You will find that some of those who are reluctant to discuss their disability are reluctant to do so because their disability is embarrassing or they become distressed if forced to discuss it. For a dog to be "recognised" they must be registered with a group, such as guide dogs UK. Groups like that will supply you with a uniform. I've had to go through all that paperwork for one of the dogs I bred in Ireland, for the owner living in NI. Guide dogs requested to evaluate the dog, and then agreed they were trained to an acceptable standard, for them to fell comfortable associating with the dog. They won't just recognise any and every dog for public assistance, because that's their reputation.
Hi there. Mostly Wright. Dog user of 25 years in the UK, and I’m a trustee of the European guide dog Federation. I’m currently working with my fourth guide dog. There are absolutely no rights whatsoever granted to dogs, it’s is unlawful to discriminate against the disabled person in the UK, including by refusing access to premises. What most businesses doing don’t do doesn’t really matter too much, what matters is whether the person is considered disabled and therefore covered under the equality act 2000 and this would be the termination for a judge to make. Being registered blind, I’m automatically covered under the equality act 2010 but if something a judge will look at and then they will look at the adventure of the, assistance concern. If not one of these organisations doesn’t mean they can’t be considered as such, but would have to make a termination of the circumstances considered. Absolutely right though, no formal registration process exists.
'Assistance Dogs' don't jump all over people they focus solely on the person they are assisting, my dog stopped me swinging from a rope and got me through some horrific times but I can't decide he's now an assistance animal so I get to drag him everywhere with me he'd eat someone! What if the nature of the dog being present assisted the person in their activities for example the presence of a dog ie aid calmed the persons mood and resulted in a positive mood or wellbeing resulting in less harm. A blind person's dog aids their sight to cause less harm, it could be argued that a dog could aid a person in another way that is a result of disability.

All dogs can be classed as support dogs but they’re not covered by law only actual assistance dogs are covered by law they’re highly trained in assisting people with certain aspects of their day to day lives and not just there to make the person feel better.

The police are annoying by trying to enforce acts and statutes which are not laws and need the consent of the governed to be enforceable we are a common law country. Let's remember how many police forces are in special measures they violate people's rights like recording in public which isn't a crime and then abuse section 43 the terrorism act and also how many people have died in police custody because of neglect.
It's the total arrogance from these officers that annoys me most. Firstly, they place their emphasis on serving the business/building owner rather than the member of the public that has reported a crime. They've seemingly made up their minds about who's in the right and who's in the wrong before they've even heard what has occurred. This isn’t America, you can’t simply demand a supervisory officer to appear. Admittedly, legislation around disability and discrimination is so varied and long it’ll be impossible to memorise and know the ins and outs of it unless you deal with the matter regularly. In this specific instance, he can’t prove there and then that the dog is in fact a ‘Assistance Dog’. If the court and court staff are preventing him from entering the building why not make a compliant and go about it a different way instead of making a RU-vid video and intentionally going out of his way to be confrontational just to get views and attention which has clearly worked in this case.

