Today I want to teach you how to use nested IRAC. Most students know about the IRAC method, which is where you identify the issue, state the rule, provide some analysis, and then state the conclusion. But nested IRAC involves creating a separate IRAC for each issue and sub-issue on an exam.

Firstly, I watched this video, and I saw no need for it cause I did not know the value. Then I did a moot court where my firm head suggested something similar to nested IRAC but using another term, then I recame back to watch this video. Thank You, very much. Now I get the value of nested IRAC. However, I use my coined variation of IRAC which is ICREAC (issue, conclusion, rule, exception, analysis, conclusion). 👍🏿

Hello, would this apply in the situation of directors duties, such as would I break my paragraph up into smaller paragraphs when I mention subsections of the companies act, as I have mentioned liability under section (1) and section 2(b) in the same paragraph ?

Nested IRAC would look like this for Battery, a three element tort: Issue (Battery) Rule Analysis Issue/element (Intent) Rule Analysis Conclusion Issue/element (harmful or offensive) Rule Analysis Conclusion Issue/element (contact) Rule Analysis Conclusion Conclusion

Look it’s my very first subject and it’s called Australian legal reasoning and methods. There are to assessments- one is fictional case and we have to use irac and the other one is legal research assignment and irac is apparently shall not be used, it’s more like an essay I guess. I might to get back to you on this once I get my task. I’m just super anxious that’s all. lol 😊

IRAC, specifically Nested IRAC, is the foundation for legal reasoning. The format of a legal research assignment is different, since you will need to cite to cases, statutes, and administrative materials. IRAC is nothing more than an organization system that forces you to think about each issue and sub-issue. Hope you do well!

When defining rules, is there only one statement? Can we re-word it at all?

This is an excellent question. Yes, you can reword the rule statement. But make sure that you continue to use the legally relevant words that are part of the rule statement. Here is an example for Battery: A Battery is the intentional harmful or offensive contact of another. Example two: A Battery occurs when someone intentionally touches another in a harmful or offensive manner. See how both statements maintain the key elements: intent, contact, harm or offense.

Hiya, Thank you very much for requesting video ideas. I would find it really useful if you did a video on critical analysis; with a specific focus on how to approach examinations to obtain a distinction grade at masters level or 3L Finals? I have written some ideas below: What specifically would the examiner be looking for when grading papers for both issue spotting exams and general legal essays that would get you a distinction mark? What are the best methods to incorporate additional reading material i.e. journals, articles, cases etc. Is there a particular method that reads better to the examiner, and allows you to score higher points? Is there a specific way that a student should use Journal or article referencing that is different than cases under exam conditions? Are there any common mistakes that students make when using additional materials in exam conditions? how if at all can these mistakes best be avoided? I have started an MA Law course which is an accelerated law conversion. I am therefore having to learn the law in a short space of time, develop legal writing skills and write at M level in closed book exams. They have given us a lot of additional reading material that they say we are expected to incorporate in our critical analysis of any issues that we spot in a fact pattern, as well as have extensive knowledge of case law and know when to apply or distinguish a case. A video that covered higher level critical analysis under exam conditions would be extremely useful :-) Another general idea I think a lot of law students would find useful is a step by step guide on how to distinguish cases on 1. point of law and 2. points of fact. Is there a particular way of doing this that reads better to the examiner? Many thanks for all your help :-)

This is one of the most challenging questions I have received during my entire teaching career. I've certainly read essays that meet this criteria, but rarely have I tried to teach someone this skill. This is because an "A" paper in United States law schools doesn't need this much, though a few students over the years have written essays at that level--always a joy to read. One that still stands out was from a student who used humor appropriately on an exam--only one I've read that has done that. Also, that student was so advanced that he matched the writing level I had seen when I practiced at the U.S. Supreme Court. I'll have to think about this request for a bit since you are asking me, what does it take to get an A+++ paper. But I like challenges. Thanks for making the request, and asking me a new question--I don't see those much anymore.

Professor thanks for sharing your gr8 wisdom. Professor my one question regarding THE IRAC will it be implement towards while READING FILE LIKE 1000 PAGES WITH OCEAN LIKE DOCUMENTS OR AS A TOOL FOR "ART OF READING FILE" OR " BRIEFING A CASE".

IRAC is an essay organization tool. Now, one can also use it for briefing cases, but only because you need to retrain your brain to think in terms of IRAC prior to writing a timed essay.

IRAC is used throughout the common law counties. But it can be used in any discipline as an organizational tool.

In the UK you generally see two types of questions. One type of question involves policy, where IRAC isn’t very useful. The second type of question involves analyzing a set of facts to which you apply the law. It is with this latter type of question where you use IRAC.

I lecture law. It is important to cite legal principles (case law or statutory provisions) in the rule part. Otherwise, the rule part is incomplete.

I tell students to do what their professor asks. In the US, citing law on a timed essay exam is not the norm. But I’ve worked with students in other countries where that is the expectation. Thank you for sharing this with my audience. By the way, where do you teach?

So the key to legal writing is to assume the reader has brain damage? There was nothing confusing or ambiguous about the first answer at all.

The key is to state everything and not leave anything to the reader’s imagination.
