Barry Bend On one hand, I commend him but I could also see that he doesn't want to get in between the mouse, Marvel and Scarjo because their legal fight is getting really ugly right know with the outcome uncertain.
Uh, you DO know that he could have been sued if he went ahead? It's not worthy of respect, he's doing it so he doesn't lose his job permanently, and get arrested himself. Those that don't get prosecuted. At least in North America.
@@Slitheringpeanut judges are largely elected in America, difficult to ignore, and nearly immune to lawsuit. The only risk staying on the case poses is the chance for appeal.
@@Rainsoakedcoat there nearly immune to lawsuit FROM CIVILIANS other judges and the BAR and Courts can sue a judge out the ars and get them disbared for shitte like conflict of intrest unlike in the uk were judges are mostly unelected and untouchable shown by the JD vs AH case were the judge had a massive conflict of intrest and blatantly favoured one side and ignored all presented evidence to the contrary and not ONE judge admonished him to the point he was allowed to deny the appeal HIMSELF.
@@sygmarvexarion7891 Disney like all companies buy the press so they don't need to fear it that is why we fans always attack by keeping awe wallets closed the day Disney goes broke the day the truth wins.
No, the judge is (probably) corrupt regardless. He recused himself because the media would have found out and that would be more even bad press more Disney.
@@briankulesz9410 You are not... wrong. There is a very large possibility. But at least we are not seeing a blantant case of biased like the JD and AH case.
You know... That's actually kind of admirable. He couldn't let his bais sway his opinion and he quit the case. I've seen a lot of judges who has ties to one side still proceed over the case and always in the favor. I'm pretty sure he'd be found out he was working for the mouse and would probably wanted to save his ass, but still, at least he's not going to make things worse I suppose.
@@cavemantero Complaining about someone doing the right thing is perhaps the worst habit. You're just saying that people should never get credit for anything they do. If that's the case, then where's the incentive of doing right? Everyone will just do wrong because at least they'll get something out of it.
@@cavemantero Which is exactly why it's admirable, because otherwise the system would've been fucked up, and too many scumbags out there are content with doing that instead of doing the right thing.
Is that really a thing in the US? Here in England judges always recuse themselves. If they don't it's a surefire way to get criticised by an appeals judge.
Ah... nothing like a conflict of interest to mess up a lawsuit. Good thing he recused himself before the trial. This could have gotten very messy if this was found out afterwards.
I wonder if Disney did this on purpose, hoping to use him to get an easier win. At this point, I will not be surprised by what lows they are willing to sink to.
@@RobertWilkinsonJKekMaloy Including putting off Final Fantasy involvement in a Square-enix×Disney collab until DLC is-a involved, i.e. Kingdom Hearts III Re:Mind
I'm pretty sure the anti-retribution clauses are meaningless in most countries, you can sue anyone for any reason, it's up to the courts to decide if you're worth hearing. No matter what wavers you've signed if you can prove negligence or wrongdoing then you can win a case.
Disney: here's the new contract, go ahead nda sign it talent: what with this line about the option of not paying me at all? disney: don't worry about it just sign unless you don't want to work with the all powerful oz
The Japanese have the best expression for this -- "Ah, so!" Roughly translates to "Is that right?" The nepotism and cronyism continues unabated in popular entertainment. Nothing new to see here, folks!
People should start suing Disney, Hollywood, Activision, EA, Naughty Dog, Marvel, DC, and other US companies for advocating misandry and misogyny since that is also happening towards fans and customers.
@@steellegion7054 I wouldn't be surprised if Naughty Dog has employees complaining about sexual harassment to other toxic topics in the work environment, Why I think like that? Well. I usually find a pattern of people to companies that say too often about promoting such equality with gender orientations to minorities like they are hiding something. Look what's happening to ActiVision-Blizzard.
@Jax Teller Can you argue that she wouldn’t have had future movie deals with Disney? And now that she has been black listed by them, that it won’t be hard for her to get future work with other studios? It’s a hypothetical question, I know you can’t.
I have mad respect for a judge that has integrity,is based, and will do the right thing when there is a conflict of interest, too bad a lot of judges aren't this way
The judge stepping down because of a conflict of interest isn't a big deal. It would be bigger if he/she didn't step down and people found out there was a conflict of interest. If a government employee did that there could be serious consequences. You would be lucky if being fired was the only thing that happened.
You can't write breach of contract out of a contract it would be a self-defeating clause. You can have established penalties and contingencies, but you can't say, "but we can do whatever we want, and you can't do anything about it". Because that fundamentally does not meet the requirements of a contract.
