Thanks for covering this and reading it. I’m a lawyer in MA who does almost entirely post-conviction work/new trial motions/direct appeals and on. This is a whopper. I’ve never heard of allegations like this toward a clerk of courts. It’s not uncommon to see claims of police misconduct, of prosecutorial misconduct, even of juror misconduct… but by the clerk, this is the first time I’ve seen something like this. Lawyers don’t make these sorts of claims on a whim. Clerks are people you routinely have to work with and those are bridges you do not want to burn. My prediction based off this: It should warrant a new trial, but my safer prediction is it gets an evidentiary hearing and not a new trial just on the papers. After that, who knows.

Obviously there needs to be an evidentiary hearing. Hopefully they will allow cameras. We need to see the evidence before we can opine whether Alec should get a new trial.

Regardless of guilt or innocence, EVERYONE deserves a FAIR trial. If an evidentiary trial concludes with these accusations to be true against Becky, then Murdaugh should get a new trial.

What bugged me about the trial is they wanted to prove he is a bad person therefore he did it. They ended up providing 3 other groups of people he screwed over might have wanted it done to make him suffer. The sad thing is they didn't bother to preserve the evidence properly so we now will never know

@@ERSwangerit escalated because of people’s subconscious biases about rich white men should get the benefit of the doubt because, surely they couldn’t murder their wife and son. People have given Alec so many excuses because he looks the part. He was found to be guilty by a jury of his peers in the jurisdiction that he demanded. Yes, it escalated quickly but it is a direct consequence of situational morality. Change the ethnicity or economic status and see whether people would have the same reaction to get him a new trial. People have been sent to jail with far less evidence. They don’t have the luxury of having expensive lawyers and that is a shame for every American.

PURE speculation on my part ... but if I was a juror I might have assumed her comments and behavior were OK since she "spoke" for the court. I might have wondered if it was OK, but not wanted to rock the boat and reassured myself it was OK since she was part of the court structure. They knew many eyes in the country were on what they were doing.

Thanks for covering this, Peter. I totally agree with you. If these are facts, then he definitely deserves a hearing. If that hearing finds he needs a new trial, so be it. This is the only system we have, and even with all it’s faults, it’s the best we have. If a new trial is had, and if he is guilty, then we have to trust the jury to see that with the evidence presented.

He should get a new trial. If there's enough evidence to find him guilty then they should be able to do that without interference. It MUST be a fair trial in every aspect for EVERY defendant, regardless how messed up he is.

Should he? We have to get these people on the stand to swear under oath that their Affidavits are true. It’s interesting that the egg lady declared that she hadn’t made up her mind about guilt or innocence, yet is the reason for the potential for a new trial. She’s a Karen.

@@changeminds2736 we haven’t heard the alleged evidence. She takes up the majority of the filings from the Defense Team. Most of the statements are allegations, and it seems like she really, really wanted to hang that jury just like her tenants told a coworker. If she “hadn’t made up her mind” like she said when confronted, why did it matter about Alex being convicted by a jury of his peers? After all, she hadn’t made up her mind, BUT she had a problem with the guns not being found. Good grief I’m also disturbed by the usage of purportedly throughout her Affidavit. Few people use that word with the exception of attorneys. Someone in that office coached that woman and it’s probably going to blow up in her face if she lied, for a great case of defamation and slander. The allegations include believing that the Jury conspired and had secret talks with the Clerk of the Court. There’s also the allegation that the Clerk walked with the Foreman of the Jury. Keep in mind that both the Judge, baliff, Defense Attorneys, and numerous others were there also. If there was a problem, why wasn’t it brought up during the trial? The Facebook posts did occur. It was the wrong person, but still had nothing to do with the egg lady’s dismissal. There is absolutely NO evidence that the Clerk swayed the jury. None. The supposed evidence is a direct result of 2 jurors who are assumed what was occurring. Social Media and Internet geniuses have blown this up out of proportion. This smells of Alec and his gift of grifting people and they never see a dime of their money. As we speak, the Satterfield sons are being dragged through the mud. @@Tinmann_77 interesting. You’re making the assumption that Alex didn’t receive a fair trial. What are your facts? We have yet to get the allegations to stand up to scrutiny in the courts. Until proven otherwise, he’s been found guilty by a jury of his peers and the verdict stands. The document is full of allegations that mean nothing. The juror can wear whatever he wants whenever he wants. The Egg Lady was not removed because of the Facebook Post that actually did occur. She was dismissed for discussing the case with her tenants. She admitted to talking about the case. This is factual. Poot is extremely good at taking comments out of context and swaying public opinions. These too are facts. Not even his attorneys asserted that Alex was found guilty because he was unlikeable. This is an interesting assumption on your part. It’s evident that he was well liked because the witnesses said so during the trial. Even the Judge stated that Alex was well regarded. It’s unnecessary to attack someone and try to discredit the entire judicial system because you disagree. Enjoy your day. I’m out

