NerdSync Yes more sketches and Batman where's the mask to protect the ones he cares about so if he has his identity revealed by some one, they, he, or she will place Batman's allies in danger. Keep his identity secret.

I believe that the answer is already in the video, as after Batman's secret identity was revealed he was quickly attacked at his home Wayne Manor, while he was hosting a party. Because Bruce Wayne is so powerful, both in and out of cowl, that makes people more liable to attack him and his assets given proper motivation. Ultimately, making Batman's secret identity as Bruce Wayne public, could result in him, all his associates, employees and his company been attacked in some fashion, result in both, at the very least, a *Financial & Political Crisis.* Thus revealing his secret identity is actual *a threat to the public,* and creating such a threat is certainly illegal.

It doesn't apply to every villain but in the case of Hugo Strange, there have been situations where he discovered Batman in the context of a therapy session and in this regard he is doing something illegal because he is not respecting a patient/doctor confidentiality agreement. Or does the same rule apply to doctor as they do to lawyer as was mentioned in this video?

Julien Cattan: I am pretty sure similar rules apply to doctors and priests, but like lethal force laws and citizen arrest laws, they can only violate confidentiality if others would be endangered if they with held the information. But then the reason most villains get out of county jail is that most comic book vigilantes don't follow the citizen arrest laws and combined with damage done to the crime scene before the professionals arrive it is very hard to hold the "bad guys" in custody when they are found beaten and bound, by law they get classified as victims in the real world unless there are other witnesses to what happened willing to make an official statement, or some other evidence that has no signs of tampering. Of course the comic book vigilantes that kill people get classified as either serial killers or terrorists, funny that Frank Castle doesn't seem to care who recognizes him.

Its a civil case, not criminal. The answer is that it is legal. As for ramifications, however, while no criminal charges can be brought fourth against Strange, Batman could take Strange to civil court to collect for personal damages iff Strange reveals his identity to the public rather than to police and possibly news agencies (as they can act as a go between for whistleblowers and state agents). So no crime against, but a possible civil case depending on how Strange reveals the identity.

Well, when I'm reading a Batman comic I'm absolutely rooting for Batman, but...honestly, if Batman were real and I was just some ordinary non-superpowered citizen living in Gotham, I would absolutely be in favour Hugo Strange revealing his identity. Accountability is important. Even if Batman is arguably doing the right thing, that cannot simply be presumed. He wasn't elected. He wasn't hired by anyone. There is no oversight of Batman's activities. Whether he is doing the right thing is secondary to the public's right to judge that for themselves.

Batman _has_ immunity through anonymity. And that's a problem. If Batman answers to nobody but his own conscience, who can stop him if he decides to do something _he_ thinks is right but which is harmful to much of Gotham? For that matter, what happens if he should make a mistake?

Johnathan, well think of secret service agents or undercover police officers. They have a certain amount of legal immunity and are often protected by anonymity, but the difference there is that their actions are ordered and monitored by an agency which takes responsibility, and which ultimately answers to elected officials. There are safeguards in place to prevent secret service agents from abusing their powers and tangible consequences for agents who go rogue. None of that applies to Batman. And I'm not arguing that obeying the law is always the right thing to do. I'm a fan of Gandhi's civil disobedience. But usually if someone does the Right Thing (tm) regardless of any consideration to legality, they also accept the consequences. Imagine if Gandhi instead of protesting English colonialism by making salt openly as himself had started an illegal salt producing and smuggling operation while wearing a mask? It would at the very least alter the moral characteristics of what he was doing. If I saw someone about to die and knew I could help them, I absolutely would without consideration for legality. But I would also have to accept it if my actions came under legal scrutiny after and accept any consequences. It's part of Batman's story that he sees working outside the law as the only option given the corruption in Gotham's politics and police force. And that might be morally justified to an extent. But the flipside of that coin is that as soon as the corruption problem is taken care of, Batman has an obligation to offer his actions up to scrutiny and then, if possible, go legit.

Frisko555, yes that's true of some incarnations of Batman, but not all. It works for Justice League Batman but it doesn't work for, for instance, Nolan's Batman. Also while the Justice League could stop Batman if he went on an obvious rampage, it's not as if it's ever been established that he reports to them, so they don't function as an oversight of Batman's work. If he decided to some subtler shady things than going on a rampage, they couldn't stop him, because there's no reason why they would know about it. And it's not like they stop him from violating people's rights. He frequently tortures people when he interrogates them, and doesn't care about people's right to privacy, just to name some examples of what the Justice League really ought to stop him from doing, but don't. You know, things that would get him fired if he were actually a lawfully employed crime fighter.

