Greater Manchester Police has released various statements in respect of the incident at Manchester Airport where an officer was seen kicking and stamping on a suspect's head whilst making an arrest.
Several people have been arrested, and this video discusses the use of force in self-defence and in making an arrest.
Please understand that I cannot speculate as to whether the use of force was justified and reasonable because we do not know all of the circumstances. It is highly likely that disciplinary and/or criminal proceedings will follow, and I cannot risk jeopardising any such proceedings by speculating as to whether this was reasonable.
For example, if a jury were ultimately asked to hear the case, I would not like them to be tainted by any views expressed here.
What I can do, however, is discuss the law generally for the use of force as it applies for self-defence in criminal and civil cases.

I have a question about the practice of Armed police officers pointing their guns at people while issuing commands such as "Get on the floor". How is this legal? My understanding is that the threat of force (e.g. raising your fist to someone) is ITSELF an act of assault, if the victim perceives there is a real possibility force might be used. When an officer points a gun at someone and says "Get on the floor" - the clear implication seems to be that the choices available are 1. Get on the floor or 2. Get shot. However, if the person is not armed and not obviously presenting an immediate risk to life, there is no way the police officer could legally shoot the person. They *can't* shoot them merely for not following the command. Legally a police officer can't use lethal force merely to prevent a person resisting arrest can they? Yet, it's standard practice for firearms officers to point their guns at suspects while issuing their commands - very much as if they are presenting them with a "Do this or get shot" ultimatum. Is this a hollow ultimatum? If the person simply turned their back and walked away, they couldn't be shot legally could they? Doesn't the threat of force that a police officer can't legally follow through on, constitute an act of Assault?

The man was on the ground with his arms by his side, you should know that even if you are defending yourself this behavior would not be tolerated by the Police or CPS and criminal charges would follow.

If the security at the Manchester Arena bombing had been a bit more like the officer at the airport, a lot of lives may have been saved. And it goes without saying, don't attack the police, especially female ones, and especially ones bearing weapons. It seems some demographics of the country just don't understand these simple truths, or chose to ignore them. And then cry racism.

Soldier gets stabbed multiple times on the street, first response from the authorities, “it’s not terror related, it could be down to mental health”, 3 police officers attending an incident at an airport are injured and hospitalised for treatment, a fourth is suspended from all duties, someone has already decided the outcome in both cases

All this namby pamby "yes please kick the sh*t out of our police officers" is why we live in a shitehole country, with thugs like that roaming the streets. A country where now women are afraid to walk the streets at night. With a court system that couldn't care less about the social costs of their modern sentencing bullshit. I want the violent thugs to be scared of our police, currently as this incident proves they're clearly not. Three officers sent to hospital because some little shit bag felt entitled to be violent towards them. That has to change.

They can use force if they are at risk, however at the time the kick and stamping on head happened, there was no threat as the suspect was face down with legs crossed and hands at the side with the officer having a knee on them and the suspect got tased, so the threat was eliminated and what the kicks done was cause others to react

The video only shows police assaulting THEM ; it is the police who should be in custody , not the victims who were only defending their elderly mother from a racist attack by another party who was using a trolley to injure her , yet it appears that the police waded in using force where none was required , and used a taser on the victim before physically assaulting him to his severe injury .That part is amply clear from the video shown , and their body cam footage plus airport CCTV is likely to be even more damaging to them . That the other three did not arrest the one who did the kicking and stamping makes them accomplices and accessories after the fact , so their inaction makes them guilty too .

@@derekheeps1244right. Its quite hilarious we only see the police “over reacting”. We haven’t seen the lead up. Many have said its over a search. If they had nothing to hide why refuse a search? And armed police have to worry about the pillocks potentially trying to grab their weapons. General rule of thumb will be to fully have control of a rifle you’ll need both hands.

These men were not in the US so US culture is not in any way relevant. Under British law these men were subdued and therefore under police "protection". The police are 100% liable for the protection of a subdued person in custody, they should not attack a prisoner and to do so is no different to a criminal attacking a policeman.

