This prosecutor must have been lucky to have never been cut off before. The truck moved over before clearing the center lane and it resulted in the truck being clipped in the right rear and the car being clipped in the left front..the total impact on the guard rail. The prosecutor f’d up and trying to save face.. making him look like a total idiot

I didn’t know anything about this case until the trial, I’ve noticed I can’t wait to hear the defense attorney’s questioning instead of the prosecutors questioning has said a lot to me. I’m learning nothing from the prosecution. What’s the crime? Do the jurors have the save reaction? This case is crazy! I’ve heard “the feds” a couple times, is there an investigation into the Alberts? This whole thing is crazy!!

This is why you should have a dash camera. Crazy stuff has happened to us in our RV. I point to our camera and people take off in a hurry.

That’s exactly why I was it purchased cameras for all around both my daughters cars!!! They travel the highway everyday! The Ford F 150 clipped his front bumper it’s not a matter of him rear ending the ford F 150. That’s the point I’d strike hard that that truck clipped his front drivers side. Everyone should know that that kind of impact would turn that truck to the right in a spin. Throwing the car forward to the left causing that truck to turn or spin backwards. Larry should have used toy match box cars on a table in front of the jury. The other attorney knows he wasn’t drunk! Did anyone test the other driver? All drivers should have had a field sobriety test!!!! I don’t know one driver of a big truck that doesn’t know where the back of their bed is!!!! Unless of course they’re impaired!!!!

Exactly. It's what cops do in pit maneuvers all the time. And that whole corner of the truck will likely be damaged, bumper and fender.

When the truck in the left lane was going 75 MPH and cut the guy off, he’s no longer going 75 MPH in a forward direction, he’s going X speed to the right as well which means he can’t be going 75 MPH in a forward/ straight line.

um. no. at 75 miles per hour, you are covering ~6,500 ft/minute, or about 650 ft in 6 seconds (about how long takes to change lanes) Changing lanes means you went sideways by about 12 ft. If you do the math with 650 ft as the hypotenuse, 12 ft as the adjacent side, and x = (the new forward speed) as the opposite side, that works out to a reduced forward speed of - - - - - - - - 74.987 mph.

@@gagenater Exactly my point. You are no longer going 75 mph and the decrease in speed while “cutting” someone off could have them hit the back right hand corner as this case shows. So yes I’m correct. Plus the fact that most people who pass a vehicle and move into the same lane if traffic after the pass tend to decrease the pressure in the gas peddle to bring them down to the speed limit or desired speed. If the speed limit is 70mph and you want to pass someone you usually speed up to over take that person ASAP. This was the passing vehicles fault, not the defendants.

@@gagenater your failed assumptions here us that you’re assuming the passing vehicle took 6 seconds to change lanes. If you cut someone off, your not taking 6 seconds to do so. Reason for the right back side being hit.

@@gagenater He never completed a clean change of lanes hence the accident, so your 12 feet is irrelevant. 12 feet is how wide the lane is. The defendants vehicle is at least 4-5 feet wide. Most drivers are not driving on the white lines so there’s a buffer if 3-4 feet on each side of the vehicle. The claim is the truck changed lanes and the defendants vehicle hit the back right hand side of the truck. So taking into account the defendants vehicle being 4-5 feet wide and in the centre of the lane, that would put the defendants vehicle around 3 1/2 feet from either white lines. If the truck changed lanes, there would be roughly 3 1/2 feet between the truck and the defendants vehicle from the time the truck crossed over the white line and the trucks back right hand corner to the defendants front left corner. If the defendant moved to the right the 3 1/2 feet to prevent the accident as the truck was entering his lane there would still only be 4-5 feed between vehicles. What’s your math now? Take into account that the defendant also stated the truck slowed down after crossing lanes. (Yes can’t prove this) but it’s typical of most vehicle passings and changing lanes.

@@Justicescales123 yes completely the reason there was a collision in this case seems to have absolutely nothing to do with the speed of either vehicle. However the question was: how much speed the vehicle could loose due to it's different vector while changing lanes, and the answer is extremely little.

In my early years (1969) I would transcribe official police accident records for the traffic engineering department of the city. Even back then there would have been photo evidence of impact points. Barring that, I would have expected to be able to get photos from the body shops. Still, great job.

The logic escapes you because you don’t want to understand basic traffic. If someone starts moves into your lane BEFORE they clear your front bumper, you would hit the back corner of the vehicle.

And if hit at that perfect angle will throw that car into a spin turning left. The momentum of which will end up with the car that cut you off behind you. My father used to test drive new vehicles in the empty mall parking lot and throw it into a spin on the ice to see how it handled. He thought this was a family event and brought us with him.