This was awesome, I would definitely like to see more videos like this one! I think the question that has to be asked based on the arguments made is: Which is more harmful? The public not knowing that rich, influential Bruce Wayne is also Batman; or the problems caused for Bruce, and his family and friends, when his secret identity is common knowledge? Considering that Batman is largely a force for good, the citizenry *probably* doesn't have to worry about being taken advantage of by him, no matter how much power he has. The danger to Bruce and his loved ones, however, is definitely very real once his villains know who he really is. I have to side with Batman and Lawyer™ on this one.

I don't know, and that's a good counter-point. My argument is that, based on Batman's history of heroism, it's unlikely that he's going to use his power and influence in a way that harms the public more than it benefits them. It's very likely, on the other hand, that harm will befall Bruce and his loved ones once his identity is revealed.

You could also say that what the people don't know won't hurt them. For all they know batman is just some guy like peter Parker. They don't know that he has all that power in and out of costume so they have nothing to worry about. At least that's how I see it :P

NerdOutpostAlpha hmm he did cause the OMAC crisis but elongatedman's wife was raped. So it comes round to more of a marvel civil war situation. Would the goverment be allowed to control that information? In the animated series amanda waller knows but doesnt reveal it to the public 🤔

My verdict is that Batman's identity being revealed should indeed depend on the particular context. If Jim Gordon were to do so as a part of his investigations into Batman breaking the law then it is in the service of the public, but for a public citizen like Hugo Strange or Tim Drake were to simply out Bruce Wayne as Batman at the very least it should be considered how much public harm it would cause on the fronts of both Batman and Bruce Wayne. Simply taking away Batman who stops crime is fairly simple, but there's the possibility that if Bruce Wayne was either encarcerated, killed, or forced into hiding by this knowledge, Wayne industries could suffer and they probably support half of Gotham and that would mean even more economic problems for Gotham and the effects of that on the rest of the world too. Is extreme loss of jobs, potential technological advancement, and charitable support really worth it? Revealing Batman's identity without providing for the fall-out in advance might even go so far as to be treasonous if it hurts the country's economy enough. Furthermore revealing Batman as Bruce Wayne could be devastating to so many more people and superheroes as well. Bruce Wayne has adopted three orphan young men around the time of each new Robin after all. And doesn't he spend an awful lot of time with Clark Kent. And did Bruce Wayne REALLY just meet Amanda Waller to donate to the Department of Homeland Security? There is just so much that would unravel if people suddenly knew Bruce Wayne was Batman. I ultimately think that unless it could be proven that not knowing would cause more aggregate harm to the public, revealing Batman's identity publicly from the public sector is an invasion of privacy and a crime. Also I do think that NerdSync could do more skit content too. That would be fun.

If Batman is, indeed, a criminal, then the consequences of him being charged with his crimes shouldn't protect him from being exposed. Imagine if a major public figure - say, Bill Gates - turned out to have been secretly breaking into people's houses for years. That would definitely be something to expose even if it meant major hardship for Microsoft employees. It's only to the extent that Batman's activities are legal, or that exposing his identity leads to extreme consequences (like a reasonable expectation of hundreds of deaths) that his secret identity should be protected.

I liked this sketch idea, Batman does a public service, every single time a superhero's identity is revealed someone close to them get's hurt. If say Superman's identity was reveled he would be concerned about people he lives with on a regular basis. Thus putting the rest of the world in danger. Look at the death of Rachel Dawes is a great example. Batman could only save Harvey Dent. What if an old chum of Batman's was in danger as well as the Mayor. Villains knowing the allies of Batman out of the cowl could endanger others.

Well technically Hugo is exposing private information that doesnt belong to him, something that can hurt Bruce's family and friends, while yes some of the things Batman does is illegal, that isnt what they are discussing, so yeah, it is illegal to reveal Batman's secret identity. Also i would love to see more sketches!

I definitely don't want the normal style of videos to go away, but that was a lot of fun, occasionally very funny, and got a lot of the same information across that we'd get from a normal video, so A+, Scott. I'd love to see more like this every now and then. Also, Ricky's Judge was a great character. Whoever wrote this script did a great job.

being Batman isn't private information to begin with, it doesn't matter how one obtained the information or exposed it, there is no violation. Batman is Batman in public, and while committing crimes against other people. if people couldn't reveal the identities of criminals, society would be very weird. by that token the woman who exposed the Boston strangler is a criminal. also, Peter Parker's identity is of public interest, because he's Spider-Man. he doesn't need to be a second publicly significant thing, one is enough. if someone is the chief consultant to the president of the United States, it's not like they can demand their identity be kept safe by saying that aside from that fact their just some nobody, that fact is important enough.

