I think it is a narrow miss, but it’s debatable. The statement, taken as a whole, is a bit too general, in my opinion (and it has to be taken as a whole). The only reference to McMorrow is the “like McMorrow” part. Torts isn’t my field, though, nor is Michigan a state in which I practice. (I had originally responded before hearing Theis’s statement, just hearing McMorrow’s summation of that statement, so apologies for that.) The statement is really gross, no question. McMorrow is probably dealing with it in the correct way.
