I know that also In California we have California Civil Code Section 51 also known as the Unruh Act which bans discrimination and hate crimes no matter what the circumstances are rather it be race, sexual orientation, gender or gender identity.
So at the moment I am dealing with this thing, my manager thinks that I am homosexual..... I have never ever said this in my life, but I am bisexual. He told me that I needed to put a bow in my hair because I am a front worker and only women work in the front. There has been numerous other things but when he told me this is rung my bell and hurt, I went to my gm and I asked him to do something about this. He did, he told me that all I do is complain and that I don’t help the company....... (He did nothing of the situation to help me) instead insulted me, and I took a leave of absence, well my area coach had called me to let me know that I was fired.

I suggest you practice acceptance, or, be more verbally aggressive in communicating your discomfort directly to the party involved. I'm straight and take more insults than this because I drive a Prius, am overweight, and have a bald spot. I see it from your point, but also, can see how they might think they're just joking and not understanding how you feel. At the same time, rather than standing up for yourself or being direct, you go to higher levels which is often perceived as being a complainer. Point being, you likely aren't being singled out and lack the diverse life skills to understand that it's an uphill battle for everyone.

I found this to be informative, but was wondering why it was listed that a straight person could not be discriminated against?????? If the HR person is gay and the person who cause harmed is gay and they stick together in this investigation and the company terminates the straight person because the gay HR person just can't believe there would be harassment from gay m/f to straight m/f why was that left out? No, you misunderstood what I said in the video. A straight person is protected under this law exactly as a homosexual person is protected. If a gay person terminates a person because he/she is straight, then the law is broken. The law applies equally to everyone.
Question: Do you have to come out of the closet first? I feel like it's no one's business that I'm gay but guys assume I'm gay because I don't talk like I'm not and then assume I like them and make abusive comments. Like "don't look at me" "don't think of me sexually" Whao whao whao" when the guys are taking warm layers off. There are rumors that I'm a pedophile. And if I complain the typical response is "you can't take a joke". This happens at every place of employment that I get and I'm tired of the atmosphere and I'm tired of being accused and even coming out of the closet doesn't help. When I meet new people I don't want to introduce myself as gay George and I don't want people to think of me as ONLY a gay person when being gay really isn't a big part of my life. I don't live on the set of Will and Grace. I'm trying to live a normal life and it's impossible making friends when guys think I'm gay. It's still heavily stigmatized. Guys think of gay as being someone who's out to molest them. No one wants to hang out or invite over someone like that. I'm sick and tired, stressed out and angry.

As to your question, to prove that harassment or discrimination is taking place on the basis of sexual orientation (Under California's FEHA statutes), you have to show that the motivating reason for the bad treatment is sexual orientation. The answer is that it depends. Take your situation as an example, you would have to show that the people doing these things to you knew or suspected that you were homosexual. Because it would be hard to say they treated you badly for being gay if they didn't actually know or suspect that you were homosexual. See what I mean?

When they make snide remarks in your presence, ask them to explain why they are saying, what they are saying. Draw them out into the open. Bullies are idiots. They are usually the dumbest people in the room. If you give them enough rope, they'll hang themselves. It takes humans hundreds of years to adjust to change. Always does. I feel like if you are in a 1% club, you should realize that it's just going to take time for people to accept. If you stop pushing, fighting, chastising, suing and hating humans for just following human nature, you'd be surprised how much they CAN come to accept if left to naturally process it. Secondly, people are allowed to think differently. Where you see this as a viable choice, or not at all, many people do not. There's nothing wrong with that either. What they don't want to see is elementary kids being introduced to homosexuality (like in Texas as of a recent news event) before their parents have even discussed sexuality with them. It just wasn't the time or place, or age group. Example: Communism is by definition more efficient than democracy. It's also a viable government option. But to teach this in the US would cause uproar. If the roles were reversed and we were communist, democracy would piss people off. And if gay were the norm and straight people started coming forward, they too would be feared, judged and have to fight for their existence. It's 100% impossible to fight human nature because it's in all of us. And gay people are no different. Deep down, there is a type, a height, a width, a level of sanitation, a skin color or a race that they too view in a strange way. The issue with the state of CA is they want to "force" or instantly "fix" problems. It took us 250 years to get to a 2015 minimum wage, Cali wants to double it in 4... Are we seriously thinking that's sustainable? And we wander why homelessness is out of control. Legitimately trying to understand the other side, struggling more and more the farther they get.

I was drunk during my holidays and I invited my line manager out for a romantic drink via private mobile text message from my private mobile to her private mobile. She declined because she said she is my 'boss'. 3-4 months later, she was absent for a month and so I sent her flowers and a card and a teddy bear and told her to get well soon. I received no thanks. What she did instead was to complain to her manager that I was being romantic and it was unwanted. I then received a meeting from her manager and then a letter was sent to me titled 'informal record of meeting' stating that I was to cease my romantic feelings as they are unwanted and unprofessional, and that if I send any further text messages, I may be subject to disciplinary proceedings. This occurred straight after I sent her the gifts. I had only said on the card to get well soon and I addressed my card to 'an awesome Team Leader' with an 'X' (kiss) and wished her a Happy Xmas.