If we're assuming Batman is an agent of justice recognized by the police, yes, it's illegal. His identity is protected under law just as much as a police informant. If he's acting as his own party, then no. He commits incredibly negligent crimes and his information is treated as necessary by the public to safeguard themselves. It's not illegal to make accusations of criminal behavior (we've seen a lot of that recently), and a mask makes no difference. Basically it comes down to whether we're helping the people with this info or intentionally hurting the man himself without justification. But hey, if anybody has any legal precedent that contradicts my informal opinions, feel free to drop them below. I could very much be wrong.

Does Batman really qualify as a protected informant? His means of collecting information is invasive. Most informants (if any) don't obtain the information they provide to the police by illegally wiretapping their sources...

futurestoryteller Well he isn't an informant. It wad just an analogy. I argued he'd be treated like one assuming they offered some kind of legal provision to allow it. And I think that's a reasonable assumption for a world populated by supers. If (big if) he's legally recognized, it would be like doxing any legally protected person (informant, undercover officer, protected witness, etc). But that's totally best case. In real life, you're right. That'd never happen. But also in real life, most of the gang bangers Batman catches would be released and Joker wouldn't go to an asylum (he'd get death). So we have to suspend disbelief.

We weren't really being asked to suspend disbelief though, as far as viewing Batman comics for entertainment purposes are concerned, we were instead being asked by Nerdsync to judge a hypothetical. If we suspend disbelief far enough into Batman's universe his actions might actually be legally protected, according to some readers of comics in the comments, but doing so actually defeats the purpose of indulging the hypothetical exercise. Also while we're nitpicking, the people Batman catches would not necessarily be released. Admittedly this information is both second hand and pretty vaguely second hand at that, (feel free to take it with a grain of salt.) In a Quora thread a few years back, there were some current and former officers discussing what a poor detective "Dirty" Harry Callahan was. I if I remember correctly, it was within this same thread that they all agreed that the movie's treatment of law enforcement was poorly constructed overall, since even with Callahan's abuse of the suspect the man could have easily been prosecuted - according to them. Although I don't know the specifics, and even _they_ didn't mostly seem to be made up of lawyers. On whether the joker would be killed... well where and how he ends up depends both on what the laws in Gotham's city and state are, and how a jury interprets his behavior.

Strange is right. Someone with the kind of political and economic influence over the city in the course of a regular life, if he's running around bashing up suspected criminals with his gadgets then the people deserve to know about it. That he's stealing from his businesses - in the Dark Knight movies at least - to do it makes him a white collar criminal as well as a violent felon driving around town at night terrorising people he deems unworthy of possessing civil rights. Given the resources and political clout he has at his command he could do untold good for the city without getting his hands dirty with pugilistic exploits against the kind of eccentric that only shows up in a town with a cape brutalising it. His exploits almost certainly make the crime more brutal than it has to be; by raising the stakes on the criminals with his illegitimate violence and psychological warfare he provokes them to irrationality. Instead of professional criminals looking for maximum payoff for minimum of fuss it seems like most hoodlums get drawn into gangs being led by lunatics looking to prove themselves against the bat - stupid melodrama setting up pointless violence. People should know what happens under the Wayne Manor, and they should stop it.

awesome video, I'm on Scott/lawyer's side I feel like everytime a villain finds out a hero's identity they attack the hero personal and do even more damage else wise. Like in the first Spider-Man movie when Green Goblin figures out Peter is Spidey and then attacks Aunt May to get to him, that wouldn't have happened if spidey's identity was still intact

Well....If we're going to be honest, Batman is a vigilante, a terrorist ( to the criminals) and a mass murderer...at least in Batman V Superman. Technically he works outside the law under his own authority which makes him a criminal. If a masked villain used the same techniques with the same " ends justify the means " mentality that Batman practices.....They would IMMEDIATELY be unmasked and their identity revealed apon capture. That's why a lot of "super" heroes have secret identities. Because they're breaking the law in the name of justice. Even Daredevil hides his identity and he's a Lawyer !!!! That's because Murdock knows he would face a lengthy prison sentence if he were caught by the cops. So yeah I think Batman's identity is fair game. "NUFF SAID"