It is a high school trigonometry problem to determine how the accident occurred. If you could assume that both speedometers were accurate. When the guy traveling 75 mph turned together in the other lane he was no longer traveling straight. We would have to know what angle he turned to determine if a rear end collision would occur.

Why weren’t any of the skid marks measured? You can tell a lot about the length of a skid mark. That cop did a horrible job of investigating the accident. What good is this cop if he can’t even work an accident properly ?

I've had idiots cut me off then back off thier gas pedal reducing speed if I hadn't hit my brakes I would of crashed this has happen in my own car and alot while I was in my semi trying to get me to hit em or go off road

Many automatic vehicles have the ability to downshift, slow down, and no breaklights will engage. All the while The cruse can still be on. 😊

Sounds believable. I’ve been in an accident when cut off by another vehicle and once a car makes impact the vehicles start spinning, making further contact. Cars are already in motion and it’s very possible to receive rear damage in a spinning car when another car is spinning also.

You gotta just love how these DAs make up a story and try and fit the circumstances to their narrative. He doesn’t think that someone would hit the brakes when somebody cuts them off then he’s pretty damn stupid. And the person in front of them would also hit the brakes once they felt the impact. I’ve been a truck driver for 40 years and I’ve seen all kinds of accidents and the one the defendant explained sounds like many that I have seen in person up close and personal.😁🎯

because the other driver probably admitted things just like this guy said but that did not fit the narrative. I mean no pictures, no video no nothing just a greenhorn rookies word i get the impression that the da leans on all rookie cops to get him cases even ones with such flimsy evidence and not to mention the judge allowing things that should not have been allowed for the DA wtf does something that the wife did 20yrs ago have to do with anything as juror i would have seen this as the DA guy knew his case was shit and was willing to do anything for a win making me question his character more than hers! and his complete lack of understanding how someone cutting over too soon will cause this exact type of accident spinning the front vehicle while the second will continue a bit further down the road. hell the DA should go on youtube and watch dashcam videos then maybe he will have an understanding he should be doing that as he spends an awful lot of time with his face about buried in his phone!

It's also incredible to me that anyone would believe someone in even a relatively minor crash wouldn't be confused or mess up a timeline or forget things. That seems like a usual thing. But it's clear the prosecutor doesn't care about anything but his conviction rate.

Also if the defendent was going 109 mph and the 3rd party was at 75 mph, both being in the centre lane the rear ending would have not looked like that. The impact would have been fully across the front and the back of the vehicles.

I didn’t like the prosecutor. He seemed to twist the testimony to fit his need to win and putting words in your client’s mouth. It is possible for a vehicle to come into your lane going 75 mph while you’re going 70 and both vehicles collide. It wasn’t your client that hit the truck, the truck hit your client’s vehicle. QUESTION LARRY did the truck’s insurance company pay the repairs/replacement to your client’s vehicle?

As a cab driver, you see people getting cut off, because the person coming in their lane, never looked over their shoulder. (The blind spot). Especially if they are from a different country. Is your last name Mason? LOL 😂 🤣 😆

This guy cut him off. That attorney knows that he’s been in the same situation himself and a car traveling 50 mph and someone can come up doing 100mph on their left cut them off and clip the front of the slower vehicle. The operitive word is he didn’t tear end the guy. He was struck by the other vehicle.

Thank you! I've been thinking the very same thing since Larry (DUI Guy) showed the diagram of the 3 vehicles occupying all three lanes. I don't understand how the state's attorney fails to comprehend the idea that it's highly possible the driver of the F-150 moved over into the center lane before fully clearing Mr. Faulkner's vehicle. The speed of the F-150 would've had no bearing whatsoever. Lastly, if the driver of the F-150 only used their passenger mirror, which clearly states,...."Objects in the Mirror are closer than they Appear", there's a good possibility they believed they had fully cleared Mr. Faulkner's vehicle, but they moved over too soon. This would also explain why the F-150 had spun around and was facing the opposite direction by the time it came to a stop. I think the state's attorney is playing dumb when he says he can't fathom how this accident unfolded simply because the driver of the F-150 claims their cruise control was set on 75 mph. There's no proof to suggest that was an indisputable fact. There's also no proof of the BAC in Mr. Faulkner's system. If the jury follows the instructions they'll be given, they should return with a "Not Guilty" verdict. I can hardly wait to hear the jury's decision.

