Omg... $2000 in debt and it turned in to $14000. This is why I don't wanna deal with credit cards anymore. That would make me physically sick. This poor girl.

pamelam4 How about she paid the $2,000 before it became $14,000? Is not like it happened over night you know. It happened through years and years of her just thinking it would magically go away and there would be no consequence simply because it didn't ruin her credit. Poor girl couldn't get away with theft.

I'm in the financial industry. I've helped two people settle with creditors for pennies on the dollar (roughly 30% of the original debt amount) without giving any of their information, no garnishments, judgments, etc. Dave knows exactly what he's talking about. Yes, you "po mouth". You just have to know how desperate they are to get it cleared and know how to negotiate.

I was recently garnished by the Department of Education for a student loan I received in 1989. At the time of my default there was a six year statute of limitations (20 usc 1091). 3 years after the statute of limitations for my loan had passed, congress amended, 20 usc 1091 , eliminating the statute of limitation. Is it a violation of the ex post facto clause to impose sanctions on me based on amended law that was enacted after the statute of limitations had passed?

​@@phuqueu9237No. The law itself didn't change (the law that you have to pay tour loans). They merely extended the time that the creditor has to pursue you under the law. It's somewhat silly logic, yes, but that is what SCOTUS has repeatedly decided.

I know someone who declared bankruptcy and in three months he was getting credit card offers. This was around 2009 or 2010. Today he has a mortgage, bought a car, he's better off than he ever was. But he was not irresponsible. Divorce, housing crash, lost job all at once did him in. But he came out great.

This American Life did a story recently about garnished wages. They found a town of neighborhoods where 1 in 4 households was being garnished by the SAME company. Even the Mayor was garnished! If you're interested, it's Episode #573 Status Update. Act 3: "There Owes the Neighborhood".

Here's a tip! Dispute that judgement with a debt valditation letter and also through the credit bureaus. They have 30 days to respond by LAW if they dont it falls off.

True, but it does not stop collection efforts. I think people fail to realize the "dispute" leaves them no option but to pursue it then. disputing something that is not legit will paint you into a corner if the balance justifies lawsuit.

@@liliyalapik7434 she should get a completely NEW checking acct to settle this and close the account within 6mos--so many people have 1 bad luck turn into a catastrophe that ruins their lives... most of us are just 1 car accident away from losing our ability to work and keep a roof over our heads. The politicians don't care because they actually own or are part owners of these FEES and MORE FEES collection companies---there must be a FEDERAL STATUTORY LIMIT on the amount of additional fees that bad debt can accumulate -*-*-*- if you wouldn't give a company your wallet to hold, NEVER give them access to your bank account * Dave's been 100% right, these companies lie lie lie if it get them the money --- if it's not in writing, it does NOT exist, their words mean nothing

I had wages garnished once. The employer charged around $40 to take care of it and if you have another garnishment, you will lose your job. Do what you can to avoid garnishment.

The IRS seized my brothers checking account and garnished 💯 percent of his wages from his employer. His bank charged him for all of the checks that bounced back because of the IRS seizure. These government agencies cause more problems by not garnishing a reasonable amount.

The VA had my wages garnished for a debt that I had already paid them. Had the written plan of payment and bank statements lined up. It was always someone else's problem or fault.

unwankster unwankster - There were late fees and interest before charge off. Then you had to pay for court filings and then pay for an attorney. That is not cheap! Also, she said it was an old judgement. If it's stipulated in it to add interest, that's more fees.

@@roxcyn There is no way way a $2,000 debt turns into owing $14,000 I don't care how long the debt is. That debt collection agency paid next to nothing to get the judgement, there was no trial, no jury. At the most the interest is 10 percent a year.

This is true. If the amount forgiven is more than $600, you will pay taxes on the amount forgiven.

@Curt Christensen yes money you received, as a loan, that you are not expected to pay back, is income. Only the forgiven debt because the creditor is saying you don't have to pay it back. When it's not forgiven or settled, it's not income because they try to get it paid back.

data furnishers are not required (and really forbidden) from bartering for removal for payment. don't be mislead by this notion that all you have to do is argue and challenge for removal. if the data furnisher complys with the law then you have no arguement.

100% agree with Ramsey all the time but if it’s old debt and not on the credit report you are not responsible for the debt (morally you are) but she’s in a hardship send a verification letter or 609 letter to the creditors ... and have them stop the garnishments and attempt to collect the debt .