Wesley Molt Yes Really......The "Good Samaritan" laws offer protection to people who give "REASONABLE" assistance to those who are, or who they believe to be injured, ill, in peril, or otherwise incapacitated. Remember....I am using Batman as the example because he is the subject of this video. When Batman/Bruce Wayne created a city wide surveillance system created through high-frequency sonar signals captured from millions of cell phones in "The Dark Knight"... that went beyond the boundaries of "REASONABLE" assistance. If a single individual had that "power" over millions you would definitely want to know who they were. "NUFF SAID"

I don't think it should be illegal for Batman's secret identity to be revealed. A person's identity is one of the few thing about a person that is not private information. "Batman" isn't a citizen of the united states, Bruce Wayne is. So you couldnt really argue that you are violating batman's rights by revealing his true identity. You could argue that you are violating Bruce Wayne's rights by revealing that he dresses up in a costume and fights crime, but I think it's a weak argument. Not only is his vigilantism in public, but it's also illegal, and you cant regulate information that could be figured out by anyone without invading someones privacy. It should be illegal to hack Bruce Wayne or Batman's phone or spy on him to figure out who he is, but it shouldnt be to just figure it out through logic and reason. It also shouldnt be illegal to expose him at least to the cops if not the public, because while there can be a risk to that persons safety by an outside party, it's not guaranteed or revealed directly to the penguin. We cant regulate Strange's ability to reveal information he figured out unless its specific enough to warrant an invasion of privacy. Let me use two examples to illustrate why a law protecting secret activities that effect the public would be flawed; 1. Lets say batman was just a really bad superhero, and almost anyone smart enough can figure it out. Maybe 10,000 people have figured it out because he drives right to Bruce manor and parks the bat mobile in the garage. Should we make it illegal to share commonly known information? Or perhaps its not that Batman is worse at keeping the secret, but rather that education funding increases in Gotham and everyone gets smarter. How do you regulate people's minds and gossip? 2. Hiesenburg. No not the famous chemist, I mean Breaking Bad. There's not as much public support for a meth dealer, but both Hiesenburg and Batman are secret identities made to protect someone committing illegal acts from being caught by the law. No one would argue that Hank finding out Walter's secret identity is invasion of privacy because Hank is a DEA agent, and it was always his job to find out. Now if Skylar had found out and then told the press immediately instead of the cops, you might have kind of a case but not much of one. Being a meth dealer is private information that isn't allowed to be private because it is illegal; therefore its not really private information, just information that hasn't been made public. The only way I could see this as being illegal is if she gave the information directly to Gus instead hoping he would kill Walter. But even then not really because like I said it's not really private information, it's secret information designed to cover up illegal activity. TL;DR? Hugo Strange could avoid this entire case if he had gone to the cops instead.

How illegal is Batman? Sure, under our legal system, his actions include a number of crimes, but he's apparently operating in a system where it's legal for Gotham Police to have a bat-signal, and sometimes even a bat-phone, which, at the least, pulls him into a legal grey area. In the wider world of DC Comics, the legal system must allow for masked costumed heroes. Otherwise there's no way that many costumed heroes could continue to operate.

Hugo Strange should have brought up how the first 5 issues of Batman Plagerized The Shadow‚ stole The Shadow's nickname as well as his villain The Grim Joker, and ripoff the concept of a Bat themed vigilante who witness his parents' murder and uses Bat themed gadgets from Johnston McCulley's The Bat.Hugo Strange would have easily won the debate.