Becky said she/they communicated with their eyes. Personally I think communication with eyes or facial expressions can be just as effective as words. After all, some of us witnessed a husband laugh at a mans joke, but after his wife rolled her eyes, he got up and slapped that joker.

I find the made up Facebook story and confronting the jury herself about the ex is really damning. And Judge Newman has already admitted to that happening. I don’t want Murdaugh to have another trial but feel he probably deserves one in this case.

There should be an evidentiary hearing. Per court documents, the Facebook issue with the egg juror was brought to Judge Newman by Ms Hill. If the allegations surrounding that story alone are substantiated in the hearing, there should be a new trial. And Ms Hill should be barred from profiting from her actions.

I read a bunch of the reviews on Becky Hill’s book and unfortunately, it really does sound like she did what they are accusing her of doing definitely disappointing that somebody would abuse their power for their own fame and attention.

I hope there is a new trial because I never felt his guilt was proven beyond a reasonable doubt. I had doubt. A bad guy history doesn’t equate to an automatic guilty verdict for murder.

No, that’s not why he was found guilty. He was convicted on plenty of evidence. His inconsistency stories of that night, testimonies of the house keepers, etc. Dick and Jim have made these things against Becky much more than what they are.

The juror was dismissed because she to talked to her renters over the weekend while delivering them a refrigerator about the trial Judge Newman interviewed the renters He also told the juror this her dismissal was not because of email

*Again Alex was a prosecutor, he investigated crimes.* _The chief/s testified that they didn't authorize him to have the lights on his vehicle, although installed by the police mechanic, that all law enforcement vehicles in the county would go to for lights. He had a badge because he was a sworn solicitor for the 14th circuit solicitor's office, he was law enforcement._ *_Did you watch the trial?_*

Even if he gets a new trial, by the time he goes back to court on all the charges related to theft, tax evasion and everything else, he will still spend the rest of his life in prison. Give him a new trial while prosecuting him on the other stuff. The guy's life is over as he knew it. No wife, no son and no money.

Yes, Murdaugh should and will get an evidentiary hearing. A new trial? It depends on which of Murdaugh's assertions are deemed credible in that hearing.

If it's proven an officer of the court tampered with the jury.... he should get a new trial even if nothing else is proven (fun fact the judge already admitted Becky tampered with the jury by having inappropriate convos with them so.....) and the court officer should be immediately fired and charged.

Not letting the jurors take cigarette breaks while deliberating _imo,_ is reason enough to warrant a new trial. If they were allowed to during normal court proceedings, than they should also be allowed to during heated debate and deliberations. I realise it is weird and seems insignificant, but cigarettes are addictive and historically cause people to make very poor decisions The best example is they will kill _you_ and yet _you_ continue to smoke them, I am sure I could rattle off a dozen more examples of the brainless mistakes/consequences people *_will_* make when they are addicted to nicotine. _Agreeing to vote quilty, for a cigarette, is twice as smart as the worst nicotine compromise _*_all_*_ of the 6 jurors that smoke have made that _day._ *_Juror Craig Moyer Said of deliberations;_* _Juror Craig Moyer told ABC News that when deliberations began, the jury immediately took a poll that came back with nine guilty votes. It didn’t take long to convince the other three._ _Initially, two jurors didn’t believe Murdaugh was the murderer, and Moyer said deliberations got heated. He said he isn’t sure what changed their minds before all 12 jurors quickly came to a consensus._ _“It was kind of loud, everybody talking over each other, but we got it done.” Moyer said, stressing that every juror was serious when discussing the case._

@@jayneroberson-blume804 lol no I wasn't in the room but I did read their affidavits. Did I offend you that you are slowly d----ing by smoking? Some people just don't have good willpower . I actually think Murdaugh is guilty, however he needs to be convicted lawfully. This isn't even an appeal yet, this is a problem with the original trial not a misstep by either the prosecutor, the judge or the defense attorneys. P.S. See how long you can go without a cigarette before you respond.

