Honestly, that speaks to the fact that these content creators need to actually learn how to run a self-employed business better. When you are dealing with this kind of money, there really isn't an excuse to not be handling your finances like any actual business would. Relying on PayPal chargebacks for your money is beyond stupidly questionable.

That is wrong, if PAYPAL is what you paid with then you 100% get your cash back without issues. Paypal always sides with the buyer over the seller when contact is just left hanging. It's the people who did NOT use Paypal who are in a LOT of trouble.

I normally am against doxxing but this goes into felony territory in terms of theft/fraud iirc. Doxxing him would help the people sue and hopefully get their money back. I wonder, even if they did go thru paypal, if they can claim fraud or if they report is as fraud then either their banks or paypal can re-emburse it or something because I believe (I could be wrong t ho) that there are insurance policies to help people victim to fraud. Plus if there is a legit report on it, then paypal, by the courts, may be forced to re-emburse the victims/give the information to the victims lawyers. I feel like people should be @ pay pal with his info from paypal to get his legal info and maybe try to start a fraud claim (if possible) and not just a chargeback.

Kinda a shame that having him sued would cost more money than could be recouped, because this dude deserves to be made bankrupt and have a criminal record for fraud. I guess if someone can find out where he operates out of, they could potentially forward a folder with evidence of the fraud to the local prosecutor and see if they can't at least have him charged with the criminal aspect of it.

If a prosecutor can prove it was a scam and not just gross incompetence, yeah, that does seem like felony level amounts of money - but actually proving it was a malicious act and not negligence is going to be pretty hard, assuming it was even a scam in the first place. Unfortunately, if it started out at least semi-legit and devolved from there, and there was no real contracts signed, actual criminal charges are very unlikely. You might have a civil case to sue him with, but a lawyer is probably going to cost $50K+, especially if you're in a big metropolitan area. And, of course, this is all assuming the guy lives in a US Jurisdiction.

They can follow legal actions, but the investigation and recollection of evidence takes time, in this case, probably would take a year at best because you have to prove he is a scammer comparing with more incidents like this.

This is why you MUST go public if you feel fraud is happening, because if you don't the one scamming you will just f off and disappear with your money. They should've gotten in contact with lawyers and the courts the second the problems started, dude was clearly scamming from the start and probably does live in a country were he will face little to no punishment. And he also doesn't care, he just made thousands off other people's work. He could care less, he'll probably try again under a new face and name when the heat dies down

The only reason an internet scam gets punished, especially if it's between countries that don't co-operate a lot, is if it happened to many, many people, the losses were massive or the victims were very, very popular. And even then the chances aren't crazy big. On the flipside it's not unlikely you'll end up losing more money and nothing else if you go after a scammer especially if you lose. The only hope you can get most times is that it gets traction or the local (yours and theirs) authority are interested in the intel. The very first thing you should do once you realize you have been scammed is to talk to your bank (or whoever owns the transaction system used to pay), then lawyer about it. Otherwise all you can do is warn others of who is a fraud. Yes it's illegal but people ignore how difficult it is to actually do anything about it with online scammers

Nijisanji is pure scum. They make tons of money and invest just the bare minimum into their talents. They sign on more and more people, squeeze them dry, and when the entire thing becomes unprofitable they will shut down 100%. You cannot blame the talents for signing on because for them it could be a big break and even if Niji fails, they might have gained enough reputation to be successful elsewhere, but it's so sad to see when you compare it to better companies and know that some assholes are laughing all the way to the bank.

Never EVER under any circumstances pay the full amount in advance. Doesn't matter how many people tell you the person is an upstanding guy, doesn't matter how reliable the company may seem, doesn't matter who is supposedly backing the project. If a person/company refuses to sign a contract and allow you to pay only a portion up front with the remainder on completion, walk away and find another company to work with. Especially when talking about projects costing in the tens of thousands of dollars. On top of that, if the person you are working with keeps asking for more money throughout the course of the project: Refuse additional funds and if they say they can't complete the project demand a full refund and terminate the project. Make sure you do this soon enough to demand a full chargeback from paypal or whichever payment provider you used if they either refuse a refund or try to use delaying tactics. It is on the customer to protect themselves from these kinds of scams. Know your options. Make sure any contract you sign guarantees a full refund if services cannot be rendered in time and on budget, and make sure the payment provider you use has a chargeback option that will get you your money back.

5:28 Sounds like his studio was going under, and he panicked. Like he asked people to pay upfront to try and keep the studio afloat, but then messed up and used the money for business expenses instead of paying animators, so they all left and he couldn't finish any jobs... At least, that's what I'd hope happened, because that would mean there's a chance of people getting their refunds.

