DAY 4 - WI v. Jessy Kurczewski | A Wisconsin woman is facing life in prison if convicted of killing a friend in her care by poisoning her with eye drops. Jessy Kurczewski, 39, is charged with one count of first-degree intentional homicide and two counts of felony theft in the 2018 death of Lynn Hernan. Opening statements begin in the Waukesha County court of Judge Jennifer Dorow.
Prosecutors say Kurczewski killed Hernan, whom she was caring for, and staged the scene to look like a suicide by drug overdose. Hernan reportedly died after drinking a water bottle mixed with 6 bottles of Visine.
Kurczewski told police Hernan was suicidal and “had been trying to kill herself by drinking Visine in vodka,” according to a criminal complaint. Investigators say, in total, Kurczewski stole $290,210.06 from Hernan before and after her death.

Am I the only one who thinks Jessy was poisoning Lynn for a while due to the defenses cross on her friend? I hope the jury picked up on how sick she got the last year and wasn't getting better after going to a doctor.

I was wondering the same. She was so sick and in pain and they just couldn't figure out what was wrong with her. And then she was murdered by poisoning.... heller, that's not a coincidence.

Totally agree, i keep screaming at the screen “why didn’t you test Lynns hair”! Pure evil to think someone would do this and watch a “dear mother figure” suffer. I’m not surprised that out of desperation she was in and out of different clinics trying to work out why she felt so unwell! Poor poor lady

That's my thought too, she was feeling sick all the time, and no medicine made her better. Also I can't understand how doctors kept giving her so many pills that cause vomiting, nausea, and that was her main concern! They should have taken her off everything, but Lynn didn't want to try diets, physiotherapy... she was lazy and addicted, and I think Jesse was taking advantage of it all and grew worried when there was no more money left and Lynn wasn't dying fast enough.

As soon as Jessy and her mum found out they were inheriting they began poisoning her. Jessy went weekly to keep poisoning her. And she never let her bf meet Lynn. Why? Because he would see her decline.

@Kryssyskingdom the reports were classified under unkmown death. She was pointing out the high levels of one drug that pertains to the case. Seeing as the defendant was found guilty her testimony worked.

Watching the trial unfoulding, it seems very likely to me, that the defendant put Lynn through a slow poisoning and when that didn´t work, she killed her with the eye drops and staged the scene. It´s sadistic and cruel beyond belief. Lynn´s last years in life must´ve been a pain. I also wonder why the mother isn´t charged with the crime, when she and Jessy seems to have conspired together.

So so right, i couldn’t agree more. I’m very surprised the victims hair wasn’t tested to check how long the poisoning went on. I do agree that Jessy probably tried out the “poison” on Lynn long ago and that’s why the Dr’s couldn’t find her problem. The poor woman probably thought she was going crazy, cameras in her hospital room, dr’s taking away her meds, she must have been desperately trying to feel well!

@@michaelirwin6568 That’s a really good point,… however the Defence would probably argue that it was solely Lynn who had self administered !? Common sense speaks loudly, that the year prior to Oct 3 2018, is when Lynn started to have more serious health issues, being the year Jessy was more available to her,… if the Jury doesn’t find her guilty on all 3 charges, I will have lost faith in our Justice System 😔

I've been thinking she had been dosing her for awhile. There's the testimony the other day about her not being able to eat soup because it was giving her mouth sores. Notice the ex said when she started feeling sick she also complained of her money disappearing.

I thought it was rather odd that there was testimony that said they never found any eye drops in the house that contained the same ingredients as visine tetrahydrozoline. All the other eye drops for dry eyes not for getting the red out. That to me made a big deal in my decision. Also the fact that they found pills in her stomach but they hadn't gone into her bloodstream yet made me think that they were trying to put things down her throat like she had killed herself so they can cover up for dosing her. That examiner was excellent witness

They are trying to establish that the drug cant kill, which by itself is already difficult, but extremely futile when going against those 2 highly decorated scientists. Thats why their cross takes literally a day, just to find some small error somewhere, its so stupid. But its about their only defence i assume because once the financials come in, i assume for the jury IF there is a killer it will be no doubt the defendant.

So is their defence that she committed suicide using eyedrops (THZ) or that the eyedrops (THZ) wasn’t what ultimately killed her? They seem to go back and forth between both defences depending on who is on the witness stand. They also insist that someone having just a little bit of other drugs in their system (I.e opioid, benzo’s etc) can kill them but then keep trying to prove that having a lot of THZ in their system isn’t fatal. I know they are supposed to create doubt for the jury but they really are all over the place and don’t make a whole lot of sense.

With these particular words, it’s especially frustrating, as it could be misinterpreted. It sounds as if Lynn borrowed money on the witness’s behalf! I suppose the end result is the same, but as a juror, I’d want clarification. I’ve only heard the uneducated speak that way.

