I agree with you, Peter. I hope they remove the judge from the case. This is too serious of a case to leave to chance. She grossly overstepped no way she should continue to reside. I hope the girl's families get justice. This whole thing feels off to me.

The opening of this video shows SCOIN's decision and order. Lawyers reinstated as court-appointed counsel. Judge Gull remains as the special judge in this case.

This ruling didn't surprise me one bit. The defense team were on the right side of the facts. Judge Gull abused her position blackmailing those lawyers into withdrawal and they definitely should have been reinstated. I am surprised Gull wasn't removed though. It's clear she doesn't favour the case the defense is building.

I think she should/would recuse herself or defence could ask her to be removed. They have the evidence that she clearly is biased or atleast didn't follow the procedure. AG office would force her to leave the case to avoid possible appeal after conviction.

"Can she now have the hearing to find them incompetent?" I don't think so. The Supreme Court would not have reinstated the lawyers if their competence was still in question.

The lawyer for Gull literally said when asked if the prosecutor could also be disqualified for leaking photos that “there was no evidence of that, there was no hearing.” Umm… _there was no hearing to prove that Baldwin and Rozzi did either!_ It drives me nuts Every time someone says that Gull made a “Finding of gross negligence” because she did not. She just didn’t. She didn’t hold a hearing, she didn’t hear evidence from both sides, she just randomly decided on a whim that they were supposedly grossly negligent. No due process = NO FINDINGS. Period.

The other part was the “Gross Negligence” wording Gull used. Those words don’t have legal definitions in this context. She was inferring she was disqualifying them as “ineffective Counsel” but she never actually says that. Also, her list of issues, aren’t examples of ineffective counsel, they are more “contempt” or would be ethic violations, if proven, which have a different remedy, not disqualification from a case, they would be sanctioned and/or reported to the Indiana Bar and they would determine the validity and punishments. To me that implies, her actions were more “goal oriented”, she wanted them off the case and worked backwards.

I live in Carroll County, Indiana. I wish the entire trial would be moved with a new judge and a new prosecutor for this trial to be fair and just. The judge and jury are already coming from another county.

I just went through my PhD candidacy exam and this hearing seriously gave me anxiety and flashbacks! Even so, it was really interesting to see the similarities between the two. The set up is basically the same but instead of 5 Supreme Court judges interrupting every 5 seconds to grill the lawyers trying to defend their clients, it’s a committee of 5 professors interrupting every 5 seconds to grill you while you are trying to defend the thesis project you designed 😂. Serious props to all the lawyers in this hearing! This type of stuff is STRESSFUL and scary and that’s even without the added pressure of basically having someone’s life in your hands!

I am disappointed that the Court didn't remove the Judge. If they thought she blackmailed them in her chambers, had made up her mind, contrary to seeking a just outcome, how could they justify keeping her as the trial judge in this case? It would seem to me that her behavior could be reported to the Supreme Court as a valid complaint against her. I'm glad that the original attnys are back on the case and that they will get paid. Mr. Allen deserves to have the attnys he wants and believes in.

Because the lower court can remove Judge Gull. Rozzi and Baldwin's motion to have a hearing to remove judge Gull filed in early November should get a scheduled hearing soon with another judge deciding. So they correctly denied this motion because both the Judge being removed as well as the 71 day trial can both be done in regular Indiana Court

Having a valid complaint isn’t necessarily a reason to remove a judge in the same way that Baldwin’s negligence isn’t enough to remove him and Rozzi as defense counsel. I’m not an attorney but, to my understanding, they have to prove that Gull has a personal bias against the defendant and/or the defense attorneys. That’s a hard thing to prove. Based on everything that’s public as of now, I don’t think there’s enough evidence to meet that burden.

Finally, the defense lawyers should have not been treated that way and it has delayed a trial and confused the defendant that he cannot pick his own lawyers. The mishap does not prove they were incompetent in dealing with the trial. The judge should be put on another trial and a new judge put in her place and get this trial going again.

I’m very relieved about this ruling. This case has gone so far off the rails. It feels like this might be the first step in getting things back on track Edit - And it feels like the judge has to be removed from the case, especially now that the attorneys she inappropriately removed are back on the case. They have a direct conflict now. It’s hard to think of a bigger appeal issue than a judge being openly biased against the defense team. Both sides should want her removed at this point Oh it’s so interesting to hear Peter say he thinks the judge will be allowed to stay. To my non-lawyer brain, if the attorneys are restored to the case there’s no option but to remove her. That would require faith that she could suddenly be fair to them after doing about the most unfair thing possible. She’d have to do a complete 180 and the perception would still exist that she has a bias against them.

So glad the ruling came back so quickly and that he gets his chosen lawyers back on his case. I can't believe that the judge will be allowed to preside over the case. I sincerely hope the defense moves to have her replaced. Her actions and the way this has played out shows her bias and that she cannot be trusted to judge impartially. Watching this defense team and their 'go for the jugular' approach is great to watch, and absolutely great lawyering (read the Franks). Beyond that, it's telling, this is what a competent defense of an innocent man looks like.

As an ex prosecutor, I agree with you on this. I’ve done hundreds of appeals. I seriously don’t understand why the judge didn’t hold the attorneys in contempt an/or put them in jail for 24hrs hours or fine them. I have been before crazy judges. But nothing like this. Edit: I spent the night making an emergency writ to get my lead counsel out of jail. The sheriff knew he couldn’t be in general lockup and slept on his couch. It was a wild night.