Legal Muggle here…I’ve just watched series 2 of the Murdaugh Murders on Netflix. Ms Becky sure had a lot to say on there too. I find this all absolutely fascinating - although your law system is kind of based on ours, it’s so different here in the UK! Regardless of the outcome, it’s all popcorn worthy for me! Love all the coverage across LawTube!

If it is proven the clerk acted outside of her duties in the way accused, Murdaugh deserves a new trial. I also think the clerk should be fired.

I have several times read that juries are composed of people who are too stupid to get out of jury duty.

There are only two Affidavits received from the jurors: one from the egg lady and the other from someone else. What bothered me about the egg lady’s Affidavit was the usage of the word purportedly. This is not a word commonly used by anyone other than Attorneys. The Affidavits were full of gossip about people going into the restroom and a few people were calling it A & D time. I’m sure that those African American women had to be “up to something”, 😅 just like the young man who wore a tie throughout the trial, but they assumed that he was wanting fame. I think that the Egg lady is lying. Hee comments to her tenants were so alarming that the woman who heard this sent the email to the Court. No one knows what Ms. Hill, an elected official, said or discussed. We do know that there was a FBook post, she couldn’t know because the egg lady came to her also to get another restraining order from the Clerk because her husband had moved back to the county. I think that an evidentiary hearing must occur at this point. I don’t think that Alex should get a new trial. There were enough jurors who believed that he was guilty after his testimony and the trip to the scene of the murders. There are many who believe that the absence of the guns aren’t enough evidence for a conviction. I’ve seen convictions for far less evidence. Great job in sticking with the facts. There will not be a new trial and the attorneys are moving to get the money owed to so many through trickery at the Federal level. Peace

I thought defense lawyers were having a conference outside while being camera recorded amongst this topic.. and that legally if you know there is possible chance of jury tampering while the trial is going on you must confess that to the judge when you notice it's happening. And they didn't announce any of this to judge Clifton Newman . So now they're coming back and saying that they didn't know and now it's cause for mistrial? What a load ofBS. IMO. It doesn't matter the next jury will find him guilty regardless the evidence is there. All this irritates me

Given the *on the record* reference to the clerk interrogating a juror, the facebook history proving the clerk lied, and the jurist being removed... I don't see how a mistrial CAN be legitimately avoided. A court official causing the removal of an impaneled juror via deceit MUST be considered prejudicial, regardless of conversations/reasoning/etc. Imagine a prosecutor falsifying facebook posts to get a juror dismissed - that would similarly demand a mistrial. Allowing *anyone* to effect the makeup of the jury via intentional deception for *any* purpose after the proceedings have begun and the reactions are observable is a fundamental affront to the idea of justice. Alternates are an insufficient cure - the only sufficient cure would be to have *no one* able to observe the jury during the entire trial. For comparison - imagine if the entire jury pool was seated for the whole trial, and voir dire happened at the end of trial right before deliberations. The judge would be able to literally direct the verdict by choosing jurors that reacted in line with his own views. (selective striking of others)

FYI - There is a book on Amazon, "Defending Alex Murdaugh" Not Guilty by Reasonable Doubt, by Crime and Cask. (also has RU-vid) with the hypothesis of 2 shooters who left Moselle just before Alex with Maggie's phone. He claims, per SLED timelines, her phone was tossed on the side of the road at 9:06 20 sec. Alex's phone was in his car outside the house at Moselle at 9:07 PM when he left to see his mother. If true, Alex could not have had Maggie's phone. He presents other information that is compelling. Might be worth a look.

They said they heard some vague rumors, of the type that come during any famous trial. They didn’t have specifics. You can’t go to the judge without something more substantial than vague gossip.

@@Debra711 The meeting was only about the FB thing & Egg Lady’s tenants. Hoot objected in the meeting & again in open court. The defence didn’t learn anything solid until AFTER the verdict. You can’t go to the judge based on courthouse whispers & rumors. That’s all they had until the jurors themselves came forward.

