Inmate Rights vs. Privileges. Know the difference.
In this episode of Tier Talk, Anthony Gangi discusses inmates rights and privileges. He argues that prisoners rights should not be confused with privileges. There are a lot of civil law suits that are claiming corrections staff are taking away inmate rights, when in fact they are privileges. Listen in and understand the difference between inmate rights and privileges.

That was pretty vague...wish you could have elaborated on what inmate rights were. I believe inmates should be educated on there rights so it cuts down on confusion.

Except a youtube channel. From my experience of being locked up...the handbooks are usually the only thing that an inmate gets...and usually it just points out that everything you spoke about is a privilege. Its all vague...just like the 8th amendment of cruel and unusual punishment. Treating a non violent inmate before conviction like a convicted murderer is pretty cruel. I respect your role of one who watches over secure facilities...but the fact is most inmates are not as informed as they should be.

Your experience may not speak for most. I can tell you from my experience inmates are well informed. Some have actually abused the system by using their rights for malicious reasons. In my experience, when inmates write complaints or grievances, they are very well informed of what they feel is being violated. Sometimes they are being helped from the outside or being helped from the inside. The problem that exist in Corrections is that people try to generalize change based on extremes or one time occurrences and that is something that needs to stop immediately. It is getting people killed. People on the outside focus on the one while we on the inside focus on the many. .

Anthony, What you explained makes imminent sense to me. The Correctional Staff and Facility needs to control the inmates. The granting or withholding of privileges provides very humane and effective positive and negative sanctions.

I agree with you about rights and privileges, but your example of contact visits lets say, inmates who have been behaving and doing what they are supposed to, to ensure they get those contact visits, but then one or two idiots screw it up for all and contact is taken away, how is that fair to the inmates who are following the rules ? Not saying all prisons, but there are some prisons that take away from ALL inmates when a breach has happened, as opposed to just taking it from the few who messed up, which in my opinion isn't fair. great channel btw.

Chispa thank you for the compliment. If there is a threat to visits in general (contraband coming in) and it can not be identified, then you have no choice but to lock it down. Universal precaution. But if you know what the issue is, and who is responsible, then you should hold them responsible without generalizing the punishment to the rest of the population. So I agree with you in regards to being fair. You are one hundred percent correct. In my example, we know who the inmate is taking advantage of the privilege.

Visitation is a privilege until an inmate is sanctioned for rule violation.

So extended family visits are a privilege right? What about holding an extended family visit application from being processed so that the inmate or family cant even get an approval or denial in the first place. I think its a RIGHT to process an application. Its not a right to receive the privilege to visit, but its a right to be able to apply for it.

An inmate has a right to put anyone on their visit card. Then there will be a background check. If the person passes the background check and there are no security concerns, the people added should be free to visit (once they show the proper form of ID). So, I don’t disagree with you. Visits, if being done for the right reasons, can aid in rehabilitation. But if visits are misused, they there needs to be some form of actions whether we do a ban (visitor is no longer allowed access or ban on contact visits, or, if need be, depending on how severe, ban on visits in general). It truly is a case by case basis. But I understand your perspective.

Rights and Privileges should be written down and documented, rather than by decision of the staff. Duh!

@@TierTalk Everything has to be documented and written down so that an inmate can look at it anytime. Just like laws and rules and regulations.

Incentive based system is the only way to keep inmates in check otherwise, we need to change constitutional laws that affect incarcerated individuals like third world countries.
