Isn't it ironic that now Kohberger is no longer an incel when he can't come into close contact with those women. At least not for a while and not to spend a normal life together. Before, nothing seemed to help and now when he finally gets women, he is firmly behind bars.

@@automnejoy5308: You’re absolutely right but you won’t convince some people of it, especially if they’re into silly conspiracy theories. The prosecutors can even ask the judge to include in the pre-deliberation charge to the jury that circumstantial evidence be considered equally with direct evidence. From what I’ve seen it’s pretty common.

I really like him too. But do you know why he stepped down as a prosecutor? Last I heard, he had a perfect (or near-perfect) record of "wins." I've seen clips of him arguing cases, and he seemed incredibly talented and dedicated (not to mention successful).

I think they have no choice but to seek the death penalty. This crime is so heinous with many victims, who were still almost children. Some of the victims' loved ones certainly won't agree to anything else either. And even though the death penalty is not used much in Idaho, one is being sought for Chad Daybell, so surely for Kohberger as well.

It will be 20 30 years before they put him on the gurney!! All their parents might not be around to see justice done! That's why lawd need to change how many appeals do they want? If a jury has voted him guilty and there is no doubt at all that he committed these crimes, why do we always give these criminals chance after chance? I thought the procecution said they are NOT using the sheets DNA in court. Defendant couldn't get "discovery on it" so since they aren't using it the procecution didn't want to put it in the discovery stuff Check it out.

He was starting his career as a serial killer like BTK & that was his major & profession of choice! Hes cold as ice & he stalked & hunted down his prey for months as I feel it was Maddie he fixated on but I feel Ethan & Xana were collateral damage as she ordered a late nite snack & saw him! Ethan broke his nose in fighting him off but was stabbed quickly thats why Xana was crying!! He wanted to get out of there fast & didnt see Dylan who can ID him!/This should be a DP case & his family is so quiet they know he did it too!! Get those rifles ready for a firing squad!! He doesmt deserve to go out easy!!!

@@AmiLouWho9495 very obvious when you see him. Look at video month before when stopped for no seatbelt - no broken nose! In mugshot nose quite crooked & eye slightly blackened. My BF got one playing basketball.I would bet my life Ethan got him with a good one before he was stabbed to death. I heard rumors on campus say he & Xana bled out that nite & her fingers were nearly cut off as defensive wounds & their blood dripped thru the foundation as they laid all nite Maddie was nearly decapitated & Kaylee gutted. I think he also killed & skinned Buddie the dog a week in October as a trial run. He's vicious & doesn't deserve to live!

I find it funny that a lot of people are claiming there is no evidence to convict him, yet here is an ex-prosecutor who says the evidence is "Overwhelming". There is also a grand jury indictment which doesn't indict willy-nilly. Though, I think life, no parole, is a worse punishment than death.

Whoever told you that prosecutors were infallible? Many innocent people have been accused and even convicted of a crime, but were later released because evidence emerged that they had been wrongfully accused/ convicted. As for the grand jury, they just give the OK for a case to go to trial, but they do not pass judgement as to whether an accused person is guilty or not. That would be left to the petit jury.

I don't understand how this former prosecutor can listen to just one side and then judge. This is the job of the judge and the jury. Prosecutors accuse/ indict. Defence lawyers defend and refute. The judge and jury pass the judgement.

Brian reportedly spent considerable time in the area of the house at night. It would be very easy to watch a person enter a house after dark and then see which room light comes on. Basic surveillance technique.

@@davidclayton3831: It’s not very difficult to know a person’s typical schedule if you’ve surveilled them for a period of time. Most people have a fairly regular routine and most students are at home through the night. This is pretty easy stuff to figure out, especially if you’re sitting in front of the house watching, lol. If Brian is the killer, knowing what we know so far, he definitely didn’t need any help. Maybe he had help but I doubt it.

@@MartinMartin-bh4ke The main evidence is the sheath, but LE has been lying to us about it. The Idaho lab found no DNA, but they told the court they had found DNA in their application for an arrest warrant. The Texas lab that found the DNA has a test that is thousands of times more sensitive, but so is the risk of contamination. They can detect as little as 15 skin cells, while the average human sheds 5 billion a day. And beyond that, it looks like a plant. Thus DNA in the car and apartment will decide guilt or innocence.

There have been a number of specialists (i.e. forensic psychiatrists, former FBI agents/profilers, former law enforcement officers, former prosecutors) who have spoken about his likely motives, based on what we do know about him. And last Friday, Dateline did a two-hour special on this case, examining a lot of that as well. I don't know if he's guilty, obviously, but most of what I've read and seen does make sense.