The judge couldn't have done that because they never really did anything wrong. She knew she couldn't do that because of it. The gag order wasn't even in place when they went public. You can't put the defense in jail for having evidence stolen. Worse the state has done all the things the judge accused the defense of doing. There's been evidence leaks. The prosecutor has been very much trying the case publicly. The SC also hinted that the state has done all the same things the defense was accused of and asked could the judge do this to the prosecutor if she wanted. The judge did this crazy thing because she knew she couldn't get away with holding the defense in contempt.

I wish one of the supreme Court judges had called him out on it in a snarky intelligent way haha. To me that was huge! Just because he added in other contexts doesn't make it better. I know it’s big to think a judge is corrupt or bias or will be. but they are human beings and even the smallest bias ruling could cause huge problems in the future,even if she doesn’t think she will be. These lawyers have caused her huge embarrassment well she has to herself let’s be real 😏 even if this is her job Never have stakes been this high for her and her reputation. Human beings have a very hard time especially people that are used to having power over others , hiding their destain when that power is challenged 🤷🏼‍♀️

????? Peter, if the Supreme Court over rules the judge’s actions, WHY leave her on the case as the judge! She already demonstrated hostility and disapproval of the attorneys by forcefully removing them…will she not be totally pissed and angry they are back?? And will she FAIRLY follow judicial procedure??? She was so rude and underhanded in the chamber hearing and unfairly punished Mr. Allen that I cannot see her being impartial at all! Also, what happens to the new motion that was filed by the new attorneys which basically mirrors what the first attorneys filed regarding the transfer of Mr. Allen back to jail because of cruel and inhumane treatment by the penitentiary! Will that motion be heard or will it just get tossed?????

The defence team asking to come back voluntarily speaks volumes. I dont have a stance on guilt or innocence, and I wont until I hear the evidence, but everyone deserves competent council. Very good summary and analysis! It was so terrifying watching it live that it took a repeat watch to realize just how well Allen's attorney argued. The explanation for his performance came in a livestream with a competing lawyer/streamer couple that featured the woman who got it going: Cara Wienecke. I learn so much from all of you lawyers, not just about legal issues but also about being human, caring and humble! Lawyers like you, that still hold up their ideals after years of practice instead of giving in to the temptation of shadiness that is practically visible, give me hope for a less corrupt and more humane future ❤

Personally I think he is bridge guy and did play a role but it was a very minor one. I don’t think he was the one to physically do it and I think the evidence listed in the Franks motion and the lack of evidence in the PCA proves there is a LOT more to this case that is trying to be kept hidden

You called it Peter. I don't see how the judge could be fair now, but I doubt she'll recuse herself. Do you think he'll get transferred to another prison since the second team of attorneys agreed with the first? Do you see the judge pushing for a hearing to have the original attorneys removed now since she didn't do that to begin with? I think that will be part of the written reasons the justices will say is reason to reinstating them.

There were major leaks long before this accidental leak, btw. That keeps getting forgotten when it comes to Baldwin & Rozzi's leaks--unintentional (by B & R) leaks of information that weren't really telling anyone anything that wasn't already out there, from what I've heard.

This restores *some* of the faith I lost in the system after watching this all debacle play out. The judges behavior was a clear and egregious attempt to interfere and sway the outcome of a trial. And that's exactly why I'm still worried. How is he going to get a fair trial with a judge who already shut down and discounted the defenses (in my opinion) plausible theory? Leak or no leak this judge was/and is going to try to prevent the defense from presenting it's case. She's making "findings!" without evidentiary hearings?!? That's insane. Not to mention It's unconstitutional that he's in a correctional facility. Between this and Murdaugh I'm regretting not being able to finish law school.

How can Judge Gull claim she did what she did to 'protect the defendant's rights" and yet keep the man in prison and actually move him to a new prison under her watch? She lost any ability to claim RA prison tenure was done by the other judge. This time it is ALL on her. And I see just one judge after another protecting each other. I foresee a hearing being ordered and Judge Gull just building a record (which she as judge can easily do) to cast more negativity and possible removal of the attorneys she detests. When this makes it to the US SUPREME COURT I hope the ruling removes the ability to house any one before trial in a prison, especially a max. security prison! This case continues to cast a darkness when it comes to IN Court system.

My daughter is doing her second mock trial as freshman in college. Pre Law in Kingston Canada, Queens University. She is super excited because this time she is a prosecutor. I think she was a juror in the first one. 💕Thanks for all your hard work.

This was a very interesting video and helpful have Peter explain each stage. I would feel very uncomfortable having her on the bench in this trial if I was the defendant and the attorneys. Maybe she will recuse herself without the defense forcing the issue.

Best commentary, so far. Well done! The judge simply cannot use competence as a sword AND a shield. I think the major issue is that the judge *knew* she'd stepped out of line - she just didn't consider the unintended consequences.

I see this clip in a Hollywood movie in the near future! I really never got into this case, but wow! Now I’ll be going down a rabbit hole tonight 🤣 Defense did AMAZING!!!!! Also, watching the lady judge ask them those question!!!! Whew! So glad we can catch this! And the little slip about competent lawyers 🤣🤣🤣 oh and no opportunity for the judge to change her mind 🤣wow, the Judges completely embarrassed them. I wonder their thought frame as to why they decided to leave the judge? I may have to go watch the whole hearing, but I probably won’t understand without the commentary

My intuition and experience (plus knowledge) tells me that even if Westerman hadn’t gotten into Baldwin’s office, the photos would still have been leaked and the defense attorneys would have blamed. Good video and explanation; thanks!
