This case taught me that the legal drinking age and mj laws don't add up to a hill of beans in Wisconsin. I also learned that 13 drunk teenagers and 20- somethings against 1 older man in poor health shouldn't make the older man fear for his life.

Well not talking to the cops is a far cry different from lying to them. Because everything he said could and would be used against him in a court of law. Lying to the cops will do you in. Pretty stupid. 🙄

To add, you must affirmatively say you do not want to talk to them. If you merely say you want to speak to your lawyer they can still weasel their way into continuing to question you because you didn't unequivocally invoke right to silence. Miranda has been slowly whittled over the years.

I think Muis brother should bring a civil suit against the big fat guy ring leader of those kids ! I’m not saying Muis innocent . I am saying those kids were clearly drinking and the father knew how out of control they’re capable of getting based on said celebration the prior year. He stated he had a smaller crowd on a different river to “control” better. What he didn’t do the one thing that would have controlled the group was not allow drinking ! Were they even of legal age?

I am an older man (in my 50s). I was once attacked by a 19 year old. I live in a non-stand your ground state. Retreating sounds great on paper, but is dangerous if you are older and slower than the attacker. You have your back to the person or you are walking backwards. I just know it is not that easy.

Exactly. People saying he should just retreat, I wonder if they saw the video. They had him surrounded and he was in the water, unable to run. If he tried to turn and leave they would have jumped on him and this may have ended with him dying instead.

Gives the jury the option to "settle" for lesser charges. Even if that happens, Miu (given his age) is most likely in jail for the rest of his life.

I think the way the defense broke down the jury instructions gives the defense an edge. The instructions are so complex and it helps if you know what is to be broken down.

Just doing their job. Attorneys on both sides represent our constitution by making sure our justice system works as designed and no rights are violated. No need to run around screaming "Shame!" It's a ridiculous thing to say.

The young adults incited a mob with their false accusation of the defendant being a paedophile. The second group that arrived having heard the accusation of paedophile did not arrive to make peace but instead, they joined the mob. The defendant was the target of the mob, a mob that showed no fear and no self-control. The water even though not deep makes it a deadly situation, when the defendant ends ou on his back in the water, he is one punch from being KO'ed and drowning. Tragic someone lost their life, but if you corner someone and make them fear for their life they will fight with everything they have.

Wrong, the bystanders were all there to break up the fight and split up the group from the defendant. They told him to leave the kids alone and go away- he decided to react with violence against people who were there to make sure nobody got hurt.

@@Princelover-ip4gn The water was knee high deep; I would say about 2 feet, maybe 18 inches. If he were to be knocked out and became unconscious, he would be absolutely in danger of drowning (unless you're an alien or one of those African tribal women with long necks and dozen of rings around them). You need to go watch the actual raw video (cell phone video from the kid that incited a riot/mob) before making stupid guesses/assumptions with your limited brain capacity! If I was a juror, I would acquit him on all charges except for perjury and/or obstruction.

I respect that you have a great knowledge of the facts of this case. Nothing disturbs me more than commentators that are uninformed. Viewers/subs, like jurors, are not stupid. Now that trial has ended, I remain at Not Guilty. What has bothered me the most throughout this trial is the constant mischaracterization of key elements by the prosecution. This prosecutor has spent so much time trying to frame the minutiae a certain way and pushing this narrative that being middle aged in a river reasonably indicates you're a pedophile. If your facts are good and accurate, why even do that? There have been so many times I have felt like the prosecutor was literally more concerned with the jury not seeing the teens as arseholes than he was about proving his case for murder/maybe-not-murder. I also have huge problems with prosecutors being able to charge every level crime between indifference or recklessness to murder one for a single offense. Either it's murder or it isn't. Charge the crime. When you argue to a jury in your closing that it's definitely murder but it might be something else, you've given them reasonable doubt. Charge the crime you have and advocate hard to prove it. The video is the best evidence for the defense. They were also organized and focused on their case. If you feel you are in imminent danger and you are being closed in on by a dozen or more people, some of whom have already assaulted you, you swing like your life depends on it. Because it might.

