@InternetUser-lj7um qualified immunity can and has been revoked in cases previously dependant on the judges view. If they drag on long enough the Judge can revoke it here too as they are in contempt of court.

The entire ATF and DOJ agencies should be held in contempt and made to pay every American they illegally seized property from $1000 a day for every day after the 30 days the ATF fails to return the property. When the ATF budget starts getting hit and their pay is taken away for failing then they will start following the courts orders.

@@JimFosterVO well I do agree the money should be taken directly from the salaries of the employees and leadership who were involved I doubt it would cover the compensation to the actual victims (the Americans who suffered a loss and were caused a great deal of fear [ATF likes to shoot innocent people]) So the rest would have to come out of these agencies budgets which could be paid back by a deduction from the agents salaries over time.

While I get the sentiment, the cases/rulings really aren’t related. Bumpstock/FRT ruling relies on the aspect of “single function of the trigger” as it relates to the definition of a machine gun. The Hoover case is entirely different in that the actual device is unquestionably a machine gun under the definition, and the question was if his picture on a card is the same as the actual device. His case would have more relevance to any ruling on the Frames/Receivers ATF rule than anything, as his case hinges on the ambiguous “readily converted” language.

Depends on what surrender document was signed by the FRT owners. One form simply gives them up ( and thus likely destroyed) and one form specifically says the item must be saved under the owner's name and is not being 'given up', only turned in. The inference of that form is ATF MUST NOT DESTROY the item and return it if things go south for ATF in court. Those items could be returned almost immediately BTW.

It's only hard if they did not maintain chain of custody, each item should have property tag attached. If they did not, then ATF committed theft by their own admission. As per janet Reno, back in the fay, they do not have 5th amendment rights in the performance of their duties. Time for jail time, who was custodian of the property list, start there.

Last time I opened my mailbox I had two pounds of mail from gun orgs begging for money after I donated to NAGR. I'm never going to donate to any of them again because they don't stop when you politely ask them to. From what I understand now, they all are like that and sell/share your data.

- The ATF will just shrug, never assign anyone to actually mail the triggers out, and never get punished for it, because who's going to enforce against them? The FBI? Unlikely. 😢 At most they'll create shipping labels so they can say, "Oh look, they must have been sent," and then dump everything in a hole.

It will be easier and cost far less to send the triggers back then it took to collect them. They sent multiple agents out to every single address, some mutiple times to get them. Now they just have to drop them in a box and slap a shipping label on them. Their argument, like always, is pathetic.

If the trigger was installed, they stole whatever it was installed in. Swapped out trigger in your high end AR with ACOG, laser, lights and whatever else you wanted to hang on it - and theft is far larger than just the trigger pack.

The part that gets me is the fact when the court rules in favor to the government its immediate. You go to jail or prison, your fined or whatever the ruling is. The opposite is true when the court rules against the government. In this case, 11, 000 FRT's were stolen by the ATF but even though the court said to the ATF, you were wrong, you lose, now return what you stole, but the ATF says they cannot. What the recourse, under this justice system, the people are the only ones that have to obey the law or go to prison. What do think will happen to the ATF if they say to the court, we're not returning the 11,000 FRT we stole. The answer is: Not one damn thing. Oh, there will be a multitude of lawyers speaking a lot of word spoken and paperwork going back and forth, but at the end of the day do you think the AFT will do jail time like you and would have to - Hell No! Here's the proof. Congress is passing a law to curb the VA from taking veteran's Constitutional rights, a VA official appeared in front of congress said, and I quote: The VA will not abide with this law that Congress passed. We have to obey the laws but the administration does not.

Assuming these FRT's were destroyed before being fully ruled on, I'd think those people that had their property seized and subsequently destroyed are due compensation. I can't quite equate this to Civil Asset Forfeiture however.

If I'm not mistaken Rarebreed triggers won it's patent infringement case against BDU. Part of the settlement was that all WOT triggers that had not been sold we're now property of Rarebreed And could be sold by Rarebreed.