Does the prosecutor have independent evidence that the man was in fact was travelling at 75 the scenario is based on what the driver told the deputy he was doing 75 and did not decelerate as he pulled over and did the other driver pass a DUI or was it only the defendant. Again it was only the deputy that claimed he told him he had drank a beer and hour or so earlier.

The truck driver could have accidentally disabled his cruise control and not realized he was slowing down. That could also explain why he cut off Mr Faulkner. I can't count the times my cruise control was disabled unintentionally. You look down and you've dropped speed without realizing it.

why is it taking for granted that the other driver was doing 75 , what is the evidence to support that , why is the other driver not there to testify if they are discussing the accident, why was Danny not breathylised ? weird

I believe that was part of the suppressed evidence. Prosecution didn’t provide discovery by deadline and all evidence not provided was suppressed. I believe this was one of 3 cases the prosecution did this on. And judge sided with Larry on suppression but declined motion to dismiss.

The other lawyer sounds like lawyer on the show, "Longmire". He was a big butt and kept asking questions the same way. Hoping to mess up the defendant.

Most people, including prosecutors apparently, confuse Acceleration Deceleration speed and velocity. The first two are derived values. Acceleration is the rate of change in velocity over time and is analyzed by inserting the appropriate values into the formula dv/dt = A Deceleration is likewise derived D=vf-vi/t where f is the final velocity and i is the initial velocity and D is expressed in distance per unit of time squared Speed is a single component value expressing a magnitude with respect to time Velocity is a two component value achieved by expressing speed in units of distance with respect to unit of time² All of the preamble was given here to point out that as the directional component of velocity changes the magnitude of the speed component must ALSO change. Therefore the static speeds on the screen in court are meaningless unless they give direction and time at initiation direction at final (final velocity is 0 relative to the ground) and closing velocities of both vehicles. It is entirely possible for the closing velocity between the two vehicles to match, indeed in any situation where one vehicle passes another there comes a moment where closing speed is equal. If that moment arrives and one vehicle has not cleared the other then a collision will occur and the following vehicle will strike the passing vehicle in the rear.

Why wasn’t the women driving the F-150 subpoenaed to testify? I feel like her testimony is pretty critical? Along with the EMT’s who arrived first?!

Because you don't know what people may day.. they could hurt ot help your case and the attorney weighs the risk. The prosecutor may have not because they knew what they wpukd say and it may hurt their case or they figured they had enough evidence to convict without them.

Honestly, I’m having trouble understanding how car a going faster than car b and moving into b’s lane hits b unless the side of a hits the side of b. OTOH, the prosecution story had car a going 75 and b going 100, yet has a overtaking b. Maybe should have prepped defendant a little better on the particulars. There’s also the fact that the specifics of the accident have no evidentiary value in determining his sobriety or intoxication.

Uk if you are involved in an accident and the airbags go off the police have to make sure you go to hospital and checked to see if you have concussion. No stupid line dancing follow my pen stand on one leg. They will stick a breathalyser in your mouth and you blow if it is below the drink drive limit off you go to hospital above they take a blood sample at the hospital. That is the end they will then work out who was at fault for the accident and issue tickets.

Prosecutor in this case seems like he's used to getting his way is frankly offended and perturbed that this big city lawyer didn't just have his client agree to the plea deal so it really put him out to have to try this case.

There are actual accident investigation experts who can tell by skid marks, etc, how fast people were going. If the prosecutor wanted to try to prove that then he should have gotten an expert. I'm not trusting some rookie cop to just take a gander at it and say, "Oh! Must have been going 100!".

The prosecuting attorney is an idiot. When you pass someone you very often times speed up. When you get past them you slow back down to the speed you were going. This happens thousands of times daily all across the country. If the guy passing wasn't paying attention, he could have thought he cleared the car and started moving over too soon.

The truck driver could have accidentally disabled his cruise control and not realized he was slowing down. That could also explain why he cut off Mr Faulkner. I can't count the times my cruise control was disabled by accident. You look down and you've dropped speed without realizing it.

@@Valerie_Dawn he/she also could have been "manually" increasing speed to pass Mr Faulkner, and then upon letting up on the "gas," speed dropped back to the cruise control setting which MIGHT HAVE BEEN under 70.

I don't think it was ever proven that the other vehicle actually had cruise control on either. I think the prosecutor said that, but I don't know why it's apparently assumed. Maybe the other driver told that to the officer and it was in the report?