I understand that it's important for the judge to do his best to appear impartial at this point, but yes, for me, and apparently others in the comments here, the reading of the jury instructions were too monotone and started to feel like, "Bueller... Bueller...Bueller...." and I had a hard time making myself stay focused).

Just found you. Thank you so much for playing the judge’s complete instructions of the various charges. It was very, very helpful. I don’t completely agree with the verdict but a life was taken so that changes many people’s perception of justice. Maybe even skewing it a bit.

I think the point of the procesutions argument in the beginning was to say afraid people dont turn their back on a threat, but angry people might which turns him checking for his weapon to an offensive act to attack someone that pissed him off.

Im so.confused with these instructions because: I 100% believe he was defending himself even if his actions AFTER the events did show disregard for human life. So how are you not allowed to use excessive force to defend yourself regard for your attackers safety at the same time? That is absurd. If you fear for you life and happen to have a bazooka in your hand you will use it! You won't think, "oh this might be excessive" I don't get how your actions after a self defense act have anything to do with the fact you did what you could to save yourself. All he had was a knife. Anyone who says they would not go down swinging if a drunk mob of 13 swarmed you, is lying.

@@dilafng Except that a mob of 13 didn't attack him, that's completely made up fantasy. They repeatedly told him to go away, didn't attack him until he hit one of the girls. When you have a knife in your pocket and you're actively aggroing group of people, refusing to leave and keep escalating, you want a fight. And when you're doing your best to escalate while knowing very well that you have a lethal weapon on you, is that self defense?

Right at @29.29 I thought the same thing, it was the prosecutor that was mischaracterizing the situation. I’m so glad you said that LYK, Nic testified he had tunnel vision, he was being surrounded. He wouldn’t know how many people were a potential threat. They all were.

Why have none of these young adults been charged with anything at all? I think that is a major political play on the part of the justice department here - and what is actually 'just' would be to charge them accordingly based on their actions as well.

There is nothing worse than the prosecution stretching the truth in order to gain a conviction. The state should never editorialize. This should not be allowed in our justice system.

Yes, seeing the prosecution trying to twist the truth and minimize the severity of the attack on Miu was really disturbing. Miu should never have been charged. He has spent the last 2 years in jail while the ones who violently attacked him have been walking free. Disturbing beyond belief.

I think this is the first case that I disagree with Peter on and I've been a member since memberships began. It seems like a due process problem if the state adds charges after the trial strategy was decided. I would defend myself differently if I had lesser included charges, but I wouldn't waste time or witnesses to defend against elements that I'm not charged with.

All sides have been demonstarbly less than truthful, but ultimately from everything I have seen the "kids" were going way out of their way and doing basically everything in their power to harass, heckle, threaten and intimidate Mr. Miu, and then escalated the situation to physical violence at the very first opportunity. I knew at the age of 8 that this type of behavior (especially aimed at a random stranger you know absolutely nothing about) is a recipe for getting oneself hurt or killed. I'm not sure what the "kids" expected, but this outcome seems like it was exactly what they wanted based on their behavior... they just never imagined that a "weird" older gentleman alone and vastly outnumbered could possibly defend himself so effectly. Obviously another mistake on their part...

MO Miu was scared and without intention reacted to what he recognized as imminent harm. I think we all know mob-mindsets. These young people provoked and initiated a response from Miu. Mob mentality is frightening and he was stuck. Everyone at any time had the option to walk away so that argument holds no merit. I feel awful about the outcome and the families must be devastated and angry. However Miu does not deserve jail time he needs treatment for PTSD instead, along with everyone involved. Defense is grasping at straws giving Miu all the blame. These kids aren't 10 years old. Everyone acted juvenile and drunked juveniles are ridiculous, and it cost a young life that everyone have to live with. MHO Miu should get at worst house arrest and probation. The youth should be on probation for alcohol and drug use until 21 years of age. Due to magnitude of this case, everyone physically involved need to suffer consequences of sorts.