I watched this trial everyday. Never saw any documentary on him and knew absolutely nothing going into this case. IMO they proved financial crimes. I would of found him not guilty for murder. They showed no proof that he murdered them. All speculation. He may be fully guilty of these murders but I didn’t see any real proof that convinced me he pulled the trigger.

I think it was the other way around. The more common practice is for the jury to choose. But this judge prefers to choose the foreperson himself. That’s in general, not just gor this trial.

Defense MUST get an evidentiary hearing regarding what's come to the surface. If the allegations of Ms. Becky having private conversations in a one-on-one setting with a cherry picked juror are shown to be true then I don't need to hear anymore. Same with telling any juror to not discuss said conversation with other jurors. Regardless of Ms. Becky's book deal being lucrative or not- if the above is shown to be true, defense MUST be granted a new trial. If a new trial is granted then we must rely on the facts presented to obtain the correct outcome in proper accordance with the justice system. It just has to happen again if it's shown that it didn't happen correctly the first time.

If the allegations are proven, then he should get a new trial. I didn’t like that the judge let all the money stuff came in. That seemed prejudicial. It didn’t seem relevant to his murder trial. I’m still on the fence as to whether he killed them. I don’t see a reason he would kill his own son and wife. It doesn’t make sense. Idk…

I think he's guilty but he should get a new trial. I've served on a jury involving a murder charge. The clerk only spoke to us regarding how long a break was and when we should expect to be back in the cortroom. Also to ask if we needed anything once we were in deliberation. Nothing about the case itself.

IF allegations are proven, then yes - has to be a new trial. I'll watch the hearing with great interest bc defense counsel has been sketchy throughout the trial in a variety of ways. I'm still confused about why/how The Elected clerk was the courtroom clerk in that case. In the jurisdiction where i practiced, each judge had his/her own courtroom clerk. The head if the clerk's office administration was not ever a courtroom clerk. The constant hammering on Hill's election is unusual to me. But it makes it all the worse - IF true - that a person of added importance/impact bc she was "elected."

All of the other incidents I don't agree with, but the one accusation that I particularly was completely unfazed by was the court clerk and juror going into a bathroom together -- I have a chronic illness and invisible disability and have gotten called up to try jury duty 3x. In my state the clerk of courts is the point of contact for disability accommodations that are needed (and since jurors have to be kept in private away from potential people for support who may normally help them) -- disabilities are usually to be kept under discretion and tons of them need help with issues where the bathroom is the right place to get that support. If she's in the bathroom helping a foreperson with an accommodation then that wouldn't be a big deal. If they're just in there gossiping, then it's different. But just because they were in the bathroom together that doesn't mean much -- she could just be fulfilling her duties to the 1 out of 5 people in the US that could get summoned to jury duty having disabilities that might need an accommodation and helping with that accommodation. That would be her job to help if she can.

I think there needs to be a hearing. Everyone needs to be questioned, all evidence presented. Then the court can make an informed decision. But if what the defense alleges is true, it’s hard to imagine that not warranting a new trial

Absolutely needs an evidentiary hearing as there is a he said/she said given there are several jurors who deny the allegations & 2 who reported the allegation. Ms. Hill has been clerk of court for decades & is very well-respected based on what I’ve heard, & has never had allegations like these made or any related complaints against her. While that doesn’t guarantee Ms. Hill is innocent of these allegations, it seems unlikely given the best predictor of current behavior is past behavior. These allegations all relate to very basic no-no’s when interacting with jurors. It is shocking if she made that kind of error unless she has very personal feelings about the defendant that interfered w/ her judgment, which again, seems unlikely, imo. Ms. Hill also has a special affinity for the Murdaugh family/the men due to having worked under Alex’s father when he was county solicitor general.

These allegations are so flagrant, I don't see how nobody noticed! I also can't understand why such an experienced and trusted clerk could possibly go so completely off the rails. I'm clinging to that, because this is such a disaster. And I can't help but consider that money is involved in possibly creating these allegations. Murdaugh had always thrown it around to get things to go his way. It certainly can't be ruled out.

He MUST get a new trial; at this point... there is enough clear substantiated evidence to show that deliberate & destructive jury tampering occured. MS Becky should of course be barred from her position for life, and she should serve a prison term. If even a third of what is being alledged is true there should (MUST) be a new trial; period. marcus