Lol did you listen to the ME going over her medical records? Lynn got fired for noncompliance and taking more meds that she was told she couldn’t take and was told not to take and she failed drug tests at the doctors, she also went and raged about this to the social worker… she also lied and said she didn’t smoke and didn’t drink and was mixing booze with her pills-including with benzos and opioids so I’m not sure what you call her behavior but this ISNT a stretch by the defense…

Odd as that is not what I see.. as I am watching the defense poke holes completely in the reports she used which she has no idea of what the COD was.. No doubt the rebuttal will be interesting.. I don’t know if this woman is guilty, but what I do know is the prosecution has made grave errors and the ME will be called back likely as she errors also and the toxicologist tried to create a narrative without completing her reports properly. I look forward to seeing all the evidence first before weighing in with a judgement.

When this defense lawyer cross examines the State’s expert witnesses, she does so in such a cynical,sarcastic & distrustful manner! It only makes her sound as if she distrusts, or simply doesn’t believe their under oath, expert testimonies! In turn, it also makes her sound so defensive when she really doesn’t need to be. It’s up to the jury whether they believe if a witness is credible or not! However, She wants the jury to believe that this expert witness doesn’t really know as much as she actually does & I find her cross examination to be appalling! Does she even realize the stupid questions she’s asking of this Doctor? I understand she has to cross examine an expert, but how dare her try to degrade this doctor with her cynical attitude!

My thoughts exactly! That DA's office is made up of some brilliant folks! And I see in the gallery one of the attorneys from the Darrell Brooks trial. I think it's great they go to listen to each other and support and help each other. And the ME? Oh my goodness is she brilliant! Thank God because Jessy could've gotten away with this if the attorneys on the DA's side were anything like the defense attorneys! Those two, that. team, they need to hang up their coats and retire.

I have a huge pet peeve for [probably or later proved to be] guilty defendants making a huge show of studious concentration and note taking during trials. It grinds my gears. Like, who tf do you think you are and what tf are you trying to prove? Obviously, if someone who does this is found not guilty, they were just trying really hard to keep up and help their defense in some way. But if they're guilty and they know it, give me break 😒...

@brent_in_aussie I hear you, but I'm not on the jury; I'm watching casually more or less as 'infotainment' and wondering how the deceased ended up with a belly full of Visine. If I was on a jury, I would take it seriously as hell and I would abide to the last of my abilities by both the spirit and the letter of the law. If prosecution didn't present a case that left me with no reasonable doubts, I would vote not to convict because I believe in our laws. And by the way, I didn't say I think she's guilty, I said what I said, which was that WHEN someone turns out to be guilty, I think in restrospect how absurd it was that they scribbled away the whole time as though they believed themselves innocent.

I’m watching this is entertainment as well and I can’t believe that a woman that was so ill had to take her pills with a teaspoon possibly crushed up would want to live. That’s like something that you would do when you’re on your last few days weeks of life..!!?? I’m torn whether this woman could actually kill her mother I know it’s happened before and I know how irritating her studious writing on posted notes while she’s studying for an exam is annoying. I’m finding this very interesting like you, I think Lyn had a lot of drama‘s being an alcohol, loving drug affective person and I did find out Visine is used as a date, rape drug also or has a sedative effect when that’s when her drugs didn’t work, so no, just putting it out there.?

Thank goodness for the guilty verdict and sentence. I honestly don’t know how Jessy can live with herself after what she did. And I really wonder if her mom was in on it all. They kept saying ‘she was our best friend! She was our best friend’ yeah with friends like that - despicable. And even though both defense attorneys were horrible I couldn’t help but feel sorry for them, they both seemed so inept.

So after that Defense request denial to recross the M.E. Yesterday-we learn that while the defense was prohibited in recrossing her- the defense didn’t even bother to subpoena the M.E. Themselves- which could have been a work around to question the M.E.- AGAIN. Nothing like a defense attempt to mislead a jury - backfiring on the Defense 😂

These defense attorneys are irksome!!! The female is combative/curt/rude/confrontational and damn male defense lawyer asks the exact same questions constantly, just worded differently !?!? Once or twice is acceptable as he might trip up a witness but nearly 8 times he's asked a question that has exactly the answer no matter how many times he re-phrases it. Very interested in this case but i can't stomach these two...

I believe Jesse had been crushing & slipping way before the day of demise… Her nausea, lower leg weakness and just overall complaints of feeling unwell would indicate such !! … I think she then staged the scene, and to make sure she would not be around, dosed her with a large quantity of the THZ ,… I truly suspect that she assumed they would have never tested for THZ post mortem,… ‘I’m just thinking out loud like a Criminal 😆

Judge Dorow is fair, but disappointing, given the high standard for civility, integrity, and poise she set in the Darrell Brooks case. Maybe she’s having a terrible week, or her approach in WI v DB was unusual for her personality, but she’s conducting the room with personal impatience & unnecessarily impolite/intimidating behavior. Why set this tone when a civil tone might actually work better? We’ll see; maybe it will get better; I’m not resigning from her fan club just yet. 😊

I also love Judge D but i noticed a difference from the DB case dealings to this one pretty quickly! Think shes an amazing woman but i do see that difference! I think she maybe had to be so switched on with the DB case however in this case she can relax a little and only interject when needed!