House arrest would not begin to be the penalty he deserves. He needs prison time. He did not have sufficient reason to be where he was, he put himself in this situation. If nobody had any duty to retreat and Miu was the one who struck first and a woman no less, he was the instigator. At that point he should have let people know he was armed or he should have backed off. Not letting people know that he was armed but sneakily pulling out his knife is a murderous very intentional act. I believe he's guilty of second-degree intentional homicide. He can get some help for PTSD in prison. I did not hear a blood alcohol level for Miu and it would be apparent to me from the footage that he had more to drink than the two beers that his then-wife suggested he'd had. A young man died and four other people were gravely injured. The fact that he stabbed the girl and she was bleeding so hard is absolutely crazy. And when he was disemboweling a young man as if that was his only choice to do that at that moment that is just not true, which makes it clear intentional homicide. He knew that his actions were over and above those needed to defend his own life. He's a murderer. He should have a minimum of 20 years.

His yelling awful lies caused more drunks to show up and swarm and physically attack him. If you watch the video, they didn't start yelling "he hit a woman" until after Mui had been pushed down into the water, slapped while down, then pushed back down into the water.

Using your same logic of the first person to put hands on is the initial agressor, wouldn't that make NM the initial aggressor when he rushed downstream to grab the teens tube and made contact with two boy's legs? He then walked around their tubes downstream from them. He only moved off to the side out of their path when the second group arrived and he walked over to Madison.

Imo there were bad decisions and dishonesty on both sides, sad situation all round that could've easily been avoided. If he literally ignored their foul mouths and stayed where he was nothing would have happened, they had already passed him.

He pulled that knife out when girls were just standing in front of him, yelling for him to leave - so that made him fear for his life … WTF. His ego was hurt! He knew damn well what he was going to do, did it and smiled through it all, never speaking a word (like HELP! Or GET BACK!) Nothing.

If the deceased hadn't advanced forward into Mui, he would not have gotten stabbed. He aggressed into Mui's knife Mui never stepped forward or reached out towards anyone who got sliced. Why weren't the "kids" charged with crimes? In exchange for their poorly crafted group story & testimony

I'm more concerned about him approaching them in the first place. He saw this group earlier that day and could observe them while approaching them through the river, he must've known that these kids would start "something" - but he took his knife and went there to look for a phone no one asked him to look for.

I see many people saying he should have done something different. I think what many of these people are not considering, is the way teens these days mob fight. Every day there is a new incident at my daughter’s school. They mob attack amd the victims are almost always critically injured. Or worse. Last year, a 17 year old boy was killed and left on my lawn for me to find at 3 am. We live in a different world these days. No, this may not be the way many would respond, but I think that is because they may be pleasantly ignorant to what’s happening everywhere. It’s a different world. These kids teamed up and mob attacked. That’s what I see on that video. If he didn’t defend himself, that certainly would have escalated on him. I do not think Miu caused death. I think the teens who attacked him should be held responsible for the death of their friend.

What disturbed me abt the Teens' behavior was that they were emboldened to bully a grown adult, and their maniacal laughter the entire time, especially when he was being physically attacked. They were so entertained by the suffering of another human. There's no defense for that. They clearly needed to learn that, in the real world, if you attack someone, they may attack back. Obviously I wish Issac had not been killed.

I agree! Every day is another one! Today, a girl at a mall called her boyfriend because 2 people were following her. He went to the mall and he was killed! He was only 14 years old! This world is a scary place.. those teens were doing this for a Tic Toc video. Jocks who had an attitude problem with an older man they chose to pick on. Plus the 2 Karen’s. Ive known lots of women like this, they’re annoying and always escalate situations.

I'm curious as to why they didn't touch him when he creepily ran up and grabbed their legs and tubes then? Not sure how someone telling you to just go and get the F out of here to de escalate the entire situation warranted Mr. Mui pushing or hitting her to where her glasses came off and she stumbled. Further more many others also yelling get away...go go go. It wasn't until he made the first violent move as well as already having the knife at his side that 2 or possibly 3 at most laid a hand on him by 1 punch, 1 slap and a couple pushes. I can't understand how so many don't see this for what it is. Yes the boys mouths are terrible and now the world has seen that but it still doesn't justify the bloodbath they had to experience and it blows my mind seeing folks like you with these excuses for Mui. He approached them and once the laughter and name calling started he had multiple opportunities to walk off. Anyone that doesn't agree has me blown away. These people didn't seek him out. It's the very opposite.

