Prosecutor Rips Alec Baldwin for Death of Cinematographer in Opening Statement - 'Rust' Trial Day 1

The Alec Baldwin trial began Wednesday morning with an opening statement from prosecutor Erlinda Johnson. After she slammed Baldwin for "playing make-believe," she said she believes Baldwin lied about not pulling the trigger of the gun used to kill “Rust” cinematographer Halyna Hutchins. Johnson continued to say that the gun didn’t malfunction on its own, claiming the trigger had to be pulled. The prop gun was later destroyed during FBI evidence testing. Baldwin's defense rebutted the state's claim in their opening statement, claiming Baldwin was doing his job as an actor and had no idea a live round was in his prop gun. The prosecution kicked off their case by calling first responders to the stand and having them testify about the day they responded to the movie set.

Baldwin’s armorer, Hannah Gutierrez-Reed, was convicted of involuntary manslaughter and sentenced to 18 months in prison. A judge will rule on these issues after hearing motions from the prosecution and Baldwin’s defense. Baldwin was indicted on one count of involuntary manslaughter in January for the death of 42-year-old cinematographer Halyna Hutchins.

It’s so sad and eerie to watch her still alive and moving around. I just assumed she was passed out by the time they got there - knowing she was fully aware and seemed to be “with it” still, is just disheartening. That poor woman.

If I ask for non-alcoholic drinks at a restaurant and the server gives me alcohol, I'm blaming the server, not myself for having alcohol in me. I relied on the server. Also, if a pharmacist gives me a narcotic instead of an antibiotic, guess who's to blame. Me? I don't think so. The reliance factor on these professionals who were supposed to be doing their job is key to this case. Alec relied on them to do their jobs. They didn't . To me, that's enough to acquit if I was a juror.

So you didn't give it a sniff to see if it had alcohol? I have never had a weapon accident because I dont trust the person handing it to me, I verify it first. Try teaching your kids that....

And in this case, the armorer is at fault even more so, since you can’t see if there’s a live round in a gun. He relied on the professionals around him. Not guilty and overcharged. This should be a civil case.

I‘m from germany and I work as a paramedic engineer for over 30 years! The airwaymanagement performed by medical staff is horrible in my opinion! 🙄🤦🏻‍♂️ No sedation, no save airways, just insufficiency with resuscitator!

A car is a potentially lethal weapon, too. Car owners trust the car manufacturer, the mechanics and the MOT inspectors. Drivers are not expected to be able to check for, and detect rare hidden faults in their cars. - In Mr Baldwin’s case, I do not blame him for having trusted in the gun being cold when he was told so.

@@sallyshafer436the point was when you purchase a new car off the lot from the dealer, (Gun safety specialist) and THEN after receiving the vehicle back from state inspection (2nd person or supervisor), you are not going to be inspecting the safety or taking it to a mechanic to make sure it is safe to drive. You put your trust in those entities to be safe and drive your family.

I am currently undecided on whether the defendant is guilty or not guilty. However, based on the limited information we currently have, after hearing opening arguments and listening to the first witness fumbling with his testimony, I don’t believe the state will get a conviction.

@@AntiPlatitude I agree somewhat, but it’s still early. I assume the prosecution has more or they wouldn’t have charged him. My biggest issue with Alec is his arrogance. Workers left the set because of unsafe working conditions. There was also some information out saying he was completely disregarding their concerns I need to hear about that part too. He was also in charge of production so he has culpability if others were complaining about recklessness and he shrugged them off , if related. That seams strange to me! Were they playing with live ammunition between takes? What was so dangerous? Absent of some aggravating behavior in management or action, they probably won’t and shouldn’t convict. I do believe no matter what I was doing, acting or not, before I pull a trigger on a real gun pointed at someone else, I would always take a second and verify it’s actually empty. But that’s how I am! Possibly being around guns in the military, but I would never not check a firearm first in any play scenario. One thing they should have done is Drug test him and the handlers! Anyone else with a work related incident would be, why not them! My understanding is the scene didn’t even call for pointing and pulling the trigger. If him or anyone was jacked up on something, then you have recklessness!

All this time. All the money spent here (on both sides), for AT MOST an 18 month conviction (that will never occur) - even if convicted, Baldwin will probably not do jail time. This is such a waste. There will be no “justice” either way. It was a critical mistake, but the prosecution already put the main person to blame on trial. The person who was responsible - and the person that was on drugs the day of - and the person that tried to hide her drugs. That’s the guilty one in this case. Baldwin and the State should have just settled a deal. This is ridiculous.

