ST. ANTHONY - Boise attorney John Prior has filed a motion to withdraw as counsel in Chad Daybell’s murder case because he says he isn’t qualified to argue a death penalty case and his client can’t pay him.
Prior has been Daybell’s defense attorney since May 2021 after a grand jury indicted Daybell and his wife, Lori Vallow Daybell, on murder and conspiracy to commit murder charges for the deaths of JJ Vallow and Tylee Ryan - two of Lori’s kids - and Daybell’s first wife, Tammy Daybell. Chad is also charged with two counts of insurance fraud in relation to Tammy Daybell’s life insurance policies.
“Mr. Daybell does not have the ability to pay for counsel‘s continued services and Mr. Daybell seeks the appointment of two capital qualified attorneys to represent him in this matter,” Prior wrote in a motion filed Thursday afternoon. “This motion is made with Mr. Daybell’s full consent. Mr. Daybell has requested from me that he be given two capital qualified attorneys for his trial.”
Prior noted the complexity of the case would require him to work “around the clock, more than full-time for more than four months without compensation and without the assistance of any other counsel.”
“I have made a diligent effort to find a lawyer to assist in this matter for a significant amount of time. The attorney who I located and agreed to try to get qualified has not yet been approved by the Public Defense Commission. The time for him to be of any assistance to me in preparing for this trial is long gone,” Prior wrote.
Prosecutors filed their intent to pursue the death penalty in Daybell’s case in August 2021. Prior has solely represented his client since being hired over three years ago.
Jury selection for Daybell’s trial is scheduled to begin less than three months from now on April 1 in Ada County. If District Judge Steven Boyce grants Prior’s request to withdraw from the case, new attorneys would be appointed and there could be significant delays in the trial start date.
“After speaking with Mr. Daybell, I have confirmed that he is unable to pay any additional funds, and he believes it would be a disservice for me to continue to represent him in a capital case and trial without compensation,” Prior wrote.
Lori Vallow Daybell was found guilty and sentenced to life in prison without parole last summer. She is currently in Arizona on charges of conspiracy to commit murder of Charles Vallow, her fourth husband, and Brandon Boudreaux, her former nephew-in-law. Once court proceedings are done in Arizona, she will return to Idaho to serve her life sentence.
A hearing on Prior’s motion to withdraw is scheduled for Thursday, Jan. 18 at 10 a.m.

He’s been complaining and giving lengthly discussions with whining during these former appearances. Why didn’t he bring this up as a serious concern back then instead of going on and on about what the Prosecution supposedly didn’t send to him to fully prepare. This will be very also very interesting to see what Prior will do with Daybell’s house and land which he also has obtained early on. To me, that property involving those bodies - Tammy ‘s , JJs and Kylies that property should have been closed off and PRESERVED for further criminal investigation purposes and poses a huge conflict of interest for this particular ONGOING case.

Doesn't matter ,he shouldve removed himself a long time ago if he wasnt qualified. Now he's not only sucked his client dry of funds and continued the court case for God knows how long, but he's now opened a whole other can of worms possibly leading to Daybell being allowed file motions that he was deceived by council and that his constitutional rights were violated because of it , blah blah blah blah blah....what I want to know is why didnt a judge find out if his counsel was dp qualified from the gate. They would have had to appoint dp qualified public defenders if he couldn't have paid for his own attorneys. So who dropped the ball? This guy never shouldve been allowed to proceed as Daybells attorney to begin with. These cases are just infuriating! I'm beginning to realize that justice is just another word, it doesn't mean anything more than the word "the" means ffs! The complete lack of ethics by this attorney, coupled with an irresponsible and negligent court system is just mind blowing. This country is toast!

He's had 4 years to prep and has done nothing but complain he doesn't have enough time the entire 4 years! He took Chunkface for the ride of his life and now wants out? He saw all the evidence from the Lorihoe trial and knows Chaddie Boy doesn't stand a chance, imo.

But he waived Speedy Trial, so if the Case is further delayed while the new Court Appointed Death Penalty Qualified Attorney gets up to speed on the Case, that's on Chad and should have no bearing on the charges or penalties the Prosecution is going for. What's another delay? It's not like he's going anywhere in the meantime.

