I wondered about this too: apparently first degree murder is a rarer charge in NY. There are a few strict criteria a crime must meet or it's second-degree. So while this has the 'second degree' label, for all intents and purposes it is a premeditated murder, hence the life sentence.

I've got family like Porco, who spent all his teen years ripping his mom's all-gold jewelry off time & time again, stealing brother's check book & forging checks & they apparently just never did _anything_ about it & it only got worse as years later father died & ultimately the "kid" gained control of the family goods, the house & even his mom as she was dying, then letting her beloved cat outside in a snow storm to disappear forever. _WAKE UP, PEOPLE, FRIENDS & FAMILY'LL DO IT TO YOU FASTER THAN TOTAL STRANGERS_ . When I was 15 Our family Doctor and his wife were murdered by their son who was in the class above us. This murderer was hyper active, oblivious and harmful to students. He was tried as an adult. The violent deaths of Dr. and Mrs.B really shook our small town up. Oddly no one ever talked about it and yet Dr.Bresnann was the only doctor in town, everybody knew him and the family. Often wonder what happened to the sister, she was just a year older than Jim, He used a knife, not just shooting. He lied and tried to cover it up by saying a stranger came to the camp grounds and killed them. I haven't been able to deal with it until lately. It just never made sense to me. But when 24 years ago my daughter said she wanted to kill me I listened to that and so after many years of her hate and anger I removed myself from the continent. I had to come to terms with why she felt that way and that it wasn't going to change.I saw similarities in her behaviors and traits and other dangerous people and so I heeded my instincts. It hasn't been easy. The need to keep mothering is very strong.

What blew me away in this case was the fact that a severely injured Peter came to and set about his daily routine like a zombie. He washed his teeth, started breakfast and even went to pick up his newspaper before succumbing to his injuries. One explanation given was that as his neocortex (the outer part of our brain) was severy damaged, his paleocortex (which is responsible for second nature took over, guiding the body to go through his routine habits. I remember first seeing that in a CSI episode and then heard about the Porco case.

I can't help but think that the brother, Johnathan has to be dealing with an unusual situation when he sees his mother. He is the son of a murdered father and a mother who survived the attempt on her life. His mother is left with severe permanent injuries. His only brother is the obvious killer. Yet his mother staunchly defends and very publicly proclaims his brother's innocence. Surely Johnathan must be experiencing conflicting emotions.

My sister lived a few houses away from the Porco’s in Delmar. I live on the other side of Albany and remember this case very well. It’s so sad. I’ve seen his Mom in the market. It’s awful what was done to her n her husband. She’s severely disfigured.Christopher’s own parents. I can’t imagine harming another and the thought of harming my own parents is unimaginable. Most of the people in the neighborhood thought he was capable of this and the immediate buzz was that it was him. It’s rumored that she knows he’s guilty but loves him anyway. She blames herself for going wrong somewhere as a parent. Again, it’s pure speculation on my part. I don’t know if this is really true or not. Delmar is a close knit community and the Porco’s were very well liked people. People still talk about it. Mr. Porco was beloved at his job. He is sorely missed. My prayers to Mrs. Porco. 🙏🏾

