Knives that are prohibited in Canada (for no good reason)

The videos talks about the following types of knives which are illegal in Canada, and why these prohibitions make little sense:
- Automatic knives / switchblades
- Centrifugal knives (e.g. flick knives, balisongs)
- Gravity knives (e.g. a certain paratrooper knife)
- Finger rings with blades
- Push daggers
- Blades concealed in everyday items with a length of less than 30 cm
- Knives with brass knuckles / knuckle duster handle (e.g. trench knife)
Source:
www.cbsa-asfc.gc.ca/publicatio...
laws-lois.justice.gc.ca/eng/ac...
A practical examination of these types of knives quickly shows that they pose no more threat than a kitchen knife. Regular folders and assisted opening knives with torsion bar open just as quickly as a switchblade and are even faster than a balisong (butterfly knife). A fixed blade doesn't even have to be opened at all and is still easily concealable.
If you want to see these arbitrary laws changed, contact your local members of parliament: www.parl.gc.ca/Parlinfo/Compil...

Not to mention -- if someone actually wants to kill someone else with a knife, their top choice would probably be a big, sturdy fixed-blade one (either because they had time to think about it and picked one, or because they _didn't_ have time to think about it and grabbed a kitchen knife), which these laws don't do anything about.

Yup. Bicycles were banned from sidewalks, because a few idiot bike couriers, in downtown Toronto, kept weaving in and out of traffic and sidewalks, causing accidents. So, bicycles are classified as ''vehicles'' and are required to be on the road, despite not needed a drivers licence to operate. And recreation biking is ruined for all of us. Makes total sense! Why just ban bikes from sidewalks, in certain areas, when you can just ban them EVERYWHERE? See that little kid over there, riding his bike with training wheels? He's a vehicle and belongs on the road, because he's a danger to pedestrians! That motorised scooter is fine though. Good job, law makers!!!
@TheActionBastard

Heh. If only logic and facts were of any use in law making... but until we all stop choosing morons as leaders I feel like we're stuck with this shit. Fortunately I am from the USA and still have my gun and my big ass knives (because Texas... don't go to California...) but as you can see it's clearly not a certainty for the future. Given the ability to manufacture a gun from a few machine tools (and a 3d printer if you like fancy tech) I just sort of scoff at disarming myself. Criminals give no fucks guns are illegal.

In Arizona, not only are any and all bladed/impact items completely legal, it is also state law that no individual city/county/town may ever make any kind of law that would criminalize any person carrying such a weapon in that district (yes, the state law explicitly overrides all individual county knife laws). The purpose of this of course was to prevent cases where a law-abiding citizen was travelling around the state and inadvertently broke the law when he/she entered a county with different knife laws... which of course is a case far more common than the case where a murderous psychopath went on a terrible rampage with a CONCEALED SWITCHBLADE OF LENGTH LESS THAN THIRTY CENTIMETERS. Needless to say, I agree with said law.

@@shutupshutup2713 uh, I don't know what country you live in, but here in Canada we don't have people being regularly killed by knives and therefor your argument about "defending yourself" seems hollow. I would argue that injury and deaths from violence go up with increased possession of weapons. The USA is proof of this. Things don't generally get banned or restricted out of the blue. Usually there is a series of injuries or deaths that predate the legislation. Lawn darts is an example. We can argue about the numbers of incidents required before restrictions are necessary. I'm a firm believer that that number should not be zero. Trying to protect from everything seems silly. But there is an incidence rate above which doing nothing is not the answer.

This is entirely speculation and heresay but back when I was a kid in Canada in the '70s (yes I'm old) and collecting knives. I asked a local dealer why "switchblades" were illegal and he said some politician's son owned one and accidentally discharged/sprung it open while in his front pocket and cut his femoral artery and he bled out and died in seconds. In response The father passed a bill banning switchblades. Also, the reason "butterfly" knives were banned is because back in '70s they became quite a fad and a lot of guys in high school were hurting themselves badly trying to flip them open like in the martial arts movies of the day. Ya, knives were a thing in the '70s. A buddy of my'n growing up was First Nations (trying to be politically correct about this, no offence intended) and he said he wanted to become "blood brothers" with me. Not knowing what that was, I said sure, he took out his knife and sliced a big gash in my hand. Then he sliced his open too then he grabbed my bleeding hand and held it in his as we both bled. Apparently, it bonded us for life. I still have the scar and that was 40 years ago!! Jimmy if you're out there? I'm still your brother LOL!!