Seems like there's now a 2 part test for machine guns (Cargill v Garland) : 1. Does the product fire mechanism function automatically? 2. Does the product fire (automatically) with a single function of the trigger? Ex. Forced Reset Triggers/SuperSafety: Q1. Yes. Q2. No. Verdict: not a machine gun. You would need a yes for both to be a machine gun. Still unconstitutional though.

@@danietkissenle US Marshals full under DoJ and do the bidding of the Executive branch. Compliance with the Judicial branch's orders is pretty much voluntary they have nobody to enforce their orders (unless the DoJ chooses to enforce)

Would love to see quite a bit more than a couple hundred, but I'm certain they'd find some way to pull it from somewhere other than their own budget. We really should be holding government officials personally responsible, criminally and monetarily, when a violation of rights occurs. It's insane that we sue the entire organization instead of the people that actually caused this.

Oh, those triggers are gone. The ATF more than likely assumed it wouldn't be challenged and destroyed them almost immediately after stealing them. That's why they're dragging their feet. They physically can't return them nor even want to.

I appreciate that tyranny has been put in its place. I also understand unrealistic deadlines. Ideally, ATF will agree do what they need to do (legally and morally) and will spend their immediate efforts on figuring out how much time it will take to actually return the illegally confiscated FRTs instead of trying to change the court's decision.

Honestly, shouldn't we all be working on getting a complete repeal of the NFA, GCA, and other amendments to the NFA? The militia clause clearly implies the right to own the same firearms that infantry soldiers carry. Those are currently full auto SBRs.

I would be disappointed if the 5th throws out the vacatur. The vacatur was based on the 'logical outgrowth' of the rule, which is a really solid basis. The final rule varied a ton from the proposed rule that included a convoluted worksheet and nearly no language about penalties. Judge O'Conner needs to tell the ATF that they are wasting time and now they only have 15 days left. The court can't force the ATF to give them back, however, 11,000 people could file lawsuits against the ATF on day 31 if they do not return our property. I am counting down the days and I do not want the judge to give them extra time.

That the ATF doesn't know who they seized what from, it was improperly gathered evidence. They then shipped them around the country, rather than keeping it at the relevant field office, or even regional offices or a single location, is amazing. The chain of evidence has been blown, and I have every reason to believe that if Judge O'Conner handed US Marshals written orders to take custody of the evidence with in 24 hours, the ATF would have no idea where a lot of these items are. This is scenario is the twincest version of why Baldwin's charges were tossed. So sorry for the folks who've lost property, but that would be awesome from everyone.

I really hope that the judge gives the ATF for the failure to return property as well as fines for loss of use. That would be great for the plaintiffs. Bad for the tasc players, but just.

That would mean that the ATF would have to send out more than 11,000 of those frts and they do have everyone's information that They confiscated them from you can absolutely guarantee that one so like I said they should reimburse these people monetarily and let them get themselves another trigger the simplest solution

It's gonna be hard for the atf to give e back all of the illegally obtained from triggers because all of the atf agents already took em home and sold them in the black market or put them in their own guns

The most mindblowing stupidity that stems from US criminal laws is that the qualified immunity is assumed and must be taken away. Everywhere else, qualified immunity can be granted by the court (senate/jury) or the local dictator (juntas in Africa, North Korea, etc.), but is not assumed/the basis that must be overturned.

The problem I see with creating protected classes of people , is the equal protection under the law clause of the constitution. That puts the courts in the position of being discriminatory against certain people. Last I heard, that's a judicial No-No.

Ther is NO Trigger Reset on ANY MACHINE GUN ...it stops firing when the trigger is let go of and it then captures the bolt

I would love to see the ATF held in contempt of court for not just complying with the court order. Most likely they will be given an extension to comply.

Funny how I never got a letter, call, or knock on my door for the RB FRT I paid cash for. With credit card companies having an MCC Merchant code for firearms purchases, online orders having databases to track, no wonder they want to go digital money. Cash brings anomality the ATF is powerless to track.