He kept stealing money from his parents when he went away to college (fraudulently) n his father threatened to cut him off. He was spending their money like it was his job. That was shortly before he murdered his father but failed at killing his mother. The two children were going to inherit money. That’s why they presume he did it motive wise. From the things that came out in the trial it appears they were good parents n good people. I remember Peter’s coworkers on the news being very emotional talking about him n what a wonderful man he was to everyone. He was an Appellate Division court clerk. No abuse or violence in the home. He's so arrogant as he's holding his mothers hand and smiling while her face is all disfigured from him hitting her with an ax. Doesn't bother him one bit. Narcissists and borderlines are dangerous. Run for the hills as soon as you know they are one and cut off all contact if possible. Even the seemingly not-so-dangerous-yet ones do have the potential to develop into one. I have seen one narcissist acting more and more in harmful ways. They change, and most often to the worse direction. The older they get, they more diabolical they are and they behave. It’s hard to believe they can, but the fact they keep lowering their moral standard has gradually convinced me to expect the worst from these personalities. There’s no limit to how low and cruel these characters can go. Experience and educating myself on Cluster B personalities has helped me reaching this mental clarity. Thank goodness for the availability of educational contents on the internet nowadays. I believe it has saved lots of innocent victims lives, or mental and physical health. I grew up knowing my borderline mom is the most dangerous person on earth that can kill or harm us kids badly. My dad recently told me on the phone that he felt she’s a scary psychopath and could kill. I could imagine his eyes filled with terror when he voluntarily told me this. Meanwhile he hasn’t treated us kids good either, he’s more of the neglecting, selfish and occasionally abusive parent, and often was and still is my mom’s flying monkey in abusing us so he can save his own ass by joining her. He’s a man coward, I have zero respect for him. I am a parent now, I can’t help comparing him with myself as parent, and he has less than one tenth of the giving, caring and protection I have given to my children.

The father’s post-injury behaviour reminds me of a case I saw in a very sad documentary years ago. I can’t recall the names of the victims but the perpetrator murdered a woman, her husband, her younger son, and kidnapped her daughter. He murdered the family with a hammer. He also struck the older son, age 13, in the head with the hammer. As he drove away with the daughter, she saw her brother grab his bleeding head and attempt to sit at the picnic table but was unable to and fell to the ground and also died. It was such a disturbing case. The girl was rescued by a heroic and clever and observant waitress. The killer was arrested. I often consider the poor teenage boy, trying to rest his battered body at that table and it’s so heartbreaking. His actions reminded me of this father in this story.

Thank you Dr Grande for the comments at the end of this case. Peter rationally understood that his son was a psychopath. Peter could not emotionally accept the reality . Peter hoped that his son could be redeemed. Isn’t that similar to “Denial “ in psychology. A defense mechanism that must be much more stronger than I thought.

In every murder case where the family has some or all of their members disbelieving that someone in their clan could commit murder in spite of all of the evidence...I feel terrible for them because the continue to enable the bad person and hide the truth from themselves...to their detriment. Sometimes they wake up but sadly not before a lot more psychological damage is done on top of the crime or crimes that led them there in the first place.

Oh this is a great real life story to do a commentary on. I actually watched that movie. In it, it said he was good at computers and was somehow able to get in to the university's report card site and change all his failing grades, to A's. Then presented it to his mother. Dr. Grande I've often wondered how he feels when his mother visits him in prison. You just made a great point. I truly believe he gets pleasure from seeing his mom viciously axed by him and knowing she still believes he is innocent. I've also watched this case on unsolved mysteries and forensic files. It is extremely heart breaking to watch his dad walk around the house after the brutal attack and blood is gushing out everywhere. Such a sad story! He's right where he belongs!

Denial to believe in his innocence? If a child of mine treated me this way I would give them the infj door slam. Why waste the gas to visit someone like that in prison? Those kind of behaviors should be expected when one or both parents do not teach boundaries. Of course some bad apples also refuse to learn. What a fool believes. I don’t have any doubts that he’s glad his mom survived. Only because he wouldn’t get any visitors and she helped him on the stand. I highly doubt he feels sorry and it just strokes his ego that he was “right” to kill his dad and attempt to kill his mom. He’s just taking advantage of her and I wonder if her brain damage made her forget the trauma she experienced.

If the parents had head injuries couldn't that have affected what they did, saw, remembered, etc? The revenger in me wonders if the mother and son are able to visit 'alone'. Did she early on tell him if he wanted donations to his candy account to continue he better sit quietly while she cursed him L, R, and C. Women can keep secrets and no one will know til she dies and the donations stop. The other son must do a lot of tongue biting. Also, was there ever an idea he may not have been alone?