Wind the clock back 16 years when I was a police officer... I was in Crown Court on an appeal hearing after having been found guilty of assault in Magistrates for arresting a member of a group for a legitimate offence. They made a complaint about it and I was investigated and prosecuted. (At this time, the Hampshire PSD actually approached every single person I used any level of force on and encouraged them to complain... most were drug dealers or burglars and they all refused.) Even the independent use of force expert involved later (we became friends) said that he had never seen such an aggressive bully of a prosecutor on a police officer. Winding up his prosecution case, the CPS Prosecutor says to me (all cocky), "So, Mr H******, you said this group were clearly in drink, is this correct?" Me, looking at Judge, "Yes, your Honour." CPS: "Mr H*****, you also said this large group were violent. Is this correct?" Me: "Yes, your Honour. " CPS: "Mr H*****, you also said that this group were causing problems with another group, and you felt in fear of your safety. Is this correct?" Me: "Yes, your Honour." CPS: "So, Mr H*****, please tell me [glasses removed, and he looks steely at me], WHY did you approach this group then?" I just let it hang in the air for a bit... I looked at the Judge, he was smiling. I looked at the Prosecutor, he had his head in his hands. I let it hang there a little bit longer in the full Court room. Then I replied to the Judge, "Your Honour, that is what Hampshire Constabulary pay me to do." Didn't take long for him to uphold my appeal after that. The prosecutor wasn't trying to be helpful. He was just too used to prosecuting people who weren't police officers. Police officers go through this "process" on a daily basis. Use of force can often look shocking to people who are unused to it. Personally, if I had seen members of my team punched to the ground, the justification for a higher level of force goes right up. That guy on the floor wasn't secured. He wasn't cuffed up. If that police officer had dropped to do so, he would have been putting his firearms in reach of the offenders hands, who had already displayed that he was willing to seriously harm police officers. I wasn't there. I can't comment. But do not jump to conclusions here.

And by the way, not using excessive force is not policy. It's law. But it wasn't excessive. You genuinely don't know your subject. What's your agenda? How would you feel if one of those police officers was your son or daughter?

What is extremely disgusting to hear is that both men that assaulted police officers have already been released from custody. It seems that mob rule is the new order in the UK. Police have cracked under pressure to let them go. That is extremely alarming as it will make them feel they can do whatever they want.

I'm fairly sure the footage shown wasn't even released by GMP, it's probably a bystander since we all know when the police come under attack, rather than offering assistance, people these days reach for their phones to record a video to post online.

@@polychadI wouldn’t call it overwhelming, it’s 52 (labour, Lib Dem, green) to 38 (conservative, uk) approx. The overwhelming majority result is because of first past the post, not because the electorate overwhelmingly voted so. Also the 2nd lowest voter turnout (60%) since 1885 which further reduces the “electorate overwhelmingly chose left/far left”. Reality is people were just sick of the absolute state of the current government rather than some massive left leaning shift. I voted labour FYI so if anything im left biased.

If you go frame by frame when you see the officer drop on him to pin his arm to the floor you can see he has a metal object in his hand, he has already proven he is a threat, and there is a civillian in the middle of the situation who keep touching the suspect limiting any chance to use firearms or tasers. The kicks gave him chance to close the distance and prevent the item being used as a weapon. This is why we need the video from 10-20 seconds earlier to see if the offcier was calling for complaince to drop the object.

Older American here. Regardless of what happened prior to the subject ending up on the floor, how can any one justify or support a police officer kicking & stomping on the head of a subdued offender, while the offender is lying face down on the floor? Those kicks to the head were acts of rage & retaliation, not good police work. Regardless of what preceded the act shown in the video, the confrontation was over, the subject had been subdued, placed in a controllable position to the point where the threat posed by this subject was minimal. The officer's stomping on the head of a detained subject was nothing short of RETRIBUTION / pay-back for the subjects totally illegal & despicable prior actions against the officers. I understand the officers motivation & emotions, especially seeing how a female officer was significantly injured, but properly trained, professional police officers, must be able to control their level of their aggression, & get their emotions under control, once a subject is no longer a significant threat. I find the tone of many of the comments posted very disturbing, reminiscent of the bad old days [1920's - early 1960's] in America's deep south. Many of the commentors seem to be applauding & justifying the officer's actions as a justifiable form of pay-back not only for the assault on the officers involved but as a justifiable expression of a general frustration for a wide range of policing, political & social issues currently facing the people in the UK. I'll assume that the police officer in question did everything by the book UP TO the point where he let his emotions run wild & he stomped & kicked a defenseless offenders head. Lets be honest here, not a good look, a police officer who lost control of his emotions, a female officer that MIGHT NOT have had enough training or MIGHT NOT have been physically able or who didn't possess the necessary skills or size to adequately defend / protect herself & a bunch of commentors, many presumably from the UK, who seem to condone police officers dishing out pay-back or taking out their frustrations on a subdued subject. This question is not intended to be offensive but I doubt I'm the only one who is curious about the statement, issued by police HQ, that said, something to the effect that, there was a clear risk that the criminals might have been able to have taken the officers gun from them. Respectfully, I'm sure I'm not the only viewer that wonders, how often have your armed police officers been disarmed by criminals? Are your armed officers so physically weak or so poorly trained that this is really a valid concern in the UK? To me this sounds like someone trying to lay the groundwork to try & justify the officer's head kicks. Thank you to all those who took the time to read this comment.