Most judges with recusal problems with huge companies would probably just let it ride and hope their masters would protect them. This case must be such a revolving door of instant-loss for Disney that even their own protections aren't enough to keep the courts crooked in their direction. He might have been more afraid of what it could cost him than honorable to take this action. I bet Disney had some secret hopes pinned on him from his service in the past. Of course, now they'll just find an easier Judge to work with and buy off during the trial instead of long before.
You know.. It's sad that anything related to the courts and judges are always thought of as negative immediately especially in cases such as this where the Judge very well could have been honorable and chose to leave out of honor of law. It's just such a shame how negative and corrupt the courts have gotten.
That's nice, clean out some of that Disney corruption. Though this is probably one of the few people with integrity if they are passing it on of their own volition.
That judge had no integrity. What we do not know is, how long did the judge have to recuse himself? Was it the moment the case was assigned to him, or did he have time - hours, days, weeks - to decide for himself to do the recusal, or was he asked to step aside? I have no faith in our justice system and this smells badly. Time is the biggest problem we have with our 'justice' system, and here we go again, a time issue.
Disney already settled with Emma Stone who was considering her own lawsuit. At Warner Bros.,they struck a deal with Jason Momoa about Aquaman 2 and HBO Max.
The movie contracts in the future will now say ''This movie will go on theaters, but if there's another pandemic or world war 3 or the second coming of Jesus, the movie will go on streaming''.
*The judge did the right thing here for sure. That being said Disney will be playing every single trick in the book that money can buy to ensure that they win this very high profile court case that everyone will be watching and following. If you don’t think that Disney was behind this change then you should! It’s highly likely that Disney decided that they wanted a different judge on this case, one that is more supportive of Disney. They likely planned this strategy out and paid a bunch of cash to the players involved, knowing exactly who the replacement judge will be. They came up with what appears to be an excellent excuse for the judge to step down pointing out his previous relationship with Disney. Guaranteed this Judges background was never an issue until Disney wanted it to be. Literally one of the most powerful corporations in the world will be spending whatever it takes to win this landmark case because it will determine other cases that follow.*
This is the first time we've ever seen a judge voluntarily leave over a conflict of interest, at least in the past decade or 20 years. Every notable celebrity case going on, we find out the judge either had "dinner" the other night or literally works with a family member with a defendant and it gets totally brushed off as a non-issue.
That i think is the first time i have heard of a high profile case involving a potential bias where the judge has removed themselves and good on them...more need to do that
This is a common thing Disney hires pretty much everyone admitted to the bar in ca to draft some basic docs etc This makes them able to conflict out a huge portion of the lawyers in ca
I hate it when parties draft contracts that include clauses like "we reserve the right to change X, Y, or Z at any given time and by signing this you forfeit all rights to complain about it".
I think that if ScarJo had gone the arbitration route per the terms of the contract she would have gotten some money, and a sequel. Now she will probably get no money, and probably reduced future opportunities.
I don't think it's the end of the rich movie star but it is probably the end of the stars getting a percentage of the box office as media will be delivered multiple ways in the future.
the judge made the right decision. i think he knew getting involved would be bad for his career so he stepped down which is respectable. though if i was an actor and saw the way they treat scarlett johansson i would probably not go work for them in fear or being retaliated against and i feel that might be what happens to disney if they keep doing this. burn too many bridges and there will be no more bridges left to cross or people that want to cross them. without talent your product will decline and in the end will hurt everything.
at this point Disney shouldn't be allowed to hire anyone under 18 and have their legal contract conditions leaked the same way copyright contracts are documented online. For example, a Vtuber has to disclose in their contract if they work for certain companies that they do not own their character if they didn't make the character prior to being on the show. Disney at this stage needs to be put on similar light. Or in the very least someone needs to grow a pair and speak out when stuff looks shitty. The only way companies get away with abusing their authority is if nobody says anything.
Disney HAD a star with big draw power . . . initials are JD. With the popularity of a variety of other media, it’s going to be more difficult and longer road for an actor to become a big international star. The money for Hollywood is drying up, contracts are going to reflect that.
When the contracts were made originally nobody expected theaters to be closed for so long. This has made me choose to not see black widow at all. Or any Scarlett Johanson movie ever.
As a person who study contract law before Disney have a less than 50% chance of loosing because nature aka covid had somehow alter the situation but since the park and some cinema are open and the other party did not been inform there still hope