That it is the first degree murder of four people and that he, Bryan Kohberger ENTERED the King Road, Moscow (house)with the INTENT to commit murder (of four individuals). Agreed?

They can't exploit it enough like "Dateline NBC" who's rehashing what they just did in another episode about the case but for a few new spatterings of new information but mostly just more "experts" chiming in. I also find it disturbing that one of Kohberger's former classmates (a criminology student) turned tiktoker into the case (Josh/"Psychological Sleuth") thought this would be cool since he talked about how "cool" it was to discuss the case w/psychologist about it and this former FBI woman who's all over the map, discussing this case and why am I not surprised when she states how "fun" it is to partake in the discussions when called upon.

They aren't allowed to, because the judge issued a gag order on further evidence being released. But even before that, the police said they had DNA on the knife sheath left at the scene, along with cell phone tower evidence showing his phone traveling from his home to the scene of the crimes, a pattern of rather alarming behaviour, etc, etc. They will still have to prove it in court, as they should, but given what they said before the gag order was put in place, I think experts are realizing that so far, anyway, the case looks as though it not only has a lot of circumstantial evidence but direct scientific evidence as well. I understand why people are saying things like "the police were pressured to solve this, so they rushed to judgement, " etc., but it's the prosecutor's decision whether to take someone to trial, not the police. And if you know anything about prosecutors, you'll know they often won't bring a case to trial until they feel like they have enough evidence to win--they hate to lose any case, but especially cases like this that have garnered so much national (or even international) attention, where everything they say and present will be examined under a microscope by the public and media who are watching the trial.

I don’t think BK, if convicted, would get an easy time from inmates in the general prison population, not necessarily. Prison is brutal and dangerous. BK would still get fan mail from supporters on Death Row, and might even enjoy the isolation and relative safety it affords him. And he could be there for a long time-one inmate, Pizzuto,has been there in Idaho for 36 years, so BK could outlive many of the players in this tragic melodrama. Death Penalty? Not sure it’s the way to go. From Moscow.

He will never be executed. Idaho does not like executing people. They have the longest serving death row inmates on average, and have only executed 3 people in the past 50 years. The odds of him being executed are slim to none.

@@retro000 Of course, people have committed worse crimes. The crime itself has zero input on if you get executed. They all get the same rights and same appeals. In Idaho though, he just like every other death row inmate, he has a better chance of dying from old age than being executed.

it's not overwhelming at this point, all we have is a bunch of circumstantial evidence. it doesn't prove HE did it. it's likely he was THERE but who is to say he acted alone? why the rush for the GJ instead of letting BF talk? there is tons we don't know. so doing these interviews that are extremely biased, is just sad imho. but i know you want to make your ratings. you do you NN

Once assigned to the case, the judge issued a gag order on release of evidence, which is why we haven't heard details beyond the circumstantial. But even before the gag order was imposed, police said they had DNA evidence on the knife sheath left behind at the crime, and I find it doubtful they would have gone forward with the charges if that DNA didn't match his. Also, his phone showed that he travelled several times to the area directly around the house, including the night of the murders. And keep in mind that as I've heard many lawyers say, "circumstantial evidence is still evidence." Many people were saying similar things about Alec Murdaugh before his trial, but as the prosecutor in that case said, "if you go inside, and come outside a little while later, and everything is wet--trees dripping, puddles on the ground--you're going to assume it rained. It doesn't matter if you were inside while it rained, because you can see the results of it and it wouldn't occur to you to think, "well, I didn't ACTUALLY see the rain, so maybe it didn't rain." In that case, though, they saved their most damning evidence (the Snapchat video clearly placing AM at the scene of the murders within a few minutes of the deaths), and the jury came back quickly with a guilty verdict. I watched that entire trial, trying to keep an open mind, but after all the evidence had been presented, I know if I had been on that jury, I would have voted "guilty" too.

Circumstantial evidence puts people away all the time. Direct evidence is rare.

@@automnejoy5308: That’s especially true in domestic murder cases where the only witness (besides the killer) is dead, DNA/fingerprints around or on the body are useless and no murder weapon has been found. Very common I’d say.

Any mother or father that sent there children out to school to better there self foremost and secondly to experience freedoom to become a adult ...should easily understand the death penalty ...i know and appreciate Steve will not rest till he see justice for his baby girl period ....b.k.thinks he will be protected by compassionate law no way ...if he get a life sentence only ...any parent should boycott and negate to send any child to any school in Idaho...it will impact the town's and economy ....ps that b.k. clown walking around courtroom no cuffs sitting beside his defense and she moves away knowing he is a creep and could put her in a arm bar choke hold at a moment notice ...idaho sharpen up the world is watching how this plays out ...

