If the lawsuit is against the DA's office, then taxpayer money would be used to pay the suit, but if the DA himself is being sued, then that's on the DA himself, which is how I'd sue him, and also file against him with the Lawyers Bar. Have him lose is state and federal lawyer's license.

The only way the DA faces any sort of judgment. The DA ends up having a taste of karma. Yet, I do not recall a story of any DA being mugged, robbed, or carjacked. Almost like criminals actually pay attention to who the DA and judges are, and they avoid them.

Prosecutors have near absolute immunity, and for good reason. Over the course of hundreds of cases, they'll inevitably have to make plenty of decisions that spark anger in some portion of the public or other. Not only would their jobs be practically impossible, but their decisions would be a lot more tainted by outside pressure if they were trying to constantly dodge legal sanctions for making one bad call. I know it feels like justice to call for their heads when you see the one exceptionally terrible decision that makes the news, but I think that if you step back and think about the broader implications for the functioning of our criminal justice system, it should be clear that you do not want overzealous DAs facing criminal charges.

Killing a man is worse than assaulting a man. He may be justified, but you can't say it's not worse. When Austin Simon stands before the judge of the universe, he's not going to use his stabbing as his defence for his hatred and assault. He will have only one defence, his repentance and the mercy of Jesus. We will see if that is his attitude. Jose Alba reacted naturally and I'm sure six days in the cooler got him to thinking. I think a lot of people in 2020 suggested police officers should be the ones with liability like this. As a former metro cop, I can tell you a lot of the problems people have with the criminal justice system are actually due to horrible DAs and Judges (though obviously there are plenty of bad cops too)

This seems incomprehensible to people from the first world, but as someone from a very corrupt third world country, I can tell you exactly what's going on here. This is not about pity for criminals, but in truth, an act of pure self interest. Why would politicians side with criminals over law-abiding citizens? It's extremely simple-because they are secretly criminals themselves, so making the law less strict is to their own benefit. Either to make their own criminal activities easier, or to make sure they won't face the consequences if they ever get caught. That really is all there is to it.

I went looking for an update on this, and just before Christmas the city's lawyers filed a motion for the lawsuit to be dismissed. They claimed it had been entirely reasonable to arrest Alba based on the testimony of the dead guy's girlfriend and on the security footage. lol. So they're trying to exculpate themselves by the word of the lady that *started* the whole thing as well as the footage that clearly showed Alba was attacked first. Brilliant. Here's hoping the judge realizes they're full of it.

This is absolutely outrageous! The thought of this DA getting away with this miscarriage of justice sickens me to my core. People like this protect criminals and law abiding citizens pay the price in every possible way...physically, mentally, emotionally and financially! The criminal had no bond. The victim had a ridiculously high bond. Imagine how many cases like this slip through the cracks because they didn't get the same media attention and backlash?

I was also outraged by the very high bail that was set. They allow violent criminals out with very low or even no bail, but not him and a couple of other cases I know about. The disparity is the race of the suspect vs. the race of the perceived "victim", as in this case. I hope you keep up with this lawsuit for us!! I'm very interested in the outcome.

Both men in this instance were victims. It is unfortunate that Austin Simon lost his life, but at the same time I can't fault Jose Alba for defending himself against an aggressor. The fact that all this went down over a declined EBT card for some chips is the real sad part. All Tina Lee had to do was ask her BF if he had some money to spare so that she could get the chips for her daughter, or the moment that her EBT card was declined just leave the store and tell her daughter that they can't get the chips, that's it.

Austin Simon violently assaulted a store clerk because his girl friend did not have enough welfare money to buy her daughter over-priced junk food. Austin was stabbed to death in the process. On what planet does that make Austin a victim? I'd like to hear what that mother thinks about the outcome of her actions. A young man is dead now. An old man was brutalized and then imprisoned for a week. For what? Because her child did not get her snack?

He did not have to die the way that he did, and it is unfortunate that-that was how the situation played out especially over a declined EBT transaction and a bag of chips. All the other cases that hit this DA's desk needs to be looked into now. How are you going to be DA, see that kind of evidence and come up with charges on the victim and throw them in jail... Something else feels dirty about this like something is going on behind the scenes on that old man or on his store. It needs to be investigated what the DA's thought process was on this along with the judge that would Grant it, aswell as the jail that would falsely imprisoned him.

The elderly gentleman involved did not warrant such treatment, and it is commendable that he has chosen to pursue legal recourse.