How is this even a case? its the person in charge of the guns and ammo/safety that should be on trial for manslaughter or gross negligience or did they not have millions of pounds in their bank accounts to pay out large lawsuits afterwards? This case stinks and his very unfair, Mr Baldwin didnt know he had a real round in the gun so how is he to blame in any way shape or form? It would be like selling a firework but its actually packed with dynamite inside it, and it kills someone and you blame the person that unknowingly bought the firework with dynamite in it

The armorer has sole responsibility. She was tried also, and found guilty. Armorers maintain the safety of weapons/props. That’s their whole purpose. Actors just act. Period.

A tragic accident has been turned into a public spectacle! The prosecutor acting like she has Jeffery Dahmer in the defence seat is more irritating than a woolly sweater on bare skin! It's because of muzzle flash and to make it real. You won't get that with a start pistol that are orange on the tip 🙈 There is a reason, but someone was responsible for that gun on the set, and to being it there, make it ready...

It actually doesnt matter - in ANY and ALL gun safety classes - you learn that the one pulling the trigger ALWAYS checks the gun ammo beforehand. You cannot ever take someones word for it (as in this case told it was a "cold" gun) It was Alecs responsibility to recheck it bfore shooting it. Whether live rounds or blanks. There is a clear difference in the tops of the rounds (gray center means Blanks) He NEVER double checked it to be sure. My take is... he hired cheap, inexpensive help (i.e., the inexperienced/young armorer) bc this was "his" movie project. His money.

It wasn’t a real gun. The manufacturer didn’t install a firing pin. Somehow, a firing pin was introduced and a live bullet as well.

If I’m an actor and hired to “act” I’m not responsible for clothes, makeup and objects I’m told to use and wear. There are HIRED folks RESPONSIBLE & PAID. I’m certainly not familiar with Alec Baldwin in general but based on the details, he was set up to FAIL.

It’s not hair extensions--it’s a gun. Movie sets don’t make anyone exempt from the laws of physics or personal responsibility for a firearm in their hand. It’s a job like any other-there’s no magic exemption.

What is the point of paying experts to manage guns, props, security if you then have to check it yourself. I am surprised Baldwin has any case to answer to. He should be able to stick that gun anywhere and pull the trigger and not be responsible for the outcome. The prosecution is getting on my nerves already.....

@@piergiorgio919 doesn't make him guilty. The safety regulations were carried out weren't they? Checked by armourer, then secondary checked by another authority, called clear. He now needs to worry playing his part. If a doctor gave a loaded syringe to a nurse and told her to inject it into you and you die, is the nurse at fault? Executive producer is in name only and that is off the table anyway. I imagine there were several EPs anyway. Are they all guilty too?

The armorers have WAY more responsibilities than just checking the firearms lol. And it’s called human error. The whole point of the rule always assume the gun is loaded until you clear it is literally to avoid situations like this where a live round gets somewhere you’d least expect it. I have no idea why some of you people find that so hard to understand. It’s astounding to me.

This is such a waste of time. The one that was rightfully charged, and should have got FAR longer sentencing was already charged and sentenced. Literally without her stupidity and incompetence this doesn't happen. Actors DO point guns at each other and fire blanks at people all the time, what doesn't happen all the time is people getting shot for real on set. She shouldn't have been near a firearm in her personal life let alone on the set of a movie to handle firearms for other people. This is like someone running a redlight and killing someone and you charge the passenger of the car along with the driver.

This one of the weakest prosecution cases I’ve ever seen. Entirely form over substance. Overzealous State prosecutor trying to manipulate the petina of the case in order to secure a conviction. At worst this rises to a civil case, MAYBE he could be culpable in a wrongful death suit in his role as one of the producers, but criminal liability for involuntary manslaughter is ridiculous. With that logic, every actor in a film using prop weapons for the last 100 years who didn’t adhere to principles such as muzzle and trigger awareness is guilty of reckless endangerment. 🤦‍♂️ As an aside, Gloria Allred is such an ambulance chaser. That woman has no shame.

Why would one have a live bullet on a movie set? Who gave him that loaded gun with a live bullet and then he was asked to fire too and in the direction of another person.... wasn't anyone responsible to check this beforehand ?? Guns always come on movie sets...

One thing I find interesting is the Defense barely mentions Hannah in opening, especially the fact that she won't be testifying. From what I understand the Defense may be calling her and making a big issue of whether certain questions are even subject to the Fifth Amendment. I will be very curious if either side tries to call her and how that works out.

In New Mexico law involuntary manslaughter requires acting in a reckless manner, proving that the death was an accident and that Alex Baldwin acted as he was supposed to be acting, and not recklessly, would exonerate him. That's why they keep pushing for witnesses to recognize it was an accident. The other charge, negligent use of a firearm, requires the defendant to have used the firearm with negligence. Negligence is defined by "omitting to do something which a reasonable man, guided by those considerations which ordinarily regulate the conduct of human affairs, would do, or doing something which a prudent and reasonable man would not do." That is why they're trying to prove that he didn't act negligently because a) It was a "cold" gun, b) He was adhering to set procedure in which two people would've reviewed the gun before handling it to him. Prosecutors are trying to suggest he acted negligently because he didn't ask about the gun once it was handled it to him. But, based on the facts, he should've been able to reasonably assume the gun didn't pose a threat and that he could handle it as his character would've handled it. Therefore, he didn't act negligently. I would be surprised if he's found guilty.