Hi there. Quite right, there is no legal registration of an assistance dog in the United Kingdom. Work is underway theoretically in Europe under technical committee 452 to address the specific issue, although whether that ever takes affect is another matter for anyone who is interested, I will try to give some analysis. I am a guide dog user of 25 years and work internationally in my spare time in the charity sector on these issues. In England, Wales and Scotland, it is unlawful to discriminate against the disabled person, and it’s almost always discrimination to refuse access to a disabled person because of an assistance dog in Northern Ireland, they use the disability discrimination act 1995, but the provisions in England, Wales and Scotland are derived from the original disability discrimination act 1995 so the effect is the same it is not however a criminal offence to refuse access to a guide or assistance dog when it’s done by a business. The only time it’s a criminal offence is when a taxi or private hire vehicle refuses in England or Wales. In Northern Ireland, it’s an offence I believe but I’m not expert in Northern Ireland, under the disability discrimination act 1995, and in Scotland, although it’s not a specific criminal offence, drivers can be prosecuted under something called the local government administration act. Again, my area of knowledge is much more England and Wales It is true to say that any business can refuse anyone for any reason, but if they do so on the basis of a protected characteristic under the equality act 2010, they are acting unlawfully as that legislation requires and imposes a duty on that business in this regard. The legal remedy in this case is civil and not criminal Unfortunately so the police officer here isn’t incorrect in what she says. Not commenting on whether she is right or wrong of course, but she is not wrong to say that it is not a crime because it isn’t hate incidents and hate crimes have changed a little bit recently, but substantively, the issue is this, in order for something to be recorded as a hate crime, you need to have a substantive crime, something that is a criminal offence not Millie something that breaches civil law -in England and Wales, so for example someone smashed your window, that would be criminal damage, and if they did that because of a protected characteristic that would be a hate crime. As I say, things have changed a little bit recently, but I hate incident is something that is not a crime, but is motivated by a protected characteristic. It’s all gets a bit complicated here but if this gentleman was indeed assaulted, and this was to discriminate based on a disability, indeed this could be I hate crime on the faith of it and in theory Now, what is an assistance stock then if they are not registered or defined. Well they are defined under section 173 of the equality act 2010 but only in relation to when a cab commits an offence, criminally when they refuse, and this relates to England and Wales only. Likewise, that same definition under section 173 of the equality act 2010 also applies to the aggravated offence of an attack on an assistance dog under the Dangerous dogs act 1991, specifically section 3 subsection one and subsection four, which rely on the definition in section 173 Whether a dog is an assistance dog, well that gets quite complex but in this sort of case rather than Cabs, the legal remedy for discrimination due to an access refusal is through the civil courts. The court with them make it determination as to whether the person is considered to be disabled under the equality act 2010, in other words they have a substantial Impact on daily life, usually a condition lasting 12 months or more although there are some exceptions to that if somebody said they had an animal for reasons of emotional support, they would first have to be a determination as to whether the person was covered under the equality act 2010, and that would be very circumstantial and individual, and then separately whether allowing a dog in would be a reasonable adjustment in the circumstance. The civil courts in this respect are not a court of record, so even when one judge might rule in one direction in one case, that cannot be quoted as authority for future cases So in summary of my rather they’ll technical post, and with No knowledge whatsoever of this gentleman or his dog, you would first have to establish whether an unlawful act has taken place and you would deal with that through the civil court. A police officer can report a taxi or private hire driver for the criminal offence in England and Wales, but the chances are they almost certainly never would because the prosecuting authority is a local council or transport for London who license the Hackney carriage or private hire vehicle. The police, without any disrespect intended whatsoever, do not have training in this regard and pretty much wouldn’t know that they would even be able to report it as an offence. Many may not even notice if he is a criminal offence What was the resolution in this case? I’m not criticising any party in this case because I don’t know the full circumstances and it looks like something happened before and after this video, but it’s technically interesting and legally so. I hope it’s been somewhat helpful. The gentleman is absolutely right that you do not have to carry any certification. I have Watts known as the yellow assistance dogs UK identification book, and it’s a good sign that a dog has training to a certain standard, but even then, there is no legal standard a dog has to meet and it can get a bit messy because of course people have the right to train their own dogs, but then what Are the implications for the safety of other assistance animals and people generally. In reality, there are no legal parameters on how a dog should be trained, when and why in that sense This will get extremely legally complex. Basically, if you’ve got a dog to guide a blind person, a dog trained to assist a death person or a dog trained by a prescribed charity for the above reasons, or Dog trained to help a disabled person, then that is the definition in relation to section 173 of the equality act 2010 I work a guide dog. Mine is trained by the very large and well-known charity that trains them. If you had a blind person and they trained their own dog to guide them, they would be entitled to all of the same legal protections as me, but then again we come back to that question of standards. unless the law says you can’t do something, then you can so that’s the reality. I have no reason to suggest in any sense this applies to this clip, but in the United States, where I have lived and worked, they are in a terrible mess with so many people claims have service animals. It’s a felon needs to fake that an animal is a service animal but under the fourth amendment and the Americans with disabilities act 2000, people cannot ask for certification identification in the USA as I say, I am issued with certification from assistance dogs UK, and it’s fairly why do you recognised, but I do not carry it with me because it’s passport sized and therefore pretty inconvenient and then moreover, there is of course no power to require identification in the United Kingdom and my dog is pretty visibly marked up. I am required to carry that ID if I wish to fly on any flight whatsoever as the airlines are entitled to ask for it. Some people with owner trained dogs find this unpalatable but that is the situation that exists at the moment. I’m fairly certain I’m writing and saying as of this date.