They bullied him but that's words. This is about actions and he made physical contact first both times. He ran after the young men and touched their legs (I would be creeped out too if a stranger was hovering and then charged me and touched me) and then he hits the woman telling him to leave. Actions have consequences and when you lay hands on someone you may get hit back. He was angry and frustrated and lashed out.

I agree with you. None of us know what we would do in his situation. Also, I don’t believe he was charged with anything that had to do with the knife afterwards. His charges are about what he did with the knife during the attack. I believe it was self defense.

It may be, but he is an experienced adult, military trained. Using a deadly weapon with force in fisticuffs with, in this case a bunch of unarmed, uncoordinated drunk teens, is a decision. He should face his decision, his responsibility and the consequences.

Almost anyone who has ever taught in a classroom has experienced situations where 13 or more teens and young people are around them with several of them heckling. Without any physical contact or direct verbal threat, it does not create a fear for ones own safety. If you were feared to the point of drawing a knife in those situations , you could not even walk through a shopping mall.

An old jury lady might be terrified at idea of teens jumping around shouting, but their imagined fear wasn't Miu's, he was comfortable. Miu chose an outing where he knew he'd be surrounded by raucous drinking young people. He even left his group, went off on his own despite his friend telling him not to because people might think he was a predator.

The idea that Miu could not just push Maddie or Riley to the side and walk back to his own group or walk a few feet away then search for his mask after the young groups drift on, is ridiculous. some loud girl tells you to go away, you can either go, or ignore them. No reasonable person decides to hit them in front of all their male adult friends.

I don't understand that conclusion. Mui was being hit and pushed from every angle, and this was all happening so fast. How was Mui supposed to know the person was trying to break up anything, when he had more than a dozen people putting hands on him? Is he supposed to be a mind-reader? If dude was trying to break up the altercation, why was he pushing Mui and not the people who were hitting and pushing him? Remember, the only people who got stabbed were people who were physically attacking him.

Initially, when I heard the lies from Miu, my inclination was Guilty. But, then ALL of those involved also lied. The State, in adding the lesser charges, gave me reasonable doubt on ALL the charges. If they have doubt about his perceptions and intentions, why wouldn't "A reasonable Person."(The Jurors)? It is said that you can't ride two bikes at the same time - The State are trying to ride four bikes, at the same time. Aside from that: Did he push Cohen? - Probably - but , only AFTER Cohen grabbed his arm. Did he punch Cohen? - I don't know Did a number of "The Kids push, slap and punch Miu? - Yes. all of the above. All create REASONABLE DOUBT

@@deejrm4148 I understand that. That was my first thought. As I said on my 1st post, it was The State's inclusion of the lesser charges which made me doubt the murder/attempted murder charges. If they aren't sure, how can 'A Reasonable Person's be sure?

@@brianstockport They added the lesser charges because they allow for a conviction if self defense was warranted but more force was used than reasonably necessary. It gives the jury more options to convict. Given Miu's age any conviction on the murder charges or 1st/2nd attempted murder charges is likely life in prison. The charges are not all or nothing.

This is one of those "rare" trials where I really feel like it could just as easily go either way. A hung jury wouldn't suprise me with this one, either. I'm personally torn between guilty and not guilty... I can't even imagine the pressure a jury feels in cases like this. I think most times, a jury's verdict is easy to predict, but this one's not so easy. I feel like if it's a guilty verdict, it won't be first degree.

As a juror I would of been annoyed they call those so called kids victims they were the one responsible along with Maddison for there situation you can hate I feel this way.. Maybe am strange but the prosecutors is the reason and helps the fact that this was self defense. While I feel for the parents that want justice there kids were being very horrific!
