On the plus side, the fact that dereliction of duty is probably punishable by death does get Nolan off the hook for the war crimes of perfidy (pretended to be Earth's hero) and Aggressive War. The Nuremberg trials and later Geneva Conventions established that a credible fear of death does remove much culpability from war crimes.

It's like when people try and bring up the Geneva convention in Star Wars, it doesn't really exist there; and it's not a magic all-binding thing even in reality. It's likely Viltrum practices totally unrestricted warfare, which means they themselves are totally open to whatever an enemy could think of doing to them too. IE it wouldn't be a war crime if Cecil's lab boys cooked up a genophage that made all viltrumites sterile, and killed them specifically, then released it on them. Unrestricted warfare is great when you have the upper hand, but it sucks if the shoe ever changes foot.

With self defense you have to fear for your life and considering how he clearly wasn't afraid, I don't think it would count If he was actually defending himself he didn't really need to do anything and if he did do something that would classify as self defense it wouldn't be killing them, it would be knocking them out or taking their guns away from them

I think it would realistically just be battery, I was actually thinking the scene with Cecil could be argued as assault, the way Omni-Man grabbed his tie, clearly with the intent to do serious damage, and probably kill him, and managed to get a hand on him.

If his target isn't also a superhuman and remains intact after it, he's clearly holding back and it's probably just battery. There are plenty of cases where he just straight up murders with his bare hands, and it isn't particularly effortful even then.

I would argue that before Mark got his powers, the time he spent with him was actually good father and son time. Afterwards though...yeah that is when things get bad.