+cha5 Fine let elaborate (prepare for an essay): Doug Moench (the creator of Moon Knight and writer of the original 1979 to 1984 run of Moon Knight) was a music interviewer article writer for the Chicago paper. His Best Friend, Donald F. Glut told Doug he could make some extra cash on the side writing comics for Warren Publishing. So Doug Moench started out writing Vampirella comics to of which they were very mediocre with the exception of the last two comic he wrote. What changed was he copied the Vampirella formula of writing from his fellow co writers at Warren Publishing. The Formula being described the background settings in great detailed since it was in Black and White among other things (but that is the most obvious one). So here's the connection: 1. Similar cast of characters: Vampirella = Marlene (Moon Knight's Girlfriend): Both are damsels in distress who can take care of themselves in battle. Are often seen naked. Adam Van Helsing = Marc Spector: Both are monster hunters/mercenaries who occasional fight vigilante crime. (Marc Spector hunts werewolves). Penn Dragon = Bernard Crawly: Both are homeless drunks and father figures to the main protagonist (Crawly was a father figure to Marc Spector and Penn Dragon was a father figure for Vampirella). Adam Van Helsing's Father = Frenchie: Both are long time allies to their Monster hunter friend (Frenchie helps Marc Spector hunt werewolves and is his Best Friend while Adam's Father helps him hunt vampires). Pantha = Moon Knight: Both became priests/warriors for an Egyptian god that brought them back to life (Moon Knight was given powers by Khonsu while Pantha was given powers by Ra). Both the cast of Moon Knight and Vampirella hang out at a dinner as a main setting point for them to progress the plot: (Moon Knight plans his vigilante missions in his dinner with his cast of characters while Vampirella and her cast of characters often bump into a new character at her dinner who help progress the plot). 2. Art Style: Doug Moench wanted Moon Knight to be in Black and White, but Marvel said no. So he settle for having Moon Knight's costume be in Black and White though he refers to it as Jet Silver. Of course, the original Vampirella comics were in black and white. 3. Story Telling: Doug Moench wrote a few one off Moon Knight stories that barely focused on Moon Knight, but rather focused on telling a horror story with an original cast of main characters. Vampirella started out as a story teller who presented one off horror stories. There were a few Moon Knight stories Doug wrote that seemed heavily inspired by Vampirella stories. EX: Moon Knight and Frenchie were tracking down a mob boss who is trafficking Cocaine. Frenchie learns his wife was involved and has Flash backs to their life together before since she's been missing from his life for a full decade. His wife is murdered and he only blames himself, Moon Knight gets put under mind control and tries to kill Frenchie but Frenchie snaps him out of it. Frenchie vows vengeance on the mob. Vampirella and Penn Dragon were captured by a mob boss who is trafficking Cocaine. Penn learns his wife, daughter, and son in law were involved. He has flash back to their life together before since he never seen his Wife and daughter since a full 20 years ago. Vampirella gets put under mind control from the cocaine and her hunger pains. Vampirella ends up killing Penn's daughter, son in law, and severally wounded his grandson. Penn Dragon only blames himself. Penn Dragon's wife Vows Vengeance on her families deaths. (there are three more stories that are very similar, but you get the picture). As mentioned before, even though Moon Knight comics were NOT in black and white. Doug Moench still felt the need to describe every single thing in the background settings through narrations just like in Vampirella comics. 4. Misconceptions: Just like how people keep mistakenly call Moon Knight a Batman ripoff, Vampirella was often called a Superman ripoff back in the day. Bonus: (just because I feel like explaining this) Moon Knight was not mentally insane nor had multiple personality disorder until 2006. Moon Knight was just very religious and was in hiding from the CIA and Terrorist. That is why he has the Steven Grant and Jake Lockely disguises since Marc Spector can no longer go out in public as himself.

Well, Batman does a lot of illegal stuff. He breaks and enters, interferes with police work and being a vigilante is illegal on its own. Not to mention child endangerment. At this point in continuity, all the Robins have been dead/should have been dead but was saved at the last moment.

In "Mask of the Phantasm" and "Year One" they actually try to shoot and kill his ass a few times. I'm sure it depends on the continuity, but it's worth noting that very few law enforcement agents have the authority to operate anonymously either. The long and the short of it is that a lack of transparency disrupts the process of checks and balances. Batman can act with relative impunity without oversight, and anyone with the means is free to impersonate Batman, making it more difficult to determine which crimes should be attributed to him if and when he breaks the law.

It should be illegal. Sure Batman does things slightly outside the law, but Batman represents the fear all criminals have. If you take away his mask then no one will fear him and the crime rates would increase therefore causing more harm to civilians than if he remained masked.

So a masked terrorist who frequently breaks into places, assaults people, destroys public property, obstructs justice, and has even committed at least voluntary manslaughter on occasion, while at the same time being the CEO of a publicly traded company that he no doubt embezzles from and uses his wealth to influence politics should not be a person the public is made aware of because he does his illegal activities while masked and other criminals are "afraid" of him? I am quite certain a lot of criminals are scared of ISIS leaders too. So those who wear masks on video should not be named or have their identities revealed to the general public?

Since Batman is in fact a criminal, revealing his identity is no different than revealing the identity of any other criminal who wears a mask. Batman is a danger. He is insane. A frequent plot point is that Batman is just as insane as the criminals he puts away, and it's absolutely true. I'm surprised the video didn't mention the fact that he trains child soldiers (Robin) and sends them up against crazed killers and literal monsters. How would people react if Gordon hired a child to work as a police officer?I love Batman and all, but if he existed in the real world, I'd want him behind bars.