Well for those interested, if you thought that knife laws in Canada were bad, well they just got worst! I just came of the phone with a CBSA officer regarding another of my knives that got seized (the 4th or 5th in 5 months!). This one was the Twosun TS40 that I bought on Ebay for about $40. If you look it up, you’ll see that it’s a regular titanium flipper, nothing special about it. I thought that for sure this one would not be seized since it cannot be open by centrifugal force (I have a friend that has one and I checked). Now, the knife runs on ball bearings and is extremely smooth. So when I inquired to why the knife had been seized, I was told that it falls under the classification of automatic knives since pressing the flipper tab leads to the blade open all the way into the locking position. I mentioned to him 2 points that were mentioned in the Memorandum D19-13-2 which is the laws for importing weapons which I am sure you are aware if you are watching this video. 1) Section 21-a states the following: An automatic knife that houses a blade that will open automatically by hand pressure applied to a lever or button in or attached to the handle (but not on the blade) of the knife. I mentioned that the flipper tab is attached to the blade and not the handle and therefore it is not an automatic knife 2) I questioned about torsion assisted flippers that are perfectly legal (as stated in section 22) and the blade deploys into the locking position when the flipper tab is exercised To my surprise, I got informed that the Memorandum had just been revised as of yesterday (November 3rd 2016) to specifically address these 2 issues. Here’s the new revised paragraph on automatic knives (now section 18 a): (a) Automatic knife - An automatic knife is one that houses a blade that will open automatically by applying hand pressure to a button, spring, lever, or other device, in or attached to the handle of the knife, including knives that have a button, spring, lever, or other device, located in the spine of the handle and attached to the inner part of the blade. Note: Knives that have a ‘thumb stud’ attached to the blade of the knife, that is independent of the handle (not protruding from the handle in the closed or folded position), and that open automatically by applying pressure to the thumb stud, do not generally meet the above definition of a prohibited weapon, and as such do not generally fall under TI 9898.00.00. However, if such a knife is found to also open by gravity or by the application of centrifugal force alone, it may still be considered to be prohibited. The misuse of knives may nonetheless be punishable under other laws. So now it specifically targets regular flippers as well. Also, the exemption for torsion assisted knives has been removed so they will fall under this category as well. Here’s a link to the updated Memorandum www.cbsa-asfc.gc.ca/publications/dm-md/d19/d19-13-2-eng.pdf So now, basically 95% of flippers (at least the good ones that can flip) will be illegal to import into Canada. - If the detente is too weak, they will fall under the centrifugal law and be seized - If the détente is good and strong so the knife can actually flip, they will fall under the automatic law and will be seized. This is pretty ridiculous and sad for Canadian knife collectors. You would think that there would be better uses for our taxes money or better ways to fight REAL crime than doing this. This will not change the crime rate by any mean, the only thing it will do is penalize knife enthusiasts in Canada. Also with existing stupid knife laws in many countries for decades, you would think that over time, things would get better, not worst! We’re stepping backwards instead of stepping forward.