Call me cynical but I have a feeling that his studio was made to function as a base for scamming rather than for honest work. Meaning it was set to fall apart from the beginning. Saruei said she gave him 23k but only 10k went to the people working on her project. I dare say every other project got the same treatment. This guy pocketed more than half of the money and underpaid the workers.

Not delivering on what you are legally required to provide is a punishable offence. When you take another's money to deliver a product you are opening yourself up to prison-time for not A) providing the product advertised, or B) refund all money given to you for it. Taking the money and running is theft. This person should not just be sued; they should be arrested and left to rot in prison.

@@gobalbucs Gross negligence doesn't protect against liability. In fact courts will not give exceptions if wanton/gross negligence is involved or/and harm is willfully inflicted. Normal negligence allows room for negotiation. Through, from what is known so far, such is way out the door. Especially, for example, when you cut contact with your clients/customers. That in and of itself is often a major red-flag to the courts that a business is seeking to escape it's obligations.

For a civil case, it's still a breach of contract and he's liable for the money he owes and the damages he caused (This includes both emotional damages from stress but also financial damages from these productions being delayed as people he didn't pay, ditched the projects) Malicious intent will be difficult to prove, while breach of contract is much easier (Though is made more complicated due to there not being actual written contracts) At the very least, he should end up having to repay the money he owes... That is if he can afford it. It's likely that the dude is completely broke and would be unable to repay the money let alone provide reparations for additional damages...

As much as im rooting for the folks affected to get justice, its gonna be quite the uphill battle getting their money back. No contracts signed (b r u h), the guy was probably originally legit since he had an actual team (will be harder to argue in court it was malicious vs negligence type stuff), and transactions being done through paypal as your only sort of protection is pretty rough. at least the dude is prolly fucked if he ever shows his face in public/online. Maybe the vtubers can get Tonari in on it since he was falsely using their name/work as his own.

One can established a fundamental contract via chat logs/records. While not as strong as your standard one, it'll be good enough to show intent. Negligence doesn't matter once it becomes Gross Negligence, as courts will give no exceptions when Gross/wanton Negligence and willful acts of harm are involved. Malice can be shown by completely cutting off contact. Basically tosses any good faith arguments right out the window.

Few rules in business: Rule number 1 in business: know who you are dealing with and their history (even weeks worth of background checks if you have to). Rule 2 in business: if they are asking full cash upfront then chances of them scamming you are drastically higher then you may think and you honestly should rather take your chances somewhere else. Rule 3 in business: if you’re able to get a ID of them in anyway you can that is legal so even if they try to disappear with your money then you have a bit of leverage for them to return your money or you will publicly show them the face of the person scamming and what they been doing. (I admit this rule is pretty dramatic for some people understandably but this is what I would do if I want giving away huge amounts of money). 4 rule in business: in online business always have text receipts and have a record of your interactions (especially on the phone and places where they can delete their message at any time) so when it’s time to be in court their is little to no breathing room for them to bs their way out of it and watch their defence crumble to pieces and don’t let them gaslight you ether when your asking for your money back. Things like “oh but I got a family mwamwamwa” or “please I need the money, I’ll pay you back later” do not fall for that crap if they making excuses to keep your money. They brought it on themselves and those around them and they have to deal with the consequences for their actions. That’s my personal rules of business engagement because I got scammed once and it was not fun. Never again

When this much money is concerned don’t they think to sign binding contracts? I never pay any large sums of money with any sort of legally binding receipt or contract. Sure, i’ve never really trusted others, but a contract seems basic when money is concerned. I’m not saying the douchebag doesn’t deserve to be sued into oblivion, but without binding contracts and receipts i’m pretty sure there isn’t much point in a lawsuit right (i’m not a lawyer)?

People like this make a career out of it; roll in, get imbedded in a company or project, overpromise and pull resources, and then bail. It's unfortunate a lot of them got hit with this. I dont want to sound like an asshole here but it looks like there were alot of redflags, notable of them being a lack of nda's. That alone is a huge redflag for professionalism let alone the marketing issues with taking someone else products to use in promotional material. So if you land into something like this you had to have not looked into the business practice or done more due dillegence regaurding the matter. Hope they can fix this eh.

IMO it feels like mismanagement to the highest degree, wanting to overpromise and only realizing too late how expensive it was to make animation and pay animators, but figured if he kept taking money from more project at some point he'd be able to deliver one and use the kickbacks for the next projects. It's popular in the business world to use other's money to finance your own projects and success, and never yours. Maybe at some point he realized he could make all of this money from these victims if he did a total rugpull, got as many projects as possible, and dipped out. Geega's pretty cutt-throat and honest when it comes to business and content, not surprised she'd be going in with an escape strategy.