I can tell from that dog's behavior in this video (and, to a lesser degree, from the human's behavior) that it is not a properly trained service animal. This person was not harassed or discriminated against. They are a fraudster being rightly called out for their bullshit.

This hole encounter could have big impacts on said service animal as you have no right to disturb a service dog working without permission from the owner. Guide dogs tend to be very quiet but even they can be stimulated by people patting them. Service dogs that are used for mental health issues, for instance, can be very energetic and could jump around all over the place depending on the situation.

You brought no documents, from your doctor that states that you need an assistants dog. No documents from the mental health or NHS to say that you need the assistance dog. The dog in question is clearly just your pet. Not the assistance dog you claim it too be. 😉

It's apparently just as difficult for the person recording to understand that just because their pet brings them comfort doesn't mean it's a support animal. Has to be trained/certified and be wearing some sort of kit that identifies it as such.
It took me a time to calm down after watching this video. My disabled wife suffered hate speech by a doctor in hospital a few days before she died, when I found out I terrified the doctors on that team. My wife died a few days later and I did nothing further, her death was devastating to me and my family. Please please complain officially and sue all concerned this should never happen.
Police Officer did a great job and acted professionally dealing with this bloke. He's a/ Clearly got issues (I'm being polite) b/Already well known and subject of the court system. That's why he's there. He’s orchestrating the scenario and the usual suspects are falling for it. See the next video where the Police Officers have made arrangements for his dog. Hes playing stupid games and anyone who's falling for it must have similar issues.

yup that's discrimination, happens everywhere with the police etc, because I had 1 beer that wasn't sold in the rugby stadium a big tyrant decided it's ok to threaten my life and chase after me , the security took the small can of beer off me and said you ain't allowed that in here, ok fair enough but you ain't allowed to threaten to kill or harm someone and chase them, I stood outside the place and called 111 for police they arrived and when I went to speak to them they just yelled No!!! and shoved me out of the way in multiple occasions , and when I pointed the tyrant thug out when he was leaving the just shoved me around again and said No!!!!
From Assistance Dog's UK Web Site... In the UK there is no assistance dog register so it is not possible to register a dog as an assistance dog, regardless of where it has been trained. Only dogs that have been trained by ADUK members are issued an ADUK Identification Booklet. ADUK cannot issue dogs that have not been trained by one of our members with identification or branded dog gear. Assistance dog owners are not required by law to carry identification. Not all assistance dogs are trained by ADUKs members or candidates.
and some of these things have children as well which is scary,rule of 8 applied again,we are above god and above humanity as taught at the academies worldwide.
Police officer has just cost her chief constable thousands if not hundreds of thousands for discriminating against a disabled person. She obviously has a contempt for disabled people. This officer should be retrained or even dismissed from the police force. Or is it now acceptable for disabled people persons to be abused by a police officer. Maybe Mr Paul Maynard should address this in the house of commens
I agree that the increasing problem of these idiots provoking members of the public to get a response and then editing to put the response of context needs legislating and should be raised