The memorandum just means that the CBSA will block them from coming in if they see them, not that they are illegal. As long as the criminal code still says the original description, you could fight it easily in court if they chose to charge you. The CBSA can act like any municipality and add further restrictions on an existing law, however if you ask the seller to tighten the pivot as much as possible so that CBSA cant play with it and open it without altering it, it should go through.
@bdpf1744
@bdpf1744 7 лет назад
Yes, I understand that it is not the law, but unfortunately, CBSA are the ones deciding if something makes it Canada or not. They interpret the law as they wish and have been blocking a lot of knives that are perfectly legal in Canada. Up to now is was mostly knives with weak detente considered "centrifugal", now they are also targetting flippers. The last one they seized from me was a regular flipper and was seized under being automatic. When I called, the reason they gave me is that if they press the flipper tab and the blade opens into the locking position, then it's an automatic :$ As for "you could easily fight them in court", I am confident in saying that you never tried. Of all the research I have done, I haven't been able to find a single case of someone winning against the CBSA, and believe me when I tell you that there are hundreds/thousands of cases. Every time I spoke with a CBSA officer and tried to explain things in a logical way, I got nowhere. For tightening the pivot, I agree, this will help getting quite a few of them through. However, some of the ball bearing flippers (usually the better ones), they are smooth enough that the blade will still flip all the way even with the pivot tightened to the max.
@Riyame
@Riyame 7 лет назад
I suppose if you knew the seller you could get them to open the knife up and add some kind of washer or shim so that the bearing/blade does not move freely and then tighten it down. Then just take them out once the knife gets to you.

I think the reason behind a lot of our rediculous laws here in Canada is because we are a nanny state. Healthcare may be great but it comes at a cost. To keep healthcare affordable the government feels the need to restrict certain things deemed a harm to others or the person using it. More trips to the hospital because of negligance = more money being shelled out and the money has to come from somewhere (our taxes) so basically everytime someone goes to the hospital we all pay meaning that in order to keep costs down and people from getting pissed about taxes they think that restricting peoples accesibility to certain things will prevent accidental injury. Sorry if I can't explain it that well I'm half awake haha. Healthcare here in Canada is a blessing and very much a curse and really doesn't matter in the end because what an American would pay in medical we already pay in taxes and everyday cost of living here (things are more expensive here blah blah blah) It's a tough call I think whether to have "free" (notice the quotations) healthcare or not.

State health care is like having life insurance, except you don't have to fight tooth and nail with an insurance company to get them to cover something. Both ways cost money, but one way is easier and you have the government on your side, keeping costs low. Medical companies can easily walk all over the little guy and gouge him for medical costs, but they have a much harder time ripping off the government. Also, I've seen plenty of cases of Americans being unable to work, because of injuries or health problems, and then can't cover their medical costs, because they can't work. They spend the rest of their days fighting for disability. Those same people would have been covered in Canada, been treated, and eventually been able to return to work, to live out normal lives. The difference is, that with state health care, you are not completely screwed if you get sick or injured. Also, there is no excuse to live on disability your whole life (for some), when free health care is available.

WELCOME TO THE NETHERLANDS: You can own a metal baseball bat, but you can't own a butterfly knife. Did i metnion you can own bowie knives with a blade length of 30 centimeters? But a butterfly knife, no, people use those for stabbing. But who stabs someone with another type of knife, right?! xD Also, we should not ban cars, even though, if you want to, you can kill dozens of people with it, without any chance of them fighting back. ... When people view something as a threat, people become scared, those people teach their kids to be scared, and they become terrified, those in turn teach THEIR kids, and when they get to power, they ban everything that scares them, without any other reason than doubtful statistics, as a half-assed solution.

as a Canadian, I can tell Americans who think this kind of shit is absurd that it aint just a Canadian thing . Some years ago i was in LA at a Martial arts specialty shop (sherido on Pico, i think, before it was burned down or moved because of the riots) buying some Okinawan made Nunchaku for my Dojo display back home. The guy told me to keep them in the box, it was a felony in California to carry them but if caught with a unregistered handgun it was only a misdemeanor.

The problem with these absurdities is that if legislators start addressing them, they're more likely to make the laws even worse. They'd rather ban something that was legal, than legalize something that was banned.

I mean, it does not affect me personally, but.. just because I don´t want to own a gun, it does not mean that I want to see them banned. The reason why the automatic knife and the ballisong are banned is because those particular designs have become so famous (because of movies) they are very desired by teenagers. In France they at least found a a "good" reason to ban switchblades: they banned all types of knives that have a blade that flick open with the help of a spring (that of course includes assisted opening knives). It is apparently for "safety" reasons, even though you are not allowed to carry a weapon of this category on you and you have to transport it in a bag and have a good reason to transport it as well. FUN FACT: In France it is an absolute nightmare to be a weapon hobbyist because you need a lot of licenses for "safety" reasons. BUT a french citizen is allowed to freely buy gunpowder and store up to 2kg of it at your home (which is way more than enough to kill you and blow up your house). So yeah Your laws actually make more sense than ours, Canada!

