be ultimately responsible for its safe or unsafe condition.

I have to disagree. Morrissey comes across as extremely condescending and extremely inappropriate. If I was a juror that would be extremely off putting to me. Her over exaggerated tone of voice; facial expressions and body movements, when objecting is too obvious in trying to evoke an emotional reaction from the jurors. She is worse in this trial compared to Hannah G. This could be a strategy in throwing off Spiro but could also backfire with the jury. I do agree that I expected more from Spiro. Do you think the other defense attorney should have done the opening ? Maybe Spiro has too much of a New York style and it comes across as arrogant. I wonder if they will make a switch.

Everyone keeps saying the gun won't go off unless the trigger is pulled. The gun will fire if the hammer is dropped on a live round. If he failed to properly cock the weapon and only pulled the hammer back and release it, the gun will fire.

Even I know that the most basic rule when holding a gun is not to point it at anyone you do not wish to shoot. Additionally, you never put your finger near the trigger until you are going to fire it. The video played of Baldwin on the set that day clearly shows him with his finger by the trigger. Yet, Baldwin claims he didn't pull the trigger.

There was a point Alec had his back to the jurors, facing his wife and she had her fingers locked ( gun shaped ironically) , with index fingers touched, pointing at him, swirling around, indicating to him to turn around and face the jurors!. He realised what she was doing and obeyed 😂. He's disinterested in this case - arrogant man!

Having worked on a set with a gun that fired blanks, you cannot let actors check their own weapons, because actors are stupid and will find a way to mess up the gun and/or hurt themselves. It’s not a silly SAG rule- it’s for safety. That’s why armorers NEED to be serious professionals who check guns in front of the actor and reiterate gun rules constantly. I personally think Alec is liable, but not because he was an actor- it’s because he’s a producer. I think not being able to bring up the fact that he was also a producer hurts the prosecution’s case. He didn’t follow gun safety rules and didnt show up to gun safety trainings because his position of power allowed him to act with wanton disregard. He was everybody’s boss! He acted like he was above the rules because he WAS above the rules… but now the jury only knows him as an actor, so the blame can absolutely be placed on the gun professionals that were hired to maintain gun safety on set.

Yes, those were my thoughts. Worked as set medic and was highly impressed with the attention to safety. I have to wonder if AB hired meek people who wouldn’t call him on his BS. The armorers I have observed would have packed their stuff up and left if they got pushback from AB.

I can see why an actor would assume there was no chance of live ammo being a possibility. I mean, even the one case I know of where an actor was killed with a prop gun it was a blank that killed him (that was Brandon Lee). Why was live ammo even on the set? I would have to say that Hannah's jail house phone calls made her sound like a big problem. Alec needs to change his courtroom demeanor.

The NUMBER ONE RULE of gun safety is to check the gun when handed to you to see if its loaded or in this case to check to see if it had blanks. Another thing i would have done is check the barrel for any thing in the barrel that could be propelled out by the blank!

I think Baldwin skates on the charges. I think the lead Prosecutor had a much easier time with the last case and this is far more nuanced. She's not too likable and I think the jury will give more weight to Baldwin's attorney's argument. I detest Baldwin and think he should go down for having so little care for the safety of the people on the set, and for blowing off his own firearms training.

If Baldwin is innocent because he didn't load the gun, then anyone who got a DUI is innocent because the barman loaded them with alcohol. As the user of a firearm you are ultimately responsible for what goes into it and how you handle it.

@@jpc347 You made an invalid argument , and who should have done what is mostly nitpicking, knowing all that i know about this Baldwin did act in a way that is ..well let's put it mildly .. irresponsible , not only during this incident but during the whole shooting of the movie, and fact is the HE is the one who killed her, but the manslaughter does have to be proven in front of a jury, its simply how it works. so its not that we disagree as such but more a matter of formalities and your rights as a citizen.

I’m 100% sure if the prosecution in one of his own trials said “it’s not a law, but common sense…” DUIG would object or heavily, heavily rail against that, and cite only what the law states. I can’t believe how biased he’s being.