One hand was under his body, it was unknown if he had a weapon, just that he had attacked 3 officers and was refusing to comply to put his hands behind his head. The firearms officer had 2 choices, use his rifle or kick, he chose the less than lethal option.

In all cases of restraint the Golden Rule is ALWAYS protect the head (I'm not in the forces, but in my roles I've had to use control and restraint techniques on numerous occasions)

Nope if you are a Police Officer with a fire arm you have to tether it to yourself or you can't take it out. A load of copers walking around with guns that they could be stripped of would pose a greater risk to the public than it solved. The Police do not walk around with their weapons loose. First of all we haven’t saw any police getting attacked and yes if and when they was getting attacked they can use force which is not a issue, but the question is at the time of the kicks was the suspect a threat ? Video shows there was no threat at that time. If you ever been to a football match then you know who the usual suspects are that commit affray and at pubs and bars etc

@@28mouse85he’s not in handcuffs, there is a further threat (other subject) just in front, they had previously been rolling around with this subjects in a bum fight where there was a risk of the firearms officers’ weapons being taken and either the officers (or more likely the subject) being sh0t. This prevented that risk.

There's no justification for that officers actions. He'd lost control, and went on a rampage. What has bugged me, is that the lad is now saying he's been left traumatised. Give me a break. He didn't care about traumatising the WPC when he smashed her nose, knocking her to the ground. He deserves jailing for attacking officers.

It has not been shown that he was the person who assaulted the WPC , several others were arrested ; the young man ( he was only 19 ) was defending his mother against a violent racist attack ; the WPC may have been injured accidentally as a result of wading into an ongoing struggle , the exact nature of which , and who was involved , beyond her , have yet to be evidenced . These police all had tasers , rather than getting into hand to hand combat , they could have subdued the others with tasers and then only restrained them once subdued . This is all a matter of police not following their own training and making a hash of the whole thing .

The bottom line, as far as I am aware, is that the suspect suffered no damage from the kick or the foot stamp. That suggests the officer was simply sending a message rather than attempting to do the suspect harm. It worked as we can see, as the suspect stopped violently trying to resist arrest.

No medical follow up was done by GMP on this, despite the head kick and head stamp. That is despite GMP, and UK police policy, of doing medical checks on all head injuries. He was later ealsed without charge.

So far we haven't seen the full film footage, apparently, there was an incident on the flight which is why the police were ready and waiting to arrest them prior to film footage that we have seen. The men resisted arrest and assaulted emergency workers, that is a crime, deserving of a prison sentence. The men that were arrested have been let free??!!!!

IF, the man was standing and lunged, jumped, or drew a weapon, then I can see that reasonable force was used or self defence, but hes on the floor, face down, this is not a threat.

The kick and stamp to the fella on the floor (who had a hand under his body and could of been reaching for a weapon) doesn't concern me. Copper orders you to show him your hands you don't fuck around or this happens, fair enough. However, the other fella with his hands on the back of his head sat in the background.....copper approaches him and orders him to get on the floor, he's in the process of kneeling down and, as soon as he dips his head, gets clubbed over the back of the head with a taser pistol. Not entirely sure that was needed since he was complying and his hands were clearly empty.

As a former healthcare professional, kicking or stamping on someone’s head can do massive damage! I can’t really see how it is appropriate in any civil context, but I haven’t seen the entire incident which is extremely important. However this type of action is often primarily aggressive and part of a vent of anger or retribution, particularly if the recipient is already prone! Do firearms officers not also carry tasers or other non-lethal aids to restraining someone?However, such conflicts involve split second decisions and reactions. These consideration does not excuse those physically attacking the Police in any way, and violence perpetrated against armed police officers could well result in discharge of their weapons, in entering such a conflict the aggressor must surly be aware of what he is doing and what risks he faces.

In this situation the 3 perps had wrestled the armed officers, who have a duty of care to not let these perps grab their gun in a crowded airport. Just because he is lying down means ZERO, the cop has to secure the perp, by kneeling and cuffing him, putting his gun in easy reach, also the female is knelt next to the perp and is a potential ally to the perp, even if it's as a distraction but more so if she puts her arms around the cop, potentially giving the perp plenty of scope to grab the gun and turn it on all the folk nearby.

They were travelling with female members of their family. People planning to engage in terrorism don't take their families with them. No one cares whether you come to UK or not. he's incapacitated as he was on floor tasered. Why didnt he cuff the assailant then? There's a whole host of issues here which indicate that the officer did not act in accordance with due procedure, there was excess force and the officer may be a loose canon. His colleagues will most likely throw him under the bus aswell. GMP have already been under investigation. Don't blindly follow them, they would have done the same to you and yours in the same scenario.