What I don’t understand is how an unpaid credit card account stays open that long and continues accumulating interest. After several month of non-payment wouldn’t the account be closed or charged off?? And how does it turn into 14k without her knowing? She made it sound like several years went by and then she was hit with a surprise bill for 14k.

Statute of limitations on debt is different depending on which state you live in. For consumer debt, it isn't nearly as forgivable as other types of debt. The cc debt can be charged off but before they do this,they sell the debt to collection agencies to recoup some of their money. The collection agencies then pursues you to collect the debt they bought. All the time that passes, you still accrue late charges,fees,attorney wages,etc.(hence why it became $14k). These collection agencies buy your debt for pennies on the dollar(lucrative business). This is why Dave told her to negotiate a much smaller amount. After a period of time,usually the collection agency will negotiate just to get their investment back with a little bit of profit...something is better than nothing. I hope this helps your question.

It's not just credit card debt. It became a judgment. A judgment is good for 10 years then creditors can renew it every 10 years.

I was just sent my last letter said my wages will be garnish and I've had this over my head for about 7 years now and it's really stressing me out. My credit would be perfect if I can get this from over my head. I work Parttime and have a child . My original loan was for 8,000 and now 11,000 including interest. What should I do??? If someone can give me advice I would appreciate it

It will not work if the student loan is not private. If you have a federal student loan, you owe the government and they don't do settlements. Settlements are for private companies only like credit cards, medical bills, and consumer debt. Federal loans have income-based payment plan if you just need help getting your head above water.

If you are not working, federal student loans can go into deferment for a period of time. If you are, then I suggest the income-based payment plan. You can always switch it back to standard after a while. You have to contact the loan provider to do both of those plans. Most federal student loan providers have these options via their website, if you don't want to call them directly. I hope this helps.

Doesn't matter. You don't help people get free from debt by telling them how horrible they were when they accumulated the debt. Most people have no idea the dangers of debt, and as Ramsey often says, it's the most aggressively marketed product in America. Unless we grew up being taught the evils of debt, we're all susceptible to it's lure. You can't blame someone for making the mistakes all of society tells them to make, you can only blame them for not making an effort to change once they've been exposed to the truth. This person is learning the truth the hard way, piling on doesn't help. That's one of the great things about Dave Ramsey. He doesn't guilt trip people he knows need encouragement. This woman clearly needed encouragement right now. She's had her wake up call, now it was time to encourage her own defiance in the face of the enemy. She's armed now. She can fight back.

If you give them access to your checking account they will take all your money out because they lie.... Kind of like how you lied when you said you would borrow money and pay them back.

Lets digest this call. 1. she owes $14,000 and started calling lawyers. 2. Wants to know how to get rid of this debt. I just love the mentality. 3. Lets not honor or repay when capable, but lets get lawyers to bully and try to "get rid" of your debt. what a joke. 4. No it did not get to $14k because of just legal fees. she agreed to a high interest rate. 5. it got there because of her abuse of the card. 6. sadly Dave suggests a settlement of $2000.00 and "don't tell them anything". Guess what they don't have to deal with you then. what Dave should suggest is COMMUNICATE with them and explain your position. if you play his way I will not deal with you and lie in the weeds until you get back on your feet. she sounds young and likely will work again. Judgements are renewable in many states for a small court fee. they will just wait and follow you until they believe you are ready to collect from. so don't take his misplaced advice. 7. this is screwing up your life? the problem is Dave's tactics do not work all the time and he thinks he is helping consumers and the state of economics. I am not a fan, but follow because I know the reality of the business he tries to challenge. And they don't clean out your checking account! he paints every creditor as Satan. ugh! get tough give me a break. Dave you should tell the truth.

A lot of these callers should file chapter 7 and start fresh. Then work your rear off and invest and build wealth.

IamJacksColon4 No garnishment in Carolinas or PA. In PA where I live they can garnish your bank account but can’t touch $300 of it.

Someone else paid off the debt so you do not need to pay the person that paid it for you. You have no contract with them just ignore them

Moses Yang not really basically she was paying on her debt but lost her job. Everyone is not guaranteed a job or a good life. Sometimes bad things happen to good people. I appreciate you're comment though. Hope you never run across hard times.

tobroke2007 In the first 20 seconds she said that the debt is extremely old and she just lost her job... Also $2,000 don't become $14,000 over night... She also said that it didn't show up in her credit report and that she has really good credit... Are you following along wiith what she is saying??? She decided to stop making payments YEARS ago because since it didn't ruin her credit, she thought there wouldn't be any consequences and she would simply get away with not paying it up. It doesn't matter if she just lost her job, she defaulted the bank by choice for years.