Mocow PD and the WSU Police screwed this up. He's going to get off on a technicality. Watch! WSU and ISP did some shady $hit in regards to evidence and Bryan, if he did do it, knows damn well what was not left as evidence sitting on the bed. He would know what he did, or did not, bring into that house and if they are saying they found something that he knows damn well he never brought in, then he knows they had to lie on the PCA because they didn't have enough. Hence why A Taylor wants to know ever tiny bit of every second in regards to chain of custody. The officer who found the girls in the upstairs room did not say he saw the sheath which was supposably laying right next to Maddie when he went into the room. He wrote, LATER I found.... Really? Later? Then good ol Ofcr Daniels with the WSU police, who held onto evidence at her dept (in an evidence locker)in Washington for 10 days ...when Idaho Police were the ones who collected it. Oh, and during those 10 days, she went back to BK's apt ALONE saying she "forgot" to leave papers when she was there previously with the Idaho Police. She says she didn't go in....but, reeeaallllyyyy????? BS. This wreaks to high heaven. It seems more and more likely they did some dirty crap to seal his arrest and he is going to get off because of it. Me personally...There is no way in hell I would convict him knowing what Daniel's did and that the Idaho State Police left evidence with her and that there was so little DNA on the button that they had to send it out of state to be tested AGAIN. Also, how many DNA cells did they find....I heard it was like 20....when someone touches something they leave thousands. It was touch DNA and THAT is why the DA won't turnover discovery and records of the collection process to BK's team. No f'n way would I convict this guy, unless they came up up with something so rock solid, which they don't have. I'm telling you they screwed this up BIG TIME!!!

Full evidence is presented at trial which in Brian’s case is scheduled for Oct 02 of this year. It will likely be delayed beyond that date so you’ll need to be patient. Also, if Brian decides to plead guilty you won’t get much of anything anyway and it will no longer matter.

This certainly wasn't unbiased or fact-driven. I'm okay with the prosecution going to the defense and saying "show me what you have" but the prosecution is *legally obligated* to show the defense what THEY have yet they continue to hide it from everyone. It was important for LE to arrest a suspect before classes began in the spring or U of I is facing a financial crisis so they put a few loose threads together so they could make an arrest and now they are trying to make the crime fit the arrest, not the other way around. What "overwhelming" evidence? It's all hearsay until we can actually see it.

Do you know for a fact that the prosecution isn't sharing it with the defense? As far as I knew, the reason we--the public--don't know a lot of details, is because the judge in the case issued a gag order, so if the prosecution shared any specific details of what they have on him with anyone not directly involved in the case, they would be breaking the law....(?)

The prosecution isn’t hiding anything but that is was the defense wants people to believe… to feel sorry for them. The facts are the facts.. his phone was so close it connected to their Wi-Fi. The knife sheath with his DNA. Isn’t it odd that he lived right next to Moscow, drove the white Elantra, questioned his neighbor about what he had heard about the slayings, decided to drive across country to go home to Pa but told the officer “we are going to get Thai food.” While wearing gloves.. he bagged up anything and everything that could have his DNA and disposed of it in the neighbors trash. This isnt circumstantial but are facts. Not to mention the 2 ID’s found in a glove of 2 other women. Where are these women?? Cannot wait for trial but think it is beyond sad that his sister even suspected him and went to the dad. Girls at the DeSalle campus having to move and eat outside because of his cringy stare. So now he will not only drag this out before the victims families but his own family as well. What is circumstantial? Have a feeling we are going to learn so much more once the trial starts.

You have no evidence he Brian did this. Actually Brent Kopacka has plenty of experience in killing people.. and his involvement with drug trade people in that town ... The university is making all kinds of pressures to hush the info on Drugs and that Moscow idaho is a Hub for drug transport from Alaska where there is another "mad greek " restaurant , through Moscow idaho and other places.

I think the families should have a say in death penalty or not. After all they lost their babies.. However , the nature of the crime and evidence BK most certainly does deserve to be considered. I continued to wonder if he has hurt others, besides the breaking and entering with the videos and the possible theft of underwear.. unless he was just getting started with this heinous act.

I am not American, so not familiar with the jury system. Wouldn't it be impossible to get a neutral, none affected jury in this case? How do they find people that never heard of this case or it's details, when it's all over the place? Also, on what do they base the decision to have a jury at all ?(as I understand it, sometimes there is no jury, even in high profile cases?) I find having a jury at all, not leaving the decision to competent well trained people in the law area, feels unsecure and a bit like jeopardy...it can go either way, sort of, despite overwhelming evidence. Leaving it up to a bunch of people, perhaps not familiar with important aspects, but more prone to relay on feelings, seems a bit "old fashion", for lack of a better word.