​@@TylerWx💯 this. Cruise control has been on my vehicles for decades now. But after the first few months I decided I don't like it, it doesn't seem safe and it's just another thing to not pay attention to driving. I never use it and haven't for decades. Just another thing I'm forced to pay for on a modern car. Guess it must be good for resale, but IDK if it even works. I have also never had a vehicle lock up with ABS. My daughter races SCCA street class, so she knows. But I do not.

Well, I see things like this happen sometimes, but when someone is coming into your lane, IF they're already ahead of you, while going FASTER than you, how is that "cutting off" really? You're not going to hit them unless they slow down suddenly. Otherwise, the distance between you will increase over time. Now, if they start coming over before being in front of you, that's a different story. But if the... defendant?... actually hit the truck in the rear, not the side, then the truck must have slowed down. But just because the truck WAS going 75, doesn't mean it continued to go 75. It is pretty common for people to slow down after "passing." That is by far the most likely scenario.

At the point where he was describing the actual collision, I noticed something. The prosecuting attorney did not ask if he saw that the vehicle slowed down. Now, I have seen plenty of accidents in my time where somebody does cut you off and in the process of cutting you off, they do slow down, which means you could possibly rear end them or make contact with the rear quarter panel of the vehicle in front of you. And yes, that could be considered an unintentional pit maneuver, which would also allow the vehicle that was merging over from the left to suddenly be facing the other way, and it would also drag the car that collided with it One Direction leading into a collision with a guard rail on the right. if you can visualize it the way I do, it’s pretty easy to see how this can come about.

I have been in bars and dance clubs and never touched a drop of alcohol and I came out smelling like alcohol because people tend to spill drinks on chairs, tables, other people and themselves throughout the night. The prosecutor went fishing without any knowledge of bar scenes nor any knowledge of how idiots cut people off on highways every minute of every day. Sometimes accidents occur and many times no accident occur. Just because someone WAS going faster than you and then cut you off does not negate a simple FACT that they could have slowed down in the process of cutting you off. You cannot ask someone to "speculate" as to what the driver that cut you off did in the process of cutting you off beyond what your eyes have seen. Then add to that when cops make their reports they can also get things mixed up and write down something that did not occur or write it in a manner in which gives a false representation as to what occurred. This is one case where a dash cam would have revealed it all.

If the judge instructs the jury that guilt must be proven beyond reasonable doubt, the verdict must be innocent. Because there's reasonable doubt that the defence witnesses are being truthful enough. And it's a one rookie cop's word, based on his personal opinions against the word of 3 people (that know each other). There's reasonable doubt that the rookie cop's arresting process was: there's been an accident, the party that told me their version of events first is the party I'm more inclined to believe (which may have included them saying that they thought the defendant had been drink driving), the driver of the other vehicle smells of alcoholic beverages, I'm going to arrest him for drink driving. And then after that, it was a case of doubling down on his arrest.

At the end of the day, if the degendent was driving at 100 mph, he would not have been there at that time. Also, if the 3rd party was driving at 75 mph, he wouldn't have been able to undertake another vehicle at 100 mph. The prosecutor is a moron.

I experienced the "impossible" while in the far right lane I had fresh green at 40mph. This dipshit in a company vehicle, made a right turn blowing the his red light. I ran into the back squared up with bumper. My truck light bar/ push bar bent in the body, off road lights fell off, i missed damage, till i was under my truck, why i didtt call LE, I put hazards on gestering to pull over. He refused to, started driving reckless / wanton on sidewalk, center median Island to lose me cause I was honking, lights, not aggressive. I got picture of the rear of van, plate, company and terminated my pursuit. Contacted company headquards, they sent it to local office. His boss contacts me saying I'm committing fraud, liar, doing 60 mph in a 40mph. I asked for their insurance and legal contact. Refused... Telling me it's my fault, just trying to get money cause covid, and contact my own insurance company. -Running red light, -Hit and Run, -Failure to Yield, -Ran another red light to attempting to lose me, -Driving on sidewalk,

Really could have used a good answer to the 70/75 speed. As I see it, the defendant can testify to what they did and saw but they can't really confirm that truck was going 75. It also sounded weird that everything was a statement of fact until questioned about the field sobriety tests where it quickly changed to "I do not recall".

...likely can't recall because this wet behind the ears, all by himself rookie cop was trying to talk to him while on the side of an interstate, while paramedics were running around and he's worried sick about his wife. That's also assuming the cop's telling the truth and actually asked him.

That's what you do for your living? ... ?" would really pi$$ me off as a Juror ... Why didn't you spent more into "So you where a professional driver? Having seen a lot and know of the responsibility of driving sober?" and into his career change to an even more responsible area (maybe working with asthma-kids?) ...