I don't know why people get hung up on how people act sitting in trial. I am anxious and nervous by nature so I would sit there for so long and just not control my face or I get twitches I cannot control. It is a not a good way to judge someone's thoughts or how they handle being stressed or uncomfortable. Maybe Stephen being in audience as a support will say something to Alec how his lawyer is not benefiting him, I am also not a fan of the Prosecutor.

​@jh-is8nq If I was creating a Short Film here in EnZed and the Plot was about Hunters in a Forest and one of the Actors or Crew got killed becos of real ammunition being in one of the Rifles ... I would EXPECT to be charged and convicted of something ... especially if I was the Person loading the Gun or Checking the Guns Ammo or if I was the Producer on Set who was constantly cutting corners

@@New_Zealand_1 exactly. If I was creating a film and the armourer was a rookie with purple and green hair and I didn't triple check the chamber I would expect to be to be charged. Especially if several crew members walked of the set only days prior stating "safety concerns". Ab was a pushy , bossy jerk who is equally at fault. The sad thing is even if he gets charged it's only going to be max 18 months, probably only probation. meanwhile an innocent person lost her life and Alex gets even more famous and ultimately more wealthy.

This isn't about using one person as a poster child for deterrence. At the time, industry custom assigned gun safety to a prop. master. An AD signed off on the gun, too. While AB might bear civil liability, he's not criminally responsible.

My only problem is that Hannah is the person that brought the lives onto the set because she would go shooting on off time. So that's my only issue. Yes he shld have checked but her ass is the one that brought them on set. I think that the crew that walked off may have put one in their to see if they were actually checking to set them up. Just my opinion.

I don't think anyone intentionally "destroyed" the gun. The gun broke in testing because it was a cheap knock-off.

I've been following you since Johnny Depp.. I love all your videos.. I think you are pretty much always spot-on with your opinions, however I just think you're wrong about Alec Baldwin and whether or not it was his duty to check that gun.. I think when the defense gets up there they're going to make it very clear that there's a separation of duties on the movie set and the buck stops with the armorer. There's just no way that the actor or actress should ever have to be worried if that gun is loaded with live rounds.. it's just a burden that is not his. And I believe the defense is going to bring up plenty of experts that will testify that it was not his responsibility.

I have to argue the safety check part you say Alex should have done one maybe but it is the job of the person that does all safety checks of props to do that that is what they hire people for that are certified for that specific field of work and get paid to to make all props safe for actors to use so if it was Alex's job to do it to then everyone that was there at that moment should have done one too. Someone had to have swopped a fake bullet for a real one so who got the dummy rounds ask them if the made sure they were all dummy rounds and them ya gotta find out if that person or any of the people that were there at the time swopped a fake for a real one and find out who had the time to do it and that will be the person they should charge with all the charges Alex is up on. why is he the only one charged why not charge the person that got the prop bullets and the person that loaded the gun with the prop bullets.

Baldwin is a grade F celebrity IMO. He's pompous and arrogant. There was a time that I liked him back in the 80s, but that was before he let his celebrity status go to his head. That being said, he's innocent until proven guilty so I'm waiting until I hear all testimony to make a decision.

I think you’re being unfair and forgetting the fact that this is a movie so imagine acting for 30 years using hundreds of prop guns how many scenes and takes you do and having hired people on the set that literally they’re only job is to handle this firearm and make sure it’s all set for you Could have done a safety check. Should he have a safety check? Yes but is it easy to see how someone could forget on a movie set or after doing 30 takes might not do it every time I think maybe some financial obligation is an order but to convict for manslaughter on a movie set, I think isn’t justice

I don’t think Alec looks bored, I think he feels uncomfortable. I don’t think he should be charged. There were multiple people who checked the gun, he was on a movie set who would NEVER think there would be a real bullet in the gun. The person who put the bullets in the gun, as well as the people who checked it, should be the ones who are charged. Plus, they say he shouldn’t have shot the gun on that specific occasion but he would have shot it later on, so 8 don’t understand the difference. Apparently the same gun went off by itself earlier on.