For example, the statute is actually called "Negligent use of a deadly weapon" so it poses the question of whether Alec Baldwin could have acted recklessly or negligently if he was handling "a prop" that was "unloaded" and technically had been supervised to ensure it could not be "deadly" or a "weapon." Thus why those in charge: armorer and AD, who knew the prop WAS a weapon and should've known it could be deadly were liable, but recklessness requires an ability to act reasonably and what's reasonable in this case is the question. We have little precedent, last similar accidents were in The Raven, when Brandon Lee died, in 1993 and there was another similar accident in the early 1980s. The actor who killed Brandon Lee wasn't charged, in the case 1980s case the actor himself was playing with the gun and killed himself by accident. So not a lot of precedent on this matter.

Well of course? Defense cross cant introduce new information, just approach the same (prosecutorial) evidence from different angles. Cross is essentially going back over the witness' initial testimony. With the prosecutions questioning he is learning their evidence and strategy as it evolves therefore: notes. Consider a test in school: During the lecture, you take detailed notes because you need to learn the info, evaluate the info, and anticipate which info will be most relevant to the exam. When you get your grade back and the instructor goes over the answers - you don't need to write down the questions or answers - they're in front of you and you've already answered them. If you studied well, none of the information should be new.

2:46:18 there is no way that I believe Alec Baldwin, who I cannot stand as a person, is guilty of anything. There is a reason that the actor is not the armor. Because many people would be in this situation this is not the first time this is has happened. I really am looking for the prosecutor to change my mind on this case because I felt this way before the armor was found guilty, I watched that trial, and I found it to be convincing that both she was guilty and that no one else was except maybe her father. I think there’s an argument that she went to jail because she wouldn’t give up the fact her dad sent her live rounds.

As the shooter he doesn’t seem to have criminal culpability to me. Maybe as producer he has some liability for hiring a bad armorer. I’m surprised they’re prosecuting him. This said, the movie industry should change their standard policies for firearms. No reason to have real weapons and real ammo in this day and age. Guns should be un-fireable, never made from real guns, never have rounds that were real or could be confused as for real. And yes everyone who handles the gun should check that it’s safe.

There are protocols to check guns are safe before handing to Baldwin. That part failed. Yes we hate arrogant, narcissistic, rich guys but that does not make them guilty. Yes, when handling a real gun do not depend on "paid" others. One of the 1st rules of a gun safety test is: Never point your gun at anything you do not intend to shoot. Those that were supposed to check the gun for blanks are responsible as well as the person who pulls the trigger. Its a matter of life and death, it only takes a few seconds to double check.

5:50:29 when people are in shock, they are trying to understand what they’re doing and they talk, because they’re trying to talk out the last few minutes of what just happened. This idea that Alec Baldwin is responsible when he shouldn’t have ever had a live gun, that’s not him. Criminally he should not be responsible and it’s annoying when people find things like oh he was talking as if that is somehow collaborating some sort of guilt. When it’s likely, just evidence of shock, as anyone who is not a murderer and isn’t intentionally trying to shoot a person would be incomplete shock when they actually shoot and un alive a person

The frequency of the prosecutor interupting the defense, starting with the opening statement, says to me they don't have a strong case. When they have to resort to constantly trying to disrupt the defense during their presentation they must be concerned. (If I recall pretty much most if not all of the objections went against them)

This is such a truly heartbreaking situation and accident. My heart breaks for the beautiful woman who lost her life, but also for Alec. People will have their own opinions on the situation. Do I think Alec is as fault, yes. Are the prop and producers whose responsibility was to check the fire arm at fault, yes! Do I think it was done on purpose, NOT AT ALL! Yep been teaching gun safety for over 20 years. Gun safety 101 teaches to never point a gun at anyone unless you intend to pull the trigger. You would also never use a gun as a pointer. This judge is allowing Alex Spiro to run to trial. Its unbelievable.

Most cases of unintentional manslaughter are accidents, it doesn't mean the person isn't guilty of a crime, being reckless which ends up in injury of a person is a crime.

The laws are different when the firearm is being used in law enforcement, while hunting, etc. Besides- a gun secured in a holster is proper storage of a firearm; if it discharges while in a holster & nobody was holding it you can’t very well say negligent actions played a role. It is completely different when someone is in control of and holding a gun in their hands when it goes off.

P.S. just some pointless information: CAD = in this context, Computer Aided Dispatch.