Thanks for covering this, Nate. I think the judge is partly to blame for this. All the postponements already! He knew it was a DP case, yet when Pryor couldn’t qualify, he didn’t appoint a DP attorney to work with Pryor and he let Pryor continue. This needs to stay a DP case. I think Pryor is just trying to get the DP off the table. He obviously knee that Chad had no more money long ago.

Prior knew this was DP case from get go! He should be barred from practicing law in Idaho for unbecoming behavior. He’s been on this case since the beginning , has hsd all the information, has delayed, delayed ,and whined. Now Chad has no money n he fears losing, he want to quit? This is not justice, this is fowl waste! This is being played as a fools game. Judge should have ordered sniff attorney to assist him previously. Chad Prior and Judge are derelict in this case. As long as he sits I. Jail, it’s insulting our state and the memories of the children, and Tammy, and families of them all.

The trial is set for April and now all of a sudden he's like: "Oh wait I can't defend him, because I'm not a death penalty qualified attorney." Are you serious? He knew from the beginning, that it was a death penalty case.😒

He will. And that's the whole point . It's what Prior is counting on. Judge denies motion ( because of Idaho rules ; lack of money -not accepted for reason of recuse ) The only way now to keep this trial on course - is for Prior to remain on the case which in turn , the judge would need to drop the death penalty.

It’s like a chess match. State/court should tell them the only way to remove the death penalty is if Chad pleads guilty and gets LWOP. Prior needs to stay on without pay until he’s sentenced. The victims will not have to wait years for new lawyers to be able to represent him and Chad will need to confess to his children that he is a murderer. Prior is the lowest form of lawyer there is.

Unfortunately some Attorneys don’t like to take on Death Penalty cases, especially if they our not DP certified they our much tougher trials .. And with a much higher conviction then Non DP trials .. This Attorney in my book should be Disbarred , He’s wasted way too much valuable court time .. but because he was privately Hired by chad himself, and obviously saw 💰💰💰💰💰signs in his Greedy eyes . But he’s obviously realised he’s in way over his head very very bad .. Behaviour by this Attorney. There is no way any Attorney would look at chad and not know he’s facing the Death penalty if convicted

It's their way of getting the death penalty removed, no doubt about it. They remove it and he stays on and the case goes forward. He and Chad seem to be playing a little poker with the court. He already owns Chads house and bank account. I wasn't looking forward to hearing his complaining tone for 8 weeks but this is absurd, he's had almost 3 years to put this together and now says he's out of time? He should go back to chasing ambulances and let the big boys take over.

He’s doing this to get the DP off the table. I say let him go. Provide him a new lawyer . I’ll wait a year or how ever long it takes to hear those words chad daybell is no longer with us. I realize with appeals that would be quite awhile. But for chad daybell everyone of those days waiting will be horrific. Those children deserve no less than the DP.

He was diligent during Lori’s trial by attending every day and taking copious notes. I was wondering where that $$$ to pay him was coming from [his wife’s life insurance. policy (did it pay?)]?

This is unreal. If JP wasn’t qualified for a DP case, why hadn’t that issue been addressed by the court before now? Also, isn’t it unethical for an attorney to take a case he isn’t qualified to handle? What about Tylee’s remains? Her remains weren’t being released until after Chad’s trial is what I understood Nate to say when J.J.’s were released. Chad needs to man up, plead guilty and just go away. At least then, poor Tylee can be laid to rest.

We all knew since he was hired he was NOT a DP lawyer... I believe they thought He could afford him once DP was taking off table for Lori...( thought he would get same treatment) If Chad had more money, he could hire a DP lawyer... This is a money issue ONLY... Prior ownS Daybell house, he needs money for investigators, an extra trial that comes with DP... Money issue!!

Agreed! Chad accepting a plea deal would certainly save the court system , attorneys, & fam a whole lot of wasted money . He would likely be offered life in prison with no possibility of parole - in exchange for dropping the death penalty..& his signature , & verbal " GUILTY" plea . Why waste all this time playing the game ... years of wasted time , attorneys fees, prolonging the emotional pain of the families who need closure .. when in the end, one way or the other - Chad Daybell will be found guilty - beyond the shadow of a doubt .