Tyler Lalonde "no one will grow some balls" yup that's how France works unfortunately. Only the youngest of us (university students mainly) know how to properly conduct a protest or sign a petition. Weapon hobbyists and hunters being a strong minority and mostly pretty old they don't ever say anything they just silently let the laws through.

Why not instead of making these "weapons" illegal, educate people in their use and defense against them? Seems kinda silly since (in my opinion) many "weapons" are tools. For example, these knives that were shown, they look like tools rather than a weapon made to kill, to me.Then again, I've seen someone cut their meat with a sword, which IS a weapon. That was an amusing night. Anyway, education in my opinion is the way to go.

This is the same argument I present to either side of the American gun debate. I was taught as a kid that the second you do not respect something that can potentially harm or kill you, you are gonna have a bad time. If the U.S. passed a law mandating that I take a required firearm/blade safety training course to keep owning them, I would do so gladly. Hell, I may even learn something.

The only thing I can think when looking at the list is they were attempting to ban piercing/stabbing optimized knives. The most common iterations of the banned knives have a dagger style blade (which shows the differentiation with the Ulu knife as it's often a crescent blade). I suppose the idea being that dagger style blades don't provide any inherent benefit to legal uses of the blade

Nice vest. Here in Alabama USA, there are no laws prohibiting what weapons you can have. There are however four weapons you are not allowed to carry around town. First one is a sling shot, you know, the rubber powered kind. Why would that be banned? I have no idea. I looked into the history of it and there was none. Just one day this law was there. The second item is "brass knuckles." The definition is VERY broad here. Basically anything that fits over the knuckles. The definition is so broad that anything other than actually knuckle dusters would most likely be thrown out of court. The third item are cane rifles or shotguns. This is a very old law when cane guns were somewhat popular. You can throw a rifle or shotgun across your back and walk just about anywhere you please, just make sure it does not have a cane handle. Lastly, Bowie knives are banned to be carried around town. The definition of a Bowie knife is kind of odd though. To be a Bowie knife by legal definition, it must be at least 11 inches in total length, it must be a fixed blade, and it must be single edged. So you can carry a great sword all you like, but not a Katana. Sabers are out, but a gladius is fine.