Yes she spoke to the toxicologist once in a way that we never saw in the DB case, how he acted she was overly polite to the point people thought she let him walk over her. Which I know why she was so patient and polite for applette purposes. When she said I am gonna stop her there answer only the question that is asked then let the state ask the follow up. It wasn't what she said it's how she said it that was rude. Like you said maybe she was having a bad day or something. Still a fan I sure ain't perfect.

Obvious he was hoping that if he kept repeating the same thing that the jury would only remember his questions .& forget what state illicited. How so, the toxicologist used reports where she has no findings for the COD but only information for what was in their system. She is doing her job that is apparent and good if she pisses of the prosecution she should as they made errors, several on this case.

Actually it was a bit annoying that Dr. Kacinko didn't wait for the question, she usually anticipated the follow-ups. That's understandable (I think that she had a bit of stage fever) but that's not how testimonies are done. She was breathless and hurrying, almost like the prosecution had to edge their questions sideways. You can't be so eager to help the jury as to not wait for the question before you answer them. :)

Can’t believe how heavy Lyn was when she passed compared to her DL of 150lb but then, my DL was originally done about 20 yrs ago & just renewed with same pic, it says 147lbs & I’m just a weeee bit more now!😊 seems something was happening to Lynn for awhile though. The female defense lawyer is beyond aggravating,she is asking the same questions over & over, she is insinuating this Dr. gave information for court that isn’t proven but she already admitted her speech in France was just to give knowledge to her peers about the textrhydrozoline (sp) dangers, and the cases she showed in court were just showing levels of that ingredient, not proving the ingredient killed anyone! So defense is just like blabbing! 🤪 The defendant keeps giving her lawyer bunch post it notes, that’s kind of strange. 🤨

The only thing I can see is ineffective council because the defense attorneys are idiots, but I think that's the only legal claim she would have. And I believe this judge is the one that would choose that with evidence shown

Their biggest problem was Jesse commenting about the water bottle she gave Lynn. If she would have kept her mouth shut they could have argued Lynn committed suicide purposefully using eye drops. Now they have to argue it was the other drugs not the bottle Jesse gave her which is a losing battle. I doubt any attorney stood a chance after Jesse ran her mouth. She got what she deserved.

As I posted on the Day 3 video please no spoilers. I think, perhaps there is a point to the testimony of the lady with the private Forensics lab. (1. Much time was spent outlining her conference participation particularly in France, where, if I am not mistaken Visene is now banned. But correct me if I am wrong, earlier was there reference to a case of someone who died in France, they weren't a French citizen and the case was solved mainly because law enforcement knew that the Visene in question was not bought in France? (2. And this is speculation, in this case, if the victim indeed wanted to self terminate, wouldn't she have just swallowed the eyedrops? That the toxin was found in an agent (Water) suggests, at least to me, that the accused was trying to obscure her attempt to harm the victim deliberately for financial gain. Hang with me here the lady had lots of health issues and the accused was her caretaker and sought to partially gain from the victim's estate. She obviously wasn't dying fast enough, as evident through previous testimony that stated that professionals in both palliative care and hospice deemed their overall services inappropriate, something which the accused was probably banking on. When that was off the table, her wheels were probably spinning as to what her next best move would be given the circumstances! (3. Again, I am waiting for detailed testimony from a forensic accountant. Estates don't just pay out right away and executors have limited powers while the financial and legal issues are being worked out. So, that the accused was easily able to steal and spend money so freely, so quickly (Until the other beneficiary caught on), suggests that suicide must be fully ruled out to give validation to the theory that the accused actually planned, or at least considered her actions beforehand. Thoughts?

They’re trying to prevent an accused criminal (or murderer, in this case) from going to prison. That, in itself, is unlikeable to most ordinary people who have been raised by TikTok and Instagram, and thus have the attention span to match. They’re already playing with the deck stacked against them. With the already negative perception most people have of individuals in their position, every little thing they do that may seem unattractive is magnified by 100.

I have watched the trial from day one and even hearings before the trial so I know Lynn is dead. I saw that one other comment and commented...so I am not stalking you. And yes I have known someone who was murdered, he was a co-worker who was also a good friend of mine that was stabbed to death in a parking lot. The male defense attorney I absolutely detest. He is a real coward. There's no skill in disparaging a dead person's character, that's so low. He also has this look of resentment that really ticks me off. Come on, defense, aren't you guys lawyers? Quit messing about with the disingenuous BS and start lawyering like real lawyers! Here in the UK the estate is protected and bank accounts frozen. It seems odd how Lynn's estate was just left for anybody to go in and help themselves to anything they wanted.
