The requirement is, depending on the level of classification, that such documents are kept safe in accordance with their classification until such time as they are submitted to the National Archives and any copies destroyed. You do not go to the NA and take out a bunch of classified docs 'on loan'.

A lot of documents are just regular administrative work that shouldn't be classified any more than your corporate management notes. Then there are other types of documents that hold real sensitive info, like data on nuclear capabilities of countries - which Trump took. Names of agents deployed in other nations.

During the cold war the CIA relied heavily on the improper disposal of classified documents from the Soviet bureaucracy to inform themselves. The US has one of the biggest. Add that most politicians are backward assholes demanding paper copies of everything.. and voila!

Yeah. In an ideal world this wouldn't happen at all, but I think we're all getting a dose of reality here. Particularly with people who deal with that much documentation, so much of it classified in some way, and probably quite often while in transit between one place and another. If I had to keep track of every piece of paper somebody shoved in to my face between bites of a sandwich and while boarding an aircraft, I think I would probably forget some, too.

While not excusing mishandling, there's long been concern about the phenomenon of "classification bloat", wherein more documents are classified than need to be in order to avoid oversight and more people are granted clearances than need them because it's regarded as a status symbol. A psychologist would see that as classic lying behavior and visible cognitive dissonance. Pence, who claims to be a "main of honor" which he is not (i.e., Trump's running mate = NOT honorable) had to sit there and lie directly on camera for a question he may not have been prepared to answer. Truth is, he probably took loads of documents home for review and reading, which I'm not actually against. After all, he obviously had security clearance to view those documents, was constantly surrounded by Secret Service and surveillance, and he eventually had to leave the White House to let Trump and Melania go to sleep. And, unlike Trump, Pence probably needed to actually READ those documents to prep for some important meetings (instead of hoarding them like Trump as display trophies or espionage leverage to keep from going to prison). So yeah, its possible, like Biden, that out of all the hundreds or thousands of classified documents that he had to shuffle around for 4 years while in office, Pence or his staff likely missed a couple when they got mixed up with other papers. No big deal. Like Biden, Pence did the right thing and immediately self-reported, returned them, and requested a thorough search for any other misc classified documents just to make sure they got them all. But Trump? No. He refused to return them for way more than a year, after multiple official NARA requests and after a subpoena, forcing the DOJ to send in the FBI to secure and recover the documents. Then came the long list of ridiculous excuses, including that they were "planted" by the FBI, that he magically declassified them "with his mind", and that they "belonged to" him. And oh boy, where there a LOT of highly classified documents, many of them missing with only empty folders remaining. We still don't know the extent of the damage with all of that yet. But one thing is clear, Biden and Pence were a simple and case of disorganization with a very small number of documents. And keep in mind, Biden has been serving in public office for many decades, not just 4 years like Trump. So he has seen and touched a LOT of documents. Not really surprising that a few got mixed in with boxes and boxes of other papers at some point. And also the fact that they are cooperating with officials to make right. Trump never did try to cooperate. And the huge cache of 300+ super top secret compartmentalized SCI documents (and many empty folders with additional documents missing) that he had stolen and then hid (and moved to evade detection) were a completely different situation. In legal proceedings, its all about INTENT. And Trump's intent was criminal.

For higher level classified docs there is supposed to be a chain of custody, but I can tell you as someone that had a TS clearance, not everyone is diligent about this - people get lazy or are afraid to tell their bosses they're supposed to return a document.