I love blades, any kind of blades, and this since I was a young lad. I have collected over many years and own many swords and all kind of knives. However, while Canada is a great country, long outdated laws, interpretation of legislation, more and more of my knives being seized and the overall public perception about knives in general makes me want to completely stop collecting. Yes, I said collecting. While I always carry a knife on my person, I've never used it in any fight or used one with the intent to hurt anyone. I use them either as a tool or I play with them as with any collection. So why should I (and many others like me) be penalized? I wouldn't be penalized if I collected kitchen knives? What's the difference? Now, what is really the problem? 1) Outdated laws. Switchblades, OTF, balisongs, etc... all banned because of a bad perception of these knives introduced in Hollywood movies from the 80s. Anyone that has ever handled a balisong will tell you that it is probably the least effective weapon of all. As for the switchblades and OTF, I can open my thumb stud folders as fast as those. 2) While these laws are outdated for the particular type of knives mentioned above, IT IS THE LAW (unfortunately)! So really nothing I can complain about if I try to import one of those and they get seized.What really pisses me off is that, on top of these laws being outdated and making no sense, we have the CBSA, a bunch of way overpaid people, with very limited knowledge of knives in general, that consider themselves the country’s police. In fact, their knowledge of knives and legislation itself is so limited, that they misinterpret the written law as they see fit in order to ban whatever they WISH to ban.After all, they have a well-paid government job that they want to keep and if they don’t show results and don’t seize anything, then maybe not so many people are needed and they might lose their golden egg!One term that they love to use is the term Centrifugal knife, which makes no sense to me as I don’t believe the opening method of a knife should have nothing to do with how dangerous it is (because it is does, the most dangerous knife is a fixed blade since it’s always opened but those are legal).So basically, any type of knife that will have a weaker detent will open if shaken hard enough and will fall under this classification. That’s what they call their famous flick of the wrist. And let me tell you, some of these officers must have some very strong wrists. I’ve had some knives seized that I was able to export to the US. When later inspecting them, some I would have to try 2 or 3 times and shake them as hard as I could in order for the blade to pop out! And let's not forget that, in my experience, about 90% of the knives that can be bought in Canadian retail stores can be opened that way, but I guess those are legal since they are for sale in Canada! Then comes the knives with flipper tabs (my favorite kind of folder). I once called CBSA to get some info about their legality. The answer that I got was that flippers by themselves are not illegal HOWEVER, if when the officer applies pressure to the tab, the blade comes out all the way into its locking position, then it will be considered an automatic knife and therefore illegal.So now here’s the problem: If the detent is weak, they’ll shake the knife, the blades comes out, it’s a centrifugal knife, prohibited.If the detent is strong, they won’t be able to make the blade pop out so it’s not a centrifugal knife BUT, since more force will be needed to break the detent, then the blade will mostly fly out when it does into the locking position, therefore it’s an auto and illegal. 3) My last point is regarding the hope that you have the possibility to make an appeal.While technically yes, you can, I haven’t seen a single appeal being lost by CBSA. The tribunal will always rule in their favor no matter the arguments shown, so in reality, you don’t have a chance of an appeal. So to conclude a fairly long rant, Canadian knife laws are outdated, public perception of knives is wrong, CBSA interprets the law as they see fit, they have the power to ban ANY knife if they want to and there’s at this point in time, nothing you can do about it. Not the best place to be a knife enthusiast.

A butterfly knife isn't banned due to them being anymore dangerous in the means of crime but actually because when they caught fire and became popular loads of people bought them leading to increases (I kid you not they actually saw an increase) in ER rooms from knife related injuries (self inflicted) with fingers being lost etc. After they banned them the rates dropped significantly. This is a matter of public stupidity being avoided rather than crime prevention. . You touched on it briefly. It wasn't "sometimes" is what I'm getting across. The reason your analogy falls through is because a car is considered in the majority of cases as a necessity in North America. Imagine no cars. Butterfly knives are not. It doesn't affect society removing them it just affects collectors.

Furthermore even if you were to consider the point an exaggeration, which it is not, the rest of the point remains. I am not a fan of gun control nor am I of any type of control on a substance or device/tool. That being said the ban is not simply a random occurrence and it had reasons which one can argue for or against leading to its ban.

No that due to the playful manner of the blade inexperienced users were hurting themselves. Are you always so energetic to resort into Ad Hominem? If so sorry your life is so negative you flex your wit online too try and prove something. The fact is that due to the large number of butterfly knives imported in the early 80's in this time frame (I'm sure you can Google it somewhere to verify I don't have the specific dates) visits to the ER for self-inflicted knife wounds surged. As a non-necessity and a collectors item mainly the ban was seen to have no consequence on the general populace and was implemented which saw a decline in those same injuries. Unless you can refute those points I can't see your counter-argument. I would hope you wouldn't continue the bravado it's mostly uninteresting and I'm sure beneath you.

***** I think that it heavily depends on the area you live in how you see things here. For example : At my school they used to go at you as a crowd when they wanted to bash you .You don't have a fair chance of winning such a fight. I could very well imagine somebody being scared of getting hurt to an extent that it makes them use whatever they have on them. While that at first seems reasonable , you still have to keep in mind that the crowds consisted of students. They surely did something wrong ,but at the end of the day , I don't want them being at hospital with some mean cuts , bleeding like shit. Being dragged along into shit like that is relatively easy , especially for mentally weak people.

The issue here in NY is that the Assisted Opening bit isn't included in the law, so technically they can fall under the switchblade law because it deploys a mechanism in the handle. My fully manual knife can even be seen as illegal when its perfectly centered because it can be opened with a flick with they argue is centrifugal force.
